Councilman Black arrived at 8:00 P.M. Also present were Attorney Seed and Engineer Lemberg. Pf~esent for the League of Women Votes were Mary Duddleston~ Betty Jones Betty Ernst, Fay Olson. Observing ~arere Arthur Erler and Allan McCoid. Roger Gratiot.of the St. Paul,Dispatch and Pioneer Press was present. Minutes Stone moved, seconded by Warkentien that the minutes ' of the meeting of April ].1, 1968 be approved. Ayes all. Nays: None., Motion was carried. Ecklund moved, seconded by Stone that the minutes of the meeting of April 17, 1968 be approved. Ayes: All. Nays: None. Motion was carried. Stone moved, Ecklund seconded that the minutes of the meeting of April 25, 196$ be approved. Ayes: All. Nays; None. Motion was carried. Correspondences University of Tn answer to Engineer Lemberg~s inquiry of March 27s Minnesota - 1968 letter from E1mer.W. Learn, Assistant to the Proposed Plans for President of the University of Minnesota, dated April Land -Cleveland 2~., 1968 was read. In part, letter states that Univer- and Roselawn Ave.: city contemplates ownership of all property rest ®f Cleveland Avenue with exception of Historical Society property. .Plans for area east of Cleveland, although not certain, include construction of married student apartments. Utility services most likely would include water from the University system, and linkage with Village sewer system would be preferred. When mayor planning study is completed, University hopes to have comprehensive plan for all activities and land use of University property in Falcon Heights. Data Processing Letter dated May 2, 1968 from Burton C. Spears Director Department - Ramsey County Data Processing Departmaent explained Assessments for amended assessment roll for Sanitary Sewer No. 1~ Sanitary Se~+rer #1- beginning with the 1968 installment payable during Magnetic Tape _ 1969, which roll was sent to Falcon Heights Clerk. System: This is pursuant to resolution adopted by the Village Council regarding Countyts use of magnetic tape systems i.n lieu of punch card system. Data Processing Department - Magnetic Tape System - Flow Chart! State of Minnesota Social-Security for Elected Officials: Letter from Burton C. Spear dated May 2 was regarding the new magnetic tape system and enclosed a ~flc~w charts of procedures used in filing records. It appears that no changes are necessary as far as Falcon Heights Clerks records are concerned. Notice from Harry Groschel, Directory Social Security Retirement Division, State of Minnesota was regarding social security coverage of elected public officials. In part, notice stated that all local governmental 2~~ elected officials who initially take office on or after January 1, 1968 will automatically be covered under Social Security. Maintenance Dept. - Strandquist moved, seconded by Stone that Maintenance Purchase Departmentts request for purchase of 200 pounds of Requisitions Monabar Chlorate soil sterilizer for killing weeds and grass along fences at playgrounds be granted. Ayest A11. Nays: None. Motion was carried. Clutch Repair on Tt was stated that the maintenance truck is being truck: repaired at Badencs Service Station inasmuch as other auto mechanics are on strike. The truck is in need of a new clutch at an estimated cost of X85.00. Request for water Engineer Lemberg's letter of May 9th included suggested connection to letter to_be sent to C. Hamblin, General Manager of the Roseville Resident: St. Paul Water Department, pursuant to request of Village Council .and was regarding request for watermain hookup at Lot 12, Block 2, Gottfried Addition, Roseville. In part suggested letter stated that because of the existing condition of the Hamlane Avenue water main (south of Garden Avenue) it is the opinion of the village council that this request should be denied. Further that unless some agreement could be arrived at ~rhereby both Roseville and St. Paul would share in the cost of the proposed new lane it is felt that it would not be fair to Falcon Heights residents to experience possible inconveniences at their expense. Resolution Receiving Stone introduced the following resolution and moved Preliminary Report and its adoptions Calling Publics Hearing on Sidewalk Improve- ~41~iERF,A.S, the Village Council deems it necessary meats - Larpenteur and expedient that the Village of Falcon Heights, Avenue and Iowa Avenue: Abi.nnesota construct certain sidewalk improvements as . described in and in accordance with preliminary plans and report prepared by Bonestroo, Rosene, Anderlik and Associates, Inc., Village Engineers, and WHEREAS, the Council has been advised by the Village Engineers that the proposed improvements are feasible and should best be made as proposed, and the report of the village engineers to this effect has heretofore been received by the Council and filed with the Clerk; and W~i7~R.F~S, the statute provides that no such improvements sha7.l be made until the Council shall have held a public hearing on such improvements following mailed notice and two publications in the official newspaper of a notic® stating time and place of the hearing, the general nature of the improvement the estimated costs thereof, and the area proposed to be assessed, NOfAf, THEREFOiRE, BE IT RESOLVED by the Village Council of the Village of Falcon Heights, Minnesota= 2715 1 1. A public hearing will be held in the Village Hall in said Village on June 6, 1968 at 8:00 o'clock PM to consider said proposed improvements. 