Fire at Falcon Heights Community Park - On Monday, September 12 at 2:30 A.M. a major fire took place at the Community Park Recreation Building. Fire Marshal Iverson, with assistance from the State Fire Marshal's Office, has determined that arson was the cause of the fire. A $1,000 reward is offered by the Minnesota Arson Reward Project to anyone providing information leading to the arrest and conviction of responsible persons. (Call collect, 612-645-8882). Household Hazardous Waste Collection - City Staff participated in a meeting with representatives of the Cities of Lauderdale and Roseville to discuss a possible joint collection effort. (It would cost approximately $30,000). Recy~ - The total collection for August reported by Super Cycle was 22.10 tons, 4.08 tons of which Baas from 1666 Coffman. The number of participating households was 704. This was the first month in which two pick-ups were made. Also present were Gedde, Wiesner and S. Chenoweth. ABSENT Ciernia. MINUTES OF AUGUST 1-0, 1988 APPROVED Council approved the Minutes of August 10, 1988 as presented. ADDENDUM TO CONSENT AGENDA Council added Item E 2(b), Planning Commission Minutes of August 22, 1988, to the. Consent Agenda. CONSENT AGENDA APPROVED Baldwin noted that under Item E1(C) the Planning Consultant had charged for a telephone conversation with a Planning Commissioner and directed Wiessner to inform all consultants in writing, that the City will not cover these charges in the future as there is a Council direction on record that all contact with consultants must be monitered by staff 1. Sheriff's Repcrt for July, 1988 CONSIDERING A NEW STRUCTURE FOR COMMUNITY CABLE ACCESS DEFERRED TO SEPTEMBER 14TH MEETING Baldwin felt that it would be more productive to discuss this when City Cable Commissioner Ron Eggert is available for the presentation and Council .agreed to defer the matter until the September 14, 1988 meeting. MINUTES AUGUST 2 4 , 19 8 8 PAGE 2 RESCHEDULING OF BUDGET WORKSHOPS Baldwin explained .that the budget workshop scheduled for August 31, 1988 is naw needed for the discussion of development of the southeast corner of Larpenteur and Snelling and asked that Council schedule a budget workshop for another date. Following a discussion the following workshops dates were established: 1) Change the meeting time for the September 8, 1988 workshop from 6:30 P.M. to 8:00 P.M., and 2) Schedule a second budget workshop for September 17, 1988, 8:00 A. M. to 10:00 A. M. 7:15 P.M. - HEARING FOR CONDITIONAL USE REQUEST FROM CHICO FERDOWSI TO OPERATE A POOL HALL IN A B-2 DISTRICT. Baldwin opened the public hearing at 7:00 p.m. and presented the Affidavit of Publication after which he explained the conditional use procedure as stipulated in the City's Zoning Code. He then accepted the petitions presented by concerned property owners. Council reviewed the Planning Commission's recommendations as determined at their August 22nd meeting after which Attorney Gedde presented some possible additions to the conditions relating to loitering, prohibiting intoxicated persons on the premises, and employment of persons who have been convicted of felonies, drug or gambling related charges. RICHARD TALBOT, 1531 WEST IDAHO, stated he felt the Planning Commission's conditions were reasonable, but wanted to know how any disturbing the peace violations would affect the conditional use permit, and how such offenses would be documented. He also asked if the concerned property owners would be notified of a six month review of the conditional use permit. Gedde replied that any police calls would be a matter of record and would be discussed at the review sessions. It was also suggested that City Hall could be notified of problems. Baldwin was of the opinion--that the review period should not be made a public hearing that the review is Council's. responsibility. MARK KOSANKE, 1471 WEST CALIFORNIA, commented on the problems encountered when the Roc-A-Fellas establishment was in the shopping center. He felt those problems (loitering, speeding, and noisy gatherings) occurred mainly between 10:00 P.M, to 1:00 A.M. and would like to see the pool hall close at 10:.00 P.M. daily. DAVID WICKHEM, 1537 WEST IOWA, stated he had noticed a lot of rowdy gatherings in the City park at Idaho and Snelling with the possible consumption-of alcohol and drugs, and felt that they congregated in the park after leaving Roc-A-Fellas. He also stated that those gatherings have been cut by 80 to 90 percent since Roc-A-Fellas has been closed. He commented on the poorly MINUTES AUGUST 24, 1988 PAGE 3 lighted park and felt steps should be taken to keep this sort of activity out of the park such as increased lighting, more police protection, and perhaps removal of hockey boards which produces a hide-a-way. Bush replied that the Park and