Mr. Kenneth L. Moser, a resident of Falcon Heights has submitted the enclosed
proposal to prohibit front yard fences in Falcon Heights. I have enclosed a
copy of the existing portion of the City Code, 9-2.06 (p. 194-195) on fences.
Mr. Moser is planning to attend the meeting on July 6, 1987 to discuss the
issue.

Subdivision 1. Fences may be allowed in any zone and are
subject to the following:

9-2.07 Height Limitations.
Subdivision 1. Limitations.
iF Any structural height exceeding the following limits
may be permitted only by conditional use permit:'
a. Residential Zone: (R-1, 2, and 3) two (2)
stories or twenty-five (25) feet. Agricultural and
Multiple Family Zone: (R-4) three (3) stories or thirty
3U) feet. Business and Industrial Zone: three (3)
stories or thirty-five (35) feet.

belfries, cupolas and domes, monuments, public and
public utility facilities, silos, barns, church
spires, chimneys, smokestacks, flag poles, and
parapet walls extending not more than four feet above
the limiting height of the building.

top structures such as mechanical equipment, elevator
s~raft an3 equipment enclosures and similar
structures, provided said ezceptions do not exceed
ten (10) feet in height above the roof line and the
area does not exceed fifteen percent (15$) of the
roof area.

2. The determination of the Commission shall be
by majority vote of the members of the Co~rnnission
present and voting on the application. If the
Commission determines not to approve the issuance of
the permit, it shall incorporate in its resolution
the grounds for said refusal.
Subd. b. Conditions. The applicant for a permit shall
establish that the exterior architectural appeal and funetianal
plan of any proposed structure or improvement will not be at
variance with existing exterior architectural appeal and
functional plans in the vicinity. The Oommission may set forth
a further condition that the building permit application
including plans and specifications be approved by the
Cprt~nission before the building permit issues so as to establish
that th is condition is met. If the property abuts a
residential district, the CoRUnission may impose reasonable
landscaping conditions to harmonize the development with the
surrounding residential area. The Commission shall have the
authority to impose such further conditions as will bring it
within the intent and purposes of the Chapter.
Subd. 7. Filing of Determination; Notice. The resolution
of the Commission shall be filed with the coning administrator
who shall serve copies thereof upon the Clerk, the applicant,
and all those who appeared at the meeting in person or by the
issuance of a statement and who requested notice thereof.
Subd. $. Official Action. Conditional use permits shall
not be issued by the Zoning Administrator until officially
approved by action of the City Council which shall consider but
not be bound by the advice and recortunendation of the Planning
Com,niss ion .
9-15.05 Amendments
Subdivision 1. Amendments. The Council may, by an
affirmative vote of four fifths (4 /5) of all members thereof.,
adopt amendments to this Chapter.
Subd. 2. Initiation of Amendment. Proceedings for
amendment of this Chapter shall be initiated by (1) a petition
of the owner or owners of the actual property, the zoning of
which is proposed to be changed; (2 ) a racvamendation +of .the
Planning Commission; or (3 ) by action cif the Oouncil . Such
notice'•shall also contain the description of the land and~e
proused charge in zoning. At least ten (10) days before the
hearing the Planning Commission shall mail an identical notice
to the owner and to each of the property owners within three
hundred (300) feet to the outside boundaries of the land
proposed to be rezoned. Failure of the Planning Commission to
mail the notice shall not invalidate the proceeds. Within

sixty (50) days after the date of referral by the Council, the
Planning Com~-ission shall make a written report to the Council

