Nilsen, Idayor; George Shavor, Trustee;. Wi11is Warkentien, Trustee; Charles Stone, Trustee; W. A. A~ortenson, Clerk. Also present were: Brad Lemberg, Village Engineer and 1~~iichael Galvin, Village Attorney. The minutes of the previous meeting were read and approved as read. Roberts Apartment I~r. Roberts was present with his attorney, John Daubney. Permit Requests Interested residents included ~~r. and hrs. Hustrulid, R?r. Bianchi, and lt~r. and dirs. Anderson, all of Fairview Avenue. ~.ir. Daubney presented copies of the revised plan for the Roberts apartment project, with an ou~tl.ine of the project to consist of lb single bedroom apartments. Lemberg reported that he had checked the plan and that it complied with the regulations for parking and set backs and illustrated the improved effect of angle P~'• The Clerk read a letter from the Village Attorney reviearing the application for the building permit, citing applicable ordinances regarding parking space, side yards, bumper curbs and fencing, and screening and fencing around off-street parking area. Re- strictive covenants in deeds on lot lines and. set backs on other Fairview Avenue lots did not apply to this property. To enforce a 50 ft. set back along the Fairview Avenue side of the Roberts Construction Company lot would present a grave constitutional question. ~~fir. Hustrulid thought statements made in the minutes of the December 21st, 1961 hearing should be entered here in reference to the 50 ft. set back. Shavor referred to the 100 ft. distance from the back of the apartment to the end of the lot gave good protection to the other properties, and that the plan seemed to be a good one. Hustrulid felt the automobile traffic would create a problem. Nilsen recited the extent of the study made to be fair with the property owners. Daubney referred to the filling station application that was withdrawn due to objection of Fairvi~+r res- idents and changed their application to an apartment for which the land was properly zoned now and when the land was first purchased. 19-5 Galvin stated we would have no reasonable right to deny the application for a permit. Warkentien moved, seconded by 5havor that the following resolution be adopted: RESOLUTION AUTHORIZING THE ISSUANCE OF A BUILDING PERMIT FOR THE ROBERTS CONSTRUCTION COMPANY WHEREAS, the Roberts Construction Company of 5t. Paul, Minnesota, has made application for a building permit fora 16-unit single family apartment building for that tract of real estate owned by Roberts Con- struction Company, located on the northwest corner of Fairview and Larpenteur Avenue iri the Village of Falcon Heights, the legal description of which is the East 158.62 feet of the South 265.125 feet of the Southwest quarter of Section 16, Toamship 29, Range 23, and, ~~-iERF~AS, said real estate is zoned R-3 under the provisions of Falcon Heights Ordinance No. 6~., and, WHI ,said application has been reviewed by the Village Council of the Village of Falcon Heights, and, ~7iERF~AS, said applicant has filed a plot plan pursuant to the ordinances of the Village of Falcon Heights, a copy of said plan being filed with the Village Clerk NOrY, THEREFORE, BE IT RESOLVED: 1. Said building permit is hereby approved by the Village Council of Falcon Heights, and said permit shall be issued by the Village Clerk upon receipt of the Completed Permit Form, and $~e fee as established by ordinance, conditioned as follows; 2. Plans and specifications of said apartment building shall conform to all ordinances, regulations and statutes in full force and effect in the Village of Falcon Heights Minnesota, including -those relating to screening, planting and fencing surrounding said lot and off street parking lot. 3. Said plans and specifications for the construct- ion of said apartment building shall conform to the plot plan which is on file in the office of the Clerk, a copy of which is attached hereto as Exhibit A and made a part hereof by reference. Flasher Signal Moved by Stone, seconded by Y`tarkentien that the Beacons: final payment for the Crosswalk Flasher Beacons on Larpenteur Avenue for X738.00 be paid. Passed. ~;~aple Knoll Traffic A letter was read from Attorney ~~3i11iam Korstad, a Control: resident of ~tiaple Knoll Area, representing a number of the residents with a request for tighter traffic controls and slower driving for Maple Knoll Drive, St. ~~~arys, and Fry Streets, particulary during heavy traffic periods from 7 to 9 A.M. and ~ to b P.M. A copy of the letter is to be sent to the Village Engineer along with a copy of the letter from the Commissioner of Highways, State of I~iinn- esota, regarding traffic studies. The engineer is to determine the costs of such a survey from the Highway Department. Sanitary Sewer A letter of information was prepared by the Engineer Extension: for citizens west of Snelling Avenue and North of Garden Avenue to determine their interest in a sanitary sewer installation and the feasability of such a project. Fire Department A letter from the Secretary of the Village Fire Election of Department, Henry Dachtera, was read submitting Officers, ~~4ay 7, the names of the follrnrring sleeted officers for 1963: council approval for a term of one year: Fire Chief: Albert J. Schoen It was moved by Stone and seconded by Nilsen that the elected officers be approved. Passed. Firemen Completing Chester Saunders, Edward Eicher, and Lloyd W. Probationary Siewert having completed their six months pro- Period: bationary period are accepted by the .department. Stone moved, Nilsen seconded they be approved. Passed. 1917 The application for a new Volunteer Fireman, Dayton LaRoy 1'dilkens, 96b Charles Street was received. No action at this time. Adjournment: On motion, council adjourned at 20:l~5 P.~a.
