HomeMy WebLinkAboutCCMin_65Sep29_Special2295 SPECIAL MEETING OF SEPTEMBER 29, 1965 (Public Hearing Continued - Storm Sewer Improvement 65 1) Continuation of Public Hearing on the Northeast Area Storm Sewer Improvement 65-1 was approved by resolution at the meeting of the council on August 18, 1965. Hearing was called to order at 8:00 P.M. with approximately ten persons present. Members of the Council present were Mayor Nilsen, Clerk Strandquist, Councilmen Black, Stone andlfifarkentien. Also present were Engineer Lemberg and Attorney Galvin. Lemberg advised that since the Hearing of August 18, 1965, he and members of the council have met with the Village Council of Roseville and it has been established that an agreement between the two municipalities can be satisfactorily executed. Proportionate costs and agreements on the installation of such a system have been worked out, Attorneys for Falcon Heights and Roseville were requested to draw up proposed agreement for sharing of costs and submit same to the councils for review and action. In answer to inquiry, Lemberg advised that boundaries of this drainage district have been re-checked by observation of water and by elevation. Mr. MacMillen again reviewed the recapitulation of results of questionnaire and submitted same to the council to be filed in the office of the village clerk. The manner of assessing was discussed at length with particular emphasis on the deep lots on Albert. MacMillan requested that two short stubs (stops) on Holton be eliminated. Lemberg advised that the detail plan has not been drawn as yet. It was stated that if it is in the best interest of the Village to include these two stubs, they shall be included in the pro3ect. Black introduced the following resolution and moved its adoption. Resolution ordering Northeast 1~HEREAS, a Resolution of the Village Council adopted Area Storm Severer Pro~eet the 26th day of May 1965 fixed a date for a Council. (Improvement 65-1) Hearing on the proposed improvement of: That portion of the Village of Falcon Heights bounded by Roselawn Avenue, Snelling Avenue, Hamline Avenue and Larpenteur Avenue by the construction of storm surer drainage area (Improve- ment 65-1) and ~iEREAS, said hearing originally scheduled for June 30 was continued by Resolution of said Council on June 23, 1965 until July 1lt, 1965, and WfiEREAS, ten days' published notice of the hearing through two weekly publications of the required notice was given and the hearing was held thereon on the lath day of June 1965, at which time all persons desiring to be heard were given an opportunity to be heard thereon, and r 1 1 1 GI~/~j5 2296 I V~HEREAS said hearing was thereafter continued until August 18, 1965, and was thereafter continued to September 29, 1965 in order to receive a report from the Village of Roseville, NCNP, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF FALCON HEIGHTS: 1. Such improvement is hereby ordered as proposed in the Council Resolution adopted Bray 26, 1965; provided, however, that a satisfactory written agreement be entered into between the Village of Falcon Heights, the Village of Roseville and the County of Ramsey for their joint construction and payment of said joint facilities. 2. Plans and specifications prepared by Bonestroo, Rosene, Anderlik aril Associates, Village Consulting Engineers, for such improvement pursuant to Council Resolution, a copy of which plans and specifications is made a part hereof by reference, are hereby approved and shall be filed with the Vi7.lage Clerk. ~i 3. The Village Clerk shall prepare and cause to be inserted in the off icial paper an advertisement for bids upon the making of such improvement under such approved plans and specifications. The advertisement shall be published for three weeks, shall specify the work to be done, shall state that bids will be opened and considered by the Council at 8x00 P.M. on February 23, 1966, in the Council Chambers of the Village Hall, and that no bids will be considered unless sealed and filed with the Clerk and accompanied by a cash deposit, cashier's check, bid bond, or certified check payable to the Clerk for 5~ of the amount of such bid. Adopted by the Council this 29th of September 1965. The motion for the adoption of the foregoing resolution was duly seconded by Stone and upon a vote being taken thereon, the following voted in favor thereof: Nilsen, Warkentien, Stone, Black and Strandquist, and the following voted against the samet None. thereupon said resolution was duly declared passed and adopted. Resolution regarding Stone moved adoption of the following resolution: Agreement with the Village of Roseville WHEREAS, the Village Council has approved and ordered and the County of the improvement of the Northeast Area Storm Sewer Project Ramsey: (Improvement 65-1), and 'WHEREAS, it is necessary to enter into an agreement with the Village of Roseville and the County of Ramsey, i NOW, T~iEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF FALCON HEIGHTS: 1. The contract in form prepared by the Village Attorney is hereby approved. 