Absents "~ Clerk Strandquist. Also present were Engineer Lemberg, Treasurer Olsen and Attorneys Galvin and Seed. League of ~Ifomen Voters representative was Mrs. Mary Duddleston. Also present was Tom Reiff. Roger Gratiot of the St. Paul Dispatch was present. Correspondences Reminder that nominations for .this years C.C.Ludwig C. C. Ludwig Award are due in the League of Minn. Municipalities Nominations s office by May 1st was_ dated April. 17, 1968. Street lights installed Letter dated April 17, 1968 from R.L. Vannelli, and removed by NSPs supervisor municipal services, advised of street _ lights installed on April 1, and also street lights that were removed at Arona and Larpenteur. St. Michaels Lutheran Warkentien announced he had received letter from Saint Church: _ Michael's Lutheran Church, Midlothian Road and County Road B,.advising of program scheduled for April 28 at 7:00 P.M, at which Frank Kent will speak on nThe ffiack and White of It.~ Registration forms were enclosed and all are invited. Open House - Minneapolis~St.Paul Invitation was extended to Councilmen to attend open Sanitary Sewer house at the Minneapolis-St.Paul Sewer Plant on Districts Tuesday, May 1l~, 1968. Clerk was instructed to check with Better Business Bureau regarding this servicE Destruction of Records: After review of list of records and miscellaneous _ items prepared by the clerks office, Black 3.ntroduced the following resolution and moved its adoption: WHEREAS, M.S.A. l~1.2.8~I authorizes the destruction of certain village records more than ten years old; and WHEREAS, a list of records has been presented to the council with a request in writing that destruction be approved by the council, and ~' , the village attorney has approved the destruction of such records in writing . _ NOW, 'T'HEREF'ORE, BE IT RESOLVED BY THE Village Council of Falcon Heights, Minnesota as follawss 2706 ~. The village clerk is hereby authorized and directed to destroy the following classes of records described in the list submitted to the councils (a) All orders and checks dated from January 1, 195lt through December 31, x.957, both dates inclusive. (b) All receipts and bank statements dated from January 1, 1953 through December 31, 1957, both dates inclusive. (c) All correspondence, 13censes and permits, police officer daily reports, arrest tags, Justice of Peace Criminal Complaints, fire reports, miscellaneous election data, village insurance policies, duplicat~a copies of building permits dated April 1, 19?~9 through December 31, 1957: both dates inclusive.. 2. Before such records are destroyed, a copy of this resolution shall be sent to the Minnesota State Archives Commission and such records shall not b® destroyed but. shall be sent to the Archives Commission if a petition or application requesting them is received by the village within thirty days from the date ttie resolution is mailed. Adopted by the Council this 25th day of April, 1968. Motion was duly seconded' by Stone and upon a vote being taken, the following voted for same= Warkentien, Stone, Ecklund and Black and the following voted against same: None. Whereupon resolution was declared passed. Fire Departments Purchase Requisition Ecklund moved, seconded by ffiack that Purchase Requi- 68-3: sition 68-3 for miscellaneous cleaning supplies dated . April 19, 1968 be approved. Ayesa Warkentien~ Stone, Black, and Ecklund. Nayss None.. Motion was carried. Reports Fire Department Reports were reviewed. High Grasses and pile Ecklund advised that Dr. Robert Thatcher, 1859 North of Brush -Thatcher Snelling Avenue has given his permission for the residence 1859 North Falcon Heights Fire Department to burn the pile of Snelling Avenues brush and also the high grasses at the rear of his property between Garden and Roselawn Avenue west of Snelling Avenue. Dr. Thatcher stated he would be responsible for cleaning the residue remaining after it is burned. 1 Ecklund moved, seconded by Stone that the Fire Department be instructed to burn the brush pile and high grass mentioned in preceding paragraph as part of drill session on a regular drill night. Ayes= All. Nays: None. Motion was carried. 2 707 Variance Request - Black introduced the following resolution and moved Fence at 1870 its adoptions Alberts 1NHEREAS,, Richard W. Brust has made an application for variance and filed the same with the Village Council of Falcon Heights ~ along with the fee of X5.00, and . WHEREAS, for reasons of privacy and iri order to improve appearance of rear property and create a buffer zone from swimming pool located on his property, the owner proposes to build a six foot high fence with an additional one foot decorative strip at the top, NONE, TfiEREE'ORE, BE IT RESOLVED ~lT'THE VILLAGE Council of Falcon Heights hereby grants the variance application made by Richard Brust on the 25th day of April 1968 for variance use of property described as 1870 No. Albert Street under the provisions of Section 16.05, Ordinance 6l~, subject to the followings 1. ~ITritten permission or approval of the property owner to the east shall be obtained. r 2. Minnesota State Fire Attorney. Galvin advised that the Village of Falcon School - Per Diem Heights has not been authorized to pay the reg~al.ar Allowance: firemen any per diem allowance. for attendance at the . Minnesota State Fire School, if they attended on their off days. Helbig and Bianchi Ecklund moved, seconded by Warkentien that registration to attends fees~to Minnesota State Fire School to be held April . 