Recreation Commission is aware of the lighting problem and it is being corrected. She assured that the Commission would attempt to find another place for the hockey boards. Baldwin encouraged the residents to call the police at any time and if they felt there was a lack of response, to call City Hall. WILLIAM FRITSCHE, 1512 WEST CALIFORNIA, commented that he had called the police many times for street fights, rowdiness, and physical assults during the Roc-A-Fellas period and felt. there was very quick police response. In his opinion the 8:00 P. M. time limit on parking in the back lot would not salve the problem of the gatherings in the lot. DANE GAUTHIER, 1469 W. CALIFORNIA, stated his concern is not the pool hall but the fear that it will be used as a hang out. He was in favor of an off duty police officer on the premises, adequate illumination of the area and recommended there be no obstructions for full visibility to the security officer. ROBERT UHLER, 1497 W. CALIFORNIA, suggested a left turn only from the back parking lot to discourage traffic from passing through the residential neighborhood. i Chico Ferdowsi, applicant for the conditional use permit, and his business partner, Mohsen Mirzai, were in attendance and Mr. Mirzai presented an explanation of the type of business they hoped to operate in the Neon Alley, including the display of neon art work by neon artists from around the area. The interior walls will be moved so that attendants will have a complete view of the game area and the parking lot. RESOLUTION R-88-13 A RESOLUTION LEVYING SPECIAL ASSESSMENTS FOR DELINQUENT UTILITY CHARGES MINUTES AUGUST 24, 1988 PAGE 4 HEARING ON CONITIONAL USE REQUEST RESUMED Mr. Mirzai resumed. his presentation by .explaining there will be two employees on the premises at all times, one being either he or Mr. Ferdowsi, as they felt having management on the premises would deter possible problems. He requested that Council consider allowing. the establishment to stay open until 1:00 A. M. during the week rather than midnight and that they not be required to have a security officer on duty as had been. recommended by the Planning Commission.. Mr. Mirzai and Mr. Ferdowsi otherwise concurred with the proposed conditions. There being no others who wished to be heard Baldwin closed. the hearing at 8:29 p.m. Council again reviewed the Planning Commission recommendations, the recommendations made by the concerned residents, and those presented by the City Attorney, after which Wallin moved adoption of Resolution R-88-14 granting the conditional use permit with the stipulation that all conditions established at this Council Meeting will be rewritten without changing the thrust and meaning. Wiessner, Administrator No. R 88-14 CITY OF FALCON HEIGHTS C O U N C I L R E S O L U T I O,N Date August 24, 1988 A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR OPERATION OF A POOL HALL AT 1550 WEST LARPENTEUR AVENUE (NORTHOME SHOPPING CENTER) WHEREAS, the City. of Falcon Heights received an'application dated July 25, 1988 for the issuance of a conditional use permit to establish a pool hall in Northome Shopping Center, 1550 West Larpenteur Avenue and; WHEREAS, the City Council did carefully consider the request as well as the recommendations made by the City's Planning Commission, and held the required public hearing; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Falcon Heights that a conditional use permit for the establishment of a pool hall at 1550 West Larpenteur Avenue be granted subject to the following conditions: 1. Maximum hours of operation will be 9:00 A.M. to 12 Midnight weekdays, and 9:00 A.M. to 1:00 A.M. Friday and Saturday. 2. Restrictions on use of back parking lot after 8:00 P.M. will be adequately posted by property owner. a. pool hall parking will be restricted to front and side parking lots after 8:00 P.M., b. all Arona exits from parking lot shall be posted "left turn only after 8:00 P.M." 3. After 8:00 P.M., the back door will be an exit only, conforming to Fire Code. 4. No less than present level of illumination in the rear parking lot will be provided. 5. No alcoholic beverages (including 3.2 beer or wine) or controlled substances without a prescription shall be sold, possessed, or consumed on the premises of the pool hall, the common areas within the building, or the parking areas. 6. The property owner will post exterior of premises "No Loitering" and. will prevent any loitering in common areas within the building or in the parking areas and sidewalks adjacent to the building. Any person who has been convicted of a felony, controlled substance abuse, or gambling law violation within the last five years is prohibited from working as an attendant at the pool hall. 8. The interior of "Neon Alley" will be free of obstructions to visual supervision by attendants and will have adequate lighting. 