Larpenteur-Prior/Gortner
A meeting was held December 7th with representatives of Ramsey County, the University
of Minnesota, Hewlett Packard and the City of Falcon Heights continuing. the discussion
to try to resolve the traffic/safety problems in this area. Dan Soler and Bob Weber.
from Ramsey County discussed four design `options for combining the :two intersections
which had been suggested at the previous meeting:. The University of Minnesota
representatives reiterated their concerns about using any University of Minnesota
land.. Ramsey County is planning a reconstruction pra~ect on Larpenteur'Avenue
from Snelling to Cleveland. This is currently scheduled for 1990-1991.:. This
would include a center left turn lane which might be enough to solve the safety
problem. It was decided that a meeting should be held with,the City Council,
State and County representatives to discuss a variety of design, financing and
timing alternatives in January. Hewlett-Packard had offered to host this meeting.
Public Works Truck
After two months of unsuccessful repair. work on our new Public Works Truck, it appears
we may have purchased a "lemon". The dealer has asked us to give them a few more
days to try something else, however, we are starting to document the sequence of
events to proceed with a claim under Minnesota's."Lemon Law",
Siren
The City has also encountered problems (as have other cities) with the newly installed
siren system. The problems have included failures to respond during the growl tests
due to battery problems and interference with the Fire Department's Radio Channel.
The Civil Defense Directors of the suburban communities are working together with
Ramsey County's emergency personnel to resolve these problems. We have been with-
holding payment to Healy-Ruff, the company which sold us the siren,, until these
problems are resolved.
Recycling
WE BROKE ALL RECORDS IN NOVEMBER!! Four hundred fourteen. households participated
with a total of 15.1 tons collected. A year end report will be prepared for the
first meeting in January.

Risk Management Training
Denise Kapler, Ramsey County's Risk Manager, will be conducting a training session
for staff on Thursday, December 17 at 2:00 P.M. She will be discussing the handling
of claims and complaints, prevention and occupational health and safety issues. The
Council is invited to attend if your schedules permit.:
Fire Department Holiday Party
Reminder - The Falcon Heights Fire Department's Holiday Party. will be held on
Sunday, December 13. Let Shirley know if you'll be able to attend.

REGULAR PLANNING COMMISSION MEETING
DECEMBER 7, 1987
Chairperson Black called the meeting to order at 7:35 P.M.
Black, Daykin, Mead, Grittner, Northrop, Nestingen and Duncan. Also
present was Council Liaison Wallin.
Finegan and Boche.
Dean Schwalm, 1725 Asbury, requested a variance to construct an addition
to their home less than 30 feet from the rear lot line.- He advised that
the addition would be 21 feet from the lot line, be constructed using cedar
siding to blend with the brick construction, shrubs will be added to .hide
footings, and windows will be placed on three sides of the room addition.
The cement work has been done (due to the possibility of early frost) and
building permit has been applied for. Mr. Schwalm presented a letter from
his neighbors voicing no objections.
After a discussion, Duncan moved, seconded by Daykin, to approve the
variance request. Motion approved unanimously.
The Planning Commission next discussed the expiration of the front yard
moratorium.
Nestingen stated she was philosophically opposed to the Planning Commission
setting rules for the construction of front yard fences since in the
neighborhood in which she resides there are several that are very attractive.
She finds it difficult that an ordinance could be written that would be
designed in such a fashion to provide a very broad umbrella to cover all
aspects.
Mead was of the opinion that tastes in construction have changed over the past
twenty years and rules should be set for front yard fence construction. There
should not be a wide open book because it could cause many problems.
Black was concerned about the safety issue, which should be considered--
especially in uncontrolled intersections.
Nestingen conversely stated that for security reasons some residents might
wish to build front yard fences--particularly those streets .that have a lot
of traffic such as Larpenteur or Snelling. Northrop also was of the opinion
that front yard fences make front yards more private and, therefore, more
useable.
Daykin was concerned about the visibility issue. If it is stated that front
yard fences should be 607 opaque, then chain link fences could be placed in
front yards and she was very much against such fences being constructed in
front yards.
Northrop also pointed out that due to the new construction in the Falcon Woods

