Our store is planning a tent sale to tie into the
re-opening ceremonies on Snelling. It would run
MON. TUES. THURS. FRI. 9-9
WEO. SAT. 9-5:30
Aug. 20 thru Aug. 22. We plan on putting up a thirty
by thirty foot tent in our parking lot, in a location
so as not to interfere with our neighbors and only
use about 8 parking spaces.
We have talked to the Fire Marshall and understand
the safety precautions.
We thank you in advance for your approval and look
forward to seeing you during the re-opening ceremonies.

Council approved the Consent Agenda as presented.
APPROVAL OF REQUEST FROM DENNETH DVERGSTEN, 1717 ASBURY, FOR CONSTRUCTION
OF A UTILITY BUILDING
Council approved Mr. Dvergsten's request to construct a utility building
on his property as unanimously recomended by the Planning Coamission at
the August 3, 1987 meeting.
APPROVAL OF VARIANCE BEQUEST FROM DEAN SCHWALM, 1725 BOLTON, FOR GARAGE
ADDITION
Wallin explained, the Planning Commission at their August 3, 1987 meeting,
recommended approval of the garage addition with the stipulation that it
be limited to three feet from the west property line, with the new
construction following the current garage wall on the north. Yellin
moved, seconded by Chenaweth approval of the garage ezpaasion :s
recommended by the Planning Commission. Motian carried unanimmusly.

VARIANCE REQUEST FROH DEAN SCHWALM, 1725 BOLTON, TO CONSTRUCT A 9 FOOT
HIGH PRIVACY FENCE REFERRED TO PLANNING COMMISSION FOR FURTHER STUDY
Wallin informed that the Planning Commission unanimously denied the
request for a nine foot fence as they felt it would be detrimental to
abating property on Snelling Avenue. Mr. Schwalm explained the fence will
not be placed on the lot line, but on the top of a deck he plans to
construct in his back yard. He indicated the fence rould actually be
seven and one-half feet in height and only twenty-two feet in length.
Following a discussion Wallin moved, seconded by Chenoweth, that based on
this new information, the Planning Commission be requested to review the
matter again, with the suggestion that they tight consider the reduced
length of the fence as a trade off for the additional height. Motion
carried unanimously.

WATERMAIN IMPROVEMENT
SALE OF 1974 FORD 1 TON TRUCK APPROVED
Wiessner explained two bids have been received on the truck, one for
750.00 and one for $800.00, after which Council authorized sale of the
truck (AS IS) to Ray Brown for $800.00.
ANIMAL CONTROL
Wiessner explained the animal control firm serving Falcon Heights is going
out of business and staff is checking into possible alternatives.
HEARING ON DELINQUENT UTILITY CHARGES SCHEDULED FOR 7:15 P/M., 9/9/87
Council agreed to schedule the hearing on delinquent utility charges for
September 9, 1987, 7:15 P.K.
CITY TO APPEAL 3X LBVY LIMIT
Wiessner informed she and Baldwin attended an informational meeting
regarding procedures for appealing the 3x levy limit established by the
State Legislature, and stressed any appeal mast be made by August 21st.
Council discussed the matter brief ly after which Chenoweth moved, seconded
by Wallin, authorizing filing of a formal appeal to the 3Z levy licit.
EUDGET WORKSHOP SCHEDULED FOR 9/2/87, 6:30 P.K.
Council scheduled a budget workshop for 6:30 P.K., September 2, 1987.

SCHEDULED FOR 9/9/87 FOLLOWING COUNCIL MEETING
A workshop to establish goals and evaluation criteria for the
Clerk/Administrator's position was scheduled September 9, 1987 following
the regular Council Keeting.
APPROVAL OF REQUEST FOR ?ENT SALE AT WARNERS' STffi.LIAN, 1711 N. SNBLLING
Council approved a request frost Warners' Stellian to ran a tent sale
August 20 through August 22 in conjunction with the Snelling Avenue
re-opening providing the sale does not interfere with the neighbors and
traffic. Council requested that criteria for tent sales be :established so
these natters may be handled administratively.

