REGULAR MEETING OF ~A~ARCH 11, 19bl~
The regular meeting was called to order at 7:00 P.M, with the following members
presents T~ayor Harold C. Nilsen; Clerk W,A, Mortenson; Trustees Willis
Warkentien, Charles Stone, and William Black, Also present were Treasurer
;'Villiam E, Olsen, Engineer Bradford Lemberg, and Deputy Clerk Tina Vavoulis.
Black moved, seconded by Mortenson that the minutes of the meeting of February
2b be approved, Motion carried.
Mrs. Ernest Rinke of the League of Women Voters was present.
Correspondence -
County Assessors Invitation to attend annual instructional meeting
for local board members and assessors on Wednesday,
March 18, 196l~ was read.
Snelling-Comp Letter was read from the Department of Highrays, signed
Avenues Grade by the District Engineer and enclosed sheets of plans
Separations for the Grade Separation Project -Snelling and, Como
Avenues-covering portion of Falcon Heights through the
southeast corner of the fair grounds,
E. J. Pennig - Letter was read from Mr, Pennig who lives at 1795 North
Condition of streets: Fry Street regarding construction treatment of utility
cuts in the streets to avoid conditions of mud and dust
on the streets.
Application for Conditi onal
Use Permit - Proposed Frank Frazer, owner of the Falcon Heights Hardware
~3arden Supply Centers Store, was present regarding the garden supply center
he would. like to build, as set forth in the conditional
use permit application form submitted.. Such proposed
center is to be located in the vacant lot known as
Falcon Heights Bank property adjacent to Webers Cafe.
Warkentien moved that the Conditional Use Application
be referred to the Zoning Administrator and the Planning
Commission for their recommendations. Mr. Frazer will
provide proper plot plans and details to the Planning
Commission, along with proposed parking plan and traffic
movement. Motion was seconded by Stone, and upon a vote
being taken, motion was carried.
Falcon Heights Mr. Frazer advised the Council that this Association has
Businessments been re-organized and has held several meetings. One of
Associations the purposes of the organization, he stated, is to improve
the business section.
Treess On motion by Stone, seconded by Black, the follcn+:ing
Resolution was adopted by the Councils
WHEREAS the special tree consultant to the Village
of Falcon Heights, Dr. C, Gustav Hard, has advised the
Village Council that certain tree diseases, including
dutch elm disease, have manifested themselves in the
metropolitan area, and
Z"JHEREAS, Dr. Hard has inspected the trees growing in
the Village of Falcon Heights, and

WHEREAS Dr. Hard has recommended to the Village
Council that it is necessary to promptly trim, repair,
and remove certain trees growing in the Village of
Falcon Heights to forestall the spread of tree diseases
Trees including dutch elm disease in the Village
NOW, THEREFORE, BE IT RESOLVED by the Village Council
of the Village of Falcon Heights, that contract in the
form of a letter attached to these minutes be entered into
with Roland B. Ford and Northland Tree Service.
Adopted this 11th day of March 196l~.
Dog Control: It was moved by Mortenson, seconded by Nilsen that the,
Village adopt the following resolution regarding the
keeping of dogs within the Village:
WHEREAS, the Village of Falcon Heights has adopted an
ordinance, the Registering and Regulating the Keeping of
Dogs - Ordinance No. 39, adopted in said Village April 11,
1956, and
WHEREAS under the provisions of Section 1!~ of said
Ordinance, the Falcon Heights Village Council is authorized
to enact a resolution prohibiting for a given time any and
all dogs from running a,t large in the Village
NOV1, THEREFORE, BE IT RESOLVED that any and all dogs
are prohibited from running at large in the Village of
Falcon Heights from April lst to September 30th, inclusive.
A dog is deemed "at large" whenever it is off the
property of his owner or keeper and not under restraint.
Such dog shall be deemed under restraint only when it is
controlled by a leash not exceeding six feet in length,
or it is at "heel" beside a competent person having
custody of him and. obedient to that person's commands,
or within a vehicle being driven or pushed on a public
street within the property limits of his owneris premises.
An unattended dog on the property of another, without the
consent of such property owner is "at large' and not under
restraint even though he is on a leash. The motion was
carried and the foregoing Resolution was adopted this
11th day of March, 196l~.
A copy of Resolution shall be sent to the Ramsey County
Suburban Life Newspaper, the Minneapolis Star Tribune, and
the St. Paul Dispatch and Pioneer Press.
Fry Street ~No Tt was agreed that for the time being, and due to conditions

removed from -the street in front of 1725 North Fry and
further north on that street.
Planning Commission At 8;00 P.M. Wednesday, April lst, the Planning Comm'ssion
Meeting: will meet to discuss problems of land use, grade separation
etc. Dean Sherwood 0. Berg, of the Institute of Agriculture
and ~fT, Hueg, Asst. Director of Agricultural Experiment
Station, and John Libby Secretary-General Manager of
the State Fair Grounds will be present.

