HomeMy WebLinkAboutCCMin_63Jun2619lt3 REGULAR MEETING OF JUNE 26, 1963 The meeting was called to order at 7:00 P.M. with the following members being present: Harold Nilsen, Mayor; George Shavor, Trustee; Charles P. Stone, Trustee; Willis Warkentien, Trustee. Also present were Brad Lemberg, Engineer; Attorney Bernard Friel; William E. Olsen, Treasurer; and Tina Vavoulis, Deputy Clerk. Clerk W. A. Mortenson was absent. Representing the League of Women Voters of Falcon Heights was Mrs. Jenkins, Nilsen moved, seconded by Stone that the minutes of the special meeting of June 19, 1963 be accepted as read. All ayes. Fire Department Requi- Nilsen moved, Shavor seconded to approve Purchase sition for Supplies: Requisition submitted by Fire Department for janitor supplies for rest rooms i.n fire station & village hall. County Commissioner asks Letter from Sheriff's Department stated they do not have for assistancefrom Police sufficient manpower to answer calls about Ramsey County Department: beaches and parks on complaints of late swimmers, vandal- ism, etc., and asked the Village for cooperation in policing these recreational areas. Sheriff's Letter about Sheriff advised that the department will allow no Gambling: gambling in Ramsey County. People have assumed that being sponsored by a club, lodge, religious or fraternal organization allows them the privilege of gambling, but such is not the case. Licenses approved: Gasoline filling station license from Hermes at the State Fair Car Wash. Stone moved, seconded by Shavor to approve. Carried. Off-sale ~c On-sale Beer Licenses for Flaherty Bowling Lanes. Warkenti.en moved, Nilsen seconded to approv®. Carried. Off sale and On-Sale Beer Licenses for Lido Cafe, Inc. Warkentien moved, Shavor seconded to approve. Carried. Schommer's Swimming Council was advised that children have been swimming in Pools the display pool. The Deputy Glerk was instructed to inquire as to whether or not the purifier was in operation at all times. Traffic Problem on Stone moved, Shavor seconded that pending adoption of St. I~Iary's and Maple the necessary corrective ordinance, the Council authorize Knolls the Village Engineer to take whatever steps are necessary to see that 'No through traffic' signs are installed on Fry, Garden, St. Mary's for the purpose of prohibiting through traffic in this area. Carried. Citizens' Recreational Warkentien moved, Shavor seconded that the appointment Advisory Committee: of the following citizens to this Committee be approved. Carried unanimously. Schmidt Mrs. Billy Foreman Mr. Howard Morse 191~lt The Deputy Clerk was instructed to make a list of thew names and addresses and mail to each one, with a copy to the League of Women Voters, and advise each one that when report is completed, they will receive a copy of same and a meeting will be called. Widening of Roselaem Letter from County Engineer advising that the plans are to Avenues reconstruct this road in about eight years to a 4!t foot width which would be two 12 foot lanes and two 10 foot parking lanes. It is necessary that all storm sewer work be accomplished prior to reconstruction of Roselawn Avenue. Hearing on Proposed Improvement of the West side of North Snelling Ave. by Installation of a Sanitary Sewer System: At 8:00 P.M. the regular meeting was recessed and Mayor Nilsen opened the Hearing. In the absence of the Clerk, the Mayor read the Notice of Hearing, and announced it was published in the Suburban Life Newspaper on June 12 and June 19 and that mailed notice had been given as required by law. Informal hearing had been held on June 3, 19b3. The opening statement as to the need for the installation of sanitary severer system was made by the Mayor. Engineer Lemberg explained the details as to method and cost. Art Granna Has this improvement been approved by the engineers who 1592 W. Roselawn: make up the Highway plan on Roselavm, or if this goes through, will it have to be moved at a later date? Lemberg: We have not been advised of the plans of the Highway Department, however, this shouldn~t have to be re-located, I can see no reason that it would have to be moved. Nilsen: Is it not true that if this pro3ect is approved, it will have to get the permission of the Highway Department and they will have to approve, and if there are any plans, they will bring them to the attention of the engineer? Lemberg: Yes. Granna: Would it not be more economical to put both water and Sewer at the same time? Lemberg: That is why we are considering both of them at the same time. The water and sewer cannot be put in the same part; the trenches have to be ten feet apart. They would have to dig two trenches, Resurfacing is included in the cost, resurfacing driveways, etc. are included. Strandquist: You said they have to be ten feet apart -what would you do? Come into the property? Lemberg: One would be on the shoulder and one