year 1990 as recommended by Staff.
COUNCIL STANDING RULES REAFFIRMED
Council discussed the present Council Standing Rules adopted in
1987, and concurred that the procedures have worked well andthatnochangesneedbemade.
COUNCIL ASSIGNMENTS FOR 1990 APPROVED
Council agreed to the 1990 Council Assigments as presented byBaldwin.
MORATORIUM DECLARED ON APPOINTMENT OF ANY NEW COMMISSION MEMBERS
Baldwin explained his rationale for reducing the size of theCityCommissions, which presently consist of nine members eachwhencompletelyfilled. He felt smaller groups would be more
efficient, speeding up decisions, and that larger CommissionscreatemoreworkforCityStaff. Ciernia informed that thePlanningCommissionhaddiscussedthematterattheirJanuarymeetingandunanimouslyrecommendedthatCommissionremainatninemembers. Council agreed to a one month moratorium on newappointmentsduringwhichtimeStaffwillsurveyother
communities to deterine the size of their commissions and if anyproblemsarecreatedbysize.
COMMISSION REAPPOINTMENTS
Gehrz moved reappointment of the following Commission members:Human Rights, Jim Olsen, two year term, expiring 12/31/91andGwenWillems, three year term expiring 12/31/92; Solid
Waste, John Hustad, Laura Kuettel and Mike Haglund, three yeartermsexpiring12/31/92; Parks and Recreation, Jeffrey JohnsonandLindaMcLoon, three year terms expiring 12/31/92, andMichaelSmallpage, two year term expiring 12/31/91; PlanningCommission, Carolyn Nestingen, three year term expiring12/31/92. Motion carried unanimously.
UPDATE ON POLICING SINCE JANUARY 1, TOM ALLEVA DEPUTY CHIEF,ROSEVILLE POLICE DEPT.
Deputy Chief Tom Alleva informed Council that the change overhadgonesmoothlywiththecooperationoftheSherrif's Dept.and Staff. He gave a brief review of the police activity inFalconHeightssinceJanuary1standpresentedanupdateon thehiringoffivenewofficers. Gedde stated he anticipates a goodrelationshipbetweenthePoliceDepartmentandtheCity'sProsecutorsandsuggestedtheDepartmentprovidetheCity with alistofticketsissuedinFalconHeights.

Wiessner explained that during the 1990 Budget discussions theCouncilagreedtoconsiderissuingbondstofinancemostofthe5yearcapitalneedsduetothefavorableinterestrates.Fiscal Consultant Apfelbacher informed Council that the interestratesareveryattractiveatthepresenttimeandalsotherewouldbeasavingstotheCity (consultant fees, etc.) if thisissueiscombinedwithHamlineAvenueImprovmentBondissue. HestatedhehadinvesigatedthepossibilityofrefinancingotherCitydebtsbuthaddetermineditwouldnotbebeneficialatthistime. Following the discussion, Ciernia moved ResolutionR-90-2 which carried unanimously.

Planner Susan Hoyt Taff reviewed the proposed code amendmentsandexplainedonewouldeliminateconflictingdefinitionsandtheotherwouldallownewsinglefamilydwellingsandnewadditionstoexistingsinglefamilydwellingstobeconstructedwithanattachedgarageinfrontoftheprincipalstructure.The Public Hearing on the amendments was held by the PlanningCommissionattheJanuary8, 1990 meeting and that bodyunanimouslyrecommendedapproval. Gehrz moved adoption ofOrdinance0-90-1 which carried unanimously.

Wiessner explained that three bids were received, but no biddersbondsaccompaniedthemdisqualifyingthebids. She added thatitmaybepossibletopurchaseapick-up by participating in aHennepinCountybidforsimilartrucks. Council directedWiessnertopursuepurchasingthroughHennepinCountyand ifthatisnotpossibletoreadvertiseforbids.

SMOKING POLICY ADOPTED
Baldwin presented the proposed Smoking Policy for the CitybuildingandvehiclesafterwhichCouncilheldadiscussionregardingphasinginasmokefreefacility. Council was inagreementontheproposedpolicyandestablishedthefollowingtimelineforthesmoke-free phase-in: Fire Department loungeandkitchen, July 1, 1990, Fire Chief's Off ice, January 1, 1991,Public Works Office, July 1, 1991, and Public Works Restroom,January 1, 1992. Wallin then moved adoption of Ordinance 0-90-2whichcarriedunanimously.

Council then reviewed the proposed amendment relating to anEthicsPolicy, after which Ciernia moved adoption of Ordinance0-90-3. Motion carried unanimously.

Council scheduled a Workshop to be held immediately followingtheJanuary24, 1990 Council Meeting to discuss revisions to theCityCompensationSystem.
PROPOSED AMENDMENT RELATING TO ALCOHOLIC BEVERAGE LICENSING
Baldwin explained that a problem arose regarding the ChinatownRestaurantWineLicenseduetothefactthattheCityCodewordinghasbeenintrepretedtoprohibitissuanceofsuchlicensestoanybusinessonpremiseswheretherearedelinquentfinancialclaimsduetheCity. Since there are outstandingclaimsagainsttheowneroftheproperty, it would not bepossibletoissuetheannualwinelicense. Gedde presentedlanguageforaproposedcodeamendment, which should alleviatetheproblem, after which Gehrz moved adoption of Ordinance0-90-4 with changes recommended by Council. Motion carriedunanimously.

Baldwin presented a letter of resignation from Councilmember PatBushandexplainedthatthereasonfortheresignationwasthatatthistime, the family intends to move from the City. CouncilexpressedregretattheresignationafterwhichWallinmovedadoptionofResolutionR-90-4 accepting the resignation. Motioncarriedunanimously.

