Public Works Truck The Ford Company has determined that they have "fixed" the truck contrarytocitystaff's opinion. (See attached chronology prepared by Al Rolek.) Animal Control The University of Minnesota may be interested in working out a cooperative arrangement for animal control on the Falcon Heights Campus. Staff is discussing this possibility. Tree Removal Contract Staff is preparing bid specifications which will be brought to the Council for approval at the next meeting, February 9th. Spiegler Apartment (Gregory Dispute) The City has received communication from the Gregory's at 1687 West Larpenteur requesting the City to intercede in a dispute with the neighboring apartment complex. It appears that there are no code violations. They have been referred to the Dispute Resolution Center and/or Conciliation Court by staff. (See attached letter.) I told him that if the truck could not be repaired another solution would have to be found, to which he replied that hs agreed. 3/88 - Bob Carter called and said he had spoken with a representative in Det~rborne, MI and has a Systems Balance Drive Shaft an order which should arrive in 1 week ar less. H• said he would call me when it arrives and is in place. I again reminded him of our dissatisfaction and that if this does not work we would want a new truck along with other considerations. He agreed that something would have to be donee although he didn't commit himself. 1/13/88 - I called Bab Carter on the progress an our truck. Mr. Carter was out sa I spoke with his Service Manager, Jerry Bauer. He said the drive shaft had not yet arrived - they had received one but it wars the wrong one and they had to reorder. I left a message far Bob Carter to ca 11 me. 1/14/68 - Bob Carter called and said they had gotten the drive shaft and installed it and that they had yet to test drive it. I spoke with him again later that day and he seemed to think that the problem had been solved. I informed Vince that the truck was ready and he should test it as soon as passible. 1/19/88 - Vince and Jay drove the truck and determined that, while there was much improvement, there is still a perceivable vibration in the vehicle. I informed Bob Carter of this and that we would not accept the vehicle in this condition. I again stated our demand far a new truck and other considerations and Mr. Carter said hs would inform the Ford representative. 1/20/88 - Jerry Bauer, Service Manager far Bob Carter Ford called and said that Randy Frick of the Ford Zane Office had driven the truck and pronounced it acceptable. I restated to Mr. Bauer that Vince and Jay had driven the truck and found it unacceptable and asked that Mr. Frick contact me or our attorney. 1/21/88 - I received a call from a person stating that Mr. Frick had driven the true that they were going to doss the file on find the solution acceptable and that the requested that Mr. Frick call and talk to would be closed at this time. at Ford Parts 8~ Service Center k and found it acceptable and our case. I told her we did not file should remain open. I me. She again said the file 1/22/88 - I talked with Beth Graver of Tom C~edde's office and informed her of the conversation of 1/21/88. She said she would contact the Ford Parts and Service Office. f 1/25!88 - Beth Graver informed me she had contacted the Fard Office andencounteredthesameattitudeIhad. She suggested we come up with athirdpartywhocoulddrivethetrucktoeithersubstantiatearrefute ourclaim. 1/26/88 - I received a call from Randy Frick. He told me he believes thetruckisfixedandacceptable. He also thinks that Vince and Jay are sotunedintothevibrationthattheymaybefeelingoneeventhoughitsgone. In other wards, they are expecting the truck to ride like a car. ItoldhimofBethGrower's third party suggestion and he said that I shouldbethethirdparty. I stated that my inexperience with trucks would be aproblemandthatanotherpartywhoworkswithanddrivestruckswouldbeabetterchoice. He told me that we should do what we had to and contacthimifwehadanyfurtherproblems. We are at a stalemate in this matter. The Leman Law does not cover oursituationasitonlyappliestopassengervehicles. I have talked to bothTamGeddeandBethGraverseveraltimesoverthelastfewweeksandhavesentthemthewarrantybookforthetruck. Liberty Bank Building 176 North Snelling Ave. St. Paul, MN 55104 Dear Mr. Wilson: It is with increasing frustration that I must bring to your attention that, since my letter of January 6, 1988, my fence has again been damaged due to being hit by a vehicle from your Falcon Arms Apartments parking lot. This is the third instance of such damage. During our telephone conversation of January ~5, 1988, concerning damage to my fence on December 23, 1988, you indicated thot you had no responsibility for such damage, that your insurance carrier would laugh" at any claim submitted by you and that you had "r ore important things to do than worry about some broken boards." Permit me to bring to your attention the following: 1. That, as indicated in your original building permit, you were and are responsible for the construction of a barrier between our respective properties. 2. That, to accommodate you, I agreed to construct the fence one foot away from the concrete divider between your pa=king lot and my driveway as a means of avciding damage by your tenants. 3.