9. Pool Hall management will take all reasonable action to expell intoxicated persons and will allow no disorderly conduct on the premises, parking areas and adjacent sidewalks. 10. Adequate supervision shall be provided until one-half hour after closing to ensure that the health, safety and welfare and existing community standards of peace and quiet are maintained. a. A minimum of two attendants will be on duty after 5:00 P.M. b. At Council's discretion additional supervisory and/or security personnel may be required. 11. First review period of this conditional use will be within six months after opening. On May 26 , 1988 the Commission accepted the attached joint powers agreement, page 5, which would. allow this program to continue beyond .December 31, 1988 subject to annual renewal. The Commission is requesting your community's approval of this agreement, including your estimated fair-share contribution for 1989. (See Appendix A of the agreement.) The Resolution of Intent to Participate (page 6) should be acted on not later than September 15, 1988. WHEREAS, the #oliowing communities are members of the Commission: Falcon Heights, Hugo, Little Canada, Maplewood, North St. Paul, Oakdale, Roseville, Vadnais Heights and White Hear Township. WHEREAS, on April 28, 1988, the Commission found: (1) that. home sharing is a cost-effective housing alternative for older adults, and (2) that continuation of Lutheran Social Service's Suburban Home-Share program beyond the pilot phase would be in the public interest; WHEREAS, on May 2b, 1988, the Home-Share Steering Commission accepted a joint powers agreement to. govern the program beginning January 1, 1989 and recommended its approval by each of the named communities; WHEREAS, the proposed maximum fair-share contribution for the city of Falcon Heights wool d be i~504, assuming each of the named parties enters into the joint powers agreement; WHEREAS, supplemental matching funds will be ,sought in an attempt to reduce each party's proposed fair-share allocation; NOW, THEREFORE, HE IT RESOLVED: 1. The City of Falcon Heights hereby approves the suburban St. Paul Home-Share Program joint powers agreement dated May 26, 1.988. and authorizes its mayor to sign_the document. 2. The City hereby authorizes a fair-share contribution not to exceed 110X of X504, to be submitted in January, 1989 to Lutheran Social Services in accordance with the provisions of th e joint powers agreement to fund the .suburban St. Paut Home-Share Program from January 1 to December 31, 1989. It is understood that the actual fair-share contribution cannot be determined until each perspective community has indicated whether they will participate. 3. The city clerk/administrator is hereby directed to submit this resolution to the Home-Share Steering Commission, c/o Randall Johnson, Department of Community Development, 1830 E. J RESOLUTION StTPPORTING COMMONITY ACCESS MANAGEl~NT BY A NON-PROFIT CORPORATION The following resolution is presented to each meaaber city by the Commissioa with a recommendation for its adoption: WHEREAS, the City of (hereinafter "City") recognizes the functions that community access on a cable codsuacations system can perform in serviag the communications seeds of the variety of community organisations, institutions and individuals, and in enriching the cable subscribers/viewers by providing information about community events and resources plus an awareness of the scope and dynamics of activity within the ten-city area, and AREAS, the North Suburban Cable Commission (hereinafter Commission") is authorized to act on behalf of the City through a 3oint and cooperative agreement to oversee and administer the franchise that the City has granted to Cable TV North Central, and WHEREAS, the Commission has completed a thorough study of community access which study's main conclusions include that community access would best be managed by a non-profit corporation rather than by the cable communications company, and that Cable TV North Central has failed in its efforts to provide the proper mix of resources to support and produce a successful access operation; THEREFORE BE IT RESOLVED THAT: The City directs its Commission representative to aupport_the Commission's negotiations to effect the orderly transfer of counityaccess maneagem~nt functions and resources fry Cable ?V North Central or its successor to 8 non-profit corporation which responsibility it is to promote the community access opportunities and to manage resources provided for ease in the ten-city area, and which will have sufficient funds to perform its duties; sad The City directs its Commission representative to report the results of negotiations to the City for review and appropriate action. 8/4/88 Consent Agcnda Item:.
