Also present were Engineer Lemberg, Attorney Galvin and Treasurer Olsen. 2~ 7b Minutess Stone moved, seconded by Strandquist that minutes of the regular meeting of May 25, 19b6 be approved. Motion carried. Hearing of June Upon request of Attorney Jerome W. Beardsley, attorney for 22nd Continued - the petitioners for the vacation of walkway between Pascal Vacation of and Holton at Ruggles, the council agreed to continue said Walkways hearing from June 22nd to July bth. Beardsley stated he will be out of town on the earlier date. Correspondence: Letter from Carl Bucher, Ramsey County Weed Inspector, Weeds to be cut advised that weeds must be eut'by July 1, 1966. by July 1, 1966: Copy of letter of Jun® 7, written to St. Paul Water St. Paul Water Department signed by Engineer Lemberg, stated that offsets Department - found necessary during construction of Storm Sewer Pro3eet N.E,Area Storm 66-1, are authorized and cost of same should be billed to Sewer Project: the Village of Falcon Heights. Capitol City ~ Letter dated May 27 from Vincent Schadegg, insurance agent, Mutual Aid Agree- addressed to Attorney Galvin was reviewed. Saone was in ment -Insurance answer to inquiry regarding insurance premiums and the Premiums Capitol City Mutual Aid Association Agreement. HEA~TNGs Improvement on At 8:00 P.M., Mayor Nilsen opened the Public Hearing for the Albert Street Proposed Albert-Larpenteur Improvement. Clerk Strandquist North of Larpenteur read the official notice of hearing. There were approx- Avenue: imately twenty people present. Engineer Lemberg gave report as to what is to be accomplished on this proposed project. R. D. 1Rhaley That water has been hitting me for a long time. Ts this all 170l~ Alberts they are going to do? We .had good drainage before the sewer was put in. I was assured then that they would go back to the elevation of the street, but instead, they raised it about eight inches. I have taken the entrance to mgr drive- way and diked it. If you put this in, in this way, how do you intend to drain it? I am definitely against this. Harry Bruncke My driveway is about at the point where the sewer clean out 1710 Alberts was, and when the sewer was put in, the cover for that manhole was put down about six inches from where the original grade was and then they raised the road six inches and my driveway was about the same as Mr. Whaley's. The water gets into the driveway and there is no way for it to get out. We had very good drainage until they built Larpenteur. That upset the apple cart. The catch basin doesn't do the fob it should. A11 these factors have contributed to this water problem. About the sixty fast - it looks to us that it should go back 160 feet. Lembergs The reason for sixty feet - that is far enough from the intersection so we can reshape the gutters to carry the water into these lower places. 2377 Resident: If you look in the records, I sent a lot of letters about the damage done and also was told I could collect nothing. It seems that the Larpenteur Avenue Improvement is the cause and we should not have to pay for this. Whaley: The street or county stopped the flow of water. The Village should have made the county take care of this James White Before they fixed the street in the fall of that year, it 1716 Alberts was so muddy, and the hole had all kinds of sand in there and then when they re-surfaced the road, they blacktopped right over that - way above grade and engineer's stakes. When I built the house in 1927, I never had a water problem on my driveway, but now, I have it running in and over the top of my sidewalk. William Mock I live on the corner of Larpenteur and Albert. That goes 1397 Larpenteur: through my property and I am very much opposed to it. Lemberg explained that the notice sent was not intended to mean there would be any work done on his property, Mocks There is no gutter at all for twenty feet. There is a rise of four to six inches - the water cannot run to the drain. Right now there is a puddle there. I say - put the gutter down a little bit. Lemberg: We have dun levels on it and it would then be too low to go into the catch basin. Mocks Higher pitch in the center, maybe? Nilsen: Where does the water come from that is in your driveway? Brunekes The water comes down the back end, down the center and winds up in Liedholm's yard, My garage is six inches below Albert - right in line with my driveway. The ditch should be lowered back here to keep it out of the driveways. How deep would this be? Lemberg: Four to six feet. Nilsens Where does the water come out? Mocks T have two lots and one is lower and it gets two to two-and- one-half feet deep in the spring. As soon as the frost gets out of the dry wells, it drains out. The present ones are six inches lower and they cannot be dropped any more. If any more, there would be a nine inch drop off. Whaley: I am for it but I don't want to pay anything if it isn't going to help the situation any, The engineer wasn't too good when they put the sewer in. If I hadn't been alert, I don't know what would have happened. They sent a high school kid around to measure. They never stopped to find out that the drain under my hous® is fourteen inches. Whites I want to get rid of it from the first catch basin on the west to the second. There is always water in front of the filling station. ~1 1 1 23 78 Lemberg: We will reshape the gutter here both ways. Blacks Will the gutter