Solid Waste Commission Meeting
January 4, 1990
The meeting was called to order by Chairperson Thompson at 7:10 pm.
COMMISSION MEMBERS PRESENT: Laura Kuettel, Nancy Misra, John Thompson,
Lyle Wray and Shirley Chenoweth, Staff Representative.
COMMISSION MEMBERS NOT PRESENT: Michael Haglund, John Hustad, Leo Klisch,
Terry Iverson, and Marty McCleery.
APPROVAL OF MINUTES: Approval of the December 7, 1989 minutes will appear on
the February 1, 1990 agenda due to lack of a quorum.
APPROVAL OF AGENDA: Item III of the January 4, 1990 agenda was clarified to
read Strategy for Organized Collection and Educating the Community.
The City of Columbia Heights is collecting information from the surrounding
communities to see where each city stands in the midst of integrated/organized
collection issue. Shirley Chenoweth will bring this information to the
February meeting.
Gene's is a licensed hauler in
Chenoweth that a 50 acre farm
of the other licensed haulers
the new regulations.
Falcon Heights. He recently informed Shirley
was at his disposal for grass clippings. Some
have no disposal site in mind, but are aware of
Marty McCleery asked John Thompson to correct information given at the
December meeting. The Newport plant was reported to be burning yard waste.
This is not the case.
John Thompson also informed the Commission that a corporate venture of farmers
is looking into a short-term (3-5 years) solution to yard waste by spreading
compost.
John Thompson reviewed an Implementation Strategy prepared by Ramsey County.
One section covered the area of multi-family housing. The county would like
to see an acceptable system of collecting recyclables provided at all
multi-housing units. Their implementation strategy is to ask municipalities
to require a recycling system and if not done by February of 1990 the county
would mandate a program. Through discussion it was decided that Ramsey County
is unrealistic in a February deadline and has not contacted Falcon Heights of
any decisions in this area.
EDUCATING THE COMMUNITY. Nancy Misra suggested a survey be taken of the
residents of Falcon Heights. John Thompson suggested a short questionnaire be
sent to the blockworkers to survey 10 homes in their neighborhoods. ShirleyChenowethwillbringthe1982pilotprogramsurveytotheFebruarymeetingfor
our information. A meeting of all blockworkers, prior to the survey, was
suggested. During our February meeting the Commission will draft a short
survey and plan a party for blockworkers. The suggested schedule far the
Commission is to finish the newsletter in February for a March printing; have
the blockworkers' party in April; and disseminate the questionnaire in May.

NEWSLETTER ISSUE. Some changes in articles for the March newsletter are as
follows: Nancy Misra will have information on 1) what to do with batteries
and car tires; 2) what to do with household hazardous waste; and
3) information on service stations as to why they must except a customer's
used motor oil, tires and batteries. Lyle Wray will provide graphs on the
recycling trends of Falcon Heights residents. Shirley Chenoweth will provide
names of haulers and their average cost for service.
At present, the City of Falcon Heights has renewed licenses for 3 commercial
haulers and 5 residential haulers. The residential haulers and their low
volume prices are: Woodlake (BFI) $38.25/grtr, Belaire $33.00/grtr, Krupenny
45.00/grtr, Gene's $33.00/grtr, and Walter's $37.50/grtr.
Nancy Misra suggested having Pollution Control brochures on hand at City Hall
for residents and will contact Colleen Halpine about copies of Ramsey County
information.

Laura Kuettel will look into a subscription to the publication Garbage and
obtaining more copies of The New 3 R's: Reduce. Reuse. Recycle.
All articles for the March Newsletter should be in to Shirley Chenoweth by
February 15, 1990.
The agenda for February 1, 1990 will contain the following: newsletter
issues, organization of a party for blockworkers, the drafting of a short
survey, and multi-family recycling strategy.

The proposed wording is as follows:
Subdivision 3. Sick Leave. Sick leave will be accumulated for all regularfulltimeemployeesattherateofonedaypercalendarmonthandmaybeaccumulatedtoamaximumof120days.. In December of any year, an employeewithatleast30daysofsickleavecreditedcansellbackuptosixdaysofsickleaveminusthenumberofsickdaysusedinthatyear. Dear Ms. Wiessner:
As requested, we have reviewed the draft feasibility study for the upgradingofClevelandAvenuefromLarpenteurAvenuetoCountyRoadB. ThefeasibilitystudywaspreparedbytheRamseyCountyDepartmentof PublicWorks. Based upon our review of the report, we would offer the followingcomments:
1. ROADWAY DESIGN
The road is proposed to be 52 feet wide from the face of curb to faceofcurb, striped with four 12 foot travel lanes, two in each direction.A three lane striping pattern with a center turn lane was considered,but not chosen due to the lack of turning movements along this stretchofClevelandandthedirectionalsplitinthetrafficvolumes. Webelievethechosenalternativeisthebestofthoseconsidered.
2. BIKE PATHWAY
The County's feasibility study states that the City is in favor of aneightfootwidebituminouspathwayontheeastsideofClevelandbetweenLarpenteurandRoselawn. In fact, this pathway is shown on theCity's Comprehensive Pathway Plan. The feasibility study also statesadditionalright-of-way is necessary to construct the pathway.
We would suggest reducing the pathway to a six foot width with a twofootboulevardbetweenthecurbandpathway. We would also suggestrequestingtheCountytooffsettheroadwaycenterlinetwofeetto thewest. It is not clear what, if any, impact this would have on theexistingtreesalongthewestsideoftheroadway. This scenarioshould, however, allow the construction of the 52 foot roadway and thesixfootpathwaywithintheexisting66footright-of-way.

Another consideration would be to request the two foot boulevard areaalsobebituminoussurfaced. This would not provide additional usablepathwayduetotheinstallationofroadwaysigning. This would,however, eliminate an area of sodding which would be difficult at besttomaintain.
3. PARKING
The proposed 52 foot wide roadway will not permit any on-streetparking. This will create a dilemma along the west side of the roadduetotheathleticfields.
To provide on-street parking would require additional right-of-way andtenfeetofadditionalstreetwidth. The total cost associated with aparkinglanewouldbetheresponsibilityoftheCity. Another optionwouldbetheconsiderationofanoff-street parking area which could besharedbytheUniversityandtheCitypark. This whole parking issueshouldbeexploredthoroughlybetweentheCityandtheUofMpriortocommentingbacktotheCountyonthefeasibilitystudy.
4. STORM DRAINAGE
The proposed road construction will require filling of approximately1/3 the existing pond at the southeast corner of Cleveland andRoselawn. Addition of the pathway would require filling substantiallymore.
The feasibility study suggests the construction of a new small holdingpondsomewherenearthesouthendoftheCitypark. This pond wouldreceivealltherunofffromClevelandbetweenLarpenteurandRoselawn.This pond construction would require additional right-of-way.
Two questions this proposal raises are; Since the additional right-of-way is needed to drain the County Road, will they pay f~,, it? 6vho willberesponsibleforlongtermmaintenanceofthepond, the City orCounty?
5. COST