~ Our agreement, a copy of which was provided to you with my letter of January 6, 1958, relative to damage to my fence. 4. That, because of this repeated damage to my fence, pour request that the fence be constructed as noted above, is no'_ sufficient to prevent continuing damage to my proper~y. Accordingly, inasmuch as the_e can be no question of your responsibility to prevent, insofar as possible, continuing and repeated damage to my property due to your commercial enterprise, I must insist that you accomplish the following as soon as possible: 1. Repair the damage to my fence. 2. He did inform Counoil he felt theyhadtwopossibleoptionsregardingadefault, 1) refuse to issueCertifioatesofCompletionontheezistingbuildsaleofthebuildings, and 2) Give the developersnotie~eithatothaththey~yareindefaultofthedevelopmentagreementandtakestestototheundevelopedportionsoPtheproperty. Gedde also commented thatltheamendmenttothedevelopmentagreementwhichCouncilhadbeenputoffbyStratfordpreviouslqapproved against National City B~, pending resolution of their legal action MINUTES JANUARY 13, 1988 PAGE 3 Council requested that Gedde give the Stratford problem top priority and he indicated he will meet with the Fiscal Consultant and Attorney for Stratford, and have pore information for the January 27th meeting. AMENDMENT OF DEVELOPMENT DEVELOPMENT DISTRICT #1 DEFERRED TO 1/27/88 Fiscal Consultant Steve Apfelbacher reviewed a January 11, 1988 report on tax increment projections (a Dopy of which is on Pile in the Clerk's Office) indioating that Stratford Office Park will not generate sufficient tax increment revenues to make the debt service paymentsin 1988-1989. He reoommended that the Council consider amending the Development Districts the three tax increment plans to allow the possible use of increments from from district to make debt service payments in another (Stratford Office Park). Council expressed ooncern that such an amendment might excuse Stratford's obligation to Dover 25x of a shortfall, and that it could delay possible early pay-off of the other distriots. Apfelbacher felt that Cuuneil should not delay a decision on the matter as possible changesinthelawmightprohibittheamendingofthedistrictsatslaterdate. He also stressed that the amendment would not require transfer of hinds Prom one district to another, but would give the City that option. Apfelbacher and Gedde will research the matter to determine whether or not the amendment would release Stratford from their shortfall responsibility. AMENDMENT OF SECTION 3-5.01 OF TH8 MUNICIPAL CODE RELATING TO FALSE ALARMS Council discussed the proposed amendment and concurred that based on the cost of dispatching personnel and afire truck on a false alarm call, the fire false alarm Pee should be increased considerably. After Council recommended a few changes in the document, Ciernia moved adoption of Ordinance #0-88-2 which carried unanimously. ORDINANCE 0-88-2 AN ORDINANCB AMENDING PART 5, SECTION 3-5.01 OF THE MUNICIPAL CODE RELATING TO FALSE ALARMS AMENDMENT OF SECTION 5-13.01 OF THE MUNICIPAL CODE RELATING TO LICENSE AND PERMIT FEES Wiessner recommended that the false alarm fee schedule become a part of the license and permit section of the code in order that all fees might be reviewed at the sane time, and would not require amending the false alarm section each time a fee change is instituted, as fees are aaended by resolution. Ciernia moved adoption of Ordinance#0-88-3 whioh carried unanimously. ORDINANCE 0-88-3 AN ORDINANCE AMENDING PART 13 OF THB MUNICIPAL CODE RELATING TO LICENSE AND PERMIT FEES APPROVAL OF ANIMAL CONTROL CONTRACT FOR 1988 Council approved an animal oontrol contract with the City of New Brighton,for the year 1988. MINUTES JANUARY 13, 1988 PAGE ~ SOLID WASTE COMMISSION TO BE APPOINTED Baldwin ezplained he Peels it is time to appoint a commission to continue the work started by the original Solid Waste Advisory Committee and he will meet with some of those persons to establish duties and determine the appropriate number of members for the commission. -- PART TIME RECREATION AND COMMUNITY SERVICE DIRECTOR TO BE HIRED Council reviewed the proposed fob description and recommendations on budgeting for the position. Bush ezplained that the Parks and Recreation Commission recommended that Recreation be added to the fob title and that two Commission Members, one Cable Access Member, the Community Sohool Coordinator, Council Liaison, and Clerk Administrator partieipate~in the interviews. Council agreed on the changes in the fob description and recommended changes in the 1988 budget.- The position will be advertised in the City Newsletter, local papers, and League of Cities Magazine. POLICY REGARDING RETIRED CITY EMPLOYEES PARTICIPATING IN HEALTH BENEFIT PROGRAM DEFERRED TO 1/27/88 Council briefly discussed the matter and requested Wiessner to contact Ramsey County (City employees are included in the County health plan) to see if rates charged the City will increase if retirees are allowed to continue or if there is an increased rate retirees could pay if allowed to continue. The matter will be discussed further at the January 27th meeting. WORESHOP SCHEDULED FOR 1/20/88 TO DISCUSS GORTNER/LARPENTEUR/PRIOR INTERSECTION Bngineer Terry Maurer presented plans prepared by the Ramsey CountyEngineersproposingvariousconfigurationstoremedythetraffichazard at the Gortner/Larpenteur/Prior intersection. We