be much deeper. Lemberg: It will be cut down so it will drain down. We want to reshape the gutters further back,too,and we expect to get a normal six inch curb, also so that we have a crown on the street. Nilsens Suppose Mr. Mock developed the back of his lot, where would the water go? Mocks It would go to Liedholm~s driveway. It is lc~w~®r. Nilsens I am concerned about the water in the spring. Bruneke: We would like to see you reshape the gutters so that we have a natural crown and natural boulevard section instead of one higher than the boulevard. Warren Hansen We have a lot of water - almost a lake, and there is 3ust a 1757 No. Alberts little too much water for the birds to drink. Warkentien: We have continual depressing of the streets in front of the Shell Station. Shouldn't we go beyond - where we can reach all the water. The big puddle is always in front of the empty lots there. Lemberg: It is cheaper and better to reshape the gutters than to lay six inch pipe all the way. The catch basins will be lower than what they are naro~. Warkentiens Let's be sure the drainage Sob is done well enough. Brunekes What is the possibility of the county paying for this? Nilsens I doubt that they would pay for anything of this nature. The County has adopted a nevi policy about all of their roads and I doubt very much they would pay any of this. Whaleys The county should have been held responsible for stopping the flow. Nilsens As far as the cost - there will not be lE~ assessment. The street is involved here, too, but the council would not want to state at this time what the proportion of assessment would be. Whaleys I bought 1~2 lo~.ds of dirt brought in to get up to Larpenteur Avenue level. My property is high enough ncsw so I don't get much water. That water doesn't come from the street, it comes from east of us. A11 we would have to do is run a dike down the back end of our lots and let Hamline Avenue keep their water over there. Gene Piche Regarding the method of assessment. It is ~' assumption that 1758 .A.7-bens the improvement would be paid for 100 by the abutting property owners on Albert. The drainage problem is not on the deeper lots. I am a little curous for the differential assessment for the deeper lots as opposed to the Larpenteur Avenue lots. 2,~ 79 Lemberg: Normally in drainage districts, the front of the lot is used. Trustee Stone brought up matter about curb and gutters that had been installed and the matter of assessments. Lembergs On curb and gutters to date, the assessment has been X2.50 per front foot and the remainder of cost and replacing of bituminous has been picked up by the Village, Nilsens This whole thing bothered me - so I came through there tonight and there isn't any water. Brunckes I am in favor of doing something and maybe this is best. Whaleys You do have drawings and stuff on paper? Lembergs Yes, Whaley: I often wondered. Brunckes I assume that the amount of assessment is so small that it will not be put on a 20 year assessment - like the sewer. Answer was 'yes, Mocks Would it be possible to knock off the hump and not go through all this pipe business? Nilsens One of the problems - even if we did that, we wouldn't get a decent curb and gutter. There have been a lot of critical problems in going back to the time this area was developed. The building inspector now has been instructed to catch these things like changes in grades. Brunckes Would it be out of the question to ask the engineer to check our street about putting a curb and gutter mayi~e at a later date? Lembergs We plan to check this at the time the improvement is made. Nilsens Would it be the consensus of the group here that we should resolve this now? Whaleys May we see the plans before it goes in? Lembergs Certainly, I will be glad to go over it with all of you. White: Is this a guarantee that it will take care of all the water? And what if it doesn't? Nilsens This problem has been gone over for a number of years. We have the assurance of the engineer and we have instructed him to lick this problem. 1 1 1 2380 f White What if he doesn't? to maintain. A11 but two were in favor, Resolution Ordering The following resolution was introduced by Councilman Improvement and Warkentien who moved its adoptions Preparation of Plans for Improvement 66-1 WHEREAS, it is proposed to improve that portion of the N.E.Area Storm SewerVillage of Falcon Heights described as follows Project A-2s Beginning at the Northeast corner of Larpenteur Avenue and Albert Avenue, thence Easterly in a line parallel to Larpenteur Avenue 50.28 feet, thence Northerly in a line perpendicular to Larpenteur Avenue 172.60 feet, thence Easterly in a line parallel to Larpenteur 2t~6 feet more or less, thence Northerly in a line parallel to Albert Avenue 681 feet more or less, thence Westerly in aline parallel to Larpenteur Avenue l~91.73 feet more or less, thence Southerly 705 feet more or less, thence Westerly in aline parallel to Larpenteur Avenue J~5.7 feet more or less, thence Southerly in a line perpendicular to Larpenteur Avenue 157 feet more or less to the Northerly line of Larpenteur Avenue, thence Easterly in a line parallel to Larpenteur Avernze 292.30 feet more or less to the point of beginning, ( hereinafter described as the Larpenteur-Albert Storm Drainage Area) by the construction of a storm sewer drainage area and to assess the benefited property, whether abutting or not, for all or a portion of the cost of the improvement, pursuant to Minnesota Statutes Section 1.29.011 to l~29.111 (laws of 1953 as amended). NOV4f, THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL OF Falcon Heights, Minnesota: 1. Such improvement is hereby ordered as proposed in the Council Resolution adopted May 11, 1966. 