Subd. 3. Application for Amendment. All applications for
amendments which are initiated by the petition of the owner or
owners of property shall be filed with the Zoning Administrator
when application involves the changing of zoning districts and
boundary thereof, the application shall be accompanied by an
abstractor's certified property certificate showing the
property owners within three hundred (300) feet of the outer
boundaries of the property in question. .The application shall
be forwarded to the Council.
Subd. 4. Referral to Planning Commission. If the
application is in the form of a petition and contains the
sig nature of fifty percent (50$) of the property owners
abutting the land affected, the Oouncil shall refer the
application to the Planning Commission.. Any other application
may be referred by the Council to the Planning Commission or
returned to the applicant. The Oouncil may of its own motion
initiate the request for amendment and refer wine to the
Planning Commission.
Subd. 5. Planning Commission Notice and Hearing on
Application. The Planning Commission shall. hold a public
hearing affording an opportunity for all parties interested to
C be heard and shall give not less than ten {10) days nor more
than thi-~ty (30) days notice of time and place of such hearing,
published in the designated legal newspaper for the City.
Subd. 6. Council Notice and Hearin on A lication. The
Council shall hold a public hearing within thirty 30 days
after the receipt of the report and recommendations from the
Planning Commission. If the Planning Commission fails to make
a report to the Oouncil within sixty {60) days after the
referral of the application, then the Council shall hold a
public hearing within thirty (30) days after the expiration of
said sixty (60) day period. Failure to receive a report. from
the Planning Commission as herein provided shall not invalidate
the proceedings or actions of the Council. The Oouncii shall
give not less than ten (10) days nor more than thirty (30) days
notice ~~f tune and place of such hearing published in the
designated legal newspaper for the City, and such notice shall
contain a description of the land .and the proposed change in
zoning. At least ten {10) days before the hearing the Council

boundaries of the land proposed to be rezoned. Failure of the
Council to mail the notice or failure of the property owners to
receive the notice shall not invalidate the proceedings. At
the time of hearing the Council may take final action upon the
application or it may continue the hearing from time to time

request further information and report from the Planning
Commission. The Council shall not rezone-any land or area in
any zoning district without having first referred it to th e
Planning Commission. Any other proposed amendment to this
Chapter maybe referred to the Planning Commission for
consideration and recommendations.
9-15.06 Fees.
The Zoning Administrator or other administrative office
having jurisdiction therein shall charge each applicant,
petitioner or other person requesting. a perniit, rezoning, or
other zoning approval or review such fees as may be prescribed
therefor by ordinance or by resolution published in the same
manner as an ordinance. Each applicant, petitioner, or other
person s'nall also pay all legal, engineering, planning, and
similar out-of-pocket costs incurred by the city in connection
with the respective matter. The zoning administrator with the
approval of the council may require each applicant, petitioner,
or other person to deposit with the City in escrow a cash
amount based on an estimate by the zoning administrator of such
fees and costs. Any surplus shall be refunded to and any
additional costs paid by the applicant, petitioner or other
person. The obligation to pay such fees and costs shall not be
affected by the disposition of the matter.
9-15.07 Enforcement; Violations; P enalties
a. Zoning Administrator and Cit Attorney. The Zoning
Administrator, with the assistance o the City Attorney, shall
have the authority to and be responsible for the enforcement of
this Chapter. Any complaint received shall be promptly
investi~3ate~9 by the Zoning Administrator. If the matter cannot
be adjusted by the Zoning Administrator to the satisfaction of
the complainant, he shall promptly report the matter to the
City Attorney, who shall then proceed to enforce the Code
according to its provisions fo llowing approval and receipt of
instructions from the City Council.
b. Cancellation of Permits. If any condition in any
permit, inch ing variances an conditional use permits, is
violated, the Zoning Administrator shall serve notice on the
owner of the permit that unless the violation is corrected in
the time set by the Zoning Administrator, not to exceed ten
days, the permit shall at the expiration of said period be
terminated, provided, that if the said owner shall within a
period of twenty days from the se rvice of said notice, correct
the violation, the order shall be stayed until the appeal has
been heard. Said notice shall be served either by personal