have assumed that the signal would be installed at Prior Avenue. We have also assumed that the signal would remain at Prior after the County's upgrading of Larpenteur Avenue. This means the equipment installed temporarily would be of permanent quality and would only require minor revisions when Larpenteur is upgraded. The estimated costs for this installation are as follows: Signal Equipment 583,000 Emergency Vehicle Pre-emption 7,800 Close Gortner Median 2,500 Estimated Total Construction Co~'~ 593,300 County Engineering (6~) 5,600 Estimated Total Project Cost 598,900 Since a signal is not warranted at Prior Avenue, the cost would have to be completely locally funded. If in the future Gortner is realigned and a signal is warranted, any revisions due to the Larpenteur upgrade would be fundable with County State Aid monies. If the signal is still not warranted at the time of a Larpenteur upgrade. the revision cost would have to be locally .funded. In either case, the City would receive no refund or credit of the initial cost of the temporary signal when Larpenteur is upgraded. Wiessner Clerk-Administrator 2077 West Larpenteur Avenue Falcon Heights, MK 55113 RE: The Use of Tax Increment Revenues from Development District No. 1 to Make Debt Service Payments in TID 1-3 Dear Janet: In our January 11, 1988 report we updated our cash flow projections for the City's four tax increment districts. Based on the assumptions outlined in that report which included no other office construction in TID No. 1-3 there would be a shortfall in the tax increment revenues from TID No. 1-3 to make the debt service payment beginning on March 1, 1989 and thereafter. In our meeting on January 19, 1988 with Tom Gedde, City Attorney for Falcon Heights we reviewed the tax increment law to determine what would be required to resolve this cash flow problem. After review of the Minnesota Statutes it was our conclusion that no amendment would be necessary to Development District No. 1 or tax increment financing plans for TID Nos. 1-1, 1-2, and 1-3. The City Council at the time it is necessary to make the March 1, 1989 payment could by resolution authorize the payment shortfall out of other tax increment revenues in Development District No. 1. The tax increment law d,` fines a ro ect as a develop_ district created, under Chapter 472A. This was t e basis for the creation of Deve opment District No. 1 in Falcon Heights. The 1982 amendment to the tax increment law contains a provision that the tax increment financing plan shall contain "(2) a statement of objectives of an authority (the City of Falcon Heights) for the improvement of a ro ect." The underlined word pro3ect meaning a developmentdistrictreplacedtheworddistrictmeaningthetaxincrementdistrict. With this wording change the legislature liberalized the tax increment law and authorized the expenditure of increment outside the district from which it was generated, so long as it was used in the project (Development District No. 1) within which the district was established. This interpretation will not affect the developer's obligation for the Stratford Office Park development and allows the City Council to transfer money only as it is required to make up the pro3ected shortfall. The State of Minnesota has discussed changes to the ~roperty~tagstructureandinfacthasapprovedachangeeffectivein1988/89. The egi~ stature is to consider a number of proposed changes to this law during this upcoming legislative session. The changes to the property tax structure could adversely affect the tax increment district revenues. Of primary concern is that the developers' in each tax increment district have guaranteed to the City a minimum market value for the projects. It is however the assessed value of the project and current mill rate that determines the tax increment revenues that will be collected by the project. The State, by changing the ratio that determines assessed value could lower the property taxes paid by commercial development even though the market value remains the same. There is a push this legislative session to reduce property taxes for commercial and industrial establishments. In addition the legislature is considering changes to the tax increment law this session. These changes will likely further restrict t e ability of the City to use tax increment financing in the future. With this background an amendment to combine both development districts and enlarge the districts would possibly provide the following benefits to the City: For TID No. 2-1 Provide a safety net in the event the shopping center project (~jt~.(.(~c.~>doesn't make its property tag payments or are less than they currently are paying due to a change in state law described above. Provide for the possible early retirement of that bond issue from Ca5(,~'`~~-1additionalfundsfromthelargerdevelopmentdistrict. The valuation would go on the property tax rolls earlier than projected. For the Southeast Corner of Larpenteur and Snelling Avenues Provide additional tag increment revenues that may be necessary to assist the development of that project and/or reduce the length of ~hlkt ~•~ a possible future district. For Possible Public Works Projects Provide a funding mechanis~lm for financing of the City share of upgrading the Larpenteur project. 1()1'~ Provide a funding source for the Gortner/Gi-evel.aad connector.