29, 30,.May 1 and 2 be paid by the village for Fire Chief Helbig and Volunteer Joe Bianchi in amount of ~lt0.00 for both. Also that.a per diem allowance of X15.00 each for the four days for a total of not to exceed X120.00 for both be granted. Ayess Warkentien, Stone, Black and Ecklund. Nays: None. Motion was carried-, Fry Street Traffic At 8x.00 P,M. those persons desiring to be heard and Related, Problems: regardingthe Fry Stxeet traffic problems were invited to speak. Me1.Spiegler of the Spiegler Apartments on Fry Street was present as was Floyd Snyker, Assistant Ramsey County Engineer. Mayor_Warkentien gave brief background of events leading up to partial ban on parking on Fry Street and the recent proposa3s and suggestions made to solve the problems. There were approximately fifty persons present, 2708 Everett Holes 1771 Fry, inquired as to how many names were on the petition to make Fry Street a one-away and answer was that nine families had signed. Dale Bergstedt, 1659 Maple Knoll Drive asked if there was a chance of appeal to the State Highway Department as regards the ~N© U Turns restriction on Larpenteur Avenue at Frye and also, why the village could not have the right to take action on this. Snyker stated the No U Turn regulation by the State Highway Department does serve a purpose. because there are about 18000 vehicles that are involved and because of the fact that most cars have to cross four lanes of traffic to make the U turns this is a hazard. Paul Loomis, 1687 Fry Street, stated it is not necessary to cross four lanes - he has a full size Chevrolet and he can make U turn from left lane and wind u.p going opposite direction without crossing four lanes. Lemberg stated it was impossible with his car. Loomis claimed this was dust as safe as having to go up to St. Maryts Street to make U turn. Furthers he couldntt see any logical reason for not cutting the median strip opposite the exit from the parking lot. Snyker stated that when the road was first laid out f®deral moneys were used and roa was built as specified. To introduce media~iu~or apartments to cross over would not b® approved by the state - it is hazardous. The cut for the village hall parking lot was in the original plans, was removed when left turn lanes were constructed last year, and at this time is merely being replaced. The traffic crossing at that point is almost always not during the peak traffic periods, E.H. Leonard, 1767-Fry Street, asked how many accidents have occurred at these points - and answer was that there are no figures available at the present tim®. Suggestion was made to construct driveway between the apartment buildings to the harking lot. Mel Spiegler~stated that originally there were to be 102 apartment units with one parking space per unit and after court case, etc. they compromised and built 68 apartment units and there are 85 to 90 parking spaces. He tried to get the State to cut the median at the entrance to parking lot because no one wanted an entrance to Fry Street. He stated that Dahlgren~ village planner_at that time,, showed him just how he wanted it. Spieglers were not particularly happy with the plans but went along. bast year small driveway eras planned on the north side of 1717 Fry Street to make it possible to drive in and back out and use that instead of residential driveways. Spiegler was willing to place fence and shrubs so that car lights would be blocked and inquired how far out to the street a fence could be built. Mrs. Kulkay thought a turn around would be dangerous and suggested a service lane to parking lot by the southernmost apartment building, then there would be no backing out. Mrs. Schultz doubted the turn-around would solve the problem and made note that even after barricades were placed on the Robert Hall boulevard, drivers continued to use the boulevard for turning around. A few residents objected to creating c one-gray on Fry Street because it would be detrimental to value of property. Stanley Schultz, 1725 Fry Street agreed that a turn- around is a good idea,_but thought it should be placed between Spieglerts buildings instead of next to his house, _ M. Marrinan, 1766 Fry Street, brought out the following points (1) people in apartments are prohibited from getting. to parking lot, (2) there is an isolated group who are wide open for anything to solve the problem of turning around in driverorays, and (3) consideration is being given to the probability of males Fry Street a one-moray. Assume that Fry Street goes south - it may solve the problem with apartment people, and solve it for 5 - 6 people who are being inconvenienced. As a whole, the people that live on St. Marys, on Garden, and the rest of Fry Street would be.affected. If people exercise one-gray prerogative they are going to have to go north on some street and logically it would be St. Mary1s. He thought people should get down to business and take into consideration the whole - that one-gray idea should be forgotten. Maybe Spiegler would agree to make a wider area for those people, not only to turn around but a place for guests to park and nose the car in and then pull it out and go in either direction. Bergstedt and Harris want to go on record as being against one moray street. Bergstedt took privi7.ege of asking Spiegler to make access a11. the way through to the parking lot. In answer to inquiry, Attorney Galvin advised that driving into driveway to turn around is not