Absents Trustee Blaek. Also present were Treasurer Olsen, Attorney Galvin and Engineer Lemberg. Minutest Stone moved, seconded by a~~arkentien that the minutes of the regular meeting of July 27, 1966 be approved, Motion was carried. Warkentien moved, seconded by Strandquist that the minutes of the special meeting of August 3, 1966 be approved. It~otion was carried. Summer Recreation Dick DeSchriver, sinner recreation program director, Program -Summary by submitted report and reviewed with the council his Directors recommendations for 1967, The program terminated this year on August 5th. Included in the report was the 1966 inventory and a list of volunteer assistants. Al Helbig, Fire Fire Chief Al Helbig was present to submit regular Chief - Report: report dated August 10, 1966. Fire Department Stone moved, seconded by ~iarkentien that Fire Department Purchase Requisi- be authorized to purchase two 10 lb. ABC type dry powder tion 6b-l1: fire extinguishers at a cost not to exceed X39.50 each and two H.D. Truektype mounting brackets, and two #93050 MSA face piece neck straps for air masks not to exceed X3.00 each. Ayes. A11. Nays: None. Motion was carried. Light Plants Helbig advised that one of the light plants on afire truck is not repairable and should be replaced. H® stated that in all probability, funds received for standing by on the Fair Grounds during State Fair Week will be used toward purchase of light plant. N.L. Hermes and rgr. '~illiam T. Tripp from Tripp Detective and Patrol State Fair Car Washs Service was present along with Mr. and Pers. Hermes. After discussion Stone moved, seconded by ti~arkentien that the following resolution be adopteds VdHEREAS, the State Fair Car Wash has made application to the Village Council of Falcon Heights for a gasoline filling station license pursuant to the provisions of Ordinance No. 27, said license to be effective July 1, 1966:; and i~dHEREAS, said license has not been issued by the Village Council because previous conditions and restrictions imposed upon said licensee have not been met because of difficulties in operation of said premises that have arisen during the past year, and WHER~:AS, at the request of said council the representatives of licensee have appeared before the 2l~1.8 council. and have agreed to certain conditions and restrictions; NOS, THEREFORE BE IT RESOLVED BY THE VILL&GE COUNCIL of the Village of Falcon Heights, that said license shall be issued conditioned on the following restrictions: 1. The licensee will provide a uniformed employee to direct traffic at the entrance of said car wash and filling station on Larpenteur Avenue on Fridays and Saturdays and on such other days and times as may be needed. 2. The metal fence paralleling Larpenteur Avenue will be cut back approximately feet to facilitate the entry of automobiles into the car wash from the entry area. 3. A speed lane will be created giving unimpeded access to the car wash premises for automobiles not purchasing gas. !t. Lanes and areas will be appropriately marked by signs indicating the speed lanes and entrances. 5. The lot area will be surfaced, said surfacing to provide for adequate drainage. 6. Additional employees or attendants will be employed to insure that multiple lines of automobiles entering the car wash premises will be adequately alternated to insure no interference with the Larpenteur Avenue traffic. 7. Final plans to be subject to the approval of the Village Consulting Entineer and a copy of said plans is made a part of this resolution by reference. Upon a vote, the foregoing resolution was Adopted this tenth day of August 1966, the vote showing the following in favor: Nilsen, Strandquist, ti~iarkentien and Stone and the following voting against: None. Public Hearing Continued Subdivision - Lindig's Continuation of Public Hearing on Subdivision of Lindig's Addition No. 3s Addition No. 3 was approved by Resolution at the council meeting of July 27, 1966, therefore, Bearing was called to order at 8:00 P.~. with interested parties present. Mrs. Emil Anderson, 1707 Fairview stated they had contacted to buy the lot in question ever since they moved into their home, but had not done anything about it since the last meeting of the council. doe Bianchi 1~Vhen my land was subdivided, you set an easement. I 1725 Fairview: understand this is of no value now and I want to know if the Village wants the land as of now. The utility lines right now do not have the right of way. If easement is going to go in different directions, it is going to be of little value. If you draw easement along property lines 2Ii19 to the west of me and south of me, 3ust ghat is the value? Maybe it should be returned to the .owners. ~1lrs. Emil Anderson: If there are no future difficulties, it would seem all right. Attorney Galvin: No one had considered the requirement of connecting the existing easement on the Bianchi-French property with the easement on the Lindig property. As a practical question, the pourer company is not going to make any change. Bianchi: If somebody decides to divide and make it two hundred feet, same as I did, some of those people are going to be five or ten feet to the west. The line will be staggered. Galvins When they do decide to sell their property, they have to make application for subdivision, Some advance planning had been considered when you subdivided your property, and. any future council will have to give long and careful consideration to establishing a line., I think the council had given consideration to making that line other than where it is now on your lot. Common sense is going to have to prevail in the future decisions, The only control the council has is the application for subdivision, The council can reserve easement on the east and north five feet. The power company may impose some conditions. I am not sure what they are going to do. They probably do not want to run two lines to serve Lindig Street and ~.