INTRODUCTION
This draft feasibility report for Cleveland Avenue from LarpenteurAvenuetoCountyRoadBhasbeenpreparedbyRamseyCountyPublicWorksDepartment. The purpose of the report is to outline whatimprovementsareneededforthissegmentofClevelandAvenue, whatalternativeshavebeenconsidered, the impacts of making theimprovementsandhowtheimprovementscouldbeimplemented.
DESCRIPTION OF E]CISTING FACILITY
Cleveland Avenue (CSAH 46) is under the jurisdiction of RamseyCounty. The portion from Larpenteur Avenue to County Road B isonemilelongandbordersFalconHeights, Roseville and includestheSt. Paul Campus of the University of Minnesota.(See Figure 1).
Cleveland Avenue has a functional classification of minorarterial. It connects subregions and activity centers withinsubregions. Current average daily traffic counts are 7,800 fromLarpenteurAvenuetoRoselawnAvenue, and 9,500 from RoselawnAvenuetoCountyRoadB. Projected traffic volumes for 2009 are12,500 and 15,000 for these sections of Cleveland Avenue. (SeeAppendixA).
The amount of right of way currently available on the east andwestsidesofClevelandAvenueis33feetfromLarpenteurAvenuetoRoselawnAvenue. The amount of right of way currentlyavailableontheeastandwestsidesofvariesbetween33and49.5feetfromRoselawnAvenuetoCountyRoadB.
Cleveland Avenue is bituminous, two lanes, undivided, withvariablewidthgravelshoulders. (See Figure 2). The road was lastsurfacedin1948withbituminoustoawidthof24feetfromLarpenteurAvenuetoRoselawnAvenueandtoawidthof22feetfromRoselawnAvenuetoCountyRoadB. There is no storm sewersystemalongClevelandAvenuebetweenLarpenteurAvenueandRoselawnAvenue. Two minor storm sewer systems exist betweenRoselawnAvenueandCountyRoadB. The terrain adjacent toClevelandAvenueisrolling. There are two areas of wetland, oneonthesoutheastcorneroftheintersectionofClevelandAvenueandRoselawnAvenue, the other on the northwest corner of theintersection. The posted speed limit is 40 miles per hour.Traffic signals are located at the intersection of ClevelandAvenueandLarpenteurAvenueandattheintersectionofClevelandAvenueandCountyRoadB. There is a four-way stop at theintersectionofClevelandAvenueandRoselawnAvenue. OtherintersectingstreetsstopforClevelandAvenuetraffic. ParkingisprohibitedalongtheeastsidefromLarpenteurAvenuetoRoselawnAvenueandalongthewestsidefromLarpenteurAvenuetotheGibbsFarmMuseumentrance.
Land use adjacent to Cleveland Avenue is public institutional fromLarpenteurAvenuetoRoselawnAvenueandpredominatelylowdensityresidentialfromRoselawnAvenuetoCountyRoadB. Ramsey CountyHistoricalSociety's Gibbs Farm Museum is adjacent to ClevelandAvenueonthewestsidenearLarpenteurAvenue. The University of

Minnesota golf course and intramural baseball fields are also
adjacent to Cleveland Avenue on the west. The Falcon Heights
Community Park borders Cleveland Avenue on the east side near
Roselawn Avenue. A geographical marker identifying the location
of the 45th parallel is located on the east side of the road
approximately 100 feet north of the Loren Road intersection. The
Midland Hills Country Club borders Cleveland Avenue on the west
near County Road B. No commercial development exists within the
project area.
EXISTING DEFICIENCIES
Cleveland Avenue from Larpenteur Avenue to County Road B is in
poor condition. The surface is eroded, cracked and patched. The
base and sub-base are inadequate to accommodate current traffic.
The existing road width and travel lane provisions are not in
accordance with accepted standards. There are drainage problems
on some sections of the road. The lack of a storm sewer system
causes poor subgrade drainage and water to pool and occasionally
flood the surface of the the road. The rideability of the road is
poor.
There are no bicycle or pedestrian facilities located on this
portion of Cleveland Avenue.
ROAD ALTERNATIVES CONSIDERED
It is recommended by Ramsey County that Cleveland Avenue be
reconstructed. Any other procedure would have no long term effect .
on correcting the deficiencies of the road. within the
reconstruction category, three alternatives have been considered.
Alternative 1 is an urban type section with storm sewer, curb and
gutter, rather than shoulders and ditches for drainage. Ditches
are, by their state aid definition, appropriate to rural areas,
not urban areas such as the area where_Cleveland Avenue is
located. The road would utilize a,four lane desi n consisting of
four 12 foot travel lanes and an additiona two feet of curb and
gutter on both sides of the roadway. (See Figure 2).
Retaining walls would be required on the west side of Cleveland
Avenue near the University of Minnesota Golf Course and north of
Skillman Avenue. A retaining wall will also be required on the
east side of Cleveland Avenue at the geographical marker (See
Figures 3-4). Retaining walls would be required with all three
alternatives.
Alternative 2 would reconstruct Cleveland, Avenue to a width of 52
feet utilizing a three lane design, two 12 foot travel lanes, one
14 foot two way center left turn lane, and two seven foot
shoulders consisting of five feet of bituminous and two feet of
curb and gutter.
Ramsey County dismissed_~h~ three lane design of Alternative 2
based on the fo lowing information: •
The portion of Cleveland Avenue between Larpenteur Avenue and
Roselawn Avenue borders the University of Minnesota's agricultural
land on the east, and the golf course and intramural fields on the
west. Few turning movements occur through this portion of