2. Bonestroo, Rosene, Anderlik and Associates are hereby designated as the engineers for this improvement, They shall prepare plans and specifications for the making of said improvement. The motion for the adoption of the foregoing resolution was duly seconded by Stone and upon a vote being taken thereon the following voted in favor thereof: Nilsen, Strandquist, Brack, Stone and Warkentien. And the following voted against the same: None. Whereupon said resolution was duly declared passed and adopted by the Council this 8th day of June 1966. Water on Hemline Mrs. Evelyn Dilger, 1811 Hemline Avenue was present and Avenue -North of explained to the council her many reasons for rejecting the Garden: 1811 No. Hemline: 2381 Water on Hamline suggested manner of obtaining water by angering under Avenue - Mrs, the street to the Roseville water main on the other Evelyn Dilger side. Her well water has now become contaminated, she 1811 No. Hamlines believes, and she is in need of water and much prefers dealing with the village in which she resides. After discussion, Strandquist introduced the following resolution and moved its adoption. Resolution Ordering WHEREAS, it is proposed to improve that portion of Preparation of the Village of Falcon Heights described as follows: Report on Improve- ment on Hamline Commencing at the intersection of Albert and Garden Avenue by installa- Avenues, thence Easterly approximately 150 feet to the tion of Water Easterly line of the Falcon Heights School (School Line: District 623) thence Northerly along said east property line of said. school to Ruggles Avenue, thence Westerly to the intersection of Ruggles Avenue and Albert Avenue by the construction of a municipal water line and to assess the benefitted property, whether abutting or not, for all or a portion of the cost of the improvement, pursuant to Minnesota Statutes Section l~20.011 to 429.111 (Laws of 1953 as amended). NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF Falcon Heights, Minnesota: That the proposed improvement be referred to Bonestroo, Rosene, Anderlik and Associates for study and that they are instructed to report to the council with all convenient speed, advising the council in the preliminary way as to whether the proposed improvement is feasible and as to whether it should best be made as provided or in connection with some other improvement, and the estimated cost of the improvement. The motion for the adoption of the foregoing resolution was duly seconded by Stone and upon a vote being taken thereon, the follcn~ring voted in favor thereof: Nilsen, Strandquist, Black, Stone and Warkentien, and the following voted against the same: None. Whereupon said resolution was duly declared passed and adopted, by the council this 8th day of June, 1966. Equipment on Squad A. W. Bohn, Jr., owner of Emergency Vehicle Supply Company Car - Agreement with submitted to the Council a five-year lease agreement dated Emergency Vehicle June 2, 1966. Agreement provides in part that said company Supply Companyz will furnish and install the following equipment on the squad car: 1 Federal Model Q2B siren, 1 Federal visibar, 1 EVS Switchbox, and 1 #90 Amber Rear Light. Strandquist moved, seconded by Warkentien that Clerk be authorized to sign said agreement. Ayers All. Nays: None. Motion carried. Technical Committee Attorney Calvin's letter of June 7 addressed to Eugene of St. Paul - Sewer Avery, St. Paul City Engineer was read. Said letter d~>ed Rates i.ri part that Village of Falcon Heights will re-evaluate its position with respect to payment of present sewer charges, in i 1 1 2382 the absence of any report from the St, Paul Technical Committee. Power of Licensing: Attorney Galvints letter of June 7 was regarding the power of licensing of the Village of Falcon Heights. This letter was prompted by inquiries about licensing of plumbers. Licensing of Letter states that a municipality cannot license an Plumbers activity in which the state has pre-empted the field pursuant to statute. It appears, therefore, that ' ~ Ordinance No. 45 of the Village is probably no longer enforceable. Further study shall be undertaken to ascertain whether Ordinance No. 45 should be revised or amended in its entirety4 Har Mar Express Strandquist advised he had been informed by Har Mar Bus Stop: officials that the express bus will not stop at Larpenteur and Snelling Avenues. .Playhouse and Fence It was brought to the attention of the council that fence for Dogs - 1627 for keeping dogs and also a children's playhouse are in Hollywood Court: violation, inasmuch as they are not on the owner's property. Said structures have been placed adjacent to the a1 ley behind 1627 Hollywood Court. Investment of Fundsa Treasurer Olsen gave report of funds available for investment. Tatum Street Drainage: Warkentien moved, seconded by Black that Villagt Mainten- ance Department be authorized to obtain help, including equipment rental and operator from the present storm sewer contractor, on an hourly basis to construct a surface drainage area between the two homes at 1776 Tatum and 1768 Tatum.