area with decks being built on second stories, which could also be the case in
residential areas abutting apartment complexes, these decks take away the
privacy residences previously had so people are moving into their front yards.
Grittner stated that in most cases the lot sizes in Falcon Heights are small
and to built front yard fences on 40 foot lots would be unsightly. He would
like to have the Planning Commission approve the construction of front yard
fences.
After further discussion, the Planning Commission requested that Councilmember
Wallin express the following recommendations to the City Council concerning the
construction of front yard fences: Consider (1) height (possibly staying with
36" as a starting point), (2) set backs from the lot lines, (3) width of the
lots in the area, (4) adjacent use, (5) visibility/opaqueness factor limitation,
6) approval of the neighbors, and (7) overall impace on neighborhood and
aesthetics. Therefore, it is recommended that front yard fences be prohibited
in Falcon Heights but a variance provision be incorporated taking into account
the above considerations.
Mead expressed concern about the number of unrelated people that can be renting
homes in the city and the problems that are can be caused by noise, commercial
vehicles being parked either on the street or driveways, many vehicles surrounding
the residences, and residences not being kept up in the manner they would be
if they were not rented or owned by more a large number of unrelated persons. The
Council Liaison advised of previous discussions with the city attorney and
the advice he had given the City Council. Mead and Gritter expressed concern
over the problems that could be caused and felt the issue needs to again be
addressed.
Black advised that three members (Mead, Northrop and Finegan) terms are to
expire on December 31. Mead has served as a member of the Planning Commission
since 1981 filling three terms. Black thanked him for his dedicated service on
the Commission. He also advised that three applicants have submitted applications
to become members of the Commission.
Grittner moved, seconded by Mead,
carried unanimously.

The Fire Marshal has been in communication with the owners of the Northome
Shopping Center regarding violations to the Fire Code since June 4, 1986.
The most recent letter (Attachment A dated November 10, 1987) gave them
until December 7th to respond or action would be taken to seal up the areas
in violation of the Code.
At this time no response has been received so we are planning to follow through
with condemnation procedures. The affected areas includes the entire basement
of the. shopping center. Fire Marshal Terry Iverson will be present to discuss.

In re: Restoration of Northome Shopping Center of Meet
Current Minnesota Fire Code
e following violations of the Current Minnesota IIniform Fire Code still exist at
orthome Shopping Center:
1. Restoration will start the week of May 25th if approved by
the Falcon Heights Building Inspector.
2. Previous to restoration, a complete set of plans will need
to be submitted and approved by the Falcon Heights Building
Inspector. The building permit will then be issued by the
City of Falcon Heights.
3. All construction will conform to the Unifosm Building Code:
one hour walls, one hour labeled doors with self closers and
one hour jams to amount doors.
4. Smoke detectors will be UL approved and installed per NFPA
Code Vol 72E. Note battery type acceptable if batteries
are replaced annually.
5. Outside rubbish receptacle must be equipped with tight fitting
covers. See attached Current Minnesota Fire Code. This hazardous
situation should be eliminated within one week. Violation of Current
Minnesota Fire Code 11.201, Accumulation of haste Material Adjacent
to Building.
6. Need letter stating completion date of restoration by Dean and
Dean Restoration.

Northome Shopping Center Fire Code Compliance Issue
As you requested, the following is an outline of the steps
necessary if the City is to bring an action under the Minnesota
Hazardous and Substandard Building Act to abate the fire code
violations at Northome Shopping Center. Under the Act,_~t ici~-
palty may femove or correct such a ha~xtrcieus condition- and asses
the costs to the"owner. A copy of the Act is attached for your
reference. Attached also is a draft resolution that could be
adopted by the City making the necessary findings under the Act
and authorizing the Mayor and City staff to begn...legal proceedings
against Northome in order to correct the hazardous conditions.
The steps prescribed by the Act to correct a hazardous
condition are as follows:
1. The City must draft an order stating that it will abate
the hazardous condition unless the owners perform specific
repairs within a reasonable time. Minn. Stat. §463.17
subd. 1. The order must further provide that the City
will seek summary enforcement of the order by the district
court unless the condition is corrected or an answer
served. Id.
2. The order is served upon the owner of record or the
owner's agent in charge of the building, along with the
occupying tenant(s) and all lien holders of record. Id.
at subd. 2. If service cannot be effected upon the
owner, service by publication is possible. Id.
3. .Copies of the order and proof of service is filed with
the Ramsey County District Court five days before an
enforcement motion. Id. at subd. 3. At this time, the
City must also serve a notice of the pendency of the
proceeding with the county recorder. Id.

4. The owner, agent, tenant or lien holders have twenty (20)
days in which to serve an answer in order to contest the
order. Minn. Stat. X463.18.
5. If there is a default (no party serves an answer) the
City may bring a summary motion for enforcement of the
order. Minn. Stat. 463.19.
6. If an answer is filed by any party a court trial is
conducted. Minn. Stat. §463.20. This trial is accele-
rated and has priority over all other pending civil
matters. Id.
If a judgement is obtained, either by default or pursuant to a
trial, the City can make the costs of abatement a special assess-
ment payable in a single installment. Minn. Stat. §463.21. The
costs of this action, including attorneys fees, may also be
assessed pursuant to a court order. Minn. Stat. §463.22. You
should keep track of all allowable costs mentioned in the Act
so that they may be easily demonstrated to the Court. We will
open a separate file on this matter to facilitate the record
keeping of our costs.

