Mortenson; Trustees Willis Warkentisn, Charles Stone, and William Black. Also present ware Treasurer William Olsen, Attorney Michael Galvin, Jr., and Deputy Clerk Tina Vavoulis. Mrs. Robert Lucas of the League of Wow Voters was present. Stone moved, seconded by Mortenson that the minutes of tie meeting of March 25th be approved as corrected. Carried. Correspondence: Vincent Bailey has contacted the 9311age Clerk regarding the Spic and Span Area Plan, which is a Spic and Span Area Flan plan comprised. of a group of civic-minded citizens, tinder the guidance of the St. Paul Area Chamber of Commerce Area Relations Committee banded together to do what they can to fight litter and spruce up areas. This group will. meet with Roseville and also the Rams®y Cot~ty League of Municipalities, and would like to have Falcon Heights included. N.W. Bell Telephone Applications by N.W. Bell Telephone Company to placs Installation of Buried additional buried cable in alley north of Hoyt Cables: Avenue east of Pascal, and also buried telephone cable on Sne]ling Avenue east service drive wer® presented to the Council for approval. Ni]s sn moved, Warkentien seconded that the two applications be approved sub3ect to the satisfactory replacement of the street and alley, and re-starfacing of same and subject to the approval after inspection of the Village Engineer. Motion was carried. Surer Trouble - Mr. A, E. Fry was present to issue complaint that 1457 Iowa Avenues his suer has stopped up again, The trouble a year ago was-from a broken tile, which was replaced. He also reported that 1E~56 Ian:a and 1l~7.3 Iowa have had trouble also. Tree Trimmers: Mrs: Wm. F. Ryan ~drs. Ryan stated that on February 18, 196t~, her boulevard 11156 W. Ions trees were triumed at a cost of ~45.0o to her, She Complaints stated that L. McCrrenr of C3eneral Tree Service (sub- contracted by Harlonr Huber of Northland Tree Service) advised her the tiro boulevard trees ware not in the contract for triBaning and that they would not be done for another three years, and he also stated that they were in such poor shape they xould probably not last three years if not trinmted at this time. He claimed he had called the village Office and obtained the above information. Discussion was held and it ~+ras tl~ opinion of the Cotancil members that payment for truing trees on contract dated March 12 be held in abeyance until such tiros as Harlo~r Huber attends the next cotuicil meeting. (The two above-mentioned txees were included with contract approved by the Council at meeting of February 12, 196l~, } 1 1 Cdr. Black seconded, and motion was carried. Culvert -Albert and Council Ras advised that the culvert at this location Garden Avenues: has sunk and is not draining property. The Village Engineer was instructed to contact Ramsey County regarding this south line of Garden crossing Albert, and advise that the culvert is not serviceable and Rill not allover water to flox properly. Bethel College Varianc® Letter from Mrs. Frances Berdie, Secretary of the Permit Refused by Planning Commission, Ras read. It is the recommendation Planning Commissions of this Commission that variance be refused by the Council. Stone moved, Mortenson seconded that the follo~ring resolution be adopted by the Village Council: RESOLUTION DENYING APPLICATION FC~t VARIANCE UNDER THE PROVISIONS OF ORDINANCE N0. 6!~ of THE PILLAGE OF FALCON HEIC;~iTS WHEREAS, ~ifarren Eastland, attorney for Bethel College, has made an application for variance and filed the same Rith th® Zoning Administrator for the Village of Falcon Heights along Kith the fee of X5.00, and WHEREAS, the matter has bean referred to the Plarming Commission for the Village of Falcon Heights, and WHEREAS, it is the recommendation of the Planning Commission of the Village of Falcon Heights that said variance application be denied by reason of the foltaaring: 1. An apartmsazt building Kith 11 units represents too high a concentration for the lot size. 2. Inadequate parking for apartment of that size. 3. Set back from Pascal Ras inadequate. NC1N, THEREFORE, BE IT RESOLVED that the Village Council of the V;lla ge of Falcon Heights denies Variance Applic anon made by Bethel College on the 20th day of March 1964 for us® of property described as Lot 7, Block 13, Northome 3rd Addition Ri.thin the Village of Falcon Heights, which property is presently zoned as R-3, all under the prov3.sions of Section 16.x, Ordina~nca 6l~ of the Village of Falcon Heights for the reasons follaR3.