2. The nature of the improvements, the estimated costs thereof, and the areas proposed to be assessed therefor are described in the form of notice of hearing hereinafter set forth. 3. The notice for said public hearing shall be in substantially the following form: NOTICE OF PUBLIC HEARING ON THE CONSTRUCTION OF SIDEWALK IMPROVEMENTS 1 NOTICE IS HEREBY GIVEN by the Village Council of the Village of Falcon Heights, Ramsey County, Minnesota, that a public hearing will be held on Thursday the 6th day of June, 1968, at 8:00 P.M. in the Village Hall of the Village of Falcon Heights, Minnesota for thepurpose of considering the construction of side~ralk improvements on the south side of Larpenteur Avenue between the West line of Snelling Avenue and the East Line of Fairv:i.ew Avenue (projected) and both sides of Iowa Avenue between the West line of Hamline Avenue and the East line of Arona Avenue, pursuant to Minnesota Statues Sections I~29.011 to l~29.111 (Laws 1953, Chapter 398, as amended) . The improvements include concrete sidewalk construction, sidewalk removal where necessary and sod replacement adjacent t o sidewalk. The area proposed to be assess for such improvements is the property abutting on those sides of the streets on which const~tction of the sidewalk improvements is proposed. The total estimated cost of said side~ralk improve- ments is $18,123. Such persons as desire to be heard ti~rith reference to the proposed sidewalk improvements will be heard at this meeting. The Village Clerk is hereby authorized and directed to cause notice of said hearing to be given two publications in the official newspaper. S~.d publications shall be one week apart, and at least three days shall elapse between the last publication and the hearing. Richard Coverdale 2.716 Motion for adoption for the foregoing resolution was duly seconded by Strandquist and upon a vote being taken, the following voted in favor of same: Warkentien, Strandquist, Black, Ecklund and Stone and the following voted against same: None. Whereupon resolution was declared adopted. Black introduced the following resolution and moved its adoption: WHEREAS, Mr. Richard J. Coverdale has made an appli= cation to the Village of Falcon Heights for a conditional use permit to construct a 23-unit apartment building at 2025 tidest Larpenteur Avenue, which property is zoned Bl-A, pursuant to Ordinance No. 64, Sections 16.5 and 10.2 (Subd. 8), as amended by Ordinance 71, and WHEREAS, the Village Council of the Village of Falcon Heights ref erred said request for conditional use permit to the Planning Commission of the Village of F~.1con Heights, and said Planning Commission .approved said conditional use request by a report dated March 28, 1968, a copy of which report is on file in the office of the Village Clerk and made apart h erof by reference, and WHEI~.EAS, the number of parking spaces and the side yard setback originally provided in the construction p7a.ns failed to meet minimum requirements of the Falcon Heights zoning ordinance, and the applicant has subse- quently amended the construction plans to provide for parking spaces and a side yard setback which now meet the requi~snents of said zoning ordinance, and WHEREAS, the proposed apartment building now conforms with all other conditions set forth in Section 8.1~ of the zoning ordinance, including density requirements, NOW, THEREOFRE, BE IT RESOLVED, by the Village Council of the Village of Falcon Heights: 1. There are special or unique characteristics involved herein, and the granting o~ said conditional use permit will not be detrimental to the health, safety or general welfare of the community, nor will cause serious traffic congestion nor hazards, nor will seriously depreciate surrounding property values, and that the granting of said conditional use permit is in harmony with the general purpose and intent of the ordinance and the comprehensive plan of said village. 2. The request for said conditional use permit is hereby granted. Motion for adoption of the foregoing resolution was duly seconded by Stone and upon a vote being taken, the following voted for same: Strandquist, Warkentien, Black, Stone and Ecklund and the following voted against same: None. Whereupon resolution was declared adopted. 