REGULAR MEETING OF P,~IARCH 25, 196l~
The meeting was called to order at 7x00 P.M. with the following members
present: Mayor Harold. C. Nilsen;. Clerk W.A~ Mortenson; Trustees Willis
Warkentien, Charles Stone, and William Black. Also present were Engineer
Brad Lemberg, Attorney Michael Galvin, and Deputy Clerk Tina Vavoulis.
P~Irs. Lois Edwards was present for the League of Women Voters. Miss Lois
Holtz of the Ramsey County Suburban Life Newspaper was also present.
Black moved, seconded by Stone that the minutes of the special hearing of
March ~.I.th, 196l~ be approved. Carried.
Mortenson moved, seconded by Warkentien that the minutes of the regular meeting
of March 11th, 1961 be approved. Carried.
Proposed Garden Supply Black moved the adoption of the following Resolution:

RESOLUTION APPROVING PLAN FOR CONSTRUCTION
OF GARDEN SUPPLY CEPITER AND CONDITIONAL
USE PERP~4IT FOR FRANK FRAZER
WHEREAS, on March 11, 196I~ 14~r. Frank Frazer
of the Falcon Heights Hardware Store applied for
a conditional use permit under the provisions of
Section 16.5 of Ordinance b4 of the Village of
Falcon Heights, in order to construct a garden
supply center, and
WHEREAS, said application for conditional use
permit has been referred to the Planning Commission
of said Village, and said permit has been approved
by said Planning Commission conditioned as set forth
below, and
tiN~iEREAS, the proposed use will not be detrimental
to the health and safety or general welfare of the
community nor vrill cause serious traffic congestion nor
hazards nor vri11 seriously depreciate surrounding
property values and that the same is in harmony with
the general purpose and intent of the ordinance in the
comprehensive plan,
NCNB, THEREFORE, BE IT RESOLVED BY THE VILLAGE
C0UNCIZ OF FALCON HEIGHTS, MINNESOTA
1. Said plat plan, a copy of which is on file
with the Clerk of the Village of Falcon Heights, is
hereby approved as modified on March 25, 1964.
2. Said conditional use permit is conditionally
approved subject to the following conditions created
by the Planning Commission of the Village of Falcon
Heights, and concurred in by the Village Council:
(a) Side yard set back of ten feet; rear
yard set back of twenty feet to conform with
Village Ordinance.

(b) Provide proper control of traffic in and
out; provide proper control of dust by surfacing drive-
ways a,nd parking space with a material to control dust,
Proposed Garden subject to the approval of the Village Council.
Supply Center:
3, Final approval of the plans, including those
modifications recommended by the Village Council to be given
by the Village ~%ngineer.
4. The applicant must apply fora building permit
as requited under the provisions of Ordinance No. 3 of the
Village of Falcon Heights, as amended, anal said plans
submitted to the Zoning Administrator and Building
Inspector for issuance of said permit, must reflect the
written approval of the Village Consulting Engineer.

The above motion was seconded by Stone, and upon a vote
being taken thereon, the Resolution was adopted by the
Council this 25th day of lt4arch, 1964.
Shell Service Station Mr. Donald Johnston was present upon request of the
Trailers for Rent: Council and advised that the three trailers on his lot were
not for sale or rent, but are merely parked there for the
convenience of his customers. He has no trailers for rent
or sale at the present time. Mr. Wayne Parker of the
U-Haul Trailers was present and explained the operation of
trailer rentals. He requested permission to rent trailers
through the She11 Service Station. A conditional use
permit would have to be submitted. by parties involved,
and the Council would then refer same to the Planning
Commission for their consideration and recommendations,
before any further action can be taken. Johnston was so
informed.
Ray Schommer~s Display Mr. Schommer was present and after discussion regarding
Swimming Pool: the parking problem, he was advised that the members of the
Council do not object to his placing signs on the property
he is leasing for swimming pool display (and sub-leasing
for the garden supply center) to the effect that "Parking
for Customers Only" is al lowed.
Bethel College - George Tfsartens, builder, was present and submitted variance
Proposed Apartment permit for councilis approval. Variance is requested in
Building: the following areas:
1. Density wish to build for 11 units - 22 stories.
2. Waiver of minimum lot requirements -12,500 feet
is required and lot is 12,000 feet.
3. Side yard requirement.
4. 14 parking spaces provided for 11 units.
5. Attached plot plan desired.
6. Street access to parking lot.
Black moved, seconded by Nilsen that the application for
variance submitted by Bethel College for construction of
11 unit apartment building on Lot 7, Block 13 in Northome 3rd
Addition be referred to the Planning Commission for their
consideration and recommendation. Upon a vote being taken
thereon, this motion was carried.

