MEETING OF JUNE 26, 1969

The regular meeting of June 22, 1968 was called to order at 7:10 P.M. with the
following members present: Mayor Warkentien, Clerk Taylor, Councilmen Stone,
Black and Ecklund. Also present were Attorney Seed and Engineer Lemberg.
Minutes: The minutes of the preceding meeting were tabled due to the
fact that copies thereof could not be found in the office.
NSPCo. Under- Clerk Taylor read a letter received from the Northern States
ground Facil- Power Compares giving revised residential rate schedule for
ities: services supplied by underground facilities, monthly minimum
charges to be $2.00. Letter was noted and filed.
License Clerk Taylor reported that license renewals are due June 30.
Renewals - While checking on this, he found no license for the DX Car
(DX Car Wash): Wash. This matter will be checked with former Clerk, Herb
Strandquist, and notice sent to DX Car Wash {formerly State
Fair Car Wash}.
Petty Cash Clerk Taylor reported a discrepancy in petty cash fund and
Discrepancy: an absence of vouchers for amounts spent. He was instructed
to check with former deputy clerks and the matter will be
placed on agenda for next meeting.
Rezoning Re- A public hearing was the next order of business following a
quest - 1697 request by Robert B. Pagenkopf, 1697 N. Hemline, that his
N. Hemline: property be rezoned from R-1 to B-2. The purpose of this re-
quest was to enable him to sell his home to Mr. and Mrs.
Wilfred R. Ortt who wished to use the home for a beauty salon.
After reading a letter from Mr. Pagenkopf and also a listing
of his reasons for this rezoning request, Councilman Black
reported that the Planning Commission had recommended denial
of the request. Attorney George Peters, First National Bank
Bldg., spoke for the Pagenkopfs' listing the several advant-
ages which would come from permission to operatethis business
at this location. Appearing in person to oppose the request
were: H. P. Bruncke, 1710 N. Albert; Don Brausen, 1707 N.
Hemline; James A. White, 1716 N. Albert; Ralph D. Whaley, 1704
N. Albert; and Mrs. R. J. Roy, 1366 W. Larpenteur. A letter
received from the Thatcher Clinic and a petition signed by 13
nearby residents in opposition were received. Speaking in
favor of the rezoning (in addition to the attorney} were Mr.
and Mrs. Pagenkopf, Mrs. Dilger (real estate agent) and Mr.
and Mrs. Ortt. Councilman Black moved the adoption of the
following resolution:
R.ESOLUPION DENYING APPLICATION FOR REZONING
WHEREAS, Robert B. and Valerie J. Pagenkopf applied
to the zoning administrator of the Village of Falcon Heights
for an amendment to the Village Heights zoning Ordinance No.
6l~, as amended, which amendment would rezone property located
at 1697 North Hemline Avenue, Falcon Heights, from apart of
One Family Residential District to a Retail Business District;
WHEREAS, the legal description of said property is
as follows:

~6s1HEREAS, notice of hearing by the planning commission and
Village Council of the Village of Falcon Heights was duly published
in the legal newspaper for the Village abd copies of said notice
were sent to all property owners within three-hundred (300) feet of
the outside boundaries of the land proposed to be rezoned;
WHEREAS, the planning commission of the Village of Falcon
Heights, after holding said public hearing, recommended in its report
of June $9, 1969, a copy of which is on file with the Village Clerk,
that the application for the rezoning be denied.
NOW THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Falcon Heights that:
1. Applicants have failed to make an adequate
showing that the proposed rezoning would serve any public need.
2. The proposed rezoning is completely out of
character with the immediate neighborhood, is contrary to the
spirit and intent of the zonir~ ordinance and the comprehensive
zoning plan for the Village and is essentially spot zoning.
3. The commercial uses allowed by the proposed
rezoning are inappropriate for the area covered by the rezoning
application.
?~. The proposed rezoning would have an adverse
effect upon property values in the immediate neighborhood, would
increase traffic congestion, and ~TOUld be contrary to the public
welfare of the Village.
5. The width of the property covered by the
proposed rezoning is so small that the side lot requirements
for a building in a B-2 district (Retail Business District)
cannot be met.
6. The application for said rezoning should be
and is hereby denied.
Councilman Stone seconded the adogtion of the above
resolution and passed.
Human Rights Councilman Stone moved, Councilman Black seconded, that the matter

Unsightly Bus - Councilman Black reported that an unsightly old bus has been

Sidewalk Im- Engineer Lemberg reported that concrete work has been finished

Street and Engineer Lemberg reported that street patching has begun. This

Sewer Problem It was reported that complaints of sewer backups at 1635 Garden
on Garden Ave.; and the home adjoining have been received. In order to avoid
recurrences of this problem, Councilman Black made a motion that
manholes should be opened twice a year and flushed and that a
report be made by manhole number, and that the Village Clerk
advise village maintenance man in writing to this effect (letter
to be drafted by Engineer Lemberg). Clerk Taylor seconded.
Motion passed.
Basketball A request has been received for basketball equipment at the
Equipment-Idaho Idaho Playgrounds. Mayor Warkentien made a motion, seconded
Playgrounds: h3'' Councilman Black, that a post be provided and, if necessary,
a backboard and hoop to be installed on blacktop area where
children's equipment is at present. Motion passed.
Village Hall Engineer Lemberg reported that one new door has been installed

Air Conditioner Clerk Taylor moved that the Village-Engineer be authorized to

Drainage Prob- Councilman Ecklund reported that complaints have been received

nothing can be done to remedy this at the present time.
Metro Park & Mayor Warkentien read a letter received from Bob Ashbach asking
Open Space for the suggestion of a person to serve on the Metro Park and
Program Com- Open Space Program. It was agreed that Len Harkness be recom-

Pollution Control, Company announcing an important meeting on pollution control
July 23: to be held at 9:30 A.M. July 23, 1969 at the Holiday Inn,
