Alsm present were Treasurer Olsen, Attorney Galvin. Absents Engineer Lomberg. Stone moved, seconded by Black that the minutes of the special meeting of April !~, 1966 be approved. Motion carried. Black moved, seconded by Stone that the minutes of the regular meeting of April 13, 1966 be approved. Motion carried. Mrs. Bobbe Nolan represented the League of Women Voters. Correspondences N, E. Storm Server Letter from Attorney Galvin under date of April 27 Improvement 65-1 enclosed certificate of insurance for workmen's compen- (66-.1)s cation and also liability for Harold Wellman dba Commercial Cartage Company. Attorney has reviewed certificate and finds that it complies with they requirements of agreement. N. E, Storm Sewer Copy of letter dated April 25, 1966 addressed to Bonestroo, Imp. 65 ~ (66-1) Rosene, Anderlik and Associates stated that Board of Approval of Board County Commissioners has approved request in behalf of of County Commissionerss Village for permission to construct N, E, Area Storm Sewer Project in the rights-of~ay of county roads. Sama was signed by Deane R. Anklan, County Engineer. Joint Agreements Letter signed by Deane R. Anklan, Count~- Engineer dated April 1l~, 1966 enclosed copy of resolution and agreement between Ramsey County, Falcon Heights and Roseville for point storm sewer improvements. Safety Belt Campaigns State Aid Memorandum No. 66-16 dated April 18, 1966 to County Highway Engineers and Municipal Engineers stated that campaign to promote the use of safety belts in automobiles began on April 15 and will extend through May 31, 1966. Lost and Abandoned Black moved that i.n the absence of an express ordinance Property found within of the Village of Falcon Heights permitting the advertise- the Village of Falcon merit of sale and the sale of lost or stolen property, and Heights in view of the difficulty that would arise with municipal officers and agents claiming title to such property after a period of abandonment through their right of finding the same, that the two bicycles abandoned and in custos~* of the Village for a period of two years, be turned over to a suitable agency or public charity. Motion was sec®nded by Warkentien and upon a vote being taken, the motion was carried. Weed Inspector Mayor Nilsen appointed Kenneth F, Quarn as Weed Inspector Appointeds for the Village of Falcon Heights for the remainder of the year 1966, with stipulation that said weed inspector shall be compensated for same. Annual Weed and Seed Official notice dated April 25, 1966 for Weed and Seed Conferenc®t Conference called for 7:30 P.M. May !~, 1966 at the County Agent's Office was read. Nilsen moved that Kenneth Quarn be authorized ~ attend this conference. Seconded by Strandquist and carried. 2362 Election Laws: Letter dated March 1~ 19b6 over signature of C. B. Kammerer, Supervisor of Elections, attached copy of number of laws relating to elections that were added or changed during 19b5 Session of Minnesota Legislature.. Course in Solid Letter dated April 13, from Institute of Technology, Waste Disposals Department of Civil Engineering advised of course in solid waste disposal at the University of Minnesota for graduate students majoring in Sanitary Engineering. Maritime Days Letter dated April 18 from the U.S. Department of Commerce was regarding Maritime day May 22, 19bb. Spic 'N Spans Letter dated April ll~, 196b from the St. Paul Area Cham#~er of Commerce was regarding Spic 'N Span plan and positive program of clean up and beautification set for the month of May. Har Mar Express Bus- Letter dated April. 27 from John H. Benidt, 1707 North Fry Suggested Bus Stc3ps Street suggested that steps be taken to have the Har Mar Express Bus make a stop at Larpenteur and Snelling. Mayor Nilsen will talk to some of the Falcon Heights businessmen regarding same. Larpenteur-Snelling A meeting was held in the Village Hall on April 22, 19bb Signal Changers regarding the proposed Larpenteur-Snelling Signal, changes. The following persons were in attendances Mayor Nilsen, Clerk Strandquist, Engineer Lemberg, Bill Cheno~reth and Deane Anklan from the Ramsey County F.k~gineer's Office. Meeting with Universi ty Mayor Nilsen and Attorney Galvin attended a meeting this Officialss day at Coffman Union on the University campus. The following persons from the University were in attendances Roy V. Lund, Vice President in charge of Physical Plant, Joseph Tierney, Attorney, Elmer Learn, Assistant to the President in charge of planning (also a resident of Falcon Height's), and James Worthington, Administrative Assistant. Tt was reported that some of the items discussed were as follows (1) Possible University acquisition of Cleveland Avenue Acquisition of property, also property located at 2129 W. Larpenteur - Propertys ad3acent to the University Golf Course. Golf Courses (2) Development of golf course south of Larpenteur Avenue. Recreation areass (3) Inquiries regarding recreation area in University Grove or on University lands should be referred to Dr. Learn It was stated. that University facilities will not be avail- ab~.e (not even on temporary basis) until plans are finalized. Expanse of Us (!