Engineer Lembergs
Playgrounds William Rorstad, chairman of Citizens Recreational
Advisory Committee, has given a proposed playground
map to the Engineer for his review.
Storm Sewer - Suggested possibility of running storm sewer down
Albert Street: Albert from Larpenteur Avenue to California with catch
basins on all four corners - estimated cost based on
current prices $l~,026. Discussion was held,
Autumn & Prior On Autumn and Prior the streets are choppy and in
Streetst generally bad condition, Engineer suggests bituminous
curbing and repair of streets. Discussion was held and
matter tabled until such time as petition is submitted,
ThePolice Department- Warkentien gave sumanary of violations during the month of
Activitys February, He also reported on results of timers that had
bean laid on Larpenteur and Fairview Avenues this week.
Vacations: Motion made by Warkentien that the present police and. fire
department employees and all present salaried employees
be placed on a calendar ~~.r basis as far as eligibility for
cations is concerned - this to be effective as of January
1, l96?~. Motion seconded by Black and upon a vote being
taken thereon, the motion was carried.
Change of Venue: It was sugg~:sted that when the court rules in favor of the
defendant and against the plaintiff (Village of Falcon
Court cases Heights) on cases where change of venue has been requested,
that the attorney representing this Village make note ,of
his observations in court and make sugges Lions to the
Police Commissioner for possible improvements or changes
in their procedure.

The Village Council of the Village of Falcon Heights, at its meeting of
March 11, 196lt authorized the Northland Tree Servic®, Inc. to do the folloRing
work in the Village of Falcon Heights under the supervision of Harlow N. Hubers
1. Trim 1a, trees on Hoyt Avenue and 5~. trees on Iowa Avenue as listed on
attached sheets and one on California Avenue at no charge for the
latter. In addition there is one to be cabled, one to be bolted, and
tWQ to be topped as specified.

2. The unit price per tree to be trimmed is ~7.0.5C and the total price
of the work to be done is $997.5C.
3. All work is to be done according to the specifications of Dr. C~
Cn~stav Hard, and subject to the inspection and approval of Dr. C.
Gustav Hard or the Village Engineer.
!t. The work to be done by Northland Tree Service is further conditioned as
followss
(a) A duplicate copy or certificate of your public liability insurance
insuring your activity is to be filed with the Village Clerk, and
kept in force and effect during the duration of this contract.
(b) All work is to be done in a workmanlike manner in accordance with
the specifications therein.
(c) Northland Tree Service agrees to indemnify the Village of Falcon
Heights against any and all claims whatsoever that may arise out
of its activities under the terms of this contract.
(d) The Village of Falcon Heights agrees to pay 1aad Tree Service
each two weeks for the work completed through each pay period, such
payment to be authorized. by inspections to be performed by Dr. C.
Gustav Hard, the Village Engineer, or any other duly appointed and
authorized Village officer.

(e) All brush, slash, and debris w311 be removed from the boulevards
in area of work each Friday by Northland Tree Service.
(f) All mayor cuts will be painted wherever reasonable and aecessable
with an approved dressing. St is agreed that a mayor cut shall be
one that is two inch®s in diamet®r or larger.

1. Raise all trees that overhang the street six to 16 feet clearance.
2. Remove all dead or dy%.ng branches,
3. Sucker growth on the central trunk and principal. branches off the central trunk
shall be cleared. to a hieght of 18 feet from the ground line. The shape and
form o f the tree must be kept in mind as sucker growth is removed. Newly planted
trees and trees which are undersized would be excluded from the 18 foot ground line
stipul ation. It is anticipated that those trees excluded will be given needed
sucker removal and attention will be given to structural development.
4. Where a tree is structurally weak, trimming to reduce excessive weight stress will
be done.
5. All cuts over two inches will be painted with an approved wound dressing.
6. The contractor will report scale or bark beetles feeding; disease, and will, record
those trees which need bracing or cabling. ~,
7. Trees that are in poor condition should be brought to the attention of the Villag ',
8. Where trees are removed, they shall be cut to gr ound line so`that a lawn mower ma,
readil y pass over the remaining stump.

(~) The trimming of the trees sha11 include removal of dead good,
suckers, weak and broken limbs, and weak crotches as specified.

(h) The work will be commenced upon acceptance of this agreement by
the Village of Falcon Heights and completed with all convenient~~;peed..:.
(i) Az~y and all lam damage wi1.1 be repaired at the sole expense of
Nort~il.and Tree Service in a workmanlike manner using good quality
materials. Any such lasm damage shall be inspected by Dr. C.
Civstav Hard, the Village Engineer, or air other duly authorized
qualified Village official.

5. This agreeffient shall become effective upon the acceptance by the Mayor
and Clerk of the Village of Falcon Heights.
6. Upon execution by an officer of the Northland Tree Service, the same shall
be transm3.tted to the office of the Village Attorney, H. J. Galvin, Jr.,
West 2162 First National Bank Building, Saint Paul, Minnesota.
