MEb'TTNG OF APRIZ 17, 1968
Meeting was called to order at 7x00 P.M. with the following members presents
Mayor Warkentien, Councilmen Stone and Ecklund. Black was attending a Ramsey
County_League of Municipalities meeting and arrived at 9t~5 P.M. Also present
were Engineer Lemberg and Attorneys Mike Galvin and Peter Seed. Absents Clerk
Strandquist. _
Mrs. Shirley Amundson represented the League of Women Voters. Tom Reiff was
once again an_observer.
Fry Street Traffic Upon request of Fry Street residents, the matters of
Problems traffic and parking on Fry Street were resumed. NFrs.
George Kulkay submitted petition of home-owners dated
April 1st who are in favor of tno parking' on the west
side of Fry Street. There were approximately twenty
people (home-owners and apartment residents) present.
Paul Loomis of 1687 Fry Street presented petition signe a
by apartment dwellers requesting council to reconsider
its order to place a ~No U Turn' sign on Larpenteur Ave.
at Fry Street. Tt was pointed out that cars coming _
from Minneapolis. must make the U turn at Fry in order to
gain entrance to the parking lot and also people wishing
to go to the Falcon Heights shopping center or points
east from the parking lot have to make U turn somewhere
on Larpenteur to get there. Petitioners were advised
that the village council has no jurisdiction over such
signs being placed on State and. County Highways and
that the council had previously requested that cut in
the median strip on La.rpenteur opposite the apt. 'house
parking lot be made, and council has recently renewed that
request. The Highway Department has stated that a cut
at that point is not feasible because of the proximity
of the opening at Fry Street. Request has also been
made for opening further west possibly in line with
house at 1687 West Larpenteur. Ramsey County has
promised that by May 9th, 1968 they will advise the
council abouf a cut in the median to ease the traffic
problem.
It was stated that if there were no parking on the west
side of Fry Street, the problem caused by cars turning
around in driveways north of 1725 Fry would be elimin-
ated. William Blair, 1687 Fry stated that each apartmeni~
unit is .assigned one parking. space in the parking lot,
which is ~z}sufficient. There are only 12 extra spaces
which makes it almost impossible to park there when one
is having guests.
Suggestion to utilize the recreation area for parking
was frowned upon by apartment residents. Mrs. William
Carter, 1707 Fry, stated that one reason for making
turning around necessary is the fact that 5t. Maryts
Street has sign posted 'not for thru traffics which
most drivers adhere to.- Paul Loomis pointed out that

the parking lot may not be completely full and it
may appear that parking on Fry Street is not necessary,
but each unit is assigned a_parking space and does use
it some, time during the day or night.
Stanley Schultz, 1725 Fry stated that the majority of cars
turning around do so in his driveway and if it is not
possible to eliminate parking on the, west side he
would suggest that Fry Street be made a one ti°Tay going
south and St. Marys Street be made a one way going
north. George Kulkay sympathized with parents wanting
the recreation area to remain as is, but pointed out
that careless drivers using his driveway to turn around
have caused anxious moments when his grandchildren are
visiting. Mr. Lee thought that if apartment residents
were made aware.. of the dangers and the inconveniences
caused by turning around, they tivould all be more
cooperative.
Engineer Lemberg advised that traffic counter had been
placed at_entranee to parking lot and it revealed that
an average of X31 trips trips into driveway had been
made per day, which creates a traffic hazard to traffic
coming down Larpenteur Avenue. To suggestion to place
driveway from Fry Street to parking lot, it was brought
out that no one would care to have a driveway going
right past a bedroom window.
It was stated that the village council may, by resolution,
change village streets into one-array streets, and Mr.
Kulkay proposed that the Council act this evening
in creating one-moray streets.
Councilman Ecklund moved that this matter be tabled
until 8:00 P.M. Thursday evening April 25, 1968 in
order that residents of St. Marys Street, and residents
on Maple Knoll Drive, and also residents on Fry Street
can be notified. Motion was duly seconded by Stone and
upon a vote being taken, the following was recorded:
Ayes: All. Nays: None. Motion was carried.
Minutes Stone moved, seconded by Warkentien that the minutes of
the meeting of March 28, 1968 be approved. Ayes: A11.
Nays; None. motion was carried.
Dry Cleaning Establishment Conditional Use Permit for use of property located at
1l~07 West Larpenteur Ave. 1l~07 West Larpenteur for a dry-cleaning establishment
Conditional Use Permit: (as per resolution adopted at March 28, 1968 meeting)
was subject to provisions of Fire Prevention No. 61..
Mr. Halverson and Mr. Gilbert.(Gilbert Construction Co.)
Solvents approved were. present and after Engineer Lemberg~s review of
by Engineer: solvents as outlined in Technical Diamond Chemicals
Bulletin pertaining to Perchlorethylene Advantages
in Dry Cleaning, which method the White Drug Company
uses in dry cleaning, Lemberg recommended. that same
be approved. Representatives of the White Drug Co.
were advised that should the company decide to use
~r~y other chemicals in the dry cleaning process, they