~) General expanse of University and possible building A ic. ~ ~ o~= locations -re-affirmed matter of permanent plots south of ' Larpenteur Avenue for agricultural purposes. (5) Possibility of thoroughfares, land switches, and transportation between the farm campus and the main campus. (b) Maintenance of streets in the University Grove area. X363 University - At the foregoing meeting, it was stated that the Watermain Improvement assessment made by the Village of Falcon Heights of 1963- Assessments for the WaterMain Improvement mf 1963 is treated as a separate item and further that the Legislator®, since 1963, has not appropriated any money for muni- cipal improvem®nts. University gill adv3.se this Village by letter (in response to our letter to the Board of Regents) that they are not in a position at the present time to pay assessment, but same will b® resubmitted to the 1967 session of the Legislature. Donald Arndt, Police Police Commissioner Donald Arndt, presented his regular Commissioner: report tc: the counci.].. Howard Raymond Jensen, who applied for position as a police officer, was introduced Howard Raymond to the council. After discussion, Warkentien moved that Jensen engaged said applicant be engaged as police officer for the as Police Officers Village of Falcon Heights subject to his passing the physical examination, and subject to the six months probation period and shall commence work as soon as possible after May 1st. Further moved that he shall be paid a salary of X475.00 during the six months pro- bation period With an increase in salary if, after review, same is merited. Motion was duly seconded by Ston®. Ayess All. Nays: None. Motion was carried. Purchase of Lawn Stone moved, seconded by Strandquist that Kenn®th Mowers quern be authorized to purchase a 21r~ Hevi-Duty Power Propelled Whirlwind Lawn Mower (Toro) from the Falcon Heights Hardware Store at a net cost ®f x.45.00 with trade-in on the present lacxrra mower. Ayess All. Nayss None. Motion was carried. University of Minnesota Treasurer Olsen gave short report on luncheon meeting Fire School Luncheons h® had attended in conjunction with the Fire School which was held on the Univ®rsity Farm Campus. Water Com~ection Charge After review, Strandquist moved, seconded by Black that Uncollectibles the water connection charge due the Village from 1816 Tatum Street be deemed uncollectible due to the fact that previous oener was deceased. Resolution Providing Stone introduced the following resolution and moved its adoption: for the Issuance and Sale off` Storm Sewer BE IT RESOLVED by the Village Council of Falcon Heights Improvem®nt Bonds of as follows 1:966: WHEREAS, the Village Council of Said Village has hereto- fore determined to construct storm sewer improvements and appurtenances thereto, in the Village, and WHEREAS, the Village Council has entered into contracts for the construction of said improvements, and WHEREAS, no other obligations have been issued to defray the expense of said improvements, NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Falcon Heights, as follows: 1. The Village shall forthwith issue its negotiable coupon general obligation bonds to be known as 'Storm Sewer Improvement Bonds of 1966~~ in the aggregate principal amount of X77,000 to be 23b4 77 in number and numbered consecutively from l to 77, both inclusive, dated April 1, 1866, to bear interest from the date thereof until the principal is paid at the rate of three and seventy-five hundredths per cent (3•?5~) per annum on all bonds, payable April 1, 1967, and semi-annually thereafter on October 1 and April 1 in each year, plus additional interest on all bonds, from June 1, 1966 to October 1, 1967 at the rate of one and seventy-five hundredths per cent (1.750 per annum, payable April 1, 1867 and October 1, 1867. Said bonds shall be payable as to principal and interest at The American National Bank .and Trust Company in St. Paul, Minnesota, and shall mature serially on April 1 in the years and amounts as follows: 7,000 in the year 1969; and 10,000 in each of the years 1970 to 1976, both inclusive. All bonds maturing in the years 1972 to 1976, both inclusive (bonds numbered 28 to 77, both inclusive), shall be subject to redemption and prior payment at the option of the Village, in inverse order of serial numbers on April 1, 1971 and on any interest payment date thereafter, at par and accrued interest, plus a premium of $20.00. At least thirty days prior notice of redemption shall in each case be given to the bank where .said bonds are payable, to Juran & Moody, Inc., St. Paul, Minnesota, and to the last known holder. Holders desiring to receive such notice must register their names, addresses and bond numbers with the Village Clerk. 2. The bonds and interest coupons to be issued hereunder shall be in substantially the following form: UNITED STATES OF AMERICA STATE OF MINNESOTA COUNTY OF RAMSEY VILLAGE OF FALCON HEIGHTS STORM SEWER IMPROVEMENT BOND OF 1966 No. $1,000.00 KNOW ALL MEN BY THESE PRESENTS that the Village of Falcon Heights, Ramsey County, Minnesota, acknowledges itself to be indebted and for value received promises to pay to bearer the sum of ONE THOUSAND DOLLARS on the first day of April, 19 , and to pay interest thereon from the date hereof until said principal sum is paid at the rate of three and seventy-five hundredths per cent (3.750 per annum, payable on April 1, 1967 and semi-annually thereafter on the first day of October and the first day of April in each year, plus additional interest at the rate of one and seventy-five hundredths per cent (1.750 per annum -Prom June 1, 1966 to October 1, 1967, payable April 1, 1967 and Octo- ber 1, 1867, in accordance with and upon presentation and surrender of the interest coupons hereto attached, which are in two sets, one representing interest at the rate of three and sevent.Y-five hundredths per cent (3.750 per mum from the date nerCOf to maturity and the other representing additional interest at the rate of one and seventy- five hundredths per cent (1.750 per annum from June 1, 1966 to Octo- ber 1, 1967. This bond is one of an issue in the total principal amount of $77,000 all of like date and tenor, except as to maturity and redemption privilege, whichbond has been issued pursuant to and in full conformity with the constitution and laws of the State of Minne- sofa for the purpose of providing money for storm sewer improvements for. the Village, and is payable out of the Storm Sewer Improvement Bonds of 1966 Fund of