These percentages reflect adefinitedirectionalsplitinthetrafficmovements. A four lanedesignaccommodatesthetrafficoperationsofClevelandAvenuebetterthanthethreelanedesignbyprovidingtwotravellanesforbothnorthboundandsouthboundtraffic.
Alternative 3 would relocate the centerline of the roadwayapproximatelyeightfeettotheeastbetweenLarpenteurAvenueandRoselawnAvenue. The centerline would be relocated to avoidimpactingthetreesonthewestsideofClevelandAvenueadjacenttotheUniversityofMinnesota's golf course fence. ClevelandAvenuewouldbereconstructedtothesamewidthwithfour12foottravellanesandanadditionaltwofeetofcurbandgutteronbothsidesoftheroadway. Additional right of way would be requiredontheeastsideofClevelandAvenuefromLarpenteurAvenuetoRoselawnAvenuetoaccommodatethisproposedalignment.
Ramsey County considered this alternative at the request of theUniversityofMinnesota. Following a more detailed evaluation ofthefactorsassociatedwiththisalternative, representatives oftheUniversityofMinnesotarequestedthisalternativebeeliminatedfromfurtherconsideration.
RECOMP4ENDED ROAD ALTERNATIVE
Ramsey County Public Works Department recommends reconstructingClevelandAvenuewithfourtravellanesandcurbandgutterFigures3-4). The road would be 48 feet in width, with anadditionaltwofeetofcurbandgutteroneachsideoftheroad.The centerline of the roadway would remain at its presentlocation. Parking would be prohibited.
This design, four travel lanes without parking, would bestaccommodateexistingandproposedtrafficvolumesonClevelandAvenueandconformstopastcountypracticeandMinnesotaDepartmentofTransportation (Mn/DOT) state aid constructionstandards.
For these reasons, Ramsey County recommends Alaternative 1,reconstruction with four travel lanes, curb and gutter for thereconstructionofClevelandAvenue.
BICYCLE PATH ALTERNATIVES CONSIDERED
It is recommended by Ramsey County that the municipalities and theUniversityconsiderdetachedbicyclepathconstructionfromLarpenteurAvenuetoCountyRoadBaspartoftheClevelandAvenuereconstructionproject. Trip generators near the proposedClevelandAvenuebicyclepathincludetheFalconHeightsCommunityPark, the University's intramural fields, the Gibbs Farm Museum,and the St. Paul Agricultural Campus of the University ofMinnesota.
A detached bicycle path exists on the south side of RoselawnAvenuefromFulhamStreettoSnellingAvenue (Trunk Highway 51).

A detached path also exists on the south side of County Road B
from Hamline Avenue to Cleveland Avenue.
Ramsey County has considered two alternatives for the bicycle
path. One alternate would consist of a detached bituminous path
eight feet in width on the east side of Cleveland Avenue. The
width of the boulevard between the road and the path would be six
feet, the minimum standard recommended by Ramsey County Public
Works Department for snow storage, signing and utilities.
A "no build" alternate is the second alternative considered by
Ramsey County. The Ramsey County Regional Recreational Bikeway
System Plan does not include a path on Cleveland Avenue from
Larpenteur Avenue to County Road 8.
A bicycle lane located on Cleveland Avenue is not recommended as
an alternative. The average daily traffic (ADT) on Cleveland
Avenue is greater than the ADT recommended in the design standards
of the Minnesota Department of Transportation Bikeway Design
Manual for bicycle lanes.
RECOMMENDED BICYCLE PATH ALTERNATIVE
Because the Ramsey County Regional Recreational Bikeway System
Plan does not include a path on Cleveland Avenue between
Larpenteur Avenue and County Road B, Ramsey County Public Works
Department should not recommend a bicycle path alternative for
this project.
The municipalities affected by this reconstruction project should •
determine the recommended bicycle path alternative selected for
the reconstruction of Cleveland Avenue from Larpenteur Avenue to
County Road B.
The City of Roseville has recommended the construction of an eight
foot wide bituminous path on the east side of Cleveland Avenue
from Roselawn Avenue to County Road B. Retaining walls would be
required on the east side of Cleveland Avenue, north and south of
Loren Road to accommodate the proposed bicycle path. (See Figure
4). The City of Roseville has proposed the construction of a
resting point at the site of the geographical marker. (See Figure
5).
The City of Falcon Heights has recommended the construction of an
eight foot wid1i.i~uminous path on the east side of Cleveland
Avenue from Larpenteur Avenue to Roselawn Avenue. The City of
Falcon Heights would need' to acquire additional right of way from
the University of Minnesota to accommodate the construction of a
detached path. The University of Minnesota does not support the
construction of a path from Larpenteur Avenue to Roselawn Avenue
as part of the reconstruction of Cleveland Avenue. Ramsey County
recommends that discussion occur with the City of Falcon Heights
and the University of Minnesota about the construction of a
bicycle path along this section of Cleveland Avenue.
Both path segments, Larpenteur Avenue to Roselawn Avenue, or .
Roselawn Avenue to County Road B, could be constructed, or, only
one segment could be constructed.
The Ramsey County Bicycle Facility Policy requires the

municipality in which a bicycle facility is located to acquire allnecessaryrightofwayforthepath. Because this corridor is notidentifiedinRamseyCounty's Regional Recreational Bikeway SystemPlan, the municipality will be responsible for funding 100 ofthecostofconstructingthepathandthemaintenanceofthepath.
STORM SEWER
Two minor storm sewer systems currently exist on Cleveland AvenuebetweenRoselawnAvenueandCountyRoadB. The first systemconsistsofcatchbasinsneartheClevelandAvenue/Loren Roadintersection. A trunk line carries the storm water run-off to thepondlocatedonthenorthwestcornerofClevelandAvenueandRoselawnAvenue. The second system consists of catch basins southofSkillmanAvenue, and a trunk line which flows north to EldridgeAvenueandeventuallytiesintotheTrunkHighway36ditchsystem.
The proposed storm sewer system consists of extending these trunklinesandinstallingadditionalcatchbasinsalongthenewlyconstructedportionsoftheroadway.
There is no existing storm sewer system between Larpenteur AvenueandRoselawnAvenue. The City of Falcon Heights does not have astormwatermanagementplanatthepresenttime. Consequently, nostormwateroutletshavebeenidentifiedforthisarea. PotentialstormwateroutletsalongthissectionofClevelandAvenuearethetwopondslocatedonthesoutheastandnorthwestcornersoftheClevelandAvenue/Roselawn Avenue intersection.
An apron inlet exists in the northwest corner of Larpenteur AvenueandClevelandAvenue. This apron can only accommodate a limitedamountofadditionalcapacity.
The low point of the Larpenteur Avenue to Roselawn Avenue sectionislocatedapproximately950feetsouthofRoselawnAvenue. Stormwaterdoespoolinthisareaatthepresenttime. In order forthisportionofClevelandAvenuetobedrainedtothetwopondsmentionedearlier, the road would need to be raised a significantamount. The raising of the roadway would require the placement offillslopesonadjacentproperties. An alternate method ofdrainingtheroadwouldbetheconstructionofasmallstormwaterJ ~ pond located near the southwest corner of the Fal con HeightsCommunityPark. (See Figure 3). Because the low point generatesasmallamountofrun-off, pond requirements would be minimal.
ESTIMATED COSTS
Cost distribution for this project is estimated in accordance withRamseyCountypolicyandpastpractices. Note: a copy of theapprovedRamseyCountypolicyisattachedtothereportinAppendix (B).

