Nilsen, Mayor; George Shavor, Trustee; Charles P. Stone, Trustee; Willis Warkentien, Trustee. Also present were Attorney Michael Galvin, Engineer Brad Lemberg, Treasurer William E. 0]s en, and Deputy Clerk Tina Vavoulis. Absent was Village Clerk, W. A, Mortensen. Stone moved, Nilsen seconded that the minutes of the meeting of August 28 be accepted. Carried. Financing of 1963 Water Main Fiscal Agent, Robert Sander, was present and and Sewer Improvements: advised that the issue discussed at the last meeting was going along well. Refinancing of the 1957 ~. Sander was of the opinion that it would. be Sanitary Sower Improvement iri the best interest of the Village to delay Bonds: refinancing on this debt inasmuch as it comes on the heels of the above sale of bonds. He stated the Village would not be hurt in the mechanics of the transaction by delaying but may be benefited., Special Meeting Galled: Nilsen moved, seconded by Shavor that a special meeting be called for September 18 for the purpose of discussing plans for the budget of 196l~. MrA Sander will be present if the Council so notifies him. Roberts Apartments: Mayor Nilsen has been in contact with Mr. Roberts and was advised that the construction shall proceed according to plans and specifications originally accepted by the Village Council. He will not put clothesline poles on the buffer zone adjacent to rear property line. Mayor Nilsen and Attorney Galvin will draft a letter to Roberts regarding this matter and also the proposed plantings ~erhich wi7.1 varg slightly from the original specifications. Falcon Heights Cities Service ~. Robert Leonard was present regarding variance Station - Variance Request: application which was made because he wants to wholesale and retail used cars at the service station. Furthermore, he wants permission to display a passenger vehicle on a non-stationary ramp. Nilsen moved, seconded. by Warkentien that the variance be referred to the Planning Commission, and the Council will await action by them. Motion carried. Junk cars: Mr. Leonard advised that there are tso junk cars on the Applebaum's parking lot which have not been moved for months. Warkentien will take the action necessary for removal. 1982 EXTRACT OF MINUTES OF MEETING OF THE VILLAGE COUNCIL OF THE VILLAGE OF FALCON HEIGHTS, MINNESOTA HELD ON SEPTEMBER II , 1963 Pursuant to due call and notice thereof, a REGULAR meeting of the Village Council of the Village of Falcon Heights, Ramsey County, Minnesota, was duly held at the Council Chambers in said Village. on SEPTEMBER it 1963, at~_o'clock F .M. M o R T E N s o N Member ~~II~LIS ~~IARKENTIEN introduced the following resolu- tion and moved its adoption: RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE OF WATERMAIN AND SANITARY SEWER IMPROVEMENT BONDS OF 1963 BE IT RESOLVED by the Village Council of the Village of Fal- con Heights, Minnesota, as follows: WHEREAS, the Village Council of said Village has heretofore determined to construct sanitary sewer, watermain and street im- provements, and WHEREAS, the Village Council has entered into contracts for the construction of said improvements, NOW THEREFORE, BE IT RESOLVED by the Village Council of the Village of Falcon Heights, Minnesota: 1. The Village shall forthwith issue its negotiable coupon eneral obligation bonds in the aggregate principal amount of 180,000, to be 180 in number, and numbered consecutively from 1 to 180, both inclusive, in the denomination of $1,000 each, dated October 1, 1963, and to bear interest from the date thereof until the principal is paid at the rate of three and ten hundredths per cent (3.100 per annum on all bonds maturing in the years 1965 to 1973, both inclusive, at the rate of three and forty hundredths per cent (3.~+0~) per annum on all bonds maturing in the years 197 to 1978, both inclusive, at the rate of three and fifty hundredths per cent (3.500 per annum on all bonds maturing in the years 1979 to 1981, both inclusive .and at the rate of three and sixty hun- dredths per cent (3.60~~ per annum on all bonds maturing in the years 1982 and 19$3, payable October 1, 196+ and semi-annually thereafter on April 1 and October 1 in each year, plus additional interest, represented by a separate set of interest coupons, at 198 the rate of two and forty hundredths per cent (2.