Also present was Engineer Lemberg. Attorney Seed arrived at 7:30 P.M.' I•iinutes: Ecklund moved that the minutes of the September 2~., 1970 meeting be approved as corrected. Black seconded and the. motion carried. Betty Ellis Delinquent Sewer Rental Accounts Certified to County Auditor - Resolution No. 70-19: 1 1 3016 Taylor moved, seconded by tidarkentien and unanimously passed that the following resolution be adopted: RESOLUTION LEVYING SPECIAL ASSESSMENTS FOR DELING~UENT SANITARY SEWER RENTAL CHARGES BE IT RESOLVED by the Village Council of the Village of Falcon Heights, Ramsey County, Minnesota, as follows: 1. It is hereby determined that there are delinquent sewer rental charges against the properties hereinafter set forth, in the amounts set forth opposite the descript~t~n of such properties. 2. A special assessment in the amount hereinafter set forth is hereby levied against each of such tracts respectively. 3. The total amount of such special assessment, in each case, shall be payable with the 1970 real estate taxes due and payable during 1971. ~.. The Clerk shall forthwith transmit a certified copy of the assessment to the County Auditor to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5. Black Roseville: seconded and the motion carried. tentative Date The Council set a tentative date for the Northwest Storm of the Torthwest Sewer Assessment Hearing for Decanber 10, 1970. Storm Sewer Hearing Tree Planting Black moved that the application submitted by Donald T~iead, Variance Denied: 1863 Sheldon Street, for planting of trees on the boulevard area of his lot be denied and that the Clerk be authorized to write him pointing out the provisions in Ordinance No. 86. ti~~arkentien seconded and the motion carried. St. Anthor~r Storra irdarkentien moved that the matter of the St. Anthony Storm Sewer: Seti~rer be ref erred to the Village Engineer. Stone seconded and the motion carried. Public. Hearing: Pursuant to due call and notice thereof, the hearing was called to order at 8:00 P.I~I. to hear all persons present as regards the assessment against abutting ~rroperties for the Iiamline Avenue T~~rater Tlain Improvement of 1969. Resolution 70-20 WIi}:~:l~EAS, pursuant to notice given as required by law the Village Council has met, heard and passed upon all object- ions to the proposed assessments for the Hamline Avenue Water Main Improvement of 1969• P10LJ THE.?EFOP~E, BE IT RESOLVED by the Village Council of the Village of Falcon Heights as follovrs; 1. Such proposed assessment roll, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein is hereby found to be benefitted by the proposed improvements. 2. Such assessments shall be payable in equal annual in- stallments to be payable over a ten year period for the yaa.rs 1970 to 1979, both inclusive. To the first installment there 3019 shall be added interest at the rate of 8;~ per annum on the entire assessment from the date of this resolution until December 31, 1971. To each subsequent iBStallment, when due, there shall be added interest for one year at said rate on all unpaid installments. The owner of any property so assessed may, at any time prior to November 8, 1970, pay the whole of the assessment on such prope~y without interest to the Municipal Treasurer; and such property owner may at any time after certification of the assessments to the County Auditor and prior to Novemberl5, of arm year, prepay to the Treasurer of the IYlunicipality the whole assessment remaining due with interest accrued to December 31, of the year in which said prepavnnent is made. 3• The Village Clerk shall forthwith transmit a certified duplicate copy of the assessment roll and resolu- tion herein to the County Auditor so that the assessment may be extended on the tax list of the County. Dale Freemen, of Census Bureau District Alanager of the Census Bureau were present at the Present: invitation of the Village Council to discuss the lowered population of Falcon Heights since last census taken. The Census Bureau stated they fully checked all residents cif all areas in Falcon Heights. Refuse Collection - Ecklund moved the adoption of Ordinance No. 109, AN ORDIN- Ordinance No. 109: ANCE REGULATING THE COLLECTIOTd ATdD DISPOSAL OF I~[TSE AND PROVIDING FOR LICENSING OF REFUSE COLLECTORS. Taylor seconded and the motion carried. Letter Covering Taylor moved that the Village Engineer be authorized and Ordinance Tdos. instructed to draft a letter covering Ordinance Nos. 108 108 and 109: and 109 to be sent to residents of Falcon Heights. The Village Council hereby determines that there is on hand in the Watermain and Sanitary Sewer Improvements of 1963 Fund, an excess amount greater than X3,000. and that the y~3,000. tax levy for the year 1970, made in Section 6 of the resolution of the Council providing for the issuance and sale of ti~datermain and Sanitary Sewer Improvement Bonds of 1963, adopted on September 11, 1963, and thereafter certi- fied to the Ramsey County Auditor and entered in the Bond Register of the Ramsey County Auditor on September 23, 1963, shall be reduced by yi3,000. and no amount thereof shall be included in the County Auditor in the tax rolls prepared for the year 1971. 2. The Village Clerk is hereby directed to file a certi- fied copy of this resolution t~,rith the County Auditor of Ramsey County, rinnesota together with such other information as he shall require. B. Section 6 of the resolution authorizing the issuance of said bonds, adopted by the Village Council on August 1l, 1960, provides for the levy upon all of the taxable property a direct general ad valorem tax in the amount of '.;1500. during the years 1960 to 1962, both inclusive, X2,000. during the years 1963 to 1976, both inclusive, $25,000. during the dears 1971 to 1973, both inclusive and X3,000. during the years 1974 to 1978, both inclusive, to provide monies for the payment of principal and interest on said bonds. C. The need for such tax levy no longer exists because of the redemption of said bonds. 3021 NOby THEREFOT?I:, Br; IT RESOLVE, by the Village Council of Falclon Heights that the County Auditor be advised of the fact that all outstanding Tr~atermain Improvement Bonds of 1960-1 have been paid pursuant to the resolution authorizing the redemption of said bonds and that all fund tax levies with regard to said bonds be revoked.