of appeals and adjustments, and it may provide an appropriate name for the board.
The board may be given such other duties as the governing body may direct.
In any municipality where the council does not serve as the board, the governingbodymay, except as otherwise provided by charter, provide that the decisions of the
board on matters within its jurisdiction are final subject to judicial review or are final
subject to appeal to the council and the right of later judicial review or are advisory to
h ittecounc l. Hearings by the board of appeals and adjustments shall beheld within sucb
time and upon such notice to interested parties as is provided in the ordinance
establishing the board. The board shall within a reasonable time make its order
i deciding the matter and shall serve a copy of such order upon the appellant or petitioner `
by mail. Any party may appear at the hearing in person or by agent or attorney. Subject
to such limitations as may be imposed by the governing body, the board may adoplrulesfortheconductofproceedingsbeforeit. Such rules may include provisions for
the giving of oaths to witnesses and the filing of written briefs by the parties. The board
pj shall provide for a record of its proceedings which shall include the minutes of itt
meetings, its findings, and the action taken on each matter heard by it, including the
final order. In any municipality in which the planning agency does not act as the board
of adjustments and appeals the board shall make no decision on an a eal or titi npppeo
until the planning agency, if there is one, or a representative authorized by it has had
reasonable opportunity, not to exceed 60 days, to review and report to the board of
adjustments and appeals upon the appeal or petition.

462.355 PREPARATION, ADOPTION, AND AMENDMENT OF COMPREHEN-
SIVE NIUNICIPALPLAN.
Subdivision 1. Preparation and review. The planning agency shall prepare tht
comprehensive municipal plan. In discharging this duty the planning agency shall ;
consult with and coordinate the planning activities of other departments and agencittofthemunicipalitytoinsureconformitywithandtoassistinthedevelopmentofthe
comprehensive municipal plan. In its planning activities the planning agency shall take ,
due cognizance of the planning activities of adjacent units of government and ocher
affected public agencies. The planning agency shall periodically review the plan andrecommendamendmentswhenevernecessary.
Subd. 2. Procedure for plan adoption and amendment. The planning agency may,unless otherwise provided by charter or ordinance consistent with the municipalcharter, recommend to the governing body the adoption and amendment from time totimeofacomprehensivemunicipalplan. The plan may be prepared and adopted in
sections, each of which relates to a major subject of the plan or to a major geographicalsectionofthemunicipality. The governing body may propose the comprehensivemunicipalplanandamendmentstoitbyresolutionsubmittedtotheplanningagency.Before adopting the comprehensive municipal plan or any section or amendment of the
plan, the planning agency shall hold at least one public hearing thereon. A notice of thetime, place and purpose of the hearing shall be published once in the official newspaperofthemunicipalityatleasttendaysbeforethedayofthehearing.
Subd. 3. Adoption by governing body. A proposed comprehensive plan or an
amendment to it may not be acted upon by the governing body until it has receivedtherecommendationoftheplanningagencyoruntil60dayshaveelapsedfromthedate
an amendment proposed by the governing body has been submitted to the planningagencyforitsrecommendation. Unless otherwise provided by charter, the governingbodymaybyresolutionbyatwo-thirds vote of all of its members adopt and amendthecomprehensiveplanorportionthereofastheollicialmunicipalplanuponsuch
notice and hearing as may be prescribed by ordinance.
Subd. 4. Interim ~dinattce. If a municipality is conducting studies or hatauthorizedastudytobeconductedorhasheldorhasscheduledahearingforthe
purpose of considering adoption or amendment of a comprehensive plan or official

plans or controls have not been adopted is annexed to a municipality, the governing

body of the municipality may adopt an interim ordinance applicable to all or part of
its jurisdiction for the purpose of protecting the planning process and the health, safety
and welfare of its citizens. The interim ordinance may regulate, restrict or prohibit any
development,. or subdivision. within the jurisdiction or a portion thereof fora
use

period not to exceed one year from the date it is effective, and may be extended for such
additional periods as the municipality may deem appropriate, not exceeding a total
additional period of 18 months. No interim ordinance may halt, delay, or impede a
subdivision which has been given preliminary approval prior to the effective date of
the interinn ordinance.