~F0~) per annum from November 22, 1963 to April 1, 1865, payable October 1, 196 and April 1, 1865. Said bonds shall be payable as to principal and interest at The American National Bank of Saint Paul, St. Paul, Minnesota, and shall mature serially on October 1 in the years and amounts as follows: 5,000 in each of the years 1965 to 1970, both inclusive; 10,000 in each of the years 1971 to 1979, both inclusive; and 15,000 in each of the years 1980 to 1983. All bonds maturing in the years 1882 and 1883, (bonds numbered 151 to 180, both inclusive), shall be subject to redemption and prior payment at the option of the Village, in inverse order of their serial numbers on October 1, 196, and on any interest payment date thereafter. All bonds maturing in the years 197 to 1881, both inclusive, (bonds numbered 61 to 150, both inclusive) shall be sub- ject to redemption and prior payment at the option of the Village, in inverse order of their serial numbers on October 1, 1973 and~on any interest payment date thereafter. Bonds so redeemed shall be redeemed at a price of par and accrued interest, plus a premium of $30.00. At least thirty days prior notice of redemption shall in each case be given to the bank where said bonds are payable, to Juran & Moody, Inc., 93 East Sixth Street, St. Paul, Minnesota, and to the last known holder. Holders desiring to receive such notice must register their names, addresses and bond numbers with the Village Clerk. 2. The bonds and interest coupons to be issued hereunder shall be in substantially the following form: UNITED STATES OF AMERICA STATE OF MINNESOTA COUNTY OF RAMSEY VILLAGE OF FALCON HEIGHTS WATERMAIN AND SANITARY SEWER IMPROVEMENT BOND OF 1863 No. $1,000.00 KNOW ALL MEN BY THESE PRESENTS that the Village of Falcon Heights, Ramsey County, Minnesota, certifies that it is indebted and for value received promises to pay to bearer the sum of ONE THOUSAND DOLLARS on the first day of October, 19 and to pay interest thereon from the date hereof until the principal is paid at the rate of three and ten hundredths per cent (3.10) per annum, interest being payable October 1, 196 and semi-annually thereafter on the first day of -2 - 198. 198. April and the first day of October in each year, plus additional interest, represented by a separate set of interest coupons,. at the rate of two and forty hundredths per cent (2.400 per annum from November 22, 1863 to April 1, 1865, payable October 1, 1864 and April 1, 1865, in accordance with and upon present~fi~ion and surrender of the interest coupons hereto attached, which are in two sets, one representing interest from the date hereof to ma- turity at the rate of three and ten hundredths per cent (3.100 per annum and the other representing additional interest at the rate of two and forty hundredths per cent (2.400 per annum for the period November 22, 1963 to April 1, 1965. Both principal and interest are payable at The American National Bank of .Saint Paul, St. Paul, Minnesota, in any coin or currency of the United States of America, which on the date of payment is legal tender for public and private debts. This bond is one of an issue in the total principal amount of $180,000, all of like date and tenor, except as to maturity, interest rate and redemption privilege, which bond has been issued pursuant to and in full conformity with the Constitution and laws of the State of Minnesota, for the purpose of providing money for the construction of sanitary sewer, watermain, and street improve- ments for said Village, and is payable out of the Watermain and Sanitary Sewer Improvements of 1g 63 Fund of the Village. :This bond constitutes a general obligation of the Village, and to provide moneys for the prompt and full payment of said principal and in- terest when the same become due, the full faith and credit of said Village have been and are hereby irrevocably pledged. IT IS HEREBY CERTIFIED AND RECITED that all acts, conditions and things required by the Constitution and laws of the State of Minnesota to be done, to happen, and to be performed precedent to and in the issuance of this bond have been done, have happened and have been performed, in regular and due form, time and manner as required by law, and this bond, together with 'all other debts of -3- 198.E [] the Village outstanding on the date hereof and the date of its actual issuance and delivery, does not exceed any constitutional or statutory limitation of indebtedness. On bonds numbered 61 to 150, both inclusive, coupons numbered 20 and higher shall contain the same clause .j 3. The bonds shall be prepared under the direction of the Village Clerk and shall be executed on behalf of the Village by the signatures of the Mayor and the Village Clerk, and the corporate seal shall be affixed thereto and the interest coupons shall be executed and