Absents Clerk Strandquist. Also present were Treasurer Olsen, Engineer Lemberg and Attorney Galvin. Minutes: Stone moved, seconded by Black that the minutes of the meeting of February 23 be approved. Motion was carried. Letter dated January 26, 1966 from Peter McGough, W. Falcon Heights President of the West Falcon Heights Playground Associatiq~, Playgrounds addressed to Kenneth Quern, maintenance department, expressed thanks for the fine fob done in keeping skating rink and warming house in excellent condition. Correspondence Falcon Heights State Letter of March 8, 1966 from D. F. Weager, Cashier of the Bank Bonds Pledged Falcon Heights State Bank was reviewed. It stated the to Villages amount of bonds pledgedto the Village totalled X168,000 and advised that all village accounts are considered as one account and insured accordingly. Application for Stone moved, seconded by Warkentien that the application Employment -Volunteer for employment submitted by Victor Vainovsk3.s be grant®d Fire Departments upon condition that applicant is found to be in good health of ter a physical examination and also subject to the six-month probation period. Ayes: All. Nayss None. Motion was carried. Donald Arndt - Donald Arndt, Police Commissioner was present and reviewed Police Commissioners activities in the Police Department for the month of February. Water problem in Lindig Mr. and Mrs. Gennaro of 1771 Lindig Street were Aresent Streets regarding water that collects bettyeen the houses. Dis- cussion was held. Engineer Lemberg will review suggestions made and the council will make further investigation to help remedy the undesirable water condition. Civil Defense - Purchase Upon request of Paul Loomis and Donald Pantzar, Civil Requisitions Defense Directors, Stone moved, seconded by Nilsen that the Village Clerk be authorized to purchase one !~-drawer letter filing cabinet to be used by civil defense directors. Ayes: A11. Nays: None. Motion was carried. Larpenteur B~anor, Inc. The following four persons revi~red with the council plans Killmer Nursery for 120 unit apartment buildings .Albert Rubinger, Fresi- Property Proposed dent Larpenteur Manor, Inc., Harry Goemann, Mel Gittleman, Apartment Buildings; and Ken Nordby, architect from the firm of Associated Architects and Engineers, Inc. After review, Black introduced the following resolution and moved its adoptions IiPHHEREAS, plans for proposed 120 unit apartment building on the former Killmer Nurseries Property described as the East 20 rods (330.0') of the N.W. 1/J.~ of the N. E. 1/~ of 2345 of Sec. 21, T. 29,N R. 23 W., exc the southerly 630 thereof and sub3ect to Larpenteur Avenue have been presented to the Council, and Larpenteur Manor, Inc. WHEREAS, application for variance has been filed Killmer Nursery along Kith the fee of $5.00 to allo~r garages to be Property - Proposed built within five feet of side lot lines, and Apartment Buildings WHEREAS, conditional use request along with the fee of $5.00 has been submitted to allow multiple family development in a B-1 ~ district in accordance with Ordinance No. 71 amending Zoning Ordinance No. 64 and, WHEREAS, the consulting engineer has been authorized to review proposed plans for said apartment buildings, NUS, THEREFORE, BE IT RESOLVED BY THE VILLAGE CO ~1CIL OF FALCON HEIGHTS that variance application and conditional use application submitted by interested parties above, be referred to the Falcon Heights Planning Commission for its review and recommendations. Motion was duly seconded by Nilsen and upon a vote being taken, the follarring voted in favor thereof: Nilsen, Black, Stone and Warkentien and the following voted against same: None. Whereupon said resolution was adopted by the Council. Art Lindig Request for Variance in Lot 1, Black introduced the following resolution and moved Block 1, Lindig First its adoptions Additions WHEREAS, Art Lindig has made an application for variance and filed the same with the Village of Falcon Heights along with the fee of $5.00, and WHEREAS, the matter has been referred to the Planning Commission for the Village of Falcon Heights, and WHEREAS, the Planning Commission of the Village of Falcon Heights has recommended that said application be denied by reason of the followings (a) The lot size is 5,700 square feet instead of the required 12,500 feet. (b) The construction of a double ~aungalow on part of the same lot which now has a greenhouse means two buildings on one lot which is prohibited. (c) The plan proposed sho~rs only one garage. (d) The back yard set back is only seven feet instead of the required thirty feet. Nom, THEREFORE, BE IT RE50LVEA that the Village Council of Falcon Heights denies the variance application 1 1 1 23ts6 made by :Art Lindig on the 23rd day of February 1966 for use of that property described as Lot 1, Block 1, Lindig First Addition located north of and adjacent to Lindig's Greenhouse at 1875 West Larpenteur Avenue which property is presently zoned as R-3, all under the provisions of Sec. 16.05, Ordinance No. 64 of the Village of Falcon Heights for the reason followings 1. Said variance is not in harmony with the general purpose and intent of the Ordinance and comprehensive plan of the Village of Falcon Heights. Motion was duly seconded by Stone and upon a vote being taken, the following voted for sames Nilsen , Black, Warkentien and Stone and the following voted against sames None. Whereupon said resolution was adopted by the Council.. Damage to Police Council was advised that minor claim against Standard Oil Car by employee Station at 1697 North Snelling Avenue was denied by insurance of Standard Oil carrier, therefore, damages amounting to X21.11 on the Village Stations police car remain unpaid. Warkentien was requested to contact Garnet Gallimore, manager of said station, in an effort to settle. Dog Control It was moved by Black, seconded by Warkentien that the Village Resolutions Council adopt the following resolution regarding the keeping of dogs within the Village of Falcon Heights WHEREAS, the Village of Falcon Heights has adopted an ordinance Registering and Regulating the Keeping of Dogs in said Village, being Ordinance No. 39, adopted April 11, 1956, and WHEREAS, under the provisions of Section 1!