Mayor Nilsen, Clerk Strandquist, Trustees Stone, Black and Warkentien. Also present were Treasurer Olsen and Consulting Engineer Lemberg. Moved by Black, seconded by Stone that the minutes of the meeting of June 30, 1965 be approved. Carried. Variance application Black moved, seconded by Warkentien that the following E. ~. Holes resolution be adopted. 17?1 North Fry: WHEREAS, Everett Holes has made an application for variance from zoning ordinance to construct a garage ahead of the house without being attached to the house, and WHEREAS, the matter has been referred to the Planning Commission of the Village of Falcon Heights, and WHEREAS, the Planning Commission has recommended that said application be granted, provided the applicant obtains the approval of the property owners within 340 feet of his property. NOW, THEREFORE, BE IT RESOLVED that the Village Council grants the variance application made by Everett Holes to construct a garage at 1771 North Fry Street detached from the house as per drawing submitted and on file in the Clerk's Office, at a distance of not less than 52 feet from the front property line. Upon a vote being taken thereupon, the foregoing resolution was unanimously adopted. Licenses Warkentien moved, Stone seconded that the following Master Plumber be granted a license. Ayes All. Nayss None. Motion carried. Master Plumbers Bi11 Schafhauser - 1199 Albemarle, St. Paul Stone moved, seconded by Strandquist that the fo11o9ring Sewer Installer be granted a license. Ayes: A11. Nayss None. Motion carried. Suer Installers Charles Omar League - 887 E. Orange, St. Paul Stone moved, Black seconded that the following be granted license to sell at retail, cigarettes, cigarette paper and cigarette wrappers. Ayes: All. Nays None. Motion carried. Cigarettes: Mrs. C.D. Junk3n - Box 51~, Glen Lake, Minnesota Minnesota State Fair Grounds - grand stand Squae3 car accident: The squad car, driven by Oren Harmer, police office was involved in a collision on July 15, 1965. Standard 031 Stations Strandquist moved, Warkentien seconded that Garnet 2271 Gallimore be granted license to operate gasoline filling station at 1691 North Snelling Avenue subject to the followings 1. There will be no burning of rubbish and waste on the premises. 2. Arrangements shall be made by Gallimore to haul away all rubbish and refuse at least twice a week. Upon a vote being taken the following vote was recordeds Ayess A11. Nays: None. Motion carried. HEARING Mayor Nilsen opened the Public Hearing Por considering Rezoning Application the application of B. V. Marschke to rezone the B. V. Marschke following described property from R-1 to B-la classification: 1695 North Clevelands The East 1166.69 feet of the North 93.3l~ feet of the South 943.69 feet of the SE 1/?~ of Sec. 17, Tsp. 29, R 23 - also known as 1695 North Cleveland Avenue. The Clerk read official notice of hearing on the rezoning application. The Falcon Heights Planning Commission has held Public Hearing an Thursday, July 15, 1965, and in its letter of July 26 to the Village Council has recommended that the B. V. Marschke property and the two adjacent lots in this isolated area remain as R 1 until there is a petition for all three lots to be rezoned to B-la. These lots, i.f individually handled, will tend to create spot zoning problems. Stone moved, seconded by Black that application for rezoning the above described property be tabled. Ayes: A11. Council Recreational was agreeable to terminate recreation program at the school Counselors on August 6, 1965 inasmuch as indoor school facilities will not be available after that date. Counselor will conduct program at Falcon Woods on August 9, 11, and 13. Ordinance No. ?3 Warkentien introduced the following resolution and moved An Ordinance its adoptions Providing for a Traffic Violations WHEREAS, the attorney for the Village of Falcon Heights Bureaus has been consulted in the preparation of proposed Ordinance No. 73, and WHEREAS, the Village Council has held discussions to consider the adoption of proposed Ordinance 73, NtXM1f, 'THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL of the Village of Falcon Heights that Ordinance 73 entitled "An Ordinance Providing for a Traffic Violations Bureau for the Village of Falcon Heights" is hereby approved for passage. 