462.356 PROCEDURE FOR PLAN EFFECTUATION; GENERALLY.
Subdivision 1. Recommendations for plan execution. Upon the recommendation
by the planning agency of the comprehensive municipal plan or sections thereof, the
planning agency shall study and propose to the governing body reasonable and practica-f -
ble means for putting the plan or section of the plan into effect. Subject to the
limitations of the following sections, such means include, but are not limited to, zoning
regulations, regulations for the subdivision of land, an official map, a program for
coordination of the normal public improvements and services of the municipality,
urban renewal and a capital improvements program.
Subd. 2. Compliance with plan. After a comprehensive municipal plan or section
thereof has been recommended by the planning agency and a copy filed with the
governing body, no publicly owned interest in real property within the municipality Ewshallbeacquiredordisposedof, nor shall any capital improvement be authorized by
the municipality or special district or agency thereof or any other political subdivision
having jurisdiction within the municipality until. after the planning agency has reviewed
the proposed acquisition, disposal, or capital improvement and reported in writing to
the governing body or other special district or agency or political subdivision con-
cerned, its findings as to compliance of the proposed acquisition, disposal or improve-
ment with the comprehensive municipal plan. Failure of the planning agency to report

designated by the governing body shall be deemed to have satisfied the requirements a
1 of this subdivision. The governing body may, by resolution adopted by two-thirds vote
dispense with the requirements of this subdivision when in its judgment it finds that
the proposed acquisition or disposal of real property or capital improvement has no
relationship to the comprehensive municipal plan.

462.357 PROCEDURE FOR PLAN EFFECTUATION; ZONING.
Subdivision 1. Authority for zoning. For the purpose of promoting the public
health, safety, morals and general welfare, a municipality may by ordinance regulate
on the earth's surface, in the air space above the surface, and in subsurface areas, the
location, height, width, bulk, type of foundation, number of stories, size of buildings
4 and other structures, the percentage of lot which may be occupied, the size of yards and
other open spaces, the density and distribution of population, the uses of buildings and
structures for trade, industry, residence, recreation, public activities, or other purposes,
and the uses of land for trade, industry, residence, recreation, agriculture, forestry, soil
conservation, water supply conservation, conservation of shorelands, as defined in t -;
access to direct sunlight for solar energy systems as defined in sectionsection105.485

Meeting called to order at 7:00 p.m. by Connie Lasser, Chair.
Summer Program
Pat Bush reported that we are offering 16 programs, several of
which are filled. Two programs were cancelled due to lack of
interest, Adult Volleyball and All-Sorts- of-Sports for kids grades
4, 5 and 6. These are the age groups we have been unable to
attract to our programs, although we are successfully offering
an adult caligraphy class, Ardis had an idea for Fun Fridays that
there be 3 special event days, each one targeted for a different
age group. Pat is working to develop this.
Equipment at Community Park
The play equipment for the Community Park has been ordered and
will be delivered in time for installation on Saturday, July 11,
with the Lions Club and commission Qolunteers being supervised
by a company representative. The representative has told Pat
that this is a common method of installation and is easily ac-
complished in a day.
DNR Community Park Plan
On Tuesday, June 2, Pat Bush, Connie Lasser and Jan Weisner, met
with Art Weiderstrom of the Department of Natural Resources at the
Community Park. We discussed how the park is used, neighborhood
screening and areas needing summer shading, such as the building
area. Art Weiderstrom is going to provide us with information
on tree programs ti~at we may qualify for. We walked the entire
park and checked the trees, most of our young deciduous trees are
showing signs of stress due to lack of rain and heat. There are
three young trees near the ball diamond that need the soil around
them aerated~.because of compaction. The City Uffice is_going to
get e~tma,tea fQr aerati on. Other young trees are dead and need
to be replaced. For the most part., the coniferous trees are
doing. well, although some of the young ones would do better if
the tall grass aroung them were cut. On the park's eastern edge
by the playground equipment the honeysuckle is overgrowing some
very nice conifers and should be severely pruned-back. We will meet
again and hope to have a hndscaping plan developed by :fall..

