HomeMy WebLinkAboutCCMin_65Sep222290 REGULAR MEETING OF SEPTEMBER 22, 1965 The regular meeting was called to order at 7:00 P.M. with the following members presents Acting Mayor Willis Warkentien, Clerk Strandquist, Councilmen Black- and Stone. Absents Mayor Nilsen. Also present were Engineer Lemberg, .Attorney Galvin and Treasurer Olsen. Correspondence: County Auditor's letter of September 13 advised that County Commissioners had authorized apportionment of Road & Bridge X1,773.73 in the County's 1965 Road and Bridge fund to Fund: this Village. Mrs. Lester Gills Letter of September 21 from Mrs. Lester Gill, 1765 St. Mary's Street was complaint about the unsatisfactory manner in which sod was laid after the WaterMain Project of 1963. Parking in Alleys: Attorney Calvin's letter of September 13 defined applicable statutes regulating parking in this Village. Hamline Avenue Letter of September 10 from Donald Fazendin, 1928 Traffic: Hamline Avenue was regarding accidents on Hamline Avenue. He expects and would like to receive traffic law enforc®- ment, ambulance service for the in3ured, competent emergency medical treatment by officers and adequate traffic controls and a wider street. Regional League of Invitation was extended to Village Officials to attend Minnesota Munici- meeting to be held on Thursday, October 7 at Bayport, palities Meetings Minnesota, this being the Regional League of Minnesota Municipalities Meeting. Rep. Robert 0. Letter from Robert 0. Ashbach, Representative l~3rd North Ashbach: District was regarding Sanitary Sewer Disposal Plants or Districts in answer to Attorney Calvin's letter. City Comptroller Letter of September 13 from Office of City Comptroller Sewer~Rates: stated that sub-committee of Technical CoYrnnittee has been working on the matter of sewer rates. License: Having met the requirements, it was moved by Black, Master Plumbers seconded by Strandquist and duly carried to issue the following Master Plumber's Licenses #127 - Kenneth Berghorst - Berghorst Plumbing & Heating Co., 1L~08 Coon Rapids Blvd., Coon Rapids, Minnesota. Street and Alley Stone introduced the following resolution and moved its Maintenance Pro3ect adoption: 1965: 11PHEREAS, Engineer Lemberg has approved and recommends for payment the Street and Alley Maintenance Project of 1965, and WHEREAS, an amount of X500 shall be retained until excess sand in alleys is removed, 2291 NOW, THEREFORE, BE IT RESOLVED BY THE COUNC ZL Street and Alley OF THE Village of Falcon Heights that the Village Maintenance Project Clerk be authorized to make payment of $lt,230.l~0 1965 (Cont'd) to T. A. Schifsky and Sons, Inc., 2319 Second St. No., No. St. Paul, Minnesota for the Street and Alley Maintenance Project of 1965. Motion was seconded by Black and upon a vote being taken, the foLlovring voted for sames Warkentien, Stone, Black and Strandquist and the following voted against the same: None. Whereupon the foregoing motion was declared adopted this 22nd day of September 1965. Snow Plow - Holly~rood Ramsey County has informed council, that snow plow Courts has been damaged in the past from low hanging tree branches in Hollywood Court alleys. Village Clerk was instructed to write to property owners stating .that unless trees are properly trimmed, the snow plow will not plow the alleys this coming winter. Young Republicans Meet Village Council granted request of Steve Kellett, in Village Halls 2803 Harrington for use of Village Hall for Young Republican Meeting on September 23, 1965 at 8s00 P.M. Northeast Area Storm Warkentien will contact Roseville Manager Richard Sewer Improvement 65-1s Turnlund in an effort to set a meeting on Monday evening, September 27 of the Falcon Heights Council and the Roseville Council to discuss proposed Northeast Area Storm Sewer Improvement 65-1. PUBLIC HEARING Rezoning application Acting Mayor Warkent~.en opened the Public Hearing A.A.Bilski for considering the application of A.A. Bilski to 1705 North Clevelands rezone the foll~ing~described property from R-1 to B-lA. classifications Sub to Cleveland Ave E l~6b 6/l0O ft of N 373 35/100 ft of SE 1/!~ of SE 1/~. of 17 292317 Clerk Strandquist read official notice of hearing on the rezoning application. The Falcon Heights Planning Commission held Hearing on Septemb®r 20, 1965 (post- poned from September 15 due to lack of a quorum present). The Planning Commission has recommended that the A. A. Bilski property and the two adjacent lots in this isolated area remain as R-1 until there is a petition for all three lots to be rezoned at B-lA,. Mr. John Daubney, attorney representing B. V. Marschke, stated that if R-1 classif ication remains, his client would suffer substantial financial loss. George Nelson, 1689 North Cleveland stated he has no objection to the rezoning of his lot (being the only one of the three that has not petitioned) if such rezoning would not have any affect on the taxes. Attorney Daubney stated he would contact the County Assessor in an effort to determine whether or not the rezoning would affect taxes. 