PUBLIC AND AGENCY INVOLVEMENT
The cities of Falcon Heights and Roseville and the University of
Minnesota have been and will be contacted about this project.
Approval of the project by the cities is required. Approval by
the Board of Ramsey County Commissioners and the Minnesota
Department of Transportation will also be required. A public
hearing is required by the Board of Ramsey County Commissioners.
This requirement is usually satisfied by having the cities hold
the hearing.
The Ramsey County Historical Society and Midland Hills Country
Club will be contacted about this project. Correspondence from
meetings with some of these agencies is contained in Appendix (C)
of this report.
RIGHT OF WAY
Ramsey County's Major Street Plan recommends a minimum of 86 feet
of right of way for this segment of Cleveland Avenue. The amount
of right of way currently available is 33 feet on both the east
and west sides of Cleveland Avenue from Larpenteur Avenue to
Roselawn Avenue and between 33 and 49.5 feet of right of way on
the east and west sides between Roselawn Avenue and County Road B.
Ramsey County foresees the possibility of future difficulties
concerning the placement of utilities and snow storage in those
areas where 33 feet of right of way exists.

In order to accommodate a bicycle path on the east side of
Cleveland Avenue from Larpenteur Avenue to Roselawn Avenue, the
City of Falcon Heights would need to acquire approximately .33
acres of additional right of way adjacent to the Falcon Heights
Community Park and approximately .6 acres of additional right of
way adjacent to the University agricultural fields.
in order to accommodate the proposed bicycle path on the east side
of Cleveland Avenue from Roselawn Avenue to County Road B,
approximately .25 acres of additional right of way from north of
Loren Road to Skillman Avenue is proposed to be acquired by the
City of Roseville.
The total amount of additional right of way required to construct
a path on the east side of Cleveland Avenue from Larpenteur Avenue
to County Road B is approximately 1.2 acres.
Any additional temporary or permanent right of way needed for the
project is to be acquired by the city in which the needed right of
way exists. The right of way will be acquired at city expense.
No property owners will be required to relocate as a result of any
right of way acquisition associated with this project.
ENVIRONMENTAL IMPACTS
No negative environmental impacts are anticipated from the
reconstruction of Cleveland Avenue from Larpenteur Avenue to
County Road B. Preparation of an environmental assessment
worksheet is necessary for this project. A permit will be

required from the Rice Creek Watershed District. The
geographical marker for the 45th parallel may be relocated a few
feet east or west of its current location. The Roseville
Historical Society will be ,consulted prior to relocating the
marker.
METHOD OF HANDLING TRAFFIC DURING CONSTRUCTION
Traffic will be allowed to use '......portions of Cleveland Avenue duringconstruction. At times traffic may be restricted to a single lane
and delays may occur. Traffic control operations will be
coordinated with municipal emergency services and schools. A
traffic control plan will be prepared.
TIMELINE
If funding is available and required approvals are received,construction could occur wi'tthin 12 months after the final
feasibility report for this project is approved.
Prior to initiating the detailed design phase of this project,Ramsey County requires each municipality identified in this reporttoprovideasignatureofaplprovaltothisfeasibilityreport.The signature of approval signifies that the municipality concurs
with the design and cost participation parameters established inthisfeasibilityreport. Major costs incurred due to a change in
scope deviating from that approved in the feasibility report willbebornebytheagencyrequestingthedesignchange.

As you requested, I have reviewed Supplement No. 1 to MnDOT Agreement #63866 norstreet, water main and storm sewer construction on the Sr.ellii~g Avenue project.In reviewing this I compared it to the original agreement and City L'ouncilresolutionR-87-8.
The original agreement estimated a total Gity r_ost of $133,826.01, while
Supplement No. 1 is in the amount of $106,962.01. It appears from my review,the reduced cost is from several changes. First, the calculation of all storm
sewer cost items has been reduced by 50% in accordance with City Council

Maurer explained after reviewing the remainder of the Snelling Avenueplans. (he previously was provided with plans for south of Larpenteuronly), he had contact with the St. Paul Water Department and found MN/DOThadprovidedSt. Paul Water with plans for construction south ofLarpenteur (Larpenteur to Como) well in advance and changes were made asrequired, but plans for the northern portion were received only one weekago. There are many areas where the plans north of Larpenteur do not meetWaterDepartmentstandardsandifdesignstandardsarenotmet, St. PaulhasindicatedthewatersystemwillbeturnedovertoFalconHeightsformaintenance. If it is not possible to change the plans, the cost ofconstructionwouldincreasegreatlytomeetspecifications. Maurer andCouncilagreedthecityshouldnotberesponsibileforcostsresultingfromMN/DOT's failure to present plans to the Water Department in a timelymanner.
Maurer also recommended working with MN/DOT and Ramsey County to tie theproposedAronawatermaintotheexistingmainonthenorthsideofLarpenteuratAronainconjunctionwiththeupgradingofLarpenteurfromAronatoSnelling.
Council discussed these matters at length plus other items of concern suchasMN/DOT'S proposed storm sewer improvement in which they expect cityparticipationintheamountof $41,000, and the negative response (letterfromDistrictEngineerMcRaedated1/18/87) relating to possible fundsowedthecityforComoLakeoverflowchargesestablishedbyMetroWasteControl. Council expressed strong opposition to charges for storm sewerimprovementswhenthepresentsewerisadequatelyservingFalconHeights,and the need for added capacity is a result of increasisng the surfacingwiththeSnellingAvenuereconstruction. Maurer was directed to determinethelifeexpectancyofthesewerwhichis40yearsold.
Council also directed Mauer to pursue making arrangements for therecommendedwatermaintieatLarpenteurandArona.
Council expressed consternation that MN/DOT had indicated at earliermeetingsthattherewouldbenocosttothecity, except for the waterprojectproposedbythecity, and they are now expecting the city to fundatotalof $133,000.
Council concurred it was impossible to consider approving the SnellingAvenuePlansandCooperativeAgreementundertheseconditions, and thematterwasdeferredtotheFebruary11, 1987 meeting.
Chenoweth moved, seconded by Wallin, directing Barnes and Maurer tocontactMN/DOT, inform them of Council's concerns relating to the changesrequiredbySt. Paul Water Department, request a list of items which canbeaddressedthroughdesignchangewithitem-by-item costs of those whichcannot, and inform them the city is not prepared to approve any planswhichcostthecityexceptforthoserequestedbythecity. Motioncarriedunanimously.