7:05 P.M. - HEARING ON VACATION OF ALLEY NORTH OF LARPERTEIIR, PASCAL TO
HOLTON
Baldwin opened the hearing at 7:05 P.K. and presented the Affidavit of
Publication. Robert D. Bentson, 1701 Holton, the resident who has. been
using a portion of the alley for garage access and. who requested council
consider vacating the alley, vas present but had no coaents. There being
ao others wishing to be heard, Baldwin closed the hearing at 7:09 P.K.
Cierna explained he and Park sad Recreation Director Pat Bush had
discussed rhether or not the alley would be desirable for a bike/hi.king
path, and concurred it was not a good area for a bike path. Wallin coved,
seconded by Chenoweth, adoption of Resolution R87-29, vacating the alley
with the understanding that the alley would be equally apportioned between
the abuting property owners. Motion carried nnaniaously.

7:15 P.M. -HEARING ON PLATTING F08 STRATFORD OFFICE PARK
Baldwin opened the hearing at 7:15 P.M. and presented the Affidavit of
Publication. Wa11-in stated the Planning Commission had unanimously
approved the platting at the July 6, 1987 meeting, however, he was
concerned that the plat drawing does not show access to the buildings on
the west. Jack Klepp, representing Stratford Investments, Ltd., explained
the purpose of the platting is to divide the property into six
parcels for the proposed siz office condominiums, that this is a flexible
condominium development with two buildings on the site at present with
four more to follow as they are sold, and that parking and access to the
parcels are held in common. Schroeder examined the coadaminium
declaration document and was of the opinion it was a proper declaration
and nothing in addition was needed. There being no others wishing to be
heard, Baldwin closed the hearing at 7:33 P.K. Cieraia moved seconded by
Wallin, adoption of 8esolution 887-30. Motion carried unanimously.

PLAT OF STBATFORD OFFICE PARK AS SUBMITTED
BEQUEST FROM CABL BLOMBERG, 1579, 1583 NORTH HAMLINE F08 A VARIANCE TO THE
FIRE CODE - DEFERRED TO 8/12/87 UNLESS THE MATTER IS BBSOLVBD PRIOR TO
THAT DATE.
Jay McNabb, representing Mr. Blomberg, commented on the letters from Fire
Chief Liadig and Building Inspector Larson upholding the code which
supported the City Fire Marshal's opinion regarding the need to either
install sprinklers in the basement of the building or provide adequate
openings for access by firefighters. Baldwin explained Council provided
for professionals with expertise to make decisions in these arese and
questioned why Council should go beyond their decisions. Discussed at
length was interpretation of the fire and building codes, conversations
held with Steve Anderson, State Fire Marshal's Office and Bob Miller who
drafted this particular portion of the Fire Code. Fire Marshal Iverson
stressed that although adequate exterior access would help provide for
safety of firef fighters, it would not save the the building as sprinklers
would, nor would it reduce fire insurance premiums. Council suggested the
parties involved attempt to find a suitable solution to the matter, and if
it is not solved by the August 12th meeting, it will be discussed further.
PROPOSED CHANGES IN CODE 8EGA8DING LOITERING AND CONSUIO'TION AS A METHOD
OF CONTROLLING PROBLEMS IN REAR PARKING LOT AT 80C-A-Fffi.LAS
Deputy Larry Janke commented on the problems encountered in the. parking
lot, such as drinking, speeding cars, drug dealing, and stated the
deputies would like some stronger wording in the code to control this type
of activity. Prosecuting Attorney Fills vas of the opinion it would not
be of any benef it to amend the code as loitering is a vague and Jiff icult
activity to prosecute. He indicated a willingness to discass the matter
with the deputies to determine what City and State laws would apply, and
to determine whether or not the code needs to be amended.
Dan Dahlia, owners of Bock-A-Fellas, stated he had jest this week become
aware of the problea and will seat with the deputies, city prosecutor, and
sanager of the shopping center to work out a solution. Mr. Dahlia will
then report back to the city.