close to the property line. Property line nvw has a twenty foot ditch in there. They will stay as close to the street as they can. 1915 Mrs, Granna: From observing the other neighborhoods, I would say this will make a real mess. Lemberg: I understand in some other areas they are not including in their cost the resurfacing and fixing of the streets and driveways, etc.; this is included in our plans. Chester Saunders On the first plan it was estimated at X6.80 front foot, 18$5 No, Snelling: now it is X10,00 afoot. I think it comes to some X67 or X77 I would be picking up of what Thatcher properties did not pay. I think we should defer payments on that property. Nilsens The assessment would be levied on front foot basis only. That is some 991.70 feet-from property line of Thatcher to North property line of Granna. It would take in all of Thatcher properties. Thatcher's will be his awn obligation. Wm. Korstad In the event the land in back of Thatcher's is developed, 1625 Garden Avenue: would they pay its own cost and would there be a connecting charge to the mains along Snelling? Nilsen: The cost of the mains would have to be borne by the abutting property ov:ners. It would be handled like a new development. Are there any other questions relative to sanitary sewer? You people have a right to come back, but there is no need to come back on July 3 for the formal hearing on this. You are assured that the maximum of ~].0 a front foot will still hold on July 3rd. The formal hearing and resolution cannot be made this evening because of failure of newspapers to publish at the proper time - and legally no resolution can be made at this time. Hearing on Improvement Mayor Nilsen opened this Hearing and read the notice of of West Side of Snelling Hearing and announced it was published in the Suburban Life Avenue by installation on June 12 and June 19 and that mailed notice had been of Water Mains given as required by law, Opening statement as to the need for the extension of water main was made by Mayor Nilsen. Engineer Lemberg explained the method and the cost of such project. He is of the opinion that the cost of this project is extremely high, and advised that there is a possibility of connecting to Roseville, Saunders: It could be possible then to come in the back lots from Roselawn Avenue? Lemberg: I do not have the cost right now and I don't think Roseville has the cost right now either. Nilsen: I think we should take steps so that if and when the situation is demanding, i.t should be brought up again at another Hearing, 19l~b Shavor: Would that be a Village project? Nilsen: That would have to be -who else could assess it? Roseville would have to bill the people. Strandquist: Some ti.ffie ago, I contacted the Dater Department to see if I could hook onto ~Irs. Pantzar's, and if the council would have given permission, I could have done it. Lemberg: It is only a three inch main, and the Department would allow it, but the pressure wouldn't be satisfactory for three of you. Nilsen: It does not seem practical in everybody's interest to accept the plans as given by Engineer Lemberg. I think we should authorize the Engineer to contact Roseville for that isolated area. Warkentien: How about the Thatcher property if it is developed? In extending a 6" main from Roseville to that property, the easement would have to be against Thatcher's property. Lemberg: If so, it would probably be cheaper to get an easement to come off this point along Garden Avenue. Nilsens Does ar~pone else have questions regarding this section of the Hearing on water mains? It is, therefore, the recommendation of Engineer Lemberg that the Water ~+Iain Extension as outlined here be disregarded and an attempt to contact Roseville and obtain their feelings to ®xtending to our portion of Falcon Heights, be made. Strandquist: Pertaining to sewer -how long do we have to pay it? Attorney Friel: You would have the right to prepay without interest, generally thirty days following the date of assessment hearing. After that, you can pay up the balance of the assessment with interest running through the end of the year at 6~. Strandquist: From the time of completion to hook up onto our homes -how long would we have? Nilsens At the present time our ordinance requires hook up by a certain date. Friel: Whether or not you connect, you pay the assessment. Lemberg: We have communities that are giving one year's time. Nilsen: How would. you feel about two years? General Opinion: This seems to be all right. Strandquists Is there a law that we would have to fill or depress our cesspools? Lemberg: They stave to be filled with sand at the time you hook up to the sewer, Nilsen: Are there arty other questions? 