Baldwin presented a variance request from Edward C. Kubes, 1877 Holton, to
expand his garage to within one foot of the lot line. Wallin explainedthePlanningCommissionapprovedthevariancewiththestipulationthatrainguttersberequiredonthestructurewithwaterdrainingtothe
street, not on the adjoining property. Mr. Kubes assured he would comply,after which Wallin moved, seconded by Ciernia approval of the variance
contingent upon compliance with conditions set forth by the PlanningCommission. Motion carried unanimously.
COOPERATIVE AGREEMENT WITH MN/DOT ON SNELLING AVENUE IMPROVEMENTS APPROVED
WITH CONDITIONS
Council reviewed items in the agreement which had been discussed at a
workshop with MN/DOT prior to the meeting, and expressed their concerns
and objections relating to the agreement. Council inquired if the bid for
the proposed new water service on the west side of Snelling is exorb it an t,and the city decides to delete that portion of the project, would the Citybeexpectedtopayforadministrativecosts. Robert Cartford, MN/DOT
engineer replied in the negative. Following a lengthy discussion Council
agreed the following contingencies be added to the agreement: (1)
willingness clause be changed to reflect that the City sees no benefit
from upgrading the storm sewer north of Larpenteur on Minnesota State
Highway 51, but as a sign of good faith will cooperate up to 50 percent of
the present ascribed cost of $41,464, (2) State will retain ownership and
maintain the storm sewer on Minnesota State Highway 51, (3) State is
responsible for all landscaping or restoration costs, (4) City considers
at minimum that MN/'DOT will make a significant effort to enact changesdetailedintheletterdatedFebruary1, 1987 to Terry Maurer, Maier,Stewart and Associates, from Robert H. Cartford, Assistant District
Engineer, Minnesota department of Transportation, and letter dated January28, 1987 from Bob Cihlar of St. Paul Water Department, and City retains
the right to contest any costs for adjustment of existing water utilities,and (5) State will agree to payment schedule outlined by MN/DOT.

JOHN CARNES, 1775 SNELLING, was pleased to hear of the contingencies to
keep costs down, and asked if there would be any direct costs to property
owners on Snelling Avenue. Baldwin explained there would be no direct
charges to residents for Snelling Avenue construction, however, there
possibly will be some charges connected with the proposed new watermain,
and those costs will be discussed at a public hearing.
GLEN OLSON, 1780 SNELLING, asked if residents would be forewarned prior to
work being done, and reported when landscaping was done last fall, the
lawn at 1770 Snelling was damaged. Cartford assured the project engineer
will keep the City and residents appraised of work scheduling, and the
damage to the lawn will be reported.
SNELLING AVENUE PLANS APPROVED
After Maurer assured he had no problems with the plans, Wallin moved,
seconded by Ciernia, adoption of Resolution R-87-9. Motion carried
unanimously.
RESOLUTION R-87-9
A RESOLUTION RELATING TO APPROVING THE PLANS FOR
SNELLING AVENUE IMPROVEMENTS, COMO AVENUE TO HIGHWAY 36
ENGINEER TO PREPARE PLANS FOR ARONA WATERMAIN - HOYT TO LARPENTEUR
Maurer presented possible locations for the proposed watermain as follows:
east right-of-way, which would be the least expensive, (approximately
8,000 less) but would require destroying 11 mature trees, the west
right-of-way, which would require major repair to the street/curb and
gutter, and middle of the street, also requiring street repair. Also
noted was the City Horticulturist's report that the mature trees could
have a life expectancy of 30 years. Council discussed the matter and
concurred it would be advisable to preserve the trees as they do add to
the appearance of the community and increase property values. Chenoweth
moved, seconded by Wallin, that the watermain be placed in the street and
the shade trees be preserved. Motion carried unanimously. Barnes will
pursue possible grants for this project and the Snelling Avenue project.

Schroeder briefly reviewed changes in the latest draft of the proposed
ordinance after which Hard presented changes requested by the Human Rights
Commission. This item was discontinued to allow for the scheduled 7:15
P.M. public hearing.
7:15 P.M. - PUBLIC HEARING ON SNELLING AVENUE WATERMAIN IMPROVEMENT
GARDEN TO CRAWFORD)
Baldwin opened the hearing at 7:15 P.M. and presented the Affidavit of
Publication. Maurer explained the improvement will provide water service
to five homes and fire hydrants on the west side of Snelling, and
commented on the estimated assessment, $2,750 per lot.
JOHN CROWLEY, 1769 N. SNELLING, stated when he purchased their lot the
contractor was told there was no water service, so a well was installed at
a cost of $5,000, and he has now been informed the contractor working on
Snelling Avenue found an existing line. He felt it unfair to be required
to pay an assessment for a water service when it was already in place and
Council concurred. Council commented on the fact that they recently
learned the John Carnes property at 1775 Snelling already has water
service and cannot be included in the assessment.
STANLEY STROMMER, 1729 SNELLING, was of the opinion Hermes Center should
also be assessed and commented on the fact that at a previous meeting
Council had indicated there would be no assessments. He felt he would not
benefit because he did not want city water. Baldwin explained making the
service available will benefit the property even though Mr. Strommer does
not desire to use the service at present and stressed that Council had
informed residents there would be no assessments for the state project but
the city project will be assessed. Council also explained that this was
the only area in the city without water service and it was prudent to
install the watermain in conjunction with the Snelling reconstruction
project.