Roberts Apartment Building- Mr. Andrew Hustrulid of 1805 No. Fairview was heard.
Complaint About Parking: regarding his complaint that cars are being parked
on the lawn and generally all over the grounds of
the Roberts Apartments.
Street Lighting: When asked about conditions of street lighting on Fairview
Avenue, Mr. Hustrulid believes the people on Fairview would
prefer not installing lights because of the poles that must
come grit h them.
Proposed Reciprocal Fire The following resolution was introduced by member Stone, who

Agreement has been presented to the Falcon Heights Volunteer
Department, and the Village of Falcon He~~~~or adoption,

WHEREAS, it appears that it is necessary in order to
proceed further that there must be additional discussions to
define the proposed agreement, and
WHEREAS, the proposal contained in said agreement is
meritorious, and would further fire protection in the Village
of Falcon Heights, and surrounding north suburban municipalities,
NO6'd, THEREFORE, BE TT RESOLVED by the Village Council
of the Vi7.lage of Falcon Heights that said Council approve
in principle the proposed Reciprocal Mutual Fire Service
Agreement among the North Suburban Communities and authorizes
representatives of the Village of Falcon Heights Fire Dept,
to conduct further discussion with other north suburban fire
departments in order to produce a workable agreement, which
will be acceptable to the Village of Falcon Heights.
Upon a second to the motion by Warkentien, and upon a vote
being taken thereon, the resolution was unanimously adopted.
Fire Department - Al Helbig, Fire Chief, advised the council that Gordon
Tank Truck: Nelson of the Volunteer Fire Department, had spent
approximately twenty hours repairing the tank truck in
order to make it ready for sale.

V'~IEREAS, pursuant to a resolution passed by the Council

prepared plans and specifications for the improvement of
California Avenue between the west line of Hamline Avenue
and the East line of Pascal Avenue by construction of curbs
and gutters aid has presented such plans and specifications
to the council for approval.;

that no bids will be considered unless sealed and filed
with the clerk and accompanied by a cash deposit, cashier's
check, bid bond or certified check payable to the clerk
for 5 per cent of the amount of such bid.
The motion for the adoption of the foregoing resolution
was introduced by Stone, seconded by Black, and upon a
vote being taken thereon, the following voted in favor
thereof: Nilsen, ~Iortenson, Warkentien, Stone, and Black:
and the following voted against the same: None.
Said resolution was duly declared passed and adopted this

to the council far approval,

improvements authorized by the Village Gouncil under this
date,

OF FALCON HEIGHTS, that the Village Engineers be authorized
to handle said maintenance and repair of Autumn Avenue as
an addition to any of the bids as a part of the 1963

Sweeping of Village Stone moved that the Village Engineer be instructed to
Streets - 1961: negotiate for the best possible price for sweeping of
streets in the Village when it is f easible to do the Sob.
The maximum cost is not to exceed $990. Black seconded
the motion, and it was duly carried.
Technical Committee - Otto Bonestroo, consulting engineer, advised he has: been
Rate Study on Sanitary attending meetings of this committee, representing Falcon
Sewers: Heights. One of the purposes of the study is to analyze
the entire bookkeeping system of the City of 5t. Paul with
regard to sanitary sewers. (Under the Ashbach Bill, the
City of Saint Paul is not entitled to any profit from
operation of the sanitary sewer system.) The Village of
Falcon Heights, if it so desires, may contribute funds
toward this study, but is not compelled to do so.
Hermes Floral Company - Lembergis letter of T.Zarch 13 was read in which Engineer
Sewer rental rates recommends that a one inch meter be installed on the line
serving sanitary facilities at Hermes Floral Company and
this be used as basis for sewer charges. They have a
large size water meter and a high consumption of water,
but most of the water is used for watering plants and
flowers. Warkentien moved, Mortenson seconded that the
matter of changing the water meter at the greenhouse be
approved and the City of Saint Paul Water Department be
notified of wane. Motion carried.
Archery Ranges: Black stated that archery ranges had been proposed, and
after discussion, it appeared that there is no suitable
location in this Village.
Right of Way Nilsen advised he had inquiry from Mr. Rydell, homeowner
Acquisitions - at 1860 No. Snelling Avenue regarding righ~Fr-of-way
Highway Department: acquisitions of property. He read from letter of the
Highway Department of February 4th, 196It which states

of the Village of Falcon Heights by the construction of
curbs and gutters on Iowa Avenue, and
VdHEREAS, upon re-checking the list of such unpaid
assessments, it was found that the owner of the above
property, E. W. Mitsch of 1l~81 W„ Iowa Avenue, had paid
to the Village Clerk on February 16, 1963 an amount of
X125.00 in payment of said improvement,
NOW, THEREFORE, BE IT RESOLVED DY THE VILLAGE COUNCIL
OF THE VILLAGE OF r'ALCON HEIGHTS:
1. That assessment levied against property located
at Pdorthome 2nd Addition, Lot 8, Block 11, Sec. 22 be
removed from the assessment roll which was certified to
the County Auditor under date of July 10, 1963.
2. That the Village Attorney will take the
necessary steps to correct.

Galvin recommended that inasmuch as the Planning Commission
has scheduled a meeting for April 1st, they could come to
a decision for arranging for public hearing on Proposed
Amendment to Ordinance No. 6~., at that meeting. Attorney
Galvin will supply the Commission with suggested dates for
such hearing.
Proposed Subdivision Black advised that Planning Commission has made a few
Ordinance No. 69: modifications and changes in the Proposed Subdivision
Ordinance and with modifications and changes, approved
of Proposed Subdivision Ordinance. Attorney wi11 review
and present same for recommendation at the next meeting
of the Village Council.

Falcon Heights Cities Clerk was iz1structed to send letter to Robert Leonard,
Service Station: owner of this service station to appear before the
Council at its next meeting, at 9:00 P. M. to show cause
why his license No, 110 to display and sell motor
fuels should not be revoked for violation of the
following:
1. Showing in excess of four (~) used cars for sale.
2. Display of unauthorized banners and signs.