~g: 207/ (a) Said variance is not in harmony with the general purpose and intent of the ordinance and comprehensive plan of the Village. Bethel College Variance (b) The proposed plan will have axi adverse Permit Refused: effect upon the safety and welfare of the existing and anticipated community. (c} Said variance will effect traffic conditions including the parking facilities on ad3acent streets. Upon a vote being taken, the above resolution was adopted this 8th day of April, 196t~. Cities Service Station: Mr. Robert Leonard is out of town and wi3.7, not appear befar~e the council ass requested. He has stated he gill appear at the next meeting. Machine Accounting of Village Accounts: Carl Pearson, Certified Public Accountant, has advised that his firm will be .equipped to handle accounting for the Village of Falcon Heights. He would like to program his new machine accounting equipment for a pilot run of January accounts. This would cost the Village nothing unless the Council elects to continue this service, Iri this event, the pilot run would be charged against the Village, but charge would be very nominal involving actual costs only. Mortenson moved, seconded by Warkentien that Council authorize Pearson and Sands to make a test run, as suggested, of January 196l~ records of the Village of Falcon Heights. Such test run of machine accounting shall be for the purpose of determining feasibility and practicality of adopting this serv3~e in lieu of present accounting system, and shall not be charged against the Village, except as stated above. Lotion was carried. Roberts Apartments: After discussion, it was agreed by council members that if Mr. Roberts and his attorney, Mr. Daubney, have a solution to the existing problems surrounding the Roberts Apartments, the Village Council should hear them befare taking action. Attorney Galvin shall advise and keep in contact with Attorney Daubney. Ioxa Avenue Curb and Stone moved, Black seconded that the follo~ring Gutter Assessor®nt Ro11 - resolution be adopted by the Councils Corrections WHEREAS, the fo].l.owing described real estate located within the Village of Falcon Heights was erroneously included in the assessment roll adopted by said council on February ~3, 1963 under the provisions of MSA lt29.01 et a1 for the improveanent of Iowa Avenue by the construction of curbs and gutters on Iowa Avenue between the East line of Arona Avenue and the ~fest line of Hamline Avenue which assessment was adopted by said council on February 13, 1963 and certified to the Ramsey County Auditor July 1©, 1963, ~J 1 2098 Lot 8, Block 11, Northome 2nd Addition, Ramsey County, Minnesota, assessed 3n the name of Edgard ~. Mitsch - 181 West Iowa Avenue, in the amount of X25.00, and Iowa Avenue Curb and WHEREAS, the full. cost of said improvements were paid Gutter Assessment in full by said csener at the time said assessment roll was Roll t certified, Correction Nom, THEREFORE, BE IT RESOLVED that said assessment i.s hereby cancelled and nullified, and it is hereby ordered that it be removed from the aforesaid assessm®nt roll. Changes in Sewer Attorney Galvin contacted Jack Stadler of the Bureau of rental chargesmade Valuations of St. Paul and was advised that a higher rate by the Bureau of for sewer rental for some home-o~rners in this Villag® Vaulations of the resulted because home-own®rs had advertised business and City of St. Pmx].= listed home addresses as places of business. According to Stadler, this is then deemed a commercial. account and must be so charged. It eras the opinion of the Council members that this is not an ob3ective standard on which to base sewer rental charges and attorney was requested to refer same to Otto Bonestroo, who is presently involved in a rate study of sanitary sewers. As far as village charges are concerned, these ooffice-residence~ businesses will be charged on a family residential basis. At least one and three- tenths (1.3) parking places per darelling unit. and inserting in its place the following: llt.2 :Multiple Dwellings. At one and one-half (1.5) Parking places per dwelling unit, Nilsen moved adoption of the following Resolution, Mortensen seconded: RAEREAS, it has been alleged that Clara Hanson was inured in a fall in the Village of Falcon Heights on or about December 17, 1963, and WHF,REAS, it has been alleged that the Village of Falcon Heights may be liable in all or in part for the inuries sustained by Clara Hansom, and 1 AREAS the claim of Clara Hanson against the Village of Falcon Heights has been referred to the Mutual Insurance Company of St. Paul, Minnesota, who is the service insurer of the Village under the provisions of a Comprehensive Public Liability Policy, and ~IHEREA,S, it appears that Mutual Service Insurance Company has made a full and exhaustive investigation of the alleged claim and have denied the same, NOW, ?.fiEREFORE, SS IT RESOLVED that the Village of Falcon Heights hereby deny the claim of Clara Hanson which was filed with the Clerk of the Village of Falcon Heights on January 16, 196lt, alleging that said claimant had received inuri.es on or about December 17, 1963, in or on the public way in the Vi7.lage of Falcon Heights, and further that a copy of this resolution be forwarded to the claimant's attorney as notice of the denial. of said claim. Upon a wte being taken thereon, the resolution was adopted by the Village Council this 8th day of April' 196it. Attorney Galvin advised Council of status of possible futEZre claims against Lam®tti, as regards statutes of limitations. 2100 Citizens Recreational Warkentien moved, Black seconded that upon receipt of Advisory Committee - a map dram up by the Citizens Recreational Advisory Committee, the Mayor be authorized to submit the Proposed locations locations, proposed by that committee for parks, to of parks: University officials through Dean Shex~rrood 0. Bergs office for recommendation. Dean Berg is with the Institute of Agriculture. Motion was carried.