~ of said Ordinance, the Falcon Heights Village Council is authorized to enact a resolution prohibiting, for a given time, any and all dogs from running at large in said Village, NOw, THEREFORE, BE IT RESOLVED that any and all dogs are prohibited from running at large in the Village of Falcon Heights from April 1st to September 30th, 1966 inclusive. A dog is deemed "at large" whenever it is off the property of his owner or keeper and not under restraint. Such dog shall be deemed under restraint only when it i~ controlled by a leash not exceeding 6 feet in length, or it is at "heel" beside a competent person having custody of him and obedient to that person's commands, or within a vehicle being driven or pushed on a public street or within the property limits of his owner's premises. An unattended dog on the property of another, without the consent of such property owner is "at large" and not under restraint even though he is on a leash. Upon a vote being taken, the following voted in favor of sames Nilsen, Stone, Warkentien and Black and the following voted against same: None. Motion was carried. 23l~7 Resolution Accepting Warkenti.en introduced the following resolution Bid for Poliee Cara and moved its adoption: WHEREAS, pursuant to advertisement for bids for the purchase of a 1966 two-door six-passenger sedan to be used as the Village police car, bids were received, opened and tabulated according to law, on February 23, and the acceptance of a bid was continued until March 9, 1966, for purposes of determining the reasonableness of said bid, the fact that it complied with the specifications and the responsibility of the bidder, and the following bid was received and determined to have complied with the advertisement: Fairview Plymouth (bid with trade-i.n allowance and with installation costs of X100) - Total ~7.,l~98.00 and WHEREAS, it appears that Fairview Plymouth of Saint Paul, Minnesota is the only bidder and is also the lowest responsible bidder, NOW, THEREFORE, BE IT RESOLVED BY THE VTLLAGE COUNCIL OF FALCON HETC~iTS, MINNESOTAs 1. The Mayor and Clerk are hereby authorized and directed to enter into the contract, a copy of which is vn file with the Clerk, with Fairview Plymouth of Saint Paul, Minnesota, in the name of the Village of Falcon Heights for the purchase of said 1966 two-door six-passenger Plymouth sedan according to the specifications therefor approved by the Village Council and on file in the office of the Village Clerk. 2. The Village Clerk is hereby authorized and directed to retain the deposit of the successful bidder until the contract has been executed. The motion was seconded by Stone and upon a vote being taken thereon, the following voted for same: Nilsen, Stone, Black and Warkentien and the following voted against samea None. Whereupon said resolution was adopted by the Village Council this 9th day of March 1966. Resolution Authorizing an Agreement betoireen the Stone introduced the following resolution and moved Villages of Falcon Heights, its adoption: Roseville and Ramsey County for the Construction of a WIiERE~iS, pursuant to public hearing and action Joint Storm Severer Facility of the Village Council of Falcon Heights, said -Improvement 65 I Council has ordered the improvement of that portion (66-1): of the Village bounded by Hemline Avenue, I~arpsnteur Avenue, Snelling Avenue and Roselawn Avenue by con- struction of a storm sewer drainage area and accessory facilities; and i 1 1 2348 i WHEREAS, in order to successfully construct and operate said facilities, it is necessary to enter into a point agreement between the Village of Falcon .Heights, the Village of Roseville and the County of Ramsey, Minnesota for the construction of said facilities, and WHEREAS, the Village of Falcon Heights has instructed its Village Attorney and Village Engineer to prepare a suitable agreement between said part3;es for the accomplishment of said ir~prbveinent, and WHEREAS, said agrent has been prepared, reviewed and approved by said Village Attorney and Village Engineer; NOW', THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF FALCON HET(~iTS, MINNESOTAs The Mayor is hereby authorised and directed to enter into said contract, a copy of which is on file with the Clerk, in the name of the Village of Falcon Heights for the con- struction of said point facilities, and the sharing of said expenses all in accordance with the plans and specifications previously approved by the Village Council and on file in the office of the Village Clerk. 1 1 Motion was seconded by Black and upon a vote being taken thereon, the following voted for same: Nilsen, Stone, Black and Warkentien and the following voted against same: Non®.