PROCEED WITH AN ACTION UNDER THE STATE
HAZARDOUS AND SUBSTANDARD BUILDINGS ACT
TO ABATE A HAZARDOUS CONDITION_AT THE
NORTHOME SHOPPING CENTER.
WHEREAS, the City Council is authorized by the state
Hazardous and Substandard Building Act, Minn. Stat. 463.161, to
abate a hazardous building within the municipality by a court-
enforced order, and
WHEREAS, the City Fire Marshall has on repeated occasions
during 1986-1987 notified the owners of the Northome Shopping
Center (the "Center"), located at the southeast corner of
Larpenteur and Snelling within Falcon Heights, that the Center
is in violation of the City Fire Code, especially in regard to the
lack of a sprinkler system in the southeast corner of the basement,
but no substantive action has been taken by the owners to correct
the situation, and
WHEREAS, the uncorrected fire code violations constitute a
fire hazard, and
WHEREAS, the City Council has determined that the abatement
proceedings must be immediately instituted and prosecuted under
the Act in order to protect the public safety and health.
NOW, THEREFORE, BE IT RESOLVED by the City of Falcon Heights
as follows
1. The City finds on the basis of information provided by
the City Fire Marshall which is on file with the Fire
Marshall that the lack of a sprinkler system in the
basement of the Center makes the Center a hazardous
building within the meaning of the Act.
2. The City will begin abatement actions as authorized by
the Act against the owners, agents, tenants and lien
holders of the Center to correct the hazardous condi-
tions in the Center.

The City Council of the City of Falcon Heights does ordain as follows:
Section 9-2.04 Accessory Buildings and Structures, Subd. 2(a)
Specific shall be amended to read:
a. Dwelling Unit: No accessory building or structure shall be used
for living purposes or as a dwelling unit.
Section 9-2.05 Required Yards and Open Spaces Subd. 2(a) Permitted
Encroachments on Required Yards:
The following shall be permitted encroachments into setbacks and
eight requirements except as restricted by other sections of this
Code.
In any yards: posts, off street parking, flues,. sills, pilasters,
lintels, cornices, eaves (up to three (3) feet), gutters, awnings, open
terraces, steps, sidewalks, essential services, stoops, or similar
features provided they do not extend five (5) feet .above the height
of the principal structure or to a distance less than three (3) feet
from any lot line nor less than one (1) foot from any existing or proposed
driveway; yard lights and nameplate signs, trees, shrubs, plants, flood-
lights or other sources of light illuminating authorized illuminated .signs,
or light standards for illuminating park areas, loading areas, or yard for
safety and security reasons, provided the direct source of light is not
visible from the public rightrof-way or adjacent residential property.

Schwalm indicated the need for a privacy fence to alleviate the Snelling Avenue
noise and bothersome light reflected onto his property. His 105• lot is DEAN

VARIANCE
Mead indicated that a fence of this nature would increase the sound from Snelling FOR GARAGE
Avenue for his neighbor at 1730 North Snelling and voiced his objection to the THREE FEET
proposal. Duncan objected to the height to which Northrop agreed that the height FROM

more city staff time than necessary. We'd like to recommend the following:

A. Even though the city is no longer mandated to have a Shade Tree Program, we
recommend continuing it. (See Enebak's memo re: diseased tree trend in City-
Attachment A.)
Tree Removal Firms
B. Rather than awarding bids 3-4 times per year, we recommend one bid process be
conducted as follows:
January - Council approve bid specifications for tree
removal firms
February - Mail invitation to bid and specifications to interested
firms

I would like to propose a revamping and streamlining of the
Falcon Heights Shade Tree Program for the upcoming field season
of 1988. And if successful to incorporate the changes to future
years. While the Minnesota Shade Tree Program is not mandatory
under the law and participation is only voluntary I feel the
current program with the City could he changed to help the City
administration, the tree removal contractors and the homeowners.
I have listed below brief summaries of the current system and of
the new proposed system.