they could do so after first advising the Fire
Department and the Council of the Village of Falcon
Heights.
Minnesota State Attorney Galvin was requested to obtain Attorney
Fire School: Generals opinion regarding Minn. Statute I~38.]-1 and
full time fire department employees being given payment
of reasonable per diem while in attendance at Minnesota
State Fire School.
Fire Department Ecklund reviewed reports of calls made by the fire
Reports: department. Letters from Ingrid Jensen and also
from Elmer Weltzin were expressions of appreciation
to Fire Department for first aid administered and
extinguishing fire.
Purchase Requisition: Ecklund moved., seconded by Stone that Purchase
Requisition #68-2 for 1 MSA Helmet complete with Eng.
#1 Shield, Chin Strap, and lidinter Liner at $17.50 and
1 New Type Spannar Belt at $10.00 be granted and Fire
Department is authorized to. purchase same. Ayest,
Warkentien, Black, Ecklund and Stone. Nays:, None.
Motion was carried.
Subscriptions to Eeklund moved, seconded by Stone that subscriptions to
Smoke Eater Publication the publication Smoke-Eater be renewed for 26
Renewed: subscriptions at a total cost of X39.00. Ayes:
Warkentien, Stone, Ecklund and Black. Nays: None.
Motion was carried.
Street Maintenance and The following resolution was introduced by Ecklund who

1. Such plans and specifications, a copy of which
are on file in the Village Clerks office are hereby
approved. ,
2. The Village Clerk shall prepare and cause to
be inserted in the official paper an advertisement for
bids upon the making of such improvement under such
approved plans and specifications. The advertisement
shall be published for ten days, shall specify the work
to be done, shall state that bids will be opened and

tabulated by the Village Engineer on PJIay 22, 1968
at 10:00 A.M. and thereafter considered by the
Village Council at 8s00 P.M. May 23, 1968 in the
council chambers of the Village Hall. No bids
will be considered unless sealed.. and filed with the
Clerk and accompanied by a cash deposit,, cashier's
check, bid bond or certified check payable to the
Clerk for five..-per cent of the amount of such bid.
Motion was duly seconded by Stone and upon a vote
being taken thereon, the following voted for same:

following voted. against same: None. Whereupon the
above resolution was adopted by the council this
17th day of April 1968.
Correspondence:
Request for Water Letter of April 10, 1968 from Clifford V~. Hamblin,
Service connection General Manager of St. Paul Water Department, stated
to the Hamline Avenue that a water service connection to.the Hamline Avenue
Vf(aterMain to serve water main to serve Lot 12, Block 2, Gottfried Addition
Roseville Resident: located in Roseville. had been req~.ested. Hamblin
_ stated he has imposed a hold over on any future
connections onto this water main .for Roseville
property owners pending a ..policy to be established
by the Village of Falcon Heights. Clerk was
instructed to reply,
Minnesota Safety

Northern States Power R. L. Vannelli, Supervisor Municipal Services, in

Condemnations: Claims Department be notified when this village has
a condemnation or vacation of public or private
property so that NSP may be prepared. if company
` facilities are involved.
NSP Street lights Letter under date of March 27, 1568 from NSP Company
Installed and listed street lights that have been installed and the
removed:' two overhead fluorescent street lights that were
removed.
League of Women Mayor Vlarkentien has received a letter from T~hrs. Robert
Voters - Recreation L. Jones, President of the Falcon Heights League of
Areas Women Voters, dated April 9, 1968... The League
expressed its interest in the Rose Hill Nursery
property east of Cleveland Avenue between Larpenteur
and Roselawn Avenues, which was platted to_include a
recreation area as shown on a Village Land Use I~1ap.

St. Paul Association Mayor 1Warkentien has received letter from the Saint
for Retarded Children: Paul Association for Retarded Children in which request
is made for financial .help of certain municipalities (Falcon
Heights included) in sponsoring a summer program to
be held at CentralPark in Roseville.
Authorization given Having met the requirements, it was moved by Black
to Plumbers to work seconded by Ecklund that the following be au-tlzorized to

