HomeMy WebLinkAboutCCMin_70May2828 MEETING OF MAY 28, 1970 The regular meeting of May 28, 1970 was called to order at 7:00 P.M. with the following members present: Clerk Taylor, Councilmen Black, Ecklund and Stone. Also present was Treasurer Olseal,. Engineer Lemberg arrived at 7:20, Attorney Seed at 7:~0 and Maylir Warkentien at 8:15 P.M. Minutes: Black moved that the minutes of the meeting o~ May 11~, 1970 be approved as corrected. Ecklund seconded and the motion carried. F3.re Department Ecklund moved that authorization be given to the Fire Purchase Department to purchase items on purchase requisition No. Requisition: 1-1970. Black seconded and the motion carried. Variance Request - Black moved that the variance and conditional use appli- 1870 North Albert: cations submitted by R. W. Brast, 1870 North Albert Street, for an accessory building to be constructed on the south east corner of his property, be approved in accordance with the diagram as drawn with the condition that the ex- treme height be 6 feet 8 inches and subject to the further condition that written approval be obta3.ned from the three ad3oining property owners. Stone seconded and the motion carried. Variance Request - Black moved that the application for a variance submitted Lido Corporation, by J. A. Labale, Vies President of the Lido Corporation, loll West Larpenteur: 1611 West Larpenteur Avenue, be approved to permit the pre- sent sign on the property to be moved to a location on the parking lat so that no part of the sign wi.11 extend further to the south than 25 feet north of the curb line. It is also moved that the portion of the applkcation requesting the flashing sign be denied. Taylor seconded and the motion carried. Variance and Black moved that the following resolution be adopted: Conditional Use Permit Denied - WHERF,AS, Arthur 3. Jorgenson, Arden Hills Investment 1830 West Larpenteur, Company, has made an application for a variance and condi- Resolution 70-10: tional use permit to construct an 18 unit apartment build- ing on pzvperty located at 1830 West B,arpenteur Avenue, which property is zoned B-lA, with a side yard set-back of 4 f eet instead of 10 f eet, a square foot density of 25, 818 square feet instead of 27,000 square feet (1,500 per dwe11.- ing unit), and parking lots wane of which are less than 9 feet wide and 20 feet long, all of which standards are re- quired by the Village of Falcon Heights zoning ordinance No. 6l~, as amended, and WHEREAS, the Village Council of the Pillage of Falcon Heights referred said request for a variance and conditional use permit to the Village Engineer and the Planning Commis- sion of the Village of Falcon Heights, and said Planning Commission recoamnended denial of said variance and condi- tional use permit by reports dated May 20, 1970 and May 27, 2983 1970 respectfully, copies of which reports are on file in the office of the Village Clerk and made a part here- of by reference, and WIDrREAS, the Village Council of the Village of Falcon Heights has reviewed the request for said variance and con- ditional use permit, and has reviewed the reports of the Village Engineer and the Planning Commission, NOW THEREFORE, BE IT RESOLVED by the Falcon Heights Village Council that 1. There are no practical difficulties or particular hardships i.u carrying out the strict letter of the regula- tions of this ordi~anc®. 2. The proposed variance is not in keeping with the character and development of the immediate neighborhood. 3. The granting of the request for a variance is not . necessary for the preservation and enjoyment of a substan- tial property right of the applicant. !~. The granting of the proposed variance will. impair an adequate supply of light and air to ad3aceat property, unreasonably increase the congestion in the public streets, increase the danger of fire, endanger the public safety, unreasonably diminish and impair established property val- ues in the susrnunding area, and otherwise impair health, safety, comforts, morals or i.n an+y other respect to be con- trax~r to the intent of ordinance No. 6l~, as amended, and the comprehensive plan of the Village. 5. The plans pertaining to said request are deficient because they fail to show drainage, elevation, landscaping and storage space in connection with the proported building. 6. The request for the variance and conditional use permit is denied. Ecklund seconded, and upon a vote, the resolution was declared unanimously passed. Variance Request - Black moved that the application for variance submitted by 18I~6 Arona Avenue: Richard A. 5hibrowski, 1816 Arona Avenue, to construct a double garage at the rear of the present sigle garage, be referred to the Planning Commission for recommendation. Stone seconded and the motion carried. Variance Request - Black moved that the application for variance submitted by 1735 Asbury Avenue: Floyd Schmid, 1735 Asbury Avenue, to build a redwood deck in the rear yard, be referred to the Planning Commission subject to his submitting further information of the plans. Ecklund seconded and the motion carried. New Members of A recreation program meeting will be held on Monday, June 1, Recreation Staff: 1970, at the Village Hall. Conditional Use Black moved that the conditional use application submitted Application -Falcon by Richard Alberg, Manager of Falcon Oil Comp, 1350 West Oil Compas~r - 1350 Larpenteur Avenue, together with all material, Midwest West Larpenteur Avenue: Planning Letter, Village Engineer Letter and Blue Prints be referred to the Falcon Heights Planning Commission for recommendation. Warkentien seconded and the motbn carried. Contract - Bonestroo, Stone moved that the contract submitted to the Council May R:osene, Anderlik & 28, 1970, by Bonestroo, Rosene, Anderlik & Associates, 1381 Associates, Eustis Street, be presented to the Mayor and Village Clerk Consulting Engineers: and that they be authorized to sign it. Ecklund seconded and the motion carried. 0olunteer Fireman Eckl.und read a letter of dismissal of Richard A. Dowdell, Dismissal: 2690 North Oxford Street, from the Falcon Heights Volunteer Fire Department, and a report of the subsequent hearing which upheld the decision to dismiss.