2297 ~I~~S Sidewalks on Garden Avenue: Rezoning Application 1689, 1705, 169 Cleveland Avenues 2. Upon acceptance by the County of Ramsey and the Village of Roseville, the Clerk and Mayor are hereby authorized to execute said contract on behalf of the Village of Falcon Heights. Motion for adoption of the foregoing resolution was seconded by Black and upon a vote being taken, the following voted for same: Nilsen, Strandquist, Stone, Warkentien and Black; and the following voted against: None. Whereupon said resolution was declared passed and adopted. Robert Moore of 1791 Asbury was present to state that consideration should be given to instal ling sidewalks on Garden Avenue. Black stated that the Planning Commission will make recommendation to rezone the third property at 1689 North Cleveland Avenue. Killmer's Nurseries Black read communication from Clarence Lowe, dated Property - 1700 West September 27, 1965, regarding building of apartments Larpenteur Avenues on Killmer Nurseries property. Attached to that letter was copy of Attorney Donald R. Bundlie's letter of July 23 which stated that the University has decided to proceed immediately with the condemnation of the rear 750 feet of the Killmer property. Lowe's letter mentioned the possibility of trading the K311mer property for land to the north which is presently owned by the Univ®rsity. Falcon Heights School Black moved, seconded by Warkentien that the following Skating Rink: resolution be adopted. WHEREAS, the representatives of the Village of Falcon Heights have been in contact with Dr. Emmett Williams, superintendent of Independent School District 623, in regard to a ma3or area for skating on the Falcon Heights School property, and WHEREAS, on September 28, 1965 Dr. Williams advised the representatives that the Village of Falcon Heights can utilize an area 30 feet east and 15 feet south of the area previously utilized, NOW, THEREFORE, BE IT RESOLVED that sub3ect to proper leasing arrangements, the Village Engineer is hereby authorized to arrange for grading of this property for skating purposes, the cost for same to be paid by the Village of Falcon Heights. Purchase of Oil Stone moved that two 265 ga]1on oil tanks for use in the Tanks for Warming warming houses at the Falcon Heights School and the Houses: Falcon Woods playgrounds be purchased. Motion seconded by Nilsen and upon a vote, motion was carried. Resolution Levying On motion by Warkentien, seconded by Black and carried, Special Assessments it was voted to adopt the following resolution levying 1 1 1 Sfor Delinquent S~itary special assessments for delinquent sanitary sewer charges. ewer Charges 2298 BE TT RESOLVED by the Village Council of the Village of Falcon Heights, Ramsey County, Minnesota as follows: 1. It is hereby determined that there are delinquent sewer charges against the properties hereinafter set forth, in the amounts set forth opposite the description of such properties. 1 2. A special assessment in the amount hereinafter set forth is hereby levied against each of such tracts respectively. 3. The total amount of such special assessment, in each case, shall be payable with the 1965 real estate taxes due and payable during 1966. 4. The Clerk shall forthwith transmit a certified copy of the assessment to the County Auditor to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the sans manner as other municipal taxes. 5. A the W 75 Feet of E l~05.48 ft of S 265.12 of E 30 acres of SW 1/!~ of 16 292316 Sewer rentals due September 30, 196l~ thru June 30, 1965 ~3l~,68 Penalties ~-• ~ ~~.5.68 2299 Resolution Authorizing the Payment of Stat®- ment of Cost of Destroying Weeds and Certifying Same to Ramsey County Auditor: WHEREAS, that certain real estate located in the Village of Falcon Heights, Minnesota, owned by Julia Lindig, 1870 West Roselawn Avenue, St. Paul, Minnesota described as Ex N 225 feet of South 825 feet W_ of E 25 ft, the South 1,050 feet more or less of the East 1/3 of the North~rest 1/!~ of the East 60 acres of the Southwest 1/~ of Sec l6, T29R23 On motion by Strandquist, seconded by Stone and carried, it was voted to adopt the follo~ring resolution certifying statement to the County Auditor for the purpose of having the same extended upon the tax lists and become a lien in the nature of a special assessment upon said property. has been found by the Village Weed Inspector to be infested with noxious weed growth, and WHEREAS, said Weed Inspector caused the notice required by statute to be served upon the said Julia Lindig requiring her to eradicate said weeds, and WHEREAS, said Julia Lindig has not complied with said notice, said Weed Inspector authorized J. W. Koalska to destroy said noxious weed growth standing and. growing upon the above described real estate, and WHEREAS, said J. W. Koalska did comply with the Inspector's authorization to destroy said noxious growth of weed and. has filed his statement of cost of destroying weeds with the Village Clerk in a total amount of $55.00 NOVP, THEREFORE, BE IT RESOLVED SY THE VILLAGE COUNCIL OF THE VILLAGE OF FALCON HEIQiTS, M~OTA 1. The Village Treasurer is hereby authorized to pay a sum of X55.00 to J.W. Koalska as the cost of destroying weeds on the above described real estate, and 2. The Clerk of the Village of Falcon Heights is hereby authorized to certify said statement to the County Auditor for the purpose of having the same extended upon the tax lists and become a lien in the nature of a special assessment upon said property.
