HomeMy WebLinkAboutCCMin_69Feb132817 T~ETING OF FEBRUARY 13, 1969 The regular meeting of February 13, 1969 was called to order at 7:00 P.M. with the following members present: Mayor Warkentien, Clerk Taylor, Councilmen Stone, Black and 'Lcklund. Also present ..:were Attorney Galvin, Treasurer Olsen and Engineer Lemberg. Minutes: 1~7arkentien moved, seconded by Stone that the minutes reflect today's receipt of the October 10, 1968 minutes from the former Deputy Clerk and that these are the last of the rrri.tzutes which were being completed by Mrs. Vavoulis. T~Iotion was carried. Stone moved, seconded by ~°~arkentien that the minutes of the Meeting of January 23, 1969 be accepted as corrected. Motion carra.ed. Application for Black advised that the application for a sign consisting of 3b0 Variance from square feet from Robert Blomberg, 153 N. Hamline, was approved R. Blomberg at by the Planning Commission. He moved that the Council approve 1583 N. Hamline: the construction of said sign. Stone seconded. .Motion was carried. Application for Black also advised the Council that the application for a variance Var~nce from for the same type of sign as mentioned above with a square footage Clarence Schiller, os' ~.UB had been approved by the Planning Commission. He, therefore, 1579 N. Hamline: moved approval. of the variance. ,Stone seconded the motion. Motion passed unanimously. Flashing Sign at The Village has a flashing sign at Mango Photo and Black moved Mando Photo: that the Council write a letter to Mango telling them that the sign is contrary to Ordinance bta.. The Council was reminded, however, of the same types of signs.througnout the Village which have been operating for some time without notification to the owners. Black withdrew his motion noting that further investigation wil.~ be made as to how man;,r signs of this type are now in operation within the Village. Application for Mr, .Marvin Day submitted an application for a building permit Variance from for a pedestal sign to be constructed for the Pizza Hut at Pizza Hut for 1650 N. Snelling. It is the standard sign for the t'ranchise. Sign: The lighting is 100% ~-thy-n and the sign does not flash or rotate. The application for. variance requests: 1. Height of sign to be 28' - Ordinance reads 251 2. Square footage of sign 1251 - Ordinance requires limits of 100' 3. Setbaclc from service road 20 to 251 - Ordinance requires 30T Black has talked to the Chairman and two otner members of the Planzii.ng Commission and they have indicated that they axe in favor of the 125' square footage and the snorter setback. Black moved tnat the application for the variance, along with the application for the building permit and the plans, be submitted to the Falcon Heights Planning Commission. Ed~lund seconded. Motion carried. Reimbursement of Stone moved, seconded by Taylor, that the Council authorize reimburse- .Fee to Deputy ment to Maureen Mc~tullen,.Deputy Clerk, in the amount of $213.75, Clerk: for the fee she paid for her position with the Village. This reimbursement was agreed upon at the time of her employment. I~Totion carried unanimously. Mr. ti,T, Anderson 1903 Tatum St. t~.e : Dog Nuisance i 1 2818 Trtarkentien explained the reason why Iulr. Anderson was called to meet with the Council referring specifically to T1r. Skogsberg's complaint at the Council Meeting of January 23, 1969. It had been reported that the dog continually ran loose and destroyed shrubbery. I~r. Anderson asked if the Council had received more than one complaint in regard to his dog. The Council informed him that they have had many cal7_s about his dog from different parties. Mr. Anderson admitted that his dog does runloose; but he said that they try to keep him tied whenever possible. When confronted witl~ a complaint that hi-s dog barked until 2:00 the morning of January 23, 1969, Mr. Anderson stated that his dog was not a barker. Ivlr. Ecklund stated that -they have had to chase the dog out of their yard 'oecause he tries to get at the rabbits in his front bushes and in so doing he breaks the brittle shrubbery. I~'Lr. Anderson stated that he was more than willing to pay for the damage the dog caused but that none of the neighbors ever tell him when the dog does damage property,*. Many times, he stated, he has received calls from people saying his dog is in their yard, but they won't say who they are so r~1r. Anderson can retrieve him. Also, he mentioned that his dog is not the only bla.clc Labrador in the area. Mr. Anderson said that the dog ti~ras registered in St. Paul but had recently lost his tag. He was not aware that Falcon Heights reduired all dogs to be licensed in the Village. NIr. Anderson felt that the stories were an exaggeration; but Ecklund informed his that he had talked to many of the neighbors and they didn't feel that way. NIr. Anderson stated that he would do the best he could to contain the dog. He purchased a dog license ~.