SPECIAL MEETING L2AY 1, 1963
. The meeting was called to order at 7:30 P,tb1. with the fol7.oaring members
being present: Harold C. Nilsen, Mayor; George J. Shavor, Trustee; and
Willis Warkentien, Trustee. Also present were~Brad Lemberg, Village
Engineer; and Ray Schommer.
Mr. Ray Schommeris Idr. Ray Schommer of 1l~97 West Idaho appeared
Swimming Pool Display; before the Planning Commission April 17 to
present his plans for establishing a Swimming
Pool Display. The Planning Commission rec-
ommended that his petition for a conditional
use premit be granted.
It was moved by Shavor, seconded by Warkentien
that the following Resolution be adopted.
Carried.
RESOLUTION OF THE VILLAGE COUNCIL OF
THE VILLAGE OF FALCON HEIGHTS
WHEREAS, Ray Schommer, of the V311age
of Falcon Heights, Minnesota, has made an
application to the Zoning Administrator of
the Village of Falcon Heights for a variance
permit under the provisions of Ordinance No.
6l~, Section 16.l~, and,
4YHEREAS, the property subject to said
request for variance permit is described as
Lot ]~ and ~ of Block 10 , Keller~s
Additio to tie Village o~ Falcon Heights
and at the present time is zoned B-2, and
WHERF~S, the application for said
variance permit has been referred by the
Village Council to the Planning Commission
of the Village of Falcon Heights which has
reviewed said application in its entirety
and,
WHEREAS, teh Falcon Heights Planning
Commission has recommended to the Village
Council of the Village of Falcon Heights in
items letter dated April 29, 1963 that said
variance permit be issued, conditioned as
hereinafter set forth:

Village Council of the Village of Falcon

1. Said variance permit be and is hereby
granted, conditioned as follows:

cation on the part of applicant, Ray Schommer,
a pool permit and license under the provisions
of Ordinance No. 65 which amends ordinance No.
t.~. of the Village of Falcon Heights. Because
of the navel and unique swimming pool operation
contemplated by applicant, said pool permit and
license is expressly declared to be an annual
permit, to be issued on an annual basis by the
Falcon Heights Village Council. It is further
conditioned that said pool will be constructed
of such material as to be placed on the surface
of the ground, being removable and severable
from said real estate. It is the understanding
of the applicant and the Village Council that
the pool license and permit contemplates an
annual seasonal operation of a swimming pool
for the limited purpose of demonstrating swircr-
ming pools and other articles or materials
directly reaped to the operation or maintenance
of swimming pools,
3. Prior to the issuance of said var-
iance and swimming pool license permit, said
applicant shall enter into an agreement with
the otivner of the real estate described above
to have the parking space on said real estate
surfaced to comply with the provisions of
Ordinance No, 6l~, Section 1.li.2, Subdivision
3.t~ which provides,
"All of the area intended to be
utilized for parking space and
driveways shall be surfaced with
a material to control dust and
drainage subject to the approval
of the Village Council, except
parking areas for less than
three vehicles.t~
!~. The following health and safety
measures shall also be required to be obser-
ved by said applicant:
A. Retractable steps and a door
on the swimming pool that can be locked when
the same is not in use.
B. Said pool should not be used
for public swimming purposes.

5. A21 signs, and all operation of
said pool areas shall conform with the exist-
ing Ordinances of the gil2age of Falcon
Heights and haws of the State of Minnesota.

It was moved by Nilsen, seconded by Shavor
that the Building Inspector be authorized
to issue a building permit to ~1r. Ray
Schorrmiers. Carried.