BOCK-A-FELLAS LICENSES APP80VED FOB A 90 DAY PERIOD
Baldwin moved, seconded by Wallin, approval of Bock-A-Fellas licenses
Lunchroom, Pool Tables, Amusement Machines., Cigarette, and On-Sale
Non-Intoxicating Malt Liquor) for a period of 90 days, and if efforts to
solve problems at the establishment have been satisfactory, the licenses
will automatically be extended, if not satisfactory, Mr. Dahlia will be
notified of that fact 10 days in advance of the end of the 90 day period.
Motion carried unanimously.
NO ACTION TAKEN ON WINFIELD DBVBLOPMENT
Representatives of Winf field Development were not in attendance to make
their presentation.
AMENDMENT TO CHAPTER 6-1.01, ALCOHOLIC BEVEBAGBS
Wiessner explained State Statute has been amended to allow sale of
intoxicating malt liquor at establishments holding both an on-sale wine
license and an oa-sale non-intoxicating malt liquor license, and that
Chinatown 8estaurant and Shakey's would both be eligible. Wiessner stated
that the owner of Chinatown has expressed interest in selling intoxicating
malt liquor. Following a short discussion Ciernia moved, seconded by
Chenoweth, adoption of Ordinance 0-87-5. Motion carried unanimously.

CRAWFORD, DENIED
Baldwin presented a letter from Mrs. Peterson dated July 1, 1987
requesting reimbursement in the amount of $862.50 for repair of her sewer
line. Based on information provided by Vince Wright and Plumbing Inspector
Richard Alquist, Ciernia moved, seconded by Wallin, denial of the request
as there was insuff icient evidence the problem ras City related, and there
was strong evidence the problem was due to tree roots. Motion carried
unanimously.
NEW TRUCK TO BE PURCHASED FOB PUBLIC WORKS DEPARTMENT
Wiessner informed that the City's one ton 1974 Ford Public Works truck
died on July 7, 1987 and aechanics at Harvest States felt the truck is not
worth repairing. After discussing the options available Cieraia moved,
seconded by Wallin, replacing the track with a new truck at a cost of
approximately $20,000, and directing Wiessner to appropriate the funds for
payment from standing reserves. Motion carried nnaniaously.
PUBLIC WORKS TO BENT TBUCR FOR Iffi~BDIATE USE
Wiessner explained there is imsiediate need for another truck while
awaiting purchase of the new vehicle, gad requested Council consider the
options, truck rental, or use of an esployee's tehicle. Chenoweth moved,
seconded by Wallin, rental of a truck for use during the interim period.
Motion carried unanimously.

DISCIISSION - DAMAGE TO LANDSCAPING AND IINDERGROUND SPRINRLEx SYSTEM AT
BULLSEYE PLAZA
Wieasner presented an update on a meeting with Don Orgeman of MN/DOT,Bob
Paine of Ramsey County Public Works, and Dennis Hunt, owner of Bullseye
Plaza, regarding damage done to the landscaping and sprinkler system
during the Larpenteur/Spelling reconstruction project, and recommended
Council consider the recommendations made in her memo dated July 22, 1987,
a copy of which is on file in the Clerk's Off ice. Following a short
discussion Giernia moved, seconded by Wallin, accepting the recommendation
for resolution of the problem contingent upon obtaining a release from
Dennis Hunt ending any further City involvement in the matter. Motion
carried unanimously.

Chenoweth moved adjournment at 8:58 P.M. and the aotion carried
unanimously.