271? Con$inued - Richard Coverdale Richard Coverdale and Robert Moder are of th® opi.nion 23 Unit Apartu~ent that any future street construction to serve the Houses. undeveloped areas north of Larpenteur Avenue would net benefit the property at 2025 West Larpenteur Avenue. Future street They are of the opinion that no assessment should be construction levied against said property for any street construction assessments that would serve the areas north. They were advised that the Village Council cannot make any commitments regarding such assessment inasmuch as it has not hs yet been determined where street will be constructed. Village Recreational Warkentien advised that the Village Recreational Advisory Committees Advisory Committee met on Tuesday evenings May 7th and discussion regarding erecting of temporary warming house (which can be relocated if necessary) at the Falcon Woods Playground was held. The possibility of erecting a basket weave fence was also explored. Dick DeSchriver, summer recreation director, attended the meeting and outlined the summer recreation programs which will be conducted from 9s30 a.m. to ~.s00 p.m. each week -- day at both the Falcon Woods and FalconHeights Elementary School playgrounds. An Ordinance Crating Ecklund introduced the following resolution and moved Human Rights its adoptions Commissions WHER~'~S~ the Village Council has held discussions Ordinance No. 85s to consider the. adoption of proposed Ordinance No. 85:and WHEREl1S, the attorney for the Village of Falcon Heights has been consulted in the preparation of proposed Ordinance No. 85, NCW, THEREFORE BE IT RESOLVED that the Village Council of Falcon Heights does ordain as follows It is hereby declared that it is the public policy of the Village of Falcon Heights to fulfill its responsibility in securing for all citizens equal opportunity in housings employments public accommodatiens, public services and education, and to work consistently to improve the human relations climate of the Village. To this ends the Village Council of Falcon Heights does ordains Section 1. There is hereby established within the Village of Falcon Heights a Human Rights Commission. Section 2. The purpose of the Commission is to secure for all citizens equal opportunity in employment ~ f housing,. public accommodations public services and education and full participation in the affairs of this community by advising the Village Council on long range programs to improve community relations in the Village. Section 3. The Commission shall consist of eleven members to be appointed by the Mayor by and with the advise and consent of the council. Members of the 2718 Commission shall be appointed with due regard to their fitness for the efficient dispatch of the functions, pourers and duties vested in and imposed upon-the Commission. Members of the Commission shall be appointed for terms of three (3) years, except that air person appointed to fill a Xacancy occurring prior to the expiration of the term for which his predecessor was appointed shall be appointed only for the remainder of such term. Upon the expiration of his term of office a member sha11 continue to serve until his successor is appointed and shall have qualified. The first Commission shall consist of .four members appointed for a term of three years, four members for a term of two years, and three members for a term of one year. The members of the Commission shall serve without compensation and may be removed from office for cause by the Mayor. Section !t. In fulfillment of its purpose the Commission's duties and responsibilities shall be tos (a) Enlist the cooperation of agencies, organi- zations,and individuals in the community in programs directed to create equal opportunity and eliminat® discrimination and inequalities. (b) Formulate a Human Relations Program for the Vi7lage,to give increased effectiveness and direction to the work of all individuals acrd agencies addressing themselves to planning, policy making and educational. programming in the area of civil and human rights. (el Advise the Mayor, the Village Council and other agencies of the government on issues of civil and human rights and recommend the adoption of such specific policies or actions as are needed to provide for full equal opportunity in the community. Section 5. This ordinance shall be in full force and effect from and after its passage and publication. Variance Request As per Council meeting of April 25, 1968 when variance Fence at 1870 for fence at 1870 North Albert was granted provided Alberts that Planning Commission recommend same, it is hereby noted that the Planning Commission, in its letter of May 9, 1968 recommends that variance be granted. Hermes Floral Company Black moved, seconded by Ecklund that variance request Flashing Signs, made by Alfred L. Hermes for flashing sign at Hermes Floral Company,..