REGULAR MEETING OF a'fARCH 10, 1965
The regular meeting was called to order at 7:00 P,M. with the following members
presents Nilsen, Warkentien, Stone and Black. Also present were Attorney Galvin,
Engineer Lemberg, Treasurer Olsen, and Deputy Clerk T. Vavoulis. Absents Clerk
Herbert H. Strandquist.
Stone moved that the minutes of the meeting of February 2l~, 1965 be approved.
Carried.
Mrs. Harry Foreman of the League of Women Voters submitted letter dated March 9,
1965 from the Executive Board in which recommendations were listed with regard
to modifications of existing grade crossing as well as the grade separation.
Mrs. Carol Kirkwood was representative of the League of Women Voters.
Correspondence:
Eugene Avery, Engineer Lemberg read letter from Eugene Avery, Chief
St. Paul Chief Engineer of the City of St, Paul regarding Snelling
Engineer: Avenue traffic.
Traffic s
Arona and There was discussion regarding traffic congestion at
Larpenteur: Arona and Larpenteur Avenues during peak hours.
Donations for Organizations or individuals wishing to donate money for
Recreational Purposes: recreation purposes should make out cheek to the Village
of Falcon Heights with notation on check stating it is to
be used for recreation.
HEARING
Pursuant to due call and notice thereof, the Hearing was
Ordinance No. 71 called at 8:00 P,M, to hear all persons resent with regard
Amending Ord. to the Proposed amendment to Ordinance 6~, which is
No. 6~.: entitled "The Zoning Ordinance of Falcon Heights, related
to a comprehensive amendment and rezoning of the Village
Amending Ordinance No. 8 originally passed by the Village
of Falcon Heights on October 21, 19~.9.~
E,C.Killmer We would like to get this amendment inasmuch as the land
1700 West is getting too high priced for the nursery business and 2
Larpenteur Ave.: am getting too old to run it. It is a nice piece of land
and very suitable for what could be on i.t and it will bring
you a nice revenue in Falcon Heights. It will be giving
you more money than the nursery. I am getting so I cannot
run the nursery business so I want to dispose of it. I
hope you folk realize that at age 78 I want to quit, but
I have been plugging along and I hope you will adopt this
amendment.
William F, Hueg, This council is aware for at least two and possibly three
Asst. Director sessions of the Legislature, the University has requested
Institute of Agr- opportunity to purchase a portion of the land, part of
iculture - Univ. which belongs to Mr. Killmer, It could be used for class-
of Minnesota: room buildings laboratory buildings, additional land area
will eventually be necessary. Mr. Ki.llmer's property would
give the village additional taxes, and if this is deeded to
the University there would be no tax money to it, If we

use this, it will mean more students for shopping, etc,
I don't feel in a very strong position to argue that you
should not pass this motion for amendment to this
Ordinance. I think if I were in Killmer's position, I guess
I might get on the impatient side myself, after all, it has
been quite a few years pending. I have this opportunity,
at least, to forestall or delay action, so the legislature
could act or the University could. We have before this
legislature a request for the money to purchase this
property. We have had some appraisals on it.
Nils-ens Do you know the exact number of feet you would purchase
on the back of the property?
Hueg: I do not, inasmuch as I have no access to those files. It
seems to me that to the legislature we are showing a
straight line across here (on the map) or an area of about
82 acres, A year ago Dean Berg and I had indicated that we
would request this,
Nilsens When I go back to the acquisition of private property, the
depth the University took along here (Larpenteur Avenue on
the map) left a very narrow strip along Larpenteur and it
seems to me that a good set of structures could have been
built; but now, there is dust a narrow strip left along
Larpenteur Avenue.
Huegs T don't think there is any magic about that 8~ acres, I
think the important thing is we would have a contiguous
piece right next door and we would have access by being
able to cross over that corner.
Nilsen: What all of us would like to see is sough land immediately
adjacent to Larpenteur. Actually, prior acquisition has
been in3urious.
Brought up in our planning years ago, was a proposal for a
land switch between the University and private holders. The
University owns up to Larpenteur Avenue, and we have talked
about switches before.
Blacks This Proposed Ordinance 71 is not changing much. It is merely
allowing additional usage. Would you care to comment on
additional usage that would be allowed?
Huegs If someone else were sitting here, they might be very strict
about this, My feeling is that if the University wanted this,
they could have purchased it before.
Killmers The University has interfered with many sales I could have made.
RESOLUTIONS Black introduced the following resolution and moved its
adoptions
WHEREAS, proposed Ordinance No. 7l which is an ordinance
amending Ordinance No. 61~, has been recommended for passage
by the Planning Commission of the Village of Falcon Heights, and