19t~7 Hearing on Proposed Improvement of Rose- lawn Ave. by con- struction of Water ~~ and Lot Services: C. RESOLUTION Resolution rejecting improvement of the west side of Snelling Avenue in the Village of Falcon ~Ieights, by installation of Water Mains. ~~HEREAS, a resolution of the Village Council adopted the 3rd day of June, 1963 fixed a date for a Council Hearing on the proposed improvement of the west side of Snelling Avenue from the south line of Roselawn Avenue to a point 220 feet south of the extension of the center line of Ruggles Street to the west line of Snelling Avenue, by the installation of 6~~ water mains and lot services, and WHEREAS, ten days published notice of the hearing through two weekly publications of the required notice was given and the hearing was held on the 2bth day of June, 19b3, at which all persons desiring to be heard were given an opportunity to be heard thereon, NO'~~, THEREFORE, BE IT RESOLVED by the Village Council of Falcon Heights: 1. Such improvement is hereby rejected as proposed by the Council resolution adopted June 3, 1963, due to the excessive costs of constructing the same. 2. Bonestroo, Rosene and Associates are hereby requested to investigate the possibility of securing water service for the property from the Village of Roseville. Final action had to be deferred until this date. Would there be any objection if I could get connection from Roseville? To serve this area, we have to bring a main down Roselawn Avenue. 1 u J 19.8 Haglunds There is already a main across the street. Lemberg: Yes, but to serve this proposed area we have to bring it around in here and this includes Ros ela:an Avenue. If we do not loop it here, we would have dead end lines here and here. We have to loop it so we can get water from either direction. Haglund: What i.s the cost per front foot? Nilsens About ~7 in the absence of a bid. ? 1938 W. Roselawn: Is this about the same figure for all of Falcon Woods? Lemberg: Yes. Nilsen: How do you people feel about the project? ? 1938 W. Roselawn I think we could end up in isolation and I think we are foolish not to do it. I am in favor of it and I also want fire plugs. Haglund: If you put it in, are you going to compel me to hook up to it? ~i Nilsen: In the absence of a situation where the health of the public is endangered, the Council could not compel you to hook up. Haglund: When we made sewer connection to the house we , put in 125 feet of copper pipe in the trench. Lemberg: What type of pipe on your sewer service -cast iron? Haglund: Yes, I got 10 footers. Nilsen: Arty other questions on Roselawn Avenue? Warkentien moved, seconded by Shavor that the follo~i.ng Resolution be adopted by the Council. Ayes: Nilsen, ' ~ , ' Shavor, Stone, ~Tarkenti.en. RESOLUTI0I~T Resolution ordering improvement and preparation of plans for the water main extension of 1963 on Roseladm Avenue by the construction of water mains and lot services bet~reen the east line of Autumn and the west line of Fairview Avenues in the Village of Falcon Heights, Minnesota. [~ WHEREAS, a resolution of the Village Council adopted the 22nd day of May 19b3 fixed a date for the Council hearing on the proposed improvement of Roselawn Avenue from the east line of Autumn Avenue to the west line of Fairview Avenue by the installation of 6~i water mains and lot services, and 199 WHEREAS, ten days published notice of the hearing through two weekly publications of the required notice was given and the hearing was held thereon on the 26th day of June, 1963, at which time all persons desiring to be heard were given an opportunity to be heard thereon, NOW, THEREFORE, BE IT RESOLVED by the Village Council of Falcon Heights: 1. Such improvement is hereby ordered as proposed in the Council resolution adopted May 22, 1963. 2. Bonestroo, ftosene and Associates are hereby designated as the Village consulting engineers for this improvement. They shall prepare plans and specifications for the making of such improvement. Nilsen: Bianchi contacted Attorney Galvin regarding a document and I am of the opinion that it is not part of this Hearing, but I cannot answer that now. The attorney gave Bianchi some information over the phone and I do not know what it is. Shavers Were those people notified of the Hearing? What attitude do those others have regarding this? Lindigs They are for it. They are willing to be assessed. Shavers Then there is no obstacle. Nilsens I would have to wait for rdr. Galvin about that. 1950 J. M. McGregor We live north of this proposed line. We were wondering 1795 No. Fairview: if some .study could be made of extending that line to cover our property if possible to benefit our prop®rties. Mr. Lemberg wrote it was terminus and the sewer would be about 6 six feet deep, Would it not be worthwhile to run a sewer in now and extend the line further north? Lemberg: This study has been made - Larch 5, 1962. At that time this had been checked out. Two possibilities of serving the property north of Lindig Avenue - connect to Fairvi6nr Avenue sewer, or the other would be to jog over to the East. McGregor: I think more studies could be made on the utili2ation. We request a further study be made about extending that project to add on to it. There are only three homes. involved. Attorney Friel: This could be petitioned and Hearing could be called, Lemberg: A j,og to the east and then to the north with minimum cover of six feet at the end of the Lindig property. 