illegal. If there is a violation of trespassing on private property, attorney said that a sworn complaint has to be made by someone who observed the violation. Architect Johnson, speaking for Spieglers, recalled that all this matter went through a year of meetings, changing designs, etc. - the main problem was people 2710 on Fry Street did not want cars coming into Fry Street from the parking lot. The problem wouldn't be solved if that were allowed. He thinks a try should be made with the-State Highway. Department and thinks efforts in that direction should be put forth. He tYinks also that notices posted in apartment buildings cautioning people about turning around in driveways would be a big help. Lemberg stated the reasons the Highway Department refused to allow for cut in median are as follawst (1) there are set up minimum distances between openings - done on statistics. There is one on F Street only about 75 feet away, (2~ it would be within the shadow lane or turn sl~t, (3 biggest reason is that traffic movements in anal out of parking lot are great - 131 daily. Movement in and out of lot coincide exactly with peak traffic on Larpenteur Avenue. Johnson stated there is about 200 feet distance from Fry to parking lot, not 75 feet. He asked if Mr. Sr~yker would cooperate in requesting the Highway Department whereupon Snyker asked what changes have occurred since the Highway Department last denied request. The answer was that there is more traffic now and more hazardous. Snyker also stated that there are mar~r apartment buildings all along Larpenteur -and accesses or median cuts from all could not be allowed. Exits and entrances should not be made or planned directly onto Larpenteur. Not allowing U turns is sensible - too_much conflict. Lemberg added that often traffic is backed up all fhe way -- to Fairv3.ew Avenue. Warkentien asked if home-owners object to driveway to parking lot. Julian Lee suggested two driveways - one in and one out. One resident thought that two drive- ways would create more of a hazard, and also was of the opinion that allowing a U turn would be most sensible. Warkentien asked Mel Spiegler if he were willing to put a stub driveway in, to which Spiegler replied he would do so between the 3rd and lath buildings. A show of hands revealed about 25 people were in favor of this plan. Philip Spiegler thought that inasmuch as only one party is affected if driveway were put north of the northern= .most building that his recommendation would be to place it there and also it would not break up the continuity. Stone asked if it were placed there, could i.t be properly screened. Spiegler will keep the south edge of the driveway in line with the north edge of the building, which would leave about 18 to 20 feet to the property lin®. He will do what engineer suggests as far as screening and will also install a light. Spiegler was advised to apply for a permit for building, after engineer has approved his plan. Mayor called recess at 1Os00 P.M. 2711 Meeting was resumed at 10:15 P.M. Tennis Courts; Review was.made of Engineer Lemberg~s report on estimated costs and,-area requirements for tennis court construction, dated March 28, 196$. This matter wi71. be placed on agenda for further discussion before budget for 1969 is adopted. North Suburban Lions Floyd Matthey has advised that North Suburban Lions Club to make donation Club wishes to make donation to Falcon Heights_to be for recreation: used for purchase that can be used for children's - recreation. Black moved, seconded by Ecklund that this be referred to the Village Advisory Recreation Committee for recommendation. Ayes: A11. Nays: None. Motion was carried. Fire Contract between Saint Paul and the University of Minn.: Future Plans for Falcon Woods Recreation Areal Attorney Galvin advised he will meet with University Attorney-to discuss (1) fire contract betvreen the University and the City of Saint Paul and will ask for copy of same in order that Falcon Heights Fire Department is made aware of what is expected of them with regard to fires on the farm campus, and (2) future plans regarding recreation area in Falcon Woods, and (3) water and sewer facilities that may be needed in the.Cleveland Avenue Roselawn area. Preparation of Report Stone introduced the following resolution and moved on the Improvement of its adoptions South side of Larpenteur - Avenu® by construction WHEREt~LS, it is proposed to improve the South side of sidewalks of Larpenteur Avenue between the West line of Snelling Avenue and the-,West line of Fairview Avenue by-the - construction of-_a side~ralk, and to assess the benefited property for all or a portion of the cost of the improvements pursuant to Minn. State., Secs. 1.1.29.0]1 to 1129.111 (Laws 1953, Ch. 398,_. as amended), NOGIf~ THEREFORE, BE IT RESOLVED BY THE VII.T~AGE COUNCIL OF FALCON HEIGHTS, MINNF50TAs ._ That the proposed improvement be referred to Bonestroo~ Rosene, Anderlik and Associates, Inc., for study and that they,are instructed to report-to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as proposed or in connection with some other improvement as recommended. Peterson, Service Contraet:._ Commissioner of Public Works, City of Saint Paul transmitted four copies_of revised sewter service contract for execution by Falcon Heights Council. Attached was photocopy of Saint Paul City Council Resolution 23809. adopted April 16, 1968 authorizing execution of the agreement_by St. Paul City officers.