WHEREAS, the attorney for the Village of Falcon
RESOLUTION Heights has been consulted in the preparation of
Approving passage proposed Ordinance No. 71, and
of Ordinance No.
71: WHEREAS, the Village Council has held discussions
to consider adoption of proposed Ordinance 71,
NONE, THEREFORE, BE IT RESOLVED by the Village
Council of the Village of Falcon Heights that Ordinance
No. 71 amending Ordinance No, 64 entitled "The Zoning
Ordinance of Falcon Heights, related to a comprehensive
amendment and rezoning of the Village amending Ordinance
No. 8 originally passed by the Village of Falcon Heights
on October 21, 1949," be approved for passage,
The motion for passage of Ordinance No. 71 was seconded
by Stone and upon a vote being taken thereon, the
following voted in favor thereof: Nilsen, Warkentien,
Stone and Black, and the following voted against sames
None, Whereupon said Ordinance was declared adopted
this 10th day of March 1965 to be in full force and
effect from and after its publication according to law,
HEARING
Pursuant to due call and notice thereof, the Hearing was
Subdivision of Land called to order at 8:30 P.M, to hear all persons present
George Gasparro Lot
1905 W, Larpenteurs with regard tp application made by George Gasparro
to subdivide property known as the South three hundred
thirty feet of the West one-half of the East sixty
acres of the South one-quarter of Section 16, T~rsp. 29,
Range 23 sub3ect to Larpenteur Avenue in the Village
of Falcon Heights.
The following resolution was introduced by Black who
moved its adoption:
RESOLUTION
Approving Sub- WHEREAS, George Gasparro is the owner of certain
division of real estate located in the Village of Falcon Heights
Lands zoned for multiple family residdntial dwellings, and
WHEREAS, said owner has submitted to the Village
Council plans and data pursuant to Ordinance 69,
Paragraph 3 of said Village for a proposed plan .for
a subdivision of an existing lot by metes and bounds
description, and the council reviewed said. preliminary
plans on February 10, 196,5 and referred them to the
Village Planning Commission pursuant to said Ordinance,
and
WHEREAS, on March 8, 1965 the Planning Commission
approved the preliminary subdivision plans as submitted
by said owner and the Village of Falcon Heights Council
then ordered a Public Hearing to be held on March 10,
1965 at 8s30 P.M, and published mailed notice was given
as required by statate,
NOW, THEREFORE, BE IT RESOLVEDs
1. Said proposed subdivision is hereby approved by

the Village Council of Falcon Heights in accordance
RESOLUTION with the Certificate of Survey of Milner W. Carley
Approving Sub- and Associates dated February 24, 1965 submitted to
division of Lands said Council and on file with the Clerk thereof,
subject to the followings
2. At the time of the conveyance of the sub-
divided lot to purchasers, George Gasparro or his
successor in interest shall create a five foot wide
easement over the westerly five feet of property
line of the new lot, all as shown on the above-
referred to survey. This is for utility purposes and
drainage as necessary on the back lot line.
3. The proposed easements shall be created by
such instruments suitable for recording to be prepared
by the Village Attorney.
The motion for the adoption of the foregoing resolution
was duly seconded by Stone and upon a vote being taken
thereon, the following voted in favor thereofs Nilsen,
Warkentien, Stone and Black whereupon said resolution was
duly declared passed and adopted.
Variance application The variance application submitted by Arthur Jorgenson
Submitted by Arthur under date of February 5, 1965 was deemed unnecessary
Jurgensons and Nilsen moved that the V3.].]_age Clerk be instructed
to return the fee of X5.00 which Jorgenson had paid.
Motion seconded by Warkentien and carried.
Proposed Apartm®nt
Buildings - Killmer's Black introduced the following resolution and moved
Nurseries Property its adoptions
1700 West Larpenteurs WHEREAS, Clarence Lowe and H. Goeman have made an
application for variance and conditional use and filed
the same with the Village of Falcon Heights along with
the fee of X10.00, and
WHEREAS, the matter has been referred to the
Planning Commission for the Village of Falcon Heights,
and
WHEREAS, the Planning Commission has recommended
that said application would be approved if the number
of feet at the rear of the building or the south end of
the property were made to conform to Ordinance 6~. with
respect to the possible extension of Hoyt Avenue,
NOW, THEREFORE, BE IT RESOLVED that Clarence Lowe
arld H. Goeman withdraw said variance and conditional
use app3i3.~ation submitted at this time and submit
new applications when plans have been revised.
Motion for the adoption of the foregoing resolution was

da3y seconded by Warkentien and upon a vote being
taken thereon, the resolution was adopted.
Falcon Heights discussion was held regarding the number of cars
Shell Service being parked at the Shell Station - 1l~07 West
Stations Larpenteur Avenue.
Storm Sewers Black moved that the Village Engineer be authorized
to make preliminary report with regard to instal ling
storm sewers in the drainage district in the northeast
section of the Village of Falcon Heights, Motion was
seconded by Warkentien and upon a vote being taken,
the motion was adopted.
Bills Warkentien moved that the following bills be paid.