REGULAR PLANNING COMMISSION MEETING
AUGUST 3, 1987
The regular meeting of the Planning Commission was called to order at 7:30 P.M.
by Chairman Black.
Black, Boche, Daykin, Mead, Finegan, Grittner, Nestingen, Northrop, and Duncan. PRESENT
Also present was Council Liaison Wallin.
None. ABSENT
Mead moved, seconded by Grittner, to approve the July 6, 1987 Minutes as presented.
Motion carried unanimously. 7/6/87
MINTES
Schema,, 1725 Asbury, presented his variance request to construct a nine APPROVED
foot fence along the west property line and extend the rear of the garage. Mr.
Schwalm indicated the need fora privacy fence to alleviate the Snelling Avenue
noise and bothersome light reflected onto his property. .His 105' lot is DEAN
presently screened with a hedge and a fence, which is in need of rQpair. •He SCHWALM,
proposed installation of a solid cedar fence. Letters were presented from his 1725
neighbors indicating no objections. ASBURY,
VARIANCE
Mead indicated that a fence of this nature would increase the sound from Snelling FOR GARAGE
Avenue for his neighbor at 1730 North Snelling and voiced his objection to the THREE FEET
proposal. Duncan objected to the height to which Northrop agreed that the height FROM
was excessive. Black was concerned about the affect to the property and that PROPERTY
it may be determintal to the Snelling-Avenue residents. Wallin voiced concern LINE
about whether a fence of this height could withstand the forces of wind. APPROVED
After further discussion, Grittner moved, seconded by Daykin, to approve the
variance request for-the construction of the garage addition but that it be
limited to three feet from the west property line with the new construction
following the current garage wall on the north. Upon a vote being taken, the
following voted in favor thereof: Boche, Daykin, Mead, Finegan, Black, Grittner
and Nestingen, and the following voted against the same: Duncan and 2orthrop.
Motion carried.
VARIANCE
Finegan then moved, seconded by Nestingen, to deny the portion of the variance FOR NINE
dealing with the height of such fence and if such a fencQ is installed, it should FOOT HIGH
follow the allowed six foot height as provided for in the Municipal Code. Motion FENCE
carried unanimously. DENIID
Dvergal~n, 1717 Holton, requested a permitted accessory use to construct
a 9 x 10 utility shed located five feet from both property lines. The shed will
be shielded by his own and neighbor's shrubbery. He presented letters from
his neighbors voicing no objection.
Boche moved, seconded by Finegan, to approve the permitted accessory use. Motion
carried unanimously.
Planning Commission members were given copies of the revised job description.
Finegan moved, seconded by Mead, to adjourn the meeting at 8:20 P.M. Motion
carried unanimously.

MEMBERS ABSENT: Ardis Hutchins, Pat Bush, Floyd Bedbury

Ice Cream Social
This is planned for July 30, 1987. Everything is set for this annual event. Hours
will be 5s30 - 9:00. Pat Bush will arrange for announcements in various newspapers.
The Senior Group will again furnish cake.
Summer Program
Everything is in place and the program seems to be running fine.
Equipment In The Falcon Heights Park
The new toddler play equipment has been installed. Sand under the equipment and
a wood border should be completed in the next several weeks.
Piano
Pat Bush found a piano suitable for the Falcon Heights City Hall. While it could
be used primarily by the Senior Group, it could also obviously be used for other
functions. A motion was passed to move ahead with purchase of the piano.
Grove Park
The lawn area needs some work on the grass and also some fill dirt.
Community Park
The Commission will check on obtaining bids for seriation of the grass area at
this park.

In my attempt to buy a new truck, everyone that I spoie to felt that they did
not want to trade for our 1974 Ford truck and if they did they would not give
us very much for it because all they would do is call a jobber to come over and
look at it and give an estimate which they would give me for the truck. One of
the Ford Dealers recommended that I call one of the people that they do business
with; which was, Dynamite Truck Sales. So I did. He came out and looked the
tzuck over, which was .amazing to me and offered me #750.00. My estimate was
about X500.00 to #550.00 maaimus for the truck. In the meantime, a fireman,
Ray Brown showed some interest in buying the truck. I told his that whatever
I could get for the truck as a trade in was what he would have to match. He
said that was fine. I received the bid at #750.00, I talked to Ray Brown and
he imsediately gave se a check for #800.00. He understands what shape the
truck is in, what is wrong with it, and that he will have to buy the truck as
is. I feel that thin was a relatively good price considering I could only get
750.00 through a trade-in. I don't perceive any probless is selling to his
as is.

The 1987 Legislature changed the formulas for determining local goverment aid
and overall levy limitations for the taxes payable year 1988. The 1988 Falcon
Heights share of Local Government Aid is $265 less than the 1987 amount.
The City is limited to a three percent increase in overall tax levy for 1988.
The deadline for appealing this limit is August 21, 1987. While it is somewhat
premature to determine whether we need to appeal, it seems we have the grounds
for a legitimate appeal based on criteria distributed by the state of
Minnesota (i.e. unusual expenditures in 1987 such as a maintenance truck,
elimination of Federal Revenue Sharing funds, etc.)