~;fter the discussion and was furnished copies of the applicable ordinances. Resignation of TrTarkentien advised the Council that Philip Stocker had been Philip Stocker elected to serve as chairman of the 1~epublican Party in District 1~9B from Human I~,ights and due to a conflict of interest, he had submitted his resignation Commission: as a member of the Human Fights Commission. Warkentien moved that the Council accept Iylr. Stocker's resignation from the Falcon Heights Human Rights Commission and commend him on his loyal and sincere service since inception of the commission. Stone seconded. Upon a cote, the motion was passed unanimously. Trdarkentien appointed George Carver, 1376 West Iowa, to the position vacated by Mr. Stocker to serve out the remainder of the three year term. Stone moved that the appointment be confirmed. Black seconded the motion. Motion was carried. Warkentien asked that the Clerk prepare a letter to Mr. Stocker regretfully accepting his resignation and to Mr. Carver advising his of his appointment. Also, Reverend Van Kirk and Mrs. Kain of the Human Rights Commission should be infomed of the appoint- ment and resignation by letter. 1 28l~9 Ramsey County Ecklund met with Captain Spencer on the 29th of January to discuss Sheriff t s Bill : Sridr$' bi11 in the amount of $1.3,098.65 for the quarter ending December 31, 1968. Captain Spencer replied by letter dated January 31, 1969 that the bill was higher because of 1r7orkmen~s Compensation in the amount of X709.65 and the firstra].f of a 12J increase in salary which became effective August 1, 1968. The check for payment was signed upon receipt of this information. A copy of Captain Spenceros letter will be forwarded to the Village Attorneys s office forfiling with the contract. F.D.~t.A. Bi.t1: Chief Helbig, Volunteers Dowdell, Bianchi, and Schirrmeister were present. Discussion .was held. in regard to the Fire Department Relief Association Bi11 and changes were made to finalize .the rough draft. Ecklund moved adoption of resolution approving substantially the same form of bill as presented at the meeting. Taylor seconded and authorized the Mayer or his designated representative to deliver the biL1. to the Legislature. Motion carried. Fire Hydrant at Volunteer Dowdell. asked what could be done about a sunken Larpenteur rTanor: hydrant at .1710 W. La~penteur Avenue. Engineer Lemberg advised that the fire hydrant is not village-owned and therefore we can do nothing about having the matter corrected. Heed, however, state that Bonestroo, Rosene, AnderLik & Associate, Inc. was stilt holding the bona for their landscaping because the grading has not been done properly. T;~b'hen they correct that problem by cutting the grade down, the hydrant will be alright. Black advised that such a hydrant could have an adverse effect on the apartrients ~ fire insurance and if the problem is not corrected this spring, this should be brought to the owners attention. Motion was carried unanimously. Employment of The attorney said that according to the Attorney Generals Bert Slama: opinion, Bert would be in danger of losing his pension benefits if n,e works on the Fire Department payroll. Stone stated that some plan should be dram up soon for him. to work in the Village. Fire Reports: Ecklund read Fire F~eports 766, 767, 768, and 769. The Council was well satisfied with the results of the response. by the men and the overall operation of the department as a volunteer unit. Reports 767-769 result from negligence on the part of the contractor who was wrecking the house and garage at 1800 T;d. Larpenteur without a burning permit. Chief Helbig agreed to sign a complaint with the Justice of the Peace against the contractor under Ordinance .5~. as amended by Ordinance 81~. Storm Sewer Lemberg presented the Council ~r1.th the Feasibility Study Improvement 6y-l: dated February7.,3, 1969 on Storm Sewer Improvement 1969-1. Falcon Heights' share of the project is $11.x,000. An.~additional w15,500 was proposed for catch basins and lines on Prior and. Autumn, making the total cost of the project approximately X29,500. Subtracting the street area from privately owned property involved would result in an assessment of X4,318.56 to the Village ana an average of :517.00 per lot to the property owners. 2850 A copy of subject letter is on file in the Village Clerks office. The attorney advised that the appropriate owners are to be notified no later than February 21, 1969. He is preparing the publication for the 19th and 26th of February in the Sun Newspapers. Edclund moved, Taylor seconded that the Engineer be authorized to prepare an information sheet to be mailed along with the Notice of Hearing to the otmers of the property involved. T~Iotion was carried unanimously. C]e~ning of Engineer advised the Council that Clem Schmidt had called Catch Basins: offering to clean off the Village catch basins for X12,00 an hour. He told the Council that the present plowing firm has been doing some of this at <~9.50 an hour. 'Erie Council felt that the present arrangement was satisfactory. Recreation at Black stated that the Recreation Committee had informally State Fairgrounds: mentioned using the camping area of the State Fairgrounds for recreational purposes. The recommendation is going before the State Fair Board in hopes of using the area until August 15, vacating for the period of the fair and re-establishing the program again in September.