Sewer Installer Having met the requirements, it was moved by Ecklund,

Jorgenson Property Black moved, seconded by Ecklund that Attorney write

Lindig Property Ecklund moved, seconded by Black that permission be

Heights has~been consulted in the preparation of
proposed Ordinance No. 8?~, and
WI~.EAS, the village council has held discussions
to consider the adoption. of proposed Ordinance No. 81~,
NOL°d, THEREFORE, BE IT RESOLVED that the Village
Council of Falcon Heights does ordain as follows:
Section 1
The Ordinance No. 5~ entitled 'tAn Ordinance
Relating to the Burning of Trash~~ is hereby amended

by striking therefrom the first sentence of
Section 3 thereof and inserting in lieu thereof,
the followings
SECTION 1
«It shall be unlawful to burn any
..material enumerated in Section 1 of
this ordinance within the Village except
between the hours of x:00 P.M. and g:00
P.M. Mondays through Fridays, and 12:00 N.
gam. to 9100 P.M. on Saturdays.~~
SECTION 2
.This Ordinance shall take effect and be
enforced from and after its passage and
publication according to law.
Motion was duly seconded by Warkentien and upon
a vote being taken thereon, .the following voted
in favor thereon: Warkentien, Stone, Black,
and Ecklund and the following voted against same;
None. Ordinance was declared passed by the Village
Council on this 17th day of April 1968.
Variance Request Black introduced the following resolution and moved
Garage at 1436 West its adoptions

tiiiHEREAS, pursuant to the Zoning Ordinance No.
6~, as amended, William E. Swenson has made application
to the Village of Falcon Heights for a variance permit
to allow for the construction and location of a garage
at 1?~36 West California, which property at the present
time is zoned R-1, with a rear yard setback of two (2)
feet instead of the required thirty (30) feet, and
WHEREAS, the Village of Falcon Heights has
referred said request for a variance. permit to the
Planning Commission of the Village of Falcon Heights
and said Planning Commission has approved said variance
request by a report dated April 17, 1968, a copy of
which is on file in the Clerkts office and incorporated
herein by reference, and
WHEREAS, the Village Council of the Village of
Falcon Heights has reviewed the request for a variance
permit and has reviewed the report of the Planning
Commission
NOW, THEREFORE, BE IT RESOLVED by the Village
Council that
1. The Village of Falcon Heights finds (a) that
the other. garages in the ..area are located on the rear
lot line of the adjoining lots and abut the alley
located therein, (b) that there are practical diffi-
culties and particular hardships in the carrying out
to the strict letter of the regulations of this
ordinance, (c) that the proposed location of the

garage is in keeping with the character and development
of the immediate neighborhood, (d) that the granting
of the requested variance is necessary for the
preservation and, enjoyment of a substantial property
right of the applicant, and (e) that the granting of
the proposed variance will not, impair an adequate
supply of light and air to adjacent property
unreasonably increase the congestion in the public
streets, increase the danger of fire, endanger the
public safety, unreasonably diminish or impair
established property values in the surrounding area
or in any other way impair health, safety, comforts
morals or in any other respect be contrary to the
intent of Ordinance No. 6l~, as amended, or the
_ comprehensive plan of said village.
2. That the Village Clerk and Village Zoning
Administrator are hereby empowered to issue said
variance permit.
Motion was duly seconded by Stone and upon a vote
being taken thereon, the following vote was recorded:

Variance Request Black introduced the following resolution and moved

Request ~ ti"1HERF~S, pursuant to the Falcon Heights Zoning
Denied Ordinance, Herbert Richards has made application to the
Village of Falcon Heights for a variance permit to
build an attached garage at 1525 West Iowa (which
property is zoned R-1), which variance, if granted,
would create a rear yard setback of only eight (8)
feet, and _
WHEREAS, the Village of Falcon Heights has
referred said request for a variance. permit to the
Planning Commission for the Village of Falcon Heights,
-and said Planning Commission has made a_recommendation
on said variance request by report dated April 17, 1968,
a copy of which is on file in the Clerks office and
incorporated herein by reference, and
WHEREAS, the Village Council of the Village of
Falcon Heights has reviewed the request for said
variance permit, and has reviewed the report of the
Planning Commission,
NOV~t;, THEREFORE, BE IT RESOLVED by the Falcon
Heights Village Council that
-- 1. The immediate neighborhood and adjoining
properties presently conform to the provisions of
Ordinance No. 6!~ and have a thirty (30~foot rear yard
setback.
2. The request for an eight (8) foot rear yard
setback is in conflict with the zoning .ordinance
requirement of a thirty (30} foot rear yard se8~ack
required by Ordinance No. 6t~.

3. The Planning Commission has recommended
denial of the request for said variance.
!~. Said variance would not be in keeping with
.the character and development of the immediate
neighborhood and is in conflict with the general
intent of the zoning ordinance to provide adequate
light and air to property in a one-family residential
district and to promote the orderly development of
said district.
5• The applicant has failed to demonstrate that
the variance is necessary for the preservation and
enjoyment of a substantial property right or give any
other compelling reason why the variance should be
granted.
6. The request for a variance should be and is
hereby denied.
Motion was duly seconded by Ecklund and upon a vote
being taken thereon, the following vote was recorded:
