HomeMy WebLinkAboutCCMin_68Aug152761 Meeting of August 15, 1968 The regular meeting was called to order at 7:00 P.M. with the following members present: Mayor Warkentien, Councilmen Black and Norman Ecklund. Absent: Clerk Strandquist and Councilman Stone. Also present were Attorney Seed, Engineer Lemberg, and Treasurer Olsen. Minutes: Ecklund moved, secondedmby Black that the minutes of the meeting of July 25, 1968 be approved. Ayes: All. Nays: None. Motion was carried. Black moved, seconded by Ecklund that the minutes of the special meeting of July 31, 1968 be approved. Ayes: All. Nays: None. Motion was carried. Request made for ~. Ernie Torok of Bisanz Brothers Realty Co. and Dr. Paul Rater hook up Lallas of Falcon Heights were present to make request that to Falcon Heights Falcon Heights Council give permission for water hookup Water on Hamline from watermain on Hamline Avenue to proposed new buildings Avenues on the Roseville side of Hamline Avenue. He stated there are four lots on the Roseville side for which plans to build homes have been approved and he was told by the City of St. Paul that in order to get water they have to get permission from Roseville and also from Falcon Heights. Roseville advised°him all they need is Falcon Heights approval to hook onto that water main. Councilmen reviewed with Mr. Torok the problem of Hamline Avenue water and the three inch galv8nized pipe that is being used and has been used since installatio~i of same in 1926. He was also informed about the meetings held between the St. Paul Water Department and the Village of Falcon Heights councilmen to resolve the matter of ownership of this line. It is Councilmen's opinion that the Village of Roseville is responsible for obtaining water for its residents and Mr. Torok was referred to 'Roseville Village Council who should instiate action. Licenses Having met the requirements, Ecklund moved, seconded by Approved: Black that Cecil H. Motion was carried. On-Sale Having met the requirements, Ecklund moved, seconded by Non-Intox. Anklan, P.E., County Engineer, gave Apartments - authorization to construct a median opening and driveway, Median Openings close the existing median and undertake appurtenant work on Larpenteur Avenue west of Fry Street. Metropolitan Letter from Metropolitan Section of the League of Minn. Councils Metro. Municipalities dated August 7s 1968 stated in part that Sever Plant Metropolitan Council adopted preliminary concept plan for providing sewer services in the entire metropolitan area. The Metropolitan Council is actively seeking questions and continents from municipal officials and other interested parties. Streets, Roadways, Memorandum to A11 Municipalities dated August 6, 1968 or Driveways entering requested that Council not approve any plans for an<y on to a County Road: street, roadway or driveway entering on to county road without requiring developer or contractor responsible to submit such plans to the Ramsey County Highway Department - Engineer's attention. Department of Letter dated July 31, 1968 from Russel G. Schwandt~ Agricultures Commissioner Minnesota Department of Agriculture stated that Abraham Rosenthal has been appointed to position of Agriculture Programs Coordinator. This position has been created for purpose of developing greater cooperation and liaison with other units of government. Waste Control, Inc. Letter dated August 1, 1968 stated in part that Waste Control, Inc. owns and operates Sanitary Landfill in Anoka. Dept. of Administration Memorandum from Documents Supervisor, Department of Publications Minn. Administration advised that 1967 edition of Minnesota Statutes 1967s Statutes is available. Black moved, seconded by Ecklund that one copy of Minnesota Statutes 1967 Editions 2 volume set, be purchased at a cost of $l~0.00. Ayes: Warkentien, ffiack and Ecklund. Nays: None. Motion was carried. County Auditor County Auditors letter of August 1 requested law Re: Law Enforcement enforcement budget for the year 1967 for. the Governoris Budget 1967 Corrmi.ssion on Law Enforcement. _ St. Paul Dept. of Letter from City_of Saint Paul Department of Public Public Works - 1~orks enclosed copy of Council File No. 239766 which Sewer charges is in regard to surer rental charges within and outside Effective of the City to be effective as of the first of January January 1~ 19693 1969. St. Paul~Association Letter from SPARC advised of a meeting to evaluate the for Retarded Children: program conducted this summer, and invited interested persons to attend. Letter was not received in time to notify council members, therefore, no council member attended. 2 763 i~ Correspondences Ramsey County - Letter of August 1, 1968 from Burton Spear, director Flog Chart - Ramsey County Data Processing Department related to Local Improvements Suburban Municipalities (Public) Local Improvements, Special Assessments -Divisions Flow Chart• NSP Company Letter dated August 1 fromJF. Owens, Jr., Vice President Increase in electric and Manager of NSP, St.