Mortensen; Trustees George J. Shaver, Charles P, Stone, and ~i11is ~arkentien. Also present were Treasurer Gilliam E. Olsen, Attorney ~i.chael Galvin, Engineer Brad Lemberg, and Deputy Clerk Tina Vavoulis. Stone-~eoved, Nilsen seconded that the minutes of the regular meeting of .October 9 be corrected and that the following Resolution replace the one made on that date s WHEREAS, the Countyy Auditor has advised that he must accept the P,E.R.A. Board. of Trustees certified figure of X2,903.61 is-lieu of the ~~,,206.20, which the Council approved under date of October 9th, and TAR `WHEREAS, the difference in the amount of .,3c~2.59_ LEVY shall be added to the General Fund and held as P.E.R.A. r®serve, changing the total in the General Fund tax levy, and AREAS, the Clerk.. has. been instructed to_request the Gounty-Auditor to void the original levy submitted October 1l~, 1963, and to re-certify th® tax levy, and to make note of .:such correction in the minutes of the meeting of October 1l~, 1963, NOS, THEREFORE, BE IT RESOLVED .that the folloaring sums be and they are hereby levied upon the taxable property_of the...Village of Falcon Heights for the year 1963,. collectible in the year 196lts GENERAL FUND 71,2i72.61 FIREl~1'S RELIEF 1,500.00 P. Thomas 2057 Knapp Refinancing of $525,000 Suer Mr. Bob Sander of Juran and Mooc~r was present and recapped Bonds: various details regarding the refunding of the $525,000 Senrer Bonds of 1957 and refinancing of same. He advised that ire have approximately 134 interest saving, which is above some of the figures that other communities have done. This 3sicluded the fact that Jvran and Moody pay the printing and legal expenses an the neR bonds and there is no fee on that at all... That firm. did not increase by one penny for thirteen years the annual .amount that has to be paid on the refunding bonds as against the original bonds. Another advantage is that the call, feature is kept exactly the same. Trees: Mr. Fournier rra,s present regarding future ixee work ixi the Village and expressed a desire to bid on same. Hooks or climber After discussion, it was decided that in tliture contracts spikes : with faces trimmers that the use of hooks or climber .spikes 3.a not permissible and should be so stated on the contract. Engineer Lemberg: Watermain corn- Engineer advised that the St. Paul Water Department gill not action ~~ approve of any connection to the Roseville Water System, Same ~~~®_ is specified in the Water Departments contract with Roseville. .Therefore, inasmuch as Nodland Construction Comq~y~s contract with this Village does not include crossing Snelling Avenue for connection to St. Paul Water, Stone introduced the following resolution and moved its adoption: Watermain & RESOLUTIOAt APPROVIlJG PLANS AND SPECIFICATIONS Seger Improvement DECLARING COST OF IMPROVE6dIIdT AND AUTFiORIZIlJG of 1963 - Change- CONS~tUCTION OF THE SAME BY GRANGE ORDER Order #1. Paul has by letter .dated. October 22, 1963. agreed to make the necessary coimections under gunk HighaPay X51 to cormect to said improvement, and S, final. amended .plans and specifications for said imp~ravement have now been received by the Council, NO~t, THEREFORE, BE IT RESOLVED that t3~ Village Council of the Village of Falcon Heights, Minnesota: 1. Said amended plans and specifications are hereby approved and a copy thereof has been placed on file with the Village Clerk. 2. The estimated total cost of said improvement is in the amount of ~3,OI~7.00, plus contingencies, and. the entire cost of said improvement will. be assessed against the benefited and petitioning property ~rners. 3. The Village Council hereby author3.Zes construction of said im~avement anti directs .that constsuct3.on be accomplished by change~rder to Nodland Gone traction Company who are now constructingother water services in the Village and hereby finds and determines chat said ..construction is in an amount less than 2~~ of the .total contract now outr- standing with Nodl.and Construction Company. !t. Said ...change-order is conditioned, ho~rever, on the issuance of tha necessary permits, easements or licenses deemed necessary by the Vi1.l.age Consulting Er-gineer. 5. The motion for the adoption of the foregoing resolution was duly seconded by Member Shavor and. upon a vote being taken thereon, the folloaring voted in favor thereof Nilsen, Stone, Mortensen, Shaver, and VYaxkentien. Carried. -~ ~ ~ ,~~ ~ ~ lark Mayor LJ 1 ~02l~ Attorney Galvin shall write a letter confirming the letter dated October 22, 1963 from the Watsr Depar-traent, and the Council wi11 act in accordance. There will be no additional cost to the Village or to the affected lot ovrners for this Change. Sevrer & Watercnain Mayor Nilsen will .prepare a statement for the nevrspapers Improvement 1963: regarding the present construction project and will advise people about plans for sodding, repaving streets, trenches, Sodding,dust, etc. Plans for finis are to complete in the spring, inas- etc. much as Engineer deems it inadvisable to try to do it now. Attorney Galvin Lindig Pro3ect: Council was advised as to the circumstances surrounding the one .foot buffer Zone, and it appears that Bianchi will not sell same to Lindig. It was the attorney's recommendation that the Agreement (as referred to in previous minutes) be dropped. There was considerable diseussior- about this pro3ect, and the Village Attorney was instructed to bring in the Agreement as originally approved. LJ Robert Hall Store - The Village has been contacted by this firm about being open Sunday opening: on Sundays before the holidays such as Christmas and Easter, for about tRO to three months. Idr. Moscow has stated he x111 agree to whatever the Village has as its policy. It appears that Sunday opening is contrary to State Lava, but it has not yet been determined whether the laav is constitutional or unconstitutional. The Village Attorney will advise Robert Hall Store that the Village does not have a policy, hanrever, the Council does not encourage opening on Sunday. Change of Venue: IIpon inquiry by Warkentien, Galvin advised that the Statute gives absolute right to indiv3.duals for change of venue. 7S' defendant demands a fury trial, it would take mo'~re time to set up a Jus tics of Peace trial.