authenticated by the printed, engraved or lithographed facsimile signatures of said officers. When the bonds have been so prepared and executed, they shall be delivered to the Village Treas- urer who shall deliver the same to the purchaser thereof as herein- after provided, but the purchaser shall not be required to see to the proper application of the purchaser price. ~. There is hereby created a special fund to be designated "Watermain and Sanitary Sewer Improvements of 1863 Fund," to be held and administered by the Village Treasurer separate and apart from all other funds of the Village. Said funds shall be main- -~+ - 1986 t tained in_the manner herein specified until all of the bonds herein authorized and interest thereon shall have been fully paid. In said fund there shall be maintained two separate accounts, to be designated as the "Construction Account" and the "Sinking Fund Account" respectively. The proceeds of the sale of the bonds herein authorized, less accrued interest received thereon, shall. be credited to the Construction Account, from which there shall be paid all costs and expenses of making said improvements, in- cluding the costs of construction contracts heretofore let and all other costs incurred and to be incurred and the moneys in said ac- count shall be used for no other purpose, provided, that if upon completion of said improvements there shall remain any unexpended balance in said Construction Account, such balance shall be trans- ferred to the Sinking Fund Account. There shall be credited to the Sinking Fund Account all collections of the special assessments herein levied, all accrued interest received upon delivery of said bonds, all funds remaining in said Construction Account after com- pletion of the improvement and payment of the costs thereof and all collections of the taxes herein levied. The Sinking Fund Account shall be used solely to pay principal or interest on the bonds is- sued hereunder. 5. It is hereby determined that no less than $II~,~00 of the costs of said improvements shall be paid by special assess- ments to be levied against every assessable lot, piece and parcel of land benefited by the said improvements. The Village hereby covenants and agrees that it will do and perform, as soon as they may be done, all acts and things necessary for the final and valid levy of such special assessments, and in the event that any of such assessments be at any time held invalid with respect to any lot, piece or parcel of land, due to any error, defect or irregularity in any action or proceedings taken or to be taken by the Village or this Council or any of the Village officers or employees, either in the making of such assessment or in the performance of any condi- tion precedent thereto, the Village and this Council will forthwith do all such further acts and take all such further proceedings as may be required by law to make such assessment a valid and binding lien upon such property. Said assessments shall be payable in 20 equal, consecutive, annual installments, the first of said install- ments to be payable with general taxes for the year 196 4 , collec- table with such taxes during the year 1g6~. To the first install- ment there shall be added interest at the rate of~ per annum on the entire assessment from the date of the resolution levying the assessment until December 31, 196. To each subsequent install- ment there shall be added interest at said rate for one year on all unpaid installments. -5- 1987 6. The full faith and oredit of the Village is hereby pledged for the payment of the principal and interest of said bonds. 8. The Village Clerk is hereby directed to file a certified copy of this resolution with the County Auditor of Ramsey County, Minnesota, together with such other information as he shall require, and to obtain from said Auditor a certificate that said bonds have been entered in the. Auditor's Bond Register. 9. The offer of Juran 8c Moody, Inc „ of St. Paul, Minnesota, to purchase the bonds to be issued hereunder at par and accrued interest is hereby accepted, and when said bonds have been printed the same shall be delivered to the purchaser in accordance with said offer. The motion for the adoption of the foregoing resolution was duly seconded by memberGEORCE J. However, inasmuchas he has no place to store cars, no action was taken. Building Permit Nr. H,N. Schroeder, builder of the house now under construction for 1775 No. Asbury at this address, has not been granted a building permit from Variance: the village for such construction. After discussion, it was moved by Stone, seconded by Warkentien that the following Resolution be adopted. Carried, WHEREAS H.N, Schroeder has applied for variance at 1775 No, Asbury Avenue in the Village of Falcon Heights, and WHEREAS, the Village of Falcon Heights does not have an ordinance to adequately cover the situation, and WHEREAS, it is necessary to grant a Variance Permit for said house now under construction, NO?