- Pauli Minnesota advised that it service rates will be necessary for NSP to increase its electric service rates. Amended electric rate schedules which will. become effective on and after November 1, 1968 were enclosed, and maximum increase is 55¢ per month. Discussion brought out the fact that Falcon Heights is in no position to state that the rates are reasonable or unreasonable. Ecklund was of the opinion that perhaps the council could write the legislature and the governor asking that a State Utilities Commission be established. Mrs. Alan McCoid Variancse and Conditional Black introduced the folla~ing resolution and moved its Use Permits - 2025 West adoptions Larpenteur Avenue -_ Student Housings ~iHBREAS, ~ioseph Wirrer, 1381 Almond Avenue, St. Paul has made an application for a variance permit and condi- tional use permit to convert a single family residence into a student boarding house on property located at -2025 West Larpenteur Avenue, which property is zoned ffi A, with ten students instead of the eight students maximum allowed by Village of Falcon Heights Zoning Ordinance No. 6i~ as amended, and ~iHEftF.A5, the Village Council of the Village of Falcon Heights referred said request for a variance permit to the Planning Commission of the Village of Falcon Heights, and said Planning Commission recommended approval of said variance permit by a r eport dated August 13, 1968, a copy of which report is on file in the office of the Village Clerk and made a part hereof by reference, and WHEREAS, the Village Council of the Village of Falcon Heights has rev.~e~red the request for said variance permit, and has reviewed the report of the Planning Commission, NOW, THEREFORE, BE IT RESOLVED by the Falcon Heights Village Council that 1. There are practical difficulties and particular hardships in carrying out the strict letter of the regulations of this ordinance. 2. The proposed variance and conditional use are not inconsistent with the character and development of the immediate neighborhood. 3. The granting of the request for a variance and conditional use permit is necessary for the preservation and enjoyment of a substantial property right of the applicant. !~. WHEREAS, the Village Council of the Village of Falcon Heights referred said request for a variance permit to the Planning Commission of Falcon Heights and said Planning Commission recommended denial of said variance permit by a report dated August 13, 1968 for the reason that such a fence would not be in character with remainder of the neighborhood, and WHEREAS, the Village Council of Falcon Heights has reviewed the request for said variance permit, and has reviewed report of the Planning Commission, NONE, THEREFORE, BE IT RESOi.VED by the Falcon Heights Village Council that the proposed variance is not in keeping With the character and development of the iYmned9ate neighborhood and is denied. The motion died for lack of a move to second its adoption. The motion was duly seconded by Warkentien. Upon a vote being taken, the following voted for s awes Ecklund and Warkentien and the following voted againstsames Black. Whereupon it was declared that the resolution was adopted. 'It is noted that the Village Council had previously taken under consideration the feasibility of erecting a fence on both sides of this walkway. Farmers Union Grain Agreement between Farmers Union Grain Terminal Association and Parking Lot leased by the Falcon Heights Volunteer Fire Department pertains to the Falcon Heights Volunteer latter leasing the formeris parking lot immediately west and Fire Department during so~zth of the Village Hall.-for the week-ends during State Fair Week: Fair Week. Ratification of Actions Ecklund moved, seconded by Warkentien that the actions taken by Village Council taken by the Village Council at the special meeting held at special meeting of on July 31, 196$ be .and are hereby ratified. Association Warkentien moved, seconded by Ecklund that the Village of Civil Defense Council authorize Henry Dachtera to join the Minnesota Directors Association of Civil Defense Directors and that dues in amount of X2.00 be authorized for payment. Ayers Warkentien, Black and Ecklund. Nays: None. Motion eras carried. Fire Department: Letter from Department of Civil Defense requested that Use of Fire fire and civil defense siren be used only in cases of Sirens emergency. Application for Application for employment of David Luikonen submitted Employment - - by Volunteer Fire Department was returned with request David Luikonens the application be fully completed. Brush Pile In answer to request of council, Fire Marshal Bert 31ama 1870 W. Roselawns inspected the brush pile at 1870 W. Rosela~m and it is his opinion that same does not constitute afire hazard.