the Village. This bond conStLtutes a general obligation of the Village and to provide moneys for the prompt and .full payment of said principal and interest when the same become due, the full faith and credit of said Village have been and are hereby irrevocably pledged. IT IS HEREBY CERTIFIED AND RECITED that all acts, conditions and things required by the constitut on and laws c~' the State of Minnesota to be done, to happen and to be performed pr$cedent to and in the issuance of this bond have been done, have happened and have been performed, in regular and due form, time and manner as required by law, and this bond, together with all other debts of the Village outstanding on the date:.herer3f • ar~d the date of its actual issuance and delivery does not exceed any constitutional or statutory limi- tation of indebtedness. The bonds shall be prepared under the direction of -the Village Clerk and shall be executed by the Mayor and the Vi11-age Clerk and the seal of the Village shall be impressed thereon. The interest coupons attached to said bonds shall be executed and authenticated by the printed, engraved, or lithographed facs~.mile signatures of the Mayor and Clerk. 'When the bonds have been so prepared and executed, they shall be delivered to the Village Treasurer who shall deliver .the same to the purchaser thereof as hereinafter provided but the purchaser shall not be required to see to the proper application of the purchase price. ~+. There is hereby created a special fund to be designated as "Storm Sewer Improvement Bonds of 1966 Fund" to be held and admin- istered by the Village Treasurer separate and apart from all other funds of the Village.. Said fund shall be maintained in the manner .herein specified until all of the bonds herein authorized and interest thereon shall have been fully paid. In said fund there shall be main- tained two separate accounts, to be designated as the "construction Account" and the "Sinking Fund Account", respectively. The proceeds of the sale of the bonds herein authorized, less accrued interest received thereon, shall be credited to the Construction Account, from which there shall`be paid all costs and expenses of making said improve ment, including the costs of construction contracts heretofore let and: all other costs incurred and to be incurred and the moneys in said account shall be used for no other purpose, provided that if upon com- pletion of said improvement there shall remain any unexpended balance in said Construction Account, such balance shall be transferred to the Sinking Fund Account. There shall be credited to the Sinking Fund Account all collections of the special assessments herein levied, all accrued interest received upon delivery of the bonds, all funds remain- ing in said Construction Account after completion of the improvement and payment of the costs thereof and all collections of taxes herein levied. The Sinking Fund Account shall be used solely to pay princi- pal and interest on the bond issued hereunder. 236:' 5. It is hereby determined that n6~less than 20/ of the cost of said improvement shall be paid by special assessments to be levied against; every assessable lot, piece and parcel of land benefited by the said improvements. The Village hereby covenants and agrees that it will do and perform, as soon as they may be done, all acts and things necessary for the final and valid levy of such special asses- sments, and in the event that any such assessment be at any time held invalt~d with respect to any lot, piece or parcel of land, due to any error, defect or irregularity in any action or proceeding taken or to be taken by the Village or this Council or any of the Village's officers or employees, either in the making of such assessment or in the per- formance of any condition precedent thereto, the Village and this Council will forthwith do and perform, all such further acts and take all such further proceedings as may be required by law to make such assessment a valid and binding lien upon such property. Said assess- ments shall be payable in 16 equal, consecutive, annual installments, the first of said installments to be payable with general taxes for the year 1966 collectible with such taxes during the year 196 7. To the firstinstallment there shall be added interest at the rate of s_ix per cent per annum on the entire assessment from the date of the resolution levying the assessment until December 31, 196 7. To each subsequent installment there shall be added interest at said rate for one year on all unpaid installments. 6. To provide moneys for the payment of principal and inter- est there is hereby levied upon all of the taxable property in the Village a direct general annual ad valorem tax, which shall be spread upon the tax rolls and colll.ected with and as apart of other general property taxes in the said Village for the years and in the amounts as '~ follows : _ . The full faith and credit of the Village is hereby pledged for the payment of the principal and interest of said bonds . 8. The Village Clerk is hereby directed to file a certified copy of this resolution with the County Auditor of Ramsey County, Minnesota, together with such other information as he shall require, and to obtain from. said Auditor a certificate that said bonds have been entered in the Auditor's Bo~id Register. 9. The offer of Juran and Moody, Irc . , of St . Paul, Minnesota, to purchase the bonds hereunder at par and accrued interest, is hereby accepted and when said bonds have been printed, the same shall be delivered to the purchaser in accordance with said offer. 236$ The motion for the adoption of the foregoing resolution was duly seconded by Black and upon a vote being taken thereon, the following voted in favor thereof: Nilsen, Strandquist, Black and Stone, and the following voted against the same.