+~1, THEREFORE, BE IT RESOLVED that said Variance Permit be granted upon condition of application and payment for same, and the Clerk is instructed to forward. a copy to the building inspector and instruct him to issue the required building permit. ~~ w , ~//~ G~erk :~ ~~'~~~ -~e-:,t .Mayer Relaxation of Building Code Shavor moved, seconded by Warkentien that the following at 11~6l~ West Resolution be approved by the Village Council. California Ave.: WHEREAS a request for relaxation of provisions of Ordinance #3 has been received from Chester Johanson, and WHEREAS, the building inspector and the zoning administrator has recommended the approval of said relaxation of provisions of Ordinaax a #3 , NOVV, THEREFORE, BE IT RESOLVED BY THE Council of the Village of Falcon Heights that the request for converting an attached garage to a bedroom be approved and that said ceiling level may be 7 feet 6 inches in said bedroom in lieu of the 8 feet as provided in said ordinance. WHEREAS, Arthur Lindig has presented a proposed plat titled HLindig~s Addition No.2~ and 1991 Lindig Addition No. 2 Falcon Heights Congregational Church - Drainage of lot next to new parsonage: hard copy of said plat. WHEREAS, the Planning Commission had previously approved said plat, and the Council of the Village of Falcon Heights has inspected same, NOW, THEREFORE, BE IT RESOLVED BY-THE Village Council of Falcon Heights, Minnesota that 1. Under terms of the agreement, and the resolution passed by the Council on January 9, 1963, this situation was to be corrected, if and when it developed Eorrection to be made by the Falcon Heights Congregational Church,~S Parsonage Deferred The existing assessment for water and sewer against Assessments: this property had been deferred until such property was unproved. Inasmuch as it is noun improved and being serviced by the utilities, the deput~r clerk was instructed to contact by 3;etter the representatives of the Church regarding payment of such assessment without interest as agreed. It should be suggested that a representative of the Church governing board contact the ViLla,ge office. State Fair Car Wash Mr, and Mrs. Norbert L. Hermes were present at the Driveways and Drainage: request of the Council. Hermes advised that the con- tractor responsible for the job was given the plans and specifications as outlined by the Village Engineer and if he did not go by the plans, Hermes was not aware of it. Hermes was advised that the provisions of Ordinance 6l~, Section 1~..3, Subd. 3 require drainage system to be installed to the approval of the Village Engineer. Also the provisions of Ordinance 25, Section 2.15 require permit for area grading on filling on private property which shall obstruct or interfere in any way with any natural drain- age waterway. Such permit must be issued by the Council. Violations of said ordinance are misdemeanors and are punishable by a fine of not less than $5.00 or more than x'100 or by imprisonment of not less than 5 days or more than 50 days. Motion carried. 1 1 1992 Tree Program: Dr. Hard was present at the request of the Council and he advised that he has contacted tree service companies and suggested that Lakeland Tree Service be contracted to carry on the tree program for the ensuing year. Dr. Hard stated it would be most advisable to establish and carry out afoot-year tree program for the entire Village. It was suggested that some estimate as to cost for this program be furnished the council at the next re,~g~-ar meeting. Dr. Hard suggested that the area i~~~~`'~ of Snelling Avenue be completed this year -Asbury Avenue would be the starting point. North Snelling Avenue Petitions have been received. Preliminary plans are as Water Connection to follouPSs Roseville system: (1) The Village of Falcon Heights would construct the system. (2) Such water line would be connected to the Roseville water system. (3) The Vi.1-lage of Falcon Heights would maintain the water lines. Water will be purchased by individual homes and bills will be submitted to them by Roseville. They will pay the same rate as Roseville citizens. Stone moved, seconded by Shavor that the following