~'001 West Larpenteur Avenue be referred to the Planning Commission_for consideration and recommendation. .Ayers All. Nays: None. Motion was carried. Agreement between ,tone introduced the following resolution and moved Saint Paul and Falcon its adoptions Heights Authorizing the Interconnection 'WH]r,RF,AS, an Agreement between the City of Saint of Public Sewers Paul and the Village of Falcon Heights authorizing the Interconnection of Public Sewers has been review®d by (Sewer Contract) members of the Village Council, and by, the village engineer, and 1NT~EREAS, said Agreement has been approved as to f©rm by the. Village Attorney, NOW, THEREFORE, ~ IT RESOLVED by the Village Council of Falcon Heights that the.Mayor and the Clerk of the Vila ge of Falcon Heights are hereby authoriz®d to execute said Agreement. on behalf of the Village of Falcon Heights. June 1$, 1968 Council Stone moved, seconded by Ecklund that the regular Meeting datechanged: council meeting scheduled for June 13, 1968 be re-scheduled for June 11, 1968 inasmuch as it appears that three councilmen will not be able to attend the June 13 meeting. Ayes: All. Nays: None. Motion was carried. Engi.neerts Report Lemberg stated that he has checked into dimensions of Idaho~nelling Playground area and the blacktopped Tennis Courts portion is not large enough to accommodate a tennis court. Highway Department Lemberg advised he has just received from the State -Local Consent Highway Department a letter dated April 29 which Bills advises of its proposed B311 on Municipal Plans or Local Consent. It appears as though Highway Department is being held up in so many places on intra-state highway construction by local communities that the Department is asking for new legislation which would provide that if local council does not act on highway department plans within three months after receipt, the Commissioner of Highways can proceed with construction; if local council does act and no tifies Commissioner within three months to oppositions an arbitration board will be, set up and final disposition of the matter will be made. Special Meeting Warkentien moved, seconded by Stone that special June 20th to meet meeting be scheduled for Thursdays June 20, 1968 at with Highway 7:30 P.M. to discuss the latest Highway Department Commission®r: plans for Larpenteur-Snelling intersection. Ayes: A11. Nayss. None. Motion was carried. Fry Street Stub Driveway: Attorneyts Report State Fairground Structures Taxes: Julia Lindig~s Estate_ and land south of 18'j0 Lemberg advised he had received a rough sketch of proposed stub driveway from Spiegler. Lemberg will contact Spiegler. Regarding private enterprise on the fairgrounds, Attorney Seed stated that structures on the fairgrounds are assessed :~, personal property and'axe not assessed as real property. There is no additional valuation with `respect to the land on which they are situated. County assessor Welhavein advised this matter had been investigated and under__the law, this is the only treatment that can be given to this property. The State Agricultural Society does not enter into a ground lease but simply issues a license enabling individuals to build the structure on the land therefore the land is not being leased. Fire Department: Ecklund stated he had attended business meeting of - Fire Department Volunteers on Tuesday May 7th. Letter dated May 8, 1968 from H.J. Dachtera, Secretary of the Fire Department Relief Association suggested that Ma$imum Starting maximum .retirement age be raised to age 70. The rules Age - Retirement and regulations of the Association, approved by the Ages Council, set the maximum age at !~5 hire and 65 retire; ,- The Falcon Heights maximum.. age affects c~ member~r of the Assoc- iation. Architect Darrell noted that the Preliminary Scheme for the residence of Mr. and Mrs. Herbert Richards dated April 16, 1968 and submitted. this evenings shows ' set back lines and additions that extend no further to the north than the existing garage. Black stated that - inasmuch as there appears to be no violation of village. ordinances, the variance application fee of X5.00 should be returned and additions to home may be commenced. Variance Request - Strandquist moved, seconded by Warkentien that the Garage at 7.lt3b West meeting be recessed in answer to William E. Swensonrs California Avenues urgent phone call to consider amending variance permit granted on April 17, 1968 for location of garag®. Ayes: All... Nays: None. Motion was carried. Council meeting was reconvened at the site of garage - 1l~36 West Cal ifornia Avenu®. 2722 Bills: Adjournment: Ecklund introduced the following resolution and moved its adoption: 1NI~[ERE~A.S, William E. Swenson applied to the Village of Falcon Heights for a variance permit to allow for the ..construction and location of a garage at 1la.36 West California, with a rear yard setback less than the minirm~m thirty (30) feet required by the awning ordinance, and 1RHEREAS, the applicant inadvertently set forth in the application form that the variance requested was a two (2) foot rear yard setback when he actually meant and was understood by the Village Council and Planning Commission' to mean c onehalf (2) foot setback, and WHEREAS, the error was not detected until after the April 17, 1968 meetingof the Village Council NOW, SORE, BE IT RESOLVED by the Village Council that the minutes of the April 17, 1968 meeting of the Village. Council ark ~iexeby amended to show that a variance permit has been granted William E. Sw®nson to construct and locate a garage at 1~.3b West California with a one half (~) foot rear yard setback instead of the required 30 feet. Motion was duly seconded by Black and upon a vote being taken the following voted for same: Warkentien, Strandquist~ Black, Ecklund and Stone, and the following voted against lames None.