ROSE WITCHER, 1757 SNELLING, did not feel there was any benefit if she did
not use the system.
Mr. Strommer again asked why Hermes Center was not being assessed and
Baldwin replied if the northernmost lot ever becomes a separate distinct
property they could be assessed. Baldwin stressed that assessing the
Hermes property would not decrease the amount of assessment to each
property owner and explained the city is already paying a large share of
the project cost.
Council discussed payment options for the $2,750 per property assessment,
such as assessing $2,000 with a $750.00 charge at time of connection, or
allowing the entire $2,750 be assessed to property owners who wish to
connect to the system immediately. There being no others wishing to be
heard, Baldwin closed the hearing at 7:57 P.M.
Chenoweth moved, seconded by Hard, approval of Resolution R-87-13. Motion
carried unanimously.

SNELLING AVENUE CONTRACTOR GRANTED PERMISSION FOR POSSIBLE NIGHT TIME WORK
Arnie Laingen, Concrete Division Engineer for Progressive Contrctors,
Inc., presented his request for a variance to the 6:00 A.M. to 10:00 P.M.
construction hours approved by Council previously, and explained the
timing of the sawing of the concrete must wait until the concrete is hard
enough to run the saw on, but not so long that cracking can start: This
could be any hour of the day or night depending upon the temperature and
humidity. He also stressed it will not be an excessive noise and compared
it to the sound of a semi truck passing on the street. Chenoweth moved,
seconded by Wallin, granting the variance. Motion carried unanimously.
CONTINUATION OF CONTRACT COMPLIANCE DISCUSSION
Hard explained the Human Rights Commission recommended Council include the
sexual preference category in the ordinance (which had been deleted by
Council at a previous meeting). Council did not feel it appropriate to
add the classification as it is not at present a part of State Statute,
concurred the ordinance should follow State Statute, and suggested the
Human Rights Commission lobby the Legislature for addition of that
category to the Statute. Following the discussion Hard moved, seconded byCiernia, adoption of Ordinance 0-87-4, with recommended changes. Motion
carried unanimously.

INTRODUCTION
This feasibility study was authorized by the Falcon Heights CityCouncilonMarch11, 1987. This report analyzes the feasibility of con-
structing watermain improvements along Snelling Avenue in conjunction withthe ,Minnesota Department of Transportation reconstruction of T. H. 51.
PROPOSED IMPROVEMENTS
As part of MnDOT project reconstructing Snelling Avenue, the City ofFalconHeightsrequestedwatermainimprovements. These watermain improve-ments will provide approximately 1000 linear feet of six inch diameter alongthewesterlyfrontageroadbeginningatthenorthendoftheFalconCenterandterminatingGardenStreet. Connection to the existing water system willbemadeateachendthusprovidingaloopedsystem. The proposed improve-ments are shown on Exhibit 1.
The proposed improvements will provide service to six homes currentlynotservedbyCitywater. A one inch service line will be extended to the
property line of each home.
All construction would be accomplished in accordance with the St. PaulWaterUtilitycriteria.
COSTS
The MnDOT project which included these improvements had bids opened on
February 13, 1987 and the contract was awarded to Progressive Contractors,Inc. The construction cost, based on their bid is shown in the followingtable. To the constructon cost MnCOT overhead must be added which covers
engineering, mobilization, field office, field laboratory, haul roads andtrafficcontrol. Also added were estimated amounts for City costs
associated with inspection and initial design.

In October, 1983 a letter was written by the former City Engineerdiscussingtheseimprovements, a copy of which is appended to this report.The estimated project cost at that time was estimated to be $36,600. TwofundingoptionsweredetailedintheletterwhichproposedtheCitypay35or50% of the cost with the remainder being assessed to the six benefitedproperties.

Recently there has been some discussion of a 25%/75% split of the costbetweenassessmentandhookupcharge. Based on the project cost of536,438.19 and no City participation, this would result in an assessment ofapproximately $1520 and a hookup charge of approximately $4555. This issubstaintiallyhigherthanmosttypicalhookupcharges. Perhaps some com-bination of assessment, hookup charge and City participation would be more
appropriate.
CONCLUSION
This estimated total project cost is $36,438.19. From an engineeringstandpoint, the proposed improvements are feasible.

This project consists of the installation of approximately 1000 feet of 6 inch
watermain on the west frontage road of Snelling Avenue. The watermain would
run from the north end of the Falcon Center to Garden Street. 1 inch service
stubs would be extended to the property line of the five homes currently not
served by City water. The proposed improvements and the estimated total
project costs are shown on the two attached exhibits.
The City Council has previously discussed funding of the improvements. The con-
sensus was a reasonable cost per home would be $2,750. One option discussed
was a $2,000 assessment and a $750 hookup charge. The reaminder of the total
project cost would be paid by the City.

were included in Agreement No. 63866 and should now be deleted
since they are County Roads; and
WHEREAS significant City cost supplemental sanitary sewer and
water main construction has been performed in connection with the
construction of Trunk Highway No. 51 (Snelling Avenue) and should
now be added to the City's cost share so that the amount advanced
by the City more accurately represents their total cost share.
IT IS THEREFORE, MUTUALLY AGREED AS FOLLOWS:
ARTICLE I - AMENDMENT OF ARTICLE II OF AGREEMENT N0. 63866
The City Cost Participation Construction description under
Article II, Section A. of Agreement No. 63866 dated March 10,
1987 is hereby amended and modified to read as follows:
CITY COST PARTICIPATION CONSTRUCTION
All of the following construction to be performed upon, along and
adjacent to Trunk Highway No. 51 (Snelling Avenue) from Engineer
Station N.B. 239+51.696 (Hoyt Avenue) to Engineer. Station N.B.
279+46.16 (Roselawn Avenue) within the corporate city limits
under State Projects No. 6216-91 (T.H. 51=125) and No. 6216-100
T.H. 51=125).
100 PERCENT shall be the City's rate of cost participation in all
of the City owned sanitary sewer and water main facilities

construction, except for the adjustment of valve boxes and frame
and ring castings covered below under "40 Percent" and "9.3
Percent".
100 PERCENT minus all anticipated Federal-aid funding shall be
the City's rate of cost participation in all of the following
construction to be performed along and adjacent to the Trunk
Highway No. 51 (Snelling Avenue) roadway from Engineer Station
N.B. 239+51.696 (Hoyt Avenue) on the east side of the roadway and
from Engineer Station N.B. 246+00 (a point approximately 175 feet
south of Hollywood Court) on the west side of the roadway to
Engineer Station N.B. 260+00 (a point approximately 350 feet
north of Crawford Street) under State Project No. 6216-100 (T.H.
51=125):

construction includes, but is not limited to, removal of curb and
gutter, sawing bituminous pavement, granular borrow, bituminous
surfacing and concrete curb and gutter.
40 PERCENT minus all anticipated Federal-aid funding shall be the
City's rate of cost participation in all of the following
construction to be performed along and adjacent to the Trunk
Highway No. 51 (Snelling Avenue) roadway from Engineer Station
N.B. 239+51.696 (Hoyt Avenue) on the east side of the roadway and
from Engineer Station N.B. 246+00 (a point approximately 175 feet