Resolution be adopted. Motion carried. RESOLUTION DECLARING ADEQUACY OF PETITION AND ORDERING PREPARATION OF REPORT ON THE IMPROVEMENT OF THE WEST SIDE OF NORTH SNELLING AVENUE BY THE IlUSTALLATION OF A 5IX MUCH WATER MAIN AND LOT SERVICES FROM THE SOUTH LINE OF ROSELAWN AVENUE TO A POINT 1,28..85 FEET SOUTH OF SAID LINE BE IT RESOLVED BY THE Village Council of Falcon Heights, Minnesota: 1. A certain petition requesting the improvement of the west side of North Snelling Avenue between the south line of Roselaaem Avenue and a point 1,28l~.85 feet south of said line by the installation of a 6 inch watermain and lot services, was filed with the Council on the 11th day of September 19b3, is hereby declared to be signed by all of the owners of property affected thereby. This declaration is made in conformity to the Minnesota Statutes l~29.035. 2. Petition is hereby referred to Bonestroo, ftosene, and Associates, the Village Consulting Engineers, and they are instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvement is feasible, and the estimated cost of the improvement as recommended. If said improvement is feasible, it should be made a part of the Water and Sewer Improvement of 1943, The above Resolution was adopted by the Council this 11th Day of September 1963. 1993 North Snelling Avenue Water Connection: Attorney Galvin: Stone moved, seconded by Shavor that the following Resolution be adopted. Motion carried. WHr~EAS, the petition was accepted by the Village Council on September 11 , 1963 for the proposed improvement of North Snelling Avenue on the w est side between the south line of Roselawn Avenue and a point 1,28l~.85 feet south of said line by the installation of a 6~i water main and lot services, and VdHEREAS, the Engineer has reported to the Council that such improvement is feasible and is best accomplished by incorporating it into the Water Main and Sewer Improvement of 1963, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE Village of Falcon Heights: 1. Such improvement is hereby ordered as proposed in the Council Resolution adopted September 11, 1963. 2. Bonestroo, Rosene, and Associates are hereby designated as engineers for this improvement. They shall prepare plans and specifications for the making of such improvement. This ~~+esoluti.on was adopted by the Village Council this llth day of September 1963. Due to legislative changes, Warkentien moved, Stone seconded Ordinance No. 68s that Ordinance No. 68 entitled 'An Ordinance regulating the use of Highways within the Village of Falcon Heights Incor- porating provisions of the Minnesota Highway Traffic Regula- tion Act and the Minnesota Driver's License Act by reference, Imposing Penalties for the Violation thereof and repealing Ordinance No. 66; be adopted by the Village Council. Motion carried. Lindig Avenue Because of the dedication of L~:ndig Avenue to the Village of Dedicated to the Falcon Heights, the Council must review the existing assess- V311age: menu on Lindig Avenue to determine the method of apportioning same. Action on this is laid over until a future date. Justice of the Peace: The Council was advised that bond and oath of new Justice of the Peace, Dwain L. Jones, will be filed with the Clerk of District Court. Engineer Lemberg: J. M. McGregor of 1795 No. Fairview was present to state Land Surveys: that a neighbor had made a survey and moved stakes on his property so that McGregor~s property was now two feet less. Lemberg advised that no private citizen has the right to do this, only the County Surveyor has such a right. Redistribution of McGregor requested redistribution of water hydrants inasmuch Hydrants Requesteds as he has a man-hole on one side of his driveway and a hydrant on the other side, and is of the opinion that this lessens the value of property. After considerable dis- cussion, it was determined that a deviation from the plans was not feasible. 1 1 1 199. Stone moved, seconded by Warkentien that Change Order No. 1 be approved to extend the main. Carried, Engineer will draft plans for same. It was also suggested that drinking fountain be installed, and this was tabled. Upon request from the Village Engineer, Warkentien moved seconded by Shavor, that Engineer be authorized to have the County dust coat Roselawn Avenue from Fairview to Autumn. Mb~:~ion carried, Letter from Ramsey County regarding snow plo~wri.ng for the coming winter was referred to the Engineer for reply, Moved by Nilsen, seconded by Shavor to accept the inventory report as submitted, and to fozward same to the Minnesota Division of Insurance.