RE: Amendments to Joint Powers Agreement
The North Suburban Cable Commission ("Commission"~ hasadoptedaresolutionrecommendingcertainamendmentstotheJointandCooperativeAgreementfortheAdministrationofaCableCommunicationsSystem, to which your City is currentlyamember. The proposed amendments to the Agreement relate tothevotingstructureoftheCommissionandthefinancialcontributionstotheCommissionofeachMemberCity.
The existing Agreement established the voting rights ofeachMemberCityonthebasisofthenumberofdwellingunitsinthemunicipalityrepresentedbyadirector. -The AgreementprovidesthatthreeyearsaftertheinceptionoftheCommission,or after the second annual report of the number of subscriberstothecablesystem, whichever occurred sooner, the voting structureoftheCommissionmaybereconstitutedtorepresentonevoteperdirectorbaseduponsubscribers, provided that each directorhasatleastonevote. Accordingly, the Commission undertooktostudyalternativemethodsofstructuringthevotingprovisionsoftheAgreementbaseduponsubscribers, while at the same timemaintaininganequivalentproportiontothecurrentvotingstructure.

RESOLUTION RECOMMENDING AMENDMENTS TO ARTICLE VI, SECTION 1ANDARTICLEX, SECTION 3 OF THE .NORTH SUBURBAN CABLE COMMISSIONJOINTANDCOOPERATIVEAGREEMENTFORTHEADMINISTRATIONOFACABLECOMMUNICATIONSSYSTEM.
WHEREAS, the North Suburban Cable Commission (hereinafterCommission") has reviewed the Joint and Cooperative AgreementFortheAdministrationOfaCableCommunicationsSystem (here-inafter "Agreement") relating to the voting structure of theCommissionandthefinancialcontributionsoftheMembers; and
WHEREAS, the Commission believes it to be in its best interestofCommissionanditsMemberCitiestoamendtheAgreement;
THEREFORE, BE IT RESOLVED, that the North Suburban CableCommissionrecommendstotheMemberCitiesamendmentsbysubstitu-tion to the existing Agreement as follows:
1• Article VI, Section 1 is recommended to be amendedinitsentiretyasfollows:

Section 1. Each Member shall be entitled to one (i)director to represent it on the Commission. Each directorisentitledtovoteindirectproportiontotheofannualrevenuesattributabletothemunicipalitycrepre-sented by the director. to the total annual revenues ofthesystemfortheprioryearroundedtothenearestwholenumber; provided, however, that each director shall haveatleastonevote. For purposes of this section, the annualrevenuesforeachMemberandthetotalannualsystemrevenuesasofDecember31ofeachyearshallbedeterminedbytherecordsofthecableoperatorfiledwiththeCommissionwiththeannualfranchisefee. Prior to the first CommissionmeetinginMarchofeachyear, the Secretary of the CommissionshalldeterminethenumberofvotesforeachMemberinaccordancewiththissectionandcertifytheresultstotheChair.

CABLE COMMUNICATIONS SYSTEM.
WHEREAS, the City of , (hereinafter "City")is an existing member of the North Suburban Cable Commissionhereinafter "Commission");.and
WHEREAS, the Commission has made recommended amendments
to the Joint and Cooperative Agreement For The Administration
Of a Cable Communications System (hereinafter "Agreement") relatingtothevotingstructureoftheCommissionandthefinancial
contributions of .the Members; and
WHEREAS, the City believes it to be in its best interest
to amend the Agreement as recommended by Commission;
THEREFORE, BE IT RESOLVED, that the City Council of the
City of amends by substitution the existingAgreementasfollows:
1. Article VI, Section 1 is amended in its entirety as
follows:
Section 1. Each Member shall be entitled to one (1)
director to represent it on the Commission. Each director
is entitled to vote in direct proportion to the percentofannualrevenuesattributabletothemunicipalityrepre-sented by the director to the total annual revenues of
the system for the prior year rounded to the nearest whole
number; provided, however, that .each director shall have
at least one vote. For purposes of this section, the annual
revenues for each Member and the total annual system revenues
as of December 31 of each year shall be determined by the
records of the cable cperator filed with the Commission
with the annual franchise fee. Prior to the first Commission
meeting in March of each year, the Secretary of the CommissionshalldeterminethenumberofvotesforeachMemberin
accordance with this section and certify the results to
the Chair.
2. Article X, Section 3 is amended in its entirety asfollows:
Section 3. The financial contributions of the Members
in support of the. Commission shall be in direct proportion