23.26 PERCENT shall be the City's rate of cost participation in
all of the following construction to be performed under State
Project No. 6216-91 (T.H. 51=125):
1. All of the construction of concrete walk including its
aggregate base and all of the construction of concrete and
bituminous driveways including their aggregate base and the
removal of pipe culvert therefor to be performed along the west
side of the Trunk Highway No. 51 (Snelling Avenue) West Frontage
Road roadway and along the east side of the Trunk Highway No. 51
Snelling_Avenue) East Frontage Road roadway.
2. Except for excavation, all of the construction to be
performed upon and within the Ruggles Avenue approach to Trunk
Highway No. 51 (Snelling Avenue) East Frontage Road. Said
construction includes, but is not limited to, sawing bituminous

pavement, granular borrow, bituminous surfacing, concrete curb
and gutter and curb ramps.
19.8 PERCENT of 50 PERCENT minus all anticipated Federal-aid
funding shall be the City's rate of cost participation in all of
the cooperative joint-use storm sewer facilities construction as
shown and/or described in "Red" color on the attached EXHIBIT
A„,
9.3 PERCENT shall be the City's rate of cost participation in all
of the following construction to be performed under State Project
No. 6216-91 (T.H. 51=125):
1. Except for excavation and removal of pavement, all of the
construction to be performed upon and within the Falcon Center
Crossover and Garden Avenue approaches to Trunk Highway No. 51
Snelling Avenue). Said construction includes, but is not
limited to, miscellaneous removals, sawing bituminous pavement,
granular borrow, bituminous surfacing, concrete curb and gutter
and curb ramps.
2. All of the sodding including its topsoil borrow to be
performed along the west side of the Trunk Highway No. 51
Snelling Avenue) West Frontage Road roadway and along the east

Road roadway.
3. All of the adjustments of City owned sanitary sewer and
water main facilities.
7.6 PERCENT minus all anticipated Federal-aid funding shall be
the City's rate of cost participation in all of the cooperative
joint-use storm sewer facilities construction as shown and/or
described in "Brown" color on the attached EXHIBIT "A".
4.7 PERCENT of 50 PERCENT shall be the City's rate of cost
participation in all of the cooperative joint-use storm sewer
facilities construction as shown and/or described in "Blue"
color on the attached EXHIBIT "A".
4.1 PERCENT of 50 PERCENT shall be the City's rate of cost
participation in all of the cooperative joint-use storm sewer
facilities construction as shown and/or described in "Pink" color
on the attached EXHIBIT "A".
ARTICLE II - AMENDMENT OF ARTICLE III OF AGREEMENT NO. 63866
Article III,- Section A. of Agreement No. 63866 dated March 10,
1987 is hereby amended and modified to read as follows:

It is estimated that the City's share of the costs of the
contract construction plus the construction engineering cost
share is the sum of $133,826.61 as shown in the attached SCHEDULE
I". Upon award of the construction contract the State shall
prepare a revised SCHEDULE "I" based on construction contract
unit prices and shall submit a copy of the revised SCHEDULE "I"
to the City. The City shall advance to the Commissioner of
Transportation the City's total estimated cost share as shown in
the revised SCHEDULE "I" be it more or less than the sum of
133,826.61 in accordance with the following advancement
schedule.
CITY COST SHARE ADVANCEMENT SCHEDULE
First Payment: Upon execution of this agreement and upon receipt
of a request from the State for such advancement of funds, the
City shall advance to the Commissioner of Transportation an
amount equal to the City's total cost share of the new water main
facilities construction as set, forth in the revised SCHEDULE "I".
Second Payment: On or before July 15, 1990, the City shall
advance to the Commissioner of Transportation an amount equal to
50 percent of that amount of the City's total cost share as set
forth in the revised SCHEDULE "I" which has not been advanced by
the City.

Third Payment: On or before July 15, 1991, the City shall
advance to the Commissioner of Transportation an amount equal to
the City's total cost share as set forth in the revised SCHEDULE
I", or the final SCHEDULE "I" if available, less the total of
all funds previously advanced by the City.
ARTICLE III - AMENDMENT OF ARTICLE IV OF AGREEMENT N0. 63866
The first paragraph of Article IV, Section D. of Agreement No.
63866 dated March 10, 1987 is hereby amended and modified to read
as follows:
It is hereby understood and agreed that, upon the satisfactory
completion of State Projects No. 6216-91 (T.H. 51=125) and No.
6216-100 (T.H. 51=125) construction, the City shall thereafter
provide for the proper maintenance, without cost or expense to
the State, of all of the City owned utility facilities
constructed within the corporate City limits under said state
projects and that neither party to this agreement shall drain any
additional drainage into the storm sewer facilities constructed
within the corporate City limits under said state projects that
is not included in the drainage for which said storm sewer
facilities were designed without first obtaining permission to do
so from the other party.

ARTICLE IV - AGREEMENT NO. 63866
Except as amended and modified herein, all of the terms and
conditions set forth in Agreement No. 63866 dated March 10, 1987
shall remain in full force and effect.

In preparing this five year program, I used the City's Street and Alley
Evaluation from August 1988, and the City's 5 year construction program for
the Municipal State Aid System. I also used Ramsey County's Capital
Improvement Program and tried to incorporate scheduled County projects.
The program not only lists-improvement projects, but attempts to list
their cost versus estimated assessments based on the City's Assessment

pregram for inflation, which would also increase the surplusishortfall
column.
You will note that in the first year, I have shown reconstruction of Albert
from Larpenteur to Garden. There are several reasons for this., They are as
follows:
1. It is shown to be in poor condition in the Street and Alley Evaluation.
2. It is the first project listed on the Municipal State Aid 5 year
Construction Program.