'that would involve just the cost of the jog and it would go through the back of your lots. Shavor: Could we undertake an addition without endangering this big project? Lemberg: This is a legal problem and if it is legally possible, that has been checked out and the line would go through the back lots and I do not know that they would be willing to give an easement on 50 foot lots. Another thing, without a street, the water and sewer would be no good. 1rYhere are you going to run the road? Lindig: There would have to be a turn around. Lemberg: It is not feasible to fill in that whole area back there arxi it would not be feasible to cut out the ponding area back there, either. Shavor: I think it would be poor planning now to put anything in there now without the property developed. McGregor: Our problem is that the land is higher. We haven't te~:ked to Mrs. Lindig at all. Friel: If, as the engineer says, the additional cost would not exceed 25~, it would be all right to add it on. Nilsens It would appear that you people would like to get the proper easements in order. Friel: An easement is when you give the village the perpetual right to maintain a utility easement over a strip of ground describing the width and depth and also the right to go into that property to repair or replace as necessary, Shavor: Can you put an easement on it without the road? 1951 McGregor: We just want an extension so we can use it. Your proposed extension could go up our south line and go across our road. Nils~s You can see that it is not feasible to construct a road straight north. Lemberg: The suer, as shorn on the map, is where it would have to to go. The road would have to be constructed as far as your prop®rty - that is, as far as the low level is concerned. McGregor: Then it is not feasible to do this because it would cut up our property. We would be taking much more of a serious loss than the people further north. Mrs. McGregor: As long as everyone is in favor of the water, what is going to be done to the property left? What per cent of the people do you need to put a road through? What per cent of the people sani$i of us? Nilsen: The people on Fairview would not want to do anything about this, I do not think as long as I am on the Council that anything will be condemned. McGregor: We just came to see what possibilities there were as far as putting in a road, We are not demanding anything. Nilsen: Brad, suppose you went straight north about a block or so and then jog and fill. Lemberg: You can fill, but then you would be taking away the ponding area. Nilsen: No, there would be nothing there as far as the ponding area. But a lot would be diverted. ~~ould you be vrilling to look at it again, Brad? Lemberg: We have explored it a dozen times. McGregor: We11, we will have to go along with the prople from the north. Nilsen: The sewer vuhen it comes in will be kept at the minimum grade - is that right? Lemberg: Yes. Warkentien moved, Shavor seconded that the following Resolution be adopted by the Council. Carried. Construction of Storage Stone moved, Shavor seconded that the engineer be Garage, etc.s authorized to draw up plans for the purpose of con- struction of a storage gashage, maintenance shop, and fire tower. Carried. i~ Lido application: The council decided that unless the Lido Cafe wishes to press the matter of application for displaying bottled liquor in their cafe, the matter would be dropped, inasmuch as an ordinance would have to be passed restricting such use. Maintenance man -Brush Stone moved, seconded by Nilsen that Mr. Quarn be authorized and tree removals to have the trees and brush hauled away -the expense not to exceed $60.00. Carried. Hermes -Fence: N. L. Hermes submitted a sketch of a fenca by Chelgren. The Council tabled any action until further investigation. Swim het donated to The deputy clerk was instructed to acknowledge with Playground: appreciation the donation made by Bernie Rechtiene of 1lt8l~ West Iowa. The wring set has been placed on the playground at Idaho and Snelling Avenues. 1953 Plumbing Inspectors Mr. Vffest was instructed to charge the same amount on all inspections -such as inspecting to see if pump had been disconnected -sewer corrections, etc. Salute Auto Parts Moved by Shavor and seconded by Nilsen that the building Signs inspector should be authorized to issue building permit for the Salute Sign. Deputy Clerk was instructed to return the X5.00 inasmuch as Conditional Use Permit was not required in this instance.