to the percent of annual revenues of each Member to the
total annual revenues of the system for the prior year
multiplied by the Commission's annual budget. The annual
budget shall establish the contribution of each Member
for the ensuing year and a timetable for the payment of
said contribution. The remainder of any franchise fee
paid to the Member by the Grantee shall be used for cable-
related expenses. Prior to the collection of franchise
fees adequate to cover expenses, the Grantee, as a prepayment
of the fees, shall reimburse Members for all cable-related
expenditures .incurred by Members and the Commission.

Baldwin opened the meeting at 7:00 P.M. and recessed the meting until
7:30 due to the lack of a quorum. Baldwin re-convened the meeting at
7:30.

Hard moved, seconded by Wallin, approval of the Consent Agenda. Motion

MINUTES OF JUNE 24, 1987 APPROVED
Wallin moved, seconded by Baldwin, approval of the Minutes of June 24,
1987. Upon a vote being taken the following voted in favor thereof:
Baldwin and Wallin, and the following voted against the same: None. Hard
abstained. Motion carried.
DISCUSSION OF PROPOSAL PROM KENNETH L. MOSER, 1883 HAMLINE, RELATING TO
PROHIBITING F80NT YARD FENCES
Wallin explained Mr. Moser had attended the Planning Commission expressing
concern that his neighbor plans to erect a fence along the side lot to the
front lot line which in his opinion would diminish property values and be
unsightly. Following Planning Commission review, that body recommended
that Council consider amending the code to require not less than 602
visib ility through any front yard fence in residential districts. Council
discussed the matter and concurred it would be prudent to declare a
moratorium on construction of front yard fences to allow time to obtain
further information and thoroughly review the subject. Hard coved,
seconded by Wallin, adoption of Resolution R-87-26. Motion carried
unanimously. Staff. was directed to obtain further information and make
recommendations to the Planning Commission.

A RESOLUTION DBCLARING A MORATORIUM ON CONSTRUCTION OF
FRONT YARD FBNCES IN RESIDENTIAL DISTRICTS, SUCH MORATORIUM NOT
TO BXTEND BEYOND OCTOBER 31, 1987

Baldwin explained when the firm had previously applied for a license
Council had informed the owner that upon having a clean record far a year
the license would be reconsidered, but the problems have continued to
exist. Baldwin coved, seconded by Hard, denial of the license. Motion
carried unanimously.

DESIGNATION OF STREETS TO BE POSTED "NO PARKING" DURING STATE FAIR
Baldwin explained the apartment dwellers on Arona have no place to park
except on the street and suggested some kind of permit system be
instigated to allow them to park on streets in the area during the period
the streets are posted "No Parking" during the State Fair. Wiesner was
directed to contact those apartment owners and work. out an appropriateparkingsystem. Hard moved, seconded by Wallin, posting the following
streets "No Parking" during the State Fair: (1) All of Northome Addition,
water side, (2) all of Hollywood Court including alley, (3) St. Mary's ,Fry, Maple Knoll Drive and Garden Avenue west of Snelling on both sides.,.4) all streets north of Larpenteur, between Snelling and Hemline runningtoRoselawn, except Holton, Albert and Sheldon north of Ruggles, water
side, (5) Tatum 1,300 feet north of Larpenteur, (6) Lindig on water aide
including the cul-de-sac, (7) Larpenteur Avenue from Snelling to
Cleveland, and (8) Snelling Drive. Motion carried unanimously.
PROPOSED RESOLUTION AMENDING THE SECTION OF THE CABLE JOINT POWERS
AGREEMENT RELATING TO THE VOTING STRUCTURE AND FINANCIAL CONTRIBUTIONS OF
THE MEMBERS
Baldwin presented the proposed resolution and explained Falcon Heights'Cable Commissioner, Ron Eggert, encourages approval as it will reduce the