These are only the major points of the two systems, if you wish
to know more about the smaller points we could go over them in
more detail. I have also attached the losses of trees in the
City for the .last four years. While the City lost 41< ~.re~es to
Dutch elm disease in 1987 there ark still well over 640 rees
left on city Blvd and on private property. These trees stand a
very goo chance of surviving for years to come but only if the
current program of identification and prompt removal of diseased
trees continues. The new system that I have proposed does not
change the current program of identification and removal but
instead speeds the process up by eliminating many of the steps
that are now in place. The new program also keeps the homeowners
more informed and involved with the tree removal process with the
added possibility of some compensation from State grants. If
you have any questions or concerns feel free to contact me at my

The Falcon Heights tree inspector was here today checking your woodpile for
bark-intact elm wood. Elm wood with bark still attached is prohibited by
ordinance except between September 15 and April 1. This city ordinance was
enacted to help protect our elms from Dutch elm disease.
Elm wood with bark attached is a breeding place for the elm bark beetles
that spread Dutch elm disease. Up to 1500 beetles may emerge from a single
f i rep 1 ace size 1 og. These beet 1 es may have the Dutch e 1 m disease fungus
clinging to their bodies. When they fly to the tops of healthy elms to
feed, the beet 1 es introduce the fungus into the tree, and u 1 timate 1 y the
tree dies.
Following our inspection, we found that you firewood pile
contains bark-intact elm wood.. P 1 ease debark the wood, burn
i t, or dispose of i t before Apri 1 1. That way your firewood
will not be a breeding place for the insects that spread Dutch
elm disease. The inspector will return by
to make sure no bark-intact elm wood remains.
Following our inspection, we found that your firewood pile does
not contain any elm wood with bark intact. Therefore it poses
no threat to our healthy elms.

operates a Shade Tree Disease Control Program.
The objectives of the City's program are to remove all
trees or wood capable of spreading oak wilt disease and
to take the necessary steps to bring the spread of the
disease under control.
The first step in controlling this=disease--is to detect
and destroy oak logs or branches that may serve as
breeding sites for oak wilt spores. Oak wilt spores ,.can
be spread from infected red oak logs to nearby healthy
oaks in the spring and early summer.
On your wood was inspected and
found to contain oak wood capable of spreading disease.
You, as a homeowner, are asked to render this wood safe.
To do this, you can burn the wood in the fireplace or
wood stove, remove all the bark from all marked logs or
haul the wood to a sanitary landfill. Oak wood may be

Elm wood stored with the bark still attached is prohibited
by ordinance except between September 15 and April 1.
This city ordinance was enacted to help protect our elms
from Dutch elm disease.
Elm wood with the bark attached is a breeding place for the
elm bark beetles that can spread Dutch elm disease. Up to
1,500 beetles may emerge from a single fireplace size log.
These beetles may have the Dutch elm disease fungus cling-
ing to their bodies. So when they fly to feed,. the beetles
spread the disease to healthy trees and more elms die.
Following our inspection, we found that your firewood
pile contains bark-intact elm wood. Please debark
the wood or burn it before the April 1 deadline.

Planting trees is one way that Falcon Heights ensures the future health
of our urban forests. The city plants trees to replace those lost to

This tree represents our tax dollars. In a few years, this tree will be
giving you energy-saving shade, reducing air and noise pollution, enhancing

One of the best ways you can help it grow is by watering it once a week.
The best way to water your new tree is to let your garden hose run very
slowly for an hour or so. This ensures a thorough soaking. Soaking-- unlike
sprinkling-- encourages the tree's root system to develop properly.
It is not advisable to apply f ertlizer until the end of the second growing
season.
If you do these things, you'll do more than ensure your future shade. You

prior to pay days. Independent contractors will be paid on a voucher
as pre-arranged by their contracts.
2. WITHHOLDING AND REPORTING - The City shall withhold and report taxes
far all part time employees, other than independent contractors, and a
Statement W-2 will be issued to each employee by January 31st.
Independent contractors will be responsible for their own withholding
and reporting. A Farm 1099 will be issued to independent contractors
by February 28th.

4. IEOAL_HOLIDAY8 - Permanent part time employees working more than 20
hours per week shall be entitled to holiday pay in the same proportion
as outlined in paragraph 3. Seasonal or temporary employees and
independent contractors shall not be eligible for such benefit.

It was brought to my attention that the University did not receive sewer
credit for the water used in field sprinkling this past summer, or for
fact, the last three or four summers.
In past years the well, normally used for field sprinkling, was not used
during the construction of Borlaug Hall. This past summer. it was not
used because the well pumped sand and had to be abandoned.
The sewer credit missed during the construction of Borlaug Hall is
apparently too far back to be considered, but we feel that the well
outage this past year is recent enough to apply for a sewer credit.
Attached is a copy of the figured accepted by Falcon Heights in 1974,
allowing for sewer credits for field sprinkling.
We are using approximately the same amount of water today as we did in
1979, so we are proposing that the same sprinkling credit, using today s
rates, be given the University.
