OF DECEMBER 11, 1969 The regular meeting of Dece:aber 11, 1969 was called to order at 7:08 P.M. with the following members present: Mayor Waxkentien, Clerk Taylor, Councilmen Black, Ecklund and Stone. Engineer L~nbexg arrived at 7:30, Treasurer Olsen at 7 stt0 and Attorney Seed at ?:55 P.M. Minutes: Stone moved that the minutes of the meeting of November 26, 1969 be approved as corrected. Ecklund seconded and the motion carried. ?nsurance Bids: Txivitation to Bid on the insurance policies for the Village were sent out on November 20, 1969. Replies were received from the Keller Agency, Mutual Service Casualty Compa~r, Northland Agency, State Automobile and Casualty Under- writers, and the Paul J. Breher Compar~r. Stone moved that the contract for Fire and Extended Coverage be awarded to the Keller Agency with the low Bid of $131.00. Seconded by Ecklund and motion carried. Stone moved that the contract for Worlanen's Compensation be awarded to the Paul J. Breher Compares with a low Bid of $819.16. Black seconded and motion carried. Black moved that the Paul J. Breher Compaxay be awarded the contract for Comprehensive General Liability and Automobile Liability on the basis of the total Bid of $7.1x15.00, this being the law ca~nbined Bid on those cover- ages. Seconded by Ecklund and motion carried. Unclaimed Bid: Specifications and invitation to Bid addressed to R. Wo7.fgram, 1530 West Iowa Avenue, have been returned as unclaimed. 2935 Appointment of Joseph Mr. Allan McCoid, Professor of Law, University of Minne- L. Mannikko, Justice sota, appeared before the Council to recorr~nend for con- of the Peace: sideration, the appo3.ntmeat of Joseph L. Mannikko, 17l~0 West Larpea~teur Avenue, a second year law student as Justice of the Peace, to fill. the vacancy created by the resignation of D. Michael Noonan, for the Village of Falcon Heights. Stone moved that Joseph L. Manni.kko be app~93nted to serge the unexpired term of D. M3.chael Noonan, as Justice of the Peace, the term to expire on December 31, 1970. Seconded by Taylor and motion carried. Taylor adm3.nistered the Oath of Office to Joseph L.Mant~tko as Justice of the Peace for the Village of Falcon He3.ghts. Letter regarding Students Taylor read a letter from Jerzy Rich, 1791 Tatum Street, Parking on Tatum Street: regarding Un3.versity of Minnesota students parking their cars on Tatum Street north of Larpea:teur Avenue. Mr. R+och thinks this is causing hazardous conditions.for residents living on Tatum Street especially during heavy snow fall. Ecklund will check with Mr. Ruch regarding this matter. Public Employees Taylor read a letter from the PERA regarding del.3.nquency Delinquency Letter: of payment from 1967-1968. The association wants payment by December 31, 1969 or a 6~ interest rate will be charged. Attorney Seed was authorized to study and recommend as to proper disposition of the matter. Letter to Minnesota Waxkentien moved that the Village Clerk be requested to Connnerce Conanission: write to the Minnesota Commerce Commission in regard to the authority of the Falcon Heights Bank to move to Roseville. We are ca1.l.ing to the Com~mi.ssion's attention, the fact thi-t we expect to replace the Falcon Heights State Bank with another bank to serve our Village, and we want this fact known so there will be no ob3ection by the Commission at a later date to our opening another bank in the Village be- cause of the proximity of the other banks in the area. If the move of the bank to Roseville would mitigate against our getting another bank, we would request that the move be denied. Seconded by Black and motion carried. Investments by Stone moved that the Village Treasurer be author3.zed to Village Treasurer: invest the surplus sinking funds in short term treasury bills and long term bonds and notes as recommended by the Village Treasurer as per Exhibit ~~A~~. Seconded by Warkentien and motion carried. Hockey League Board: Warkentien moved that the Village appoint l~r. Thomas Mcaough, 1938 Summer Street, Mr. Donald K. Drach, 1877 Sheldon Street, and Mr. Richard G. Thorp, 1929 Sumner Street, as representa- tives of the Lauderdale-Falcon Heights Youth Hockey Board. Seconded by Ecklund and motion carried. 2936 r, U 1 1 Payment to T. J. Reilly Taylor moved that the Village of Falcon Heights pay the Plumbing Company: T. J. Reilly Plumbing Company the sum of $300 on recom- mendation of the Village Engineer, for time and labor expended 3.n the installation of service stub at 1818 West Larpenteux Avenue, due to improper designation of the stub on the surer plan. Seconded by Bla.ok and motion carr3.ed. Labor Union Contract: Stone moved that Mayor Warkentien and Clerk Taylor be authorized to sign the labor union contract for the year 1970, per the attached Exhibit "B". The parties to this Agreement are the Village of Falcon Heights (hereinafter "Falcon Heights"), its full time employees (hereinafter "employees") and Teamsters Local No, 149 (hereafter "Teamsters"). B. This Agreement shall be effective bettnieen January 1, 1970 and December 31, 1970. C. The terms and conditions of the Agreement are a,s follows: 1. Hours of Employment: The hours ofemployment and shifts are to be those as established by direction of the Village Council after notice given to the employees affected by any change. The presently established hours of employment and shifts are: 2939 a. Admiriistratiye~ 'Dep'artment - Wa,thin each two week period commencing January 1, 1869, an average of a 40-hour week with the hours of em- ployment to be Council. b . Maintenance D'e' week beginning ending at 4:30 Friday with the -fixed by the Village p'artment - A 40-.hour at $:00.a.m. and p.m. Monday through Crty (30) minutes for lunch. 