1 1 i The motion for the passage of Ordinance 73 was seconded by 2272 ~l Black and upon a vote being taken thereon, the following voted in favor thereof: Nilsen, Strandquist, Warkentien, Stone and Black, and the following voted against same: None. Whereupon Said ordinance was declared adopted this 28th day of July 1965 to be in full force and effect from and after its publication according to law. Ramsey County League The Ramsey County League of Municipalities in its letter of of Municipalities July 6 requested that this municipality designate someone to act as liaison man with. the Study Committee on surface and storm water drainage. Inasmuch as this Village is now working out its own common problems with the Village of Roseville, the Council feels it is unnecessary to be included in such a study, Variance Application Black introduced the following resolution and moved its William E. Olsen adoptions 17811 North Pascal Garages WHEREAS, William E, Olsen has made an application for variance from ordinance to build a garage at the rear of his home at 178. North Pascal, and WHEREAS, the matter has been referred to the Planning Commission for the Village of Falcon Heights, and WHEREAS, the Planning Commission has recommended that said application be granted if the side yard set back is held to a minimum of 30 inches in lieu of the two feet requested, NOW, THEREFORE, BE IT RESOLVED THAT THE VILLAGE COUNCIL of Falcon Heights grants the variance application made. by William E. Olsen on June 9, 1965 on the basis of the Planning Commission's recommendation and the plans as submitted with the variance application. Granting of this variance is further conditioned upon removal of any other garage type structures on the property prior to construction. Motion was seconded by Warkentisn and upon a vote being taken, the following was recorded: Ayes: All. Nays; None, Motion carried. Conditional Use Black introduced the following resolution and moved its Application - adoptions Ramsey County Historical WHEREAS, the Ramsey County Historical Society has made Society: an application for conditional use permit to place a one- room country school house on the property located at 2097 West Larpenteur Avenue, and WHEREAS, the matter has been referred to the Planning Commission for the Village of Falcon Heights, and L WHEREAS, the Planning Commission has recommended that said application to locate a one-room country schoolhouse on the property providing that the rear and side yard set backs be no less than five feet as required by Ordinance 611, NON, THEREFORE, BE IT RESOLVED THAT THE COUNGII, OF THE Village of Falcon Heights grants the conditional use permit 2273 j/ $ ~ 5 to the Ramsey County Historical Society for use of that property within the Village of Falcon Heights located at 209? West Larpenteur Avenue, which property is presently zoned R-1, all under the provisions of Section 16.05, Ordinance 61~, on the basis that the Planning Commission's recommendation is adhered to, regarding set backs. The foregoing motion was seconded by Stone and upon a vote being taken, the motion was unanimously carried. Application for Stone moved, Strandquist seconded that the application for employment - Fire employment submitted by Leo Lindig, 2061 West Larpenteur be Department Volunteer granted upon condition that applicant is found to be in good Leo Lindig: health after a physical examination and also subject to the six-month probation period, Motion carried. Proposed Northeast Mayor Nilsen read letter of July 23 addressed to Emil Cedarholm, Area Storm Sewer Roseville Mayor. Nilsen's letter was regarding the proposed Improvement 65-1s 1965 Storm Sewer Improvement. Special Meetings State Highway Commissioner John Jamieson and the Council will discuss Larpenteur-Snelling intersection at special meeting called for August ~.th at 7:30 P.M. in the Village Hall. Twin City Lines, Inc. Letter of July 28 from executive vice president, S. A. Caria, Proposed change of of Twin City Lines requested council approval of route change Router to operate over Roselawn Iiamline in lieu of Roselawn-Pascal route. Matter tabled pending comments from citizens. Squad car accident Letter of Swanson and Christoffersen, attorneys, under date Dece ber 19, 196. - of July 22 advised that Mutual Service Casualty Insurance Dewe~ A, Smiths Company has forwarded file to them regarding accident between Officer Smith and vehicle owned by Arthur Holmberg. Clerk was instructed to advise above attorneys that arrangements as indicated in letter are satisfactory to this village and per- mission is granted for their firm to represent the village in reference to the $50 deductible portion which has been paid.