~airview Avenue. They might move twenty to thirty feet over onto Mr. Lindig's property and R2r. Lindig or his successors would have to agree to it if they want any service. Nilsen: ~Zr. Bianchi, regarding your line, where it was established was the most reasonable considering all the factors. Tt just happenec that you were the first one and it seemed like a reasonable thing considering all angles. Ydith regard to ten foot easement, it is impossible to have only a five foot easement for water flow - you cannot accomplish anything. ~'~farkentien introduced the folloering resolution and moved its adoption: Resolution ~°dHEREAS, rdr. and i~trs. Arthur Lindig have made Approving Preliminary application to the Village Gouncil of Falcon Heights for Plat - Lindig Addition a subdivision to be known as Lindig's Addition No. 3 No. 3: pursuant to the provisions of Ordinance No. b9; and ' WHERE.~S, said applicants have filed with the Village Council and the Village Planning Commission a preliminary plat, and 1NHEREAS, said plat was referred to the Village Planning Commission and said commission has approved said 2.20 plat, the council having held a public hearing pursuant to notice and Ordinance on July 27, 1966 and continued the same until August 10, 1966; NOW, ',EHEREFORE, HE IT REiOLVED BY THE VILLAGE GOUNCIL of Falcon Heights as follows: 1. Sand preliminary plat be and is hereby approved by the Village Council of the Village of Falcon Heights subject to the insertion therein of a five foot ease- ment for drainage and utilities commencing at the junction of the Bianchi French-Lindig property lines, thence running in an easterly direction parallel to the northerly line of said Lindig plat to the easement located and shown on -the easterly line of said plat. 2. Submission to the council fvr final approval of the final plat pursuant to ordinance. The motion to adopt the foregoing resolution was seconded by Stone and upon a vo to the following voted for same: Nilsen, Strandquist, Stone and ~~farkentien, and the following voted against same: None. Whereupon said resolution was adopted this 10th day of August 1966, Roberts Apartment Mrs. Anderson inquired a'~out the Roberts property and Buildings at 18.5 and why trees have not been planted as planned. Clerk read 1855 West Larpenteur letter addressed to John Daubney, attorney for Roberts, ,Avenue: from Village Attorney Galvin which stated in part that Adlr. Roberts has failed to comply with some of the conditions pertaining to the granting of the building permit and has made no efforts to comply with the reasonable and valid requests of the Village of Falcon Heights. This communication dated August ~., 1966 also stated that council will reconsider this matter on August 10 and if Mr. Roberts has not made arrangements to satisfactorily correct these conditions and comply with regulations of the Village, the council will authorize the Village Attorney to proceed to enforce the existing village ordinances. after discussion, Strandquist moved, Stone seconded that the Village Attorney be instructed to proceed to enforce the existing Village Ordinances as stated in above- mentioned communication to attorney Daubney. Upon a vote being taken, the following voted in favor of same: Nilsen, Strandquist, Warkentien and Stone and the following voted against same: None. Motion was carried.. Spiegler Apartments - After discussion, Clerk was instructed to call ~rlel Fry Streets Spiegler of the Spiegler Apartments 1b87, 1697, 1707 and 1717 Fry Street advising that council requests that the turn-around drive be placed ten feet south of the property line between the apartment at 1717 Fry Street and the residence at 1725 Fry Street. Conditional Use Stone moved, seconded by ~Yarkentien that the request Application - 1875 West for conditional use permit submitted by ~.irs. Arthur Larpenteur Avenue - Lindig, 1875 West Larpenteur Avenue be referred to the Renting bedrooms: Planning Commission for its recommendation. Motion was carried. 1 1 Flag Pole Purchased: Strandquist advised that flag pole had been purchased and will be set up on the front lawn of the village hall. Gasoline Purchases Strandquist stated that Cities Servic® Station (Citgo) to be made at Falcon has been bought out by Gulf Oil Corporation and the Heights Shell manager of the latter does not wish to continue the Station: former's practice of selling gasoline to the Village of Falcon Heights at a discount. Strandquist moved, seconded by Warkentien that future gasoline purchases be made at the Falcon Heights Shell Station, 1407 West Larpenteur Avenue. Ayes: All. Nays: None. Motion was carried. Plumber authorized Having met the requirements, it was moved by Warkentien to obtain permits: seconded by Strandquist that Francis Wagner dba Rose Plumbing be authorized to obtain permits to do plumbing work in the Village of Falcon Heights. Ayes: All. Nays: None. Motion was carried. Non-Intoxicating Having met the requirements, it was. moved by Warkentien, Malt Liquor seconded by Stone that the following be granted Licenses -State licenses to sell Non-Intoxicating ~;Ialt Liquor at the Fair Grounds: following locations Chester D. Parham Mrs. Harold Stevenson The following resolution was introduced by UVarkentien who moved its adoption: ~'~REAS, pursuant to resolution of the council adopted July 27, 1966, a report has been prepared by Bonestroo, Rosene, Anderlik and Associates with reference to the improvement of Hoyt Avenue between Snelling Drive and Hemline Avenue by .the construction of sidewalks; and WHEREAS, the Council thereafter requested a feasibility study on the improvement of the same area of Hoyt Avenue by the installation of curbs and gutters and, WHEREAS, said reports were received by the council on August 10, 19bb, NOb~, THEREFORE, BE IT RESOLVED BY THE VSLI,AGE COUNCIL Of Falcon Heights, Minnesota: 1. Said improvements are feasible and can best be made in conjunction with one another. 2. The council will consider the improvement of such street in accordance with the report and the assessment of benefited or abuttingrroperty for all or a portion of the. cost of the improvement pursuant to Minn. Stets., Secs. l~29.011 to lt29.111 (Lativs 1953, Ch, 398, as amended) at an estimated total cost of the improvement of X6,000.00. 3. Falcon Heights ChurchClerk was requested to direct communication to Falcon Property - Land Heights Congregational Church advising that present Reclamation: deposit of material in vacant lots known as Barthel Villas, Lots 20 and 21 is not regarded as i.n violation of Ordinance 6t~, 5ectian I~.10 entitled Land Reclamation.