3. Overtime: a. Administrative Department - Over- time will be paid at the rate of $4.43 an hour when said overtime is requested and authorized by the Village Council or its duly authorized representatives. Over- time will be computed on a bi-weekly basis as constituting all hours of employment during the preceding two week period. b. Maintenance Department - Maintenance employees will be paid time and one- half for emergency work when requested -2- 29l~0 and authorized by the Council or its duly authorized representative. In the event of special programs other than ordinary work, compensatory time off will be afforded at the regular rate . 4.~ Hohidays: The following will be holidays re- cognized by the Village of Falcon Heights: New Year's Day Labor Day Washington's Birthday Veteran's Day Memorial Day Thanksgiving Day Fourth of July Christmas Day It In the event an employee is required to work on a holi- day, he. will be compensated at twice the regular hourly rate. Only the employees working on the holiday or some portion thereof will be afforded holiday pay. 5. Vacations: The Village employees will be auth- orized vacations with permission of the Council or its duly authorized representatives during the calendar year in which they have completed the following term of service for the Village of Falcon Heights: a. 12 months' employment 2 weeks vacation b. 10 years' employment 3 weeks vacation c. 20 years' employment 4 weeks vacation t Vacations, or portions of vacations, must be taken within one year after the vacation has accrued unless other arrange- -3- 291 ments have been made with the Village Council for extensions. Vacations may be used in addition to sick leave.. 6. Sick Leave: The sick leave policy of the Village of Falcon Heights is applicable to all employees as follows: a. Each employee will be entitled to 28 days of sick leave if he had been employed by the Council for a period of two years or more as of January 1, 1967. Probationary employees will commence employment with 7 days of accumulative sick leave at the rate It of one day per month. after the third month (or beginning with the fourth. month) until 28 days are accumulated. At the end of the second year of employment, the following sick leave schedule will be applicable. b. Sick leave shall accumulate after the second year of employment at the rate of one-half day per month, or six days a year, thereafter. c. The maximum sick leave to be accumu- lated by any employee will be eighty (80) days. s -4- 292 It It ~ a d. In the event ,of an injury or illness related to a compensable injury suf- fered during employment with the Village of Falcon Heights, the sick. leave policy of the Village of Falcon Heights shall not be applicable. e. Accumulated sick leave shall be avail- able in the event of illness or death in the family other than that of the employee himself or herself. This sick leave shall be limited,to one week with pay. Nothing in this pro- vision shall be construed to limit the right of the Village of Falcon Heights to grant a leave of absence without pay for a period of more than one week. f. In the event of a compensable injury incurred during employment with the Village of Falcon Heights, sick leave may be used to supplement the Workmen's Compensation benefits provided by the laws of the State of Minnesota. It is r7 l7 the intention of this provision to com- -5- 2943 i• L pensate the .employee by use of accumu- lated sick leave during the first week of disability from such a compensable injury. It is further the intent of this provision to reduce the expense of sick leave to the Village of Falcon Heights for a compensable injury by the amount of the Workmen's Compensa- tion benefits and to require the em- ployee to assign to the Village of Falcon Heights his Workmen's Compen- sation benefits. In lieu of said benefits, the employee shall receive his sick leave benefits. When the sick leave benefits have been ex- hausted, the Village shall have no further claim against the Workmen's Compensation benefits. g. In the event of termination of the employee's employment with the Vil- lage of Falcon Heights, any accumu- lated sick leave shall not be con- sidered to have any value to the employee. -6- r ,. i, b 294. 7. Medical and Hospital Insurance: As of January 1, 1869, the Village of Falcon Heights will pay the full premium on medical and hospital insurance for its employees and all their dependants who are under the age of twenty-one (21) years and living at home. The coverage for both the employees and depen- dants will be the same as the coverage now afforded the employees under existing Village policies. 8. Term Life hnsurarice: As of January 1, 1869, the Village of Falcon Heights will pay th.e full prem- ium on $2,500 worth of term life insurance for each It of its employees. 9.