2292 Stone moved, seconded by Black that this Hearing, and the Hearing of July 28th (regarding B. V. Marschke's application to rezone) be continued until October 27, 1965 at 8:00 P.M. Ayes: All. Nays: None. Motion was carried. Engineer's Report Warkentien moved, seconded by Stone that engineer's Hockey rinks: recommendation to purchase 300 feet of chicken netting for hockey rinks at Falcon Heights School and Idaho-- Snelling as protection from hockey pucks be authorized. Motion carried. Oil Burning Stove Warkentien moved, seconded by Black that Village Clerk Falcon Heights be authorized to purchase oil burning stove for warming School Shelters house at Falcon Heights School grounds. Such purchase shall be made :"for the Falcon Heights School Grounds. Such purchase shall be made from the Falcon Heights Hardware at an approximate cost of X85.00. Ayers All. Nays: None. Motion was carried. Warming House at Stone moved, seconded by Warkentien that Village Clerk Falcon Heights be authorized to purchase building materials needed for School - Repairs: repair of the warming house at the Falcon Heights School, at a cost not to exceed X39.08. Motion was carried. Tatum Street Drainage: Attorney advised that E. J. Kammer was willing to give Village license to maintain drainage. At the present time, the Village is seeking mandatory injunction to remove obstruction to the natural drainage of graters. This would place maintenance of same in the hands of the property owner. Kammer states that an easement would lower property value and also that if natural drainage were allowed, his basement would be flooded. Mayor Nilsen and Engineer Lemberg have studied the latter, and are of the opinion that inasmuch as he has had no problems with water in the basement to date, it is highly unlikely that he will have any water if the natural drainage of water is allowed. Variance application Arthur S.Jurgenson 1707 Tatum Streets Apartment Building Garages: Black introduced the following resolution and moved its adoption. WHEREAS, Arthur S. Jorgenson has made an application for variance and filed the same with the Clerk for the Village of Falcon Heights along with the fee of X5.00 and WHEREAS, the matter has been referred to the Planning Commission for the Village of Falcon Heights, and WHEREAS, said variance requests permission to eon-'_: struct three additional garages in conjunction with apartment building at 1707 Tatum Street. WHEREAS, the Planning Commission of the Village of Falcon Heights has recommended that said application be denied, NON(, THEREFORE, BE IT RESOLVED that the Council of the Village of Falcon Heights denies the variance 2293 application made by Arthur S, Jorgenson on September 15, 1965 for variance use of that property described as the N 150 feet of the S 333 feet of the W 1/3 of the S 1/2 of the W 1/2 of the E 60 acres of the StN~ 1/!~ of Sec. 16, T. 29, R. 23 located at 1707 Tatum Street within the Village ofFalcon Heights, which property is presently zoned at R-3, all under the provisions of Section 16.05, Ordinance 6!t for the following reason: 1. Said variance is not in harmony with the general purpose and intent of the ordinance and comprehensive plan of the Village of Falcon Heights. The above motion was seconded by Stone and the following vote was recorded: Ayesz All. Naysa None. Motion carried. Stop Payment on Black moved, seconded by Strandquist that Treasurer Two Checkss be authorized to issue stop payment orders on the following two cheeks: 1. General Fund check 2122 issued to Ramsey County Suburban Life on the ll~th day of May 196t~ for various advertisetteents for bids and publications in the amount of ~291~.30. 2. General Fund check 239lt issued to Nancy Stevenson on November 2l~, 196lt for election fudge duties in the amount of $5.50. The above amounts shall be credited to the General Fund account of the Village of Falcon Heights. The following vote was recorded. Ayess All, Nays: None. Motion was carried. Investment of Fundsz Treasurer Olsen made report of funds available for investment at the present time, whereupon Black moved, Stone seconded the adoption of the following resolutions WHEREAS, on September 30, 1965 there will be funds available for investments, and 'WHEREAS, a schedule of investments and surplus funds has been prepared by the Village Treasurer, NO~if, THEREFORE, BE IT RE50LVED that the Village Treasurer is authorized to make such investments of funds in United States Treasury Bonds and United States Treasury BiL1s to mature as indicated in schedule. Upon a vote being taken, the following vote was recorded: Ayes: All.
