2~3 REGULAR MEETING OF SEPTEMBER 28, 1966 1 The regular meeting was called to order at 7s00 P.M. with the following presents Mayor Nilsen, Clerk Strandquist, Councilman Black and Warkentien. Absents Councilman Stone.- Also present were Engineer Lemberg,_.Attorney Kyle and - Treasurer Olsen. _ _ Minutes: Strandquist moved, seconded by Nilsen that the minutes of • the meeting of August 2l~, 1966 be approved. Ayes: All. Nayst None. Motion was carried. . Correspondence Mando Photos Letter under-date of September 1l~, 1966 from Ruttenberg, _ fJrren, Griswold and Cohen, attorneys at-3aw, advised that Mando Photo has nor acquired the property at 1780 west Larpenteur Avenue which property will be used as parking space. 1 1 • Mr. Ruttenberg, representing Mando Photo, and Mr. Walsh of the Steenberg Construction Company, were present. Council reviewed some of the plans andadvised the two representatives that a meeting with the Village Attorney and Village consulting Engineer would be in~order, ~t©rthome Walter Stepnitz and Don Julen~ representing the Cohen ~< •S~~pping Properties known as Narthome Shopping Center were present. Centers They advised that they would appear at the council meeting of October 12 to reviev~ plans for the parking area located at the rear of these properties. HEARING Larpenteur- Albert Imp. Wm. G. Bertossi 1750 No. Alb At 8:00 P.M. Mayor Nilsen opened the Public Hearing for the Proposed Assessment for the Improvement of Larpenteur and 66 la Albert by„the construction of a storm sewer... drainage area described as Improvement 66-1), Clerk Strandquist read the notice of Public Hearing, -.Attorney Kyle explained assessment procedures. v f The first thing I do not understand is why it should be erts assessed to the property owners, It seems like it is a . repair job just as an ordinary repair job in the streets, How about if in two or five years it needs further repair who pays than? Will it go back to the property owners again? I think it never should have been brought up here. I donut , think we shotald be charged for it. Lembergs Under normal procedure, this is how it is handled. The original drainage was put in by the county and went to the edge of the county right-»of-gray. We have gone back now and tried to correct this somewhat and we feel that our design is going to work. Tam optimistic. Bertossis Why not go back to the county and make them pay for it? Lemberg: The water isn~t coming from the county road. We have to remember as more homes are being built, problems are created. -. Probably 20 years ago there were ditches that adequately handled water. 2? ~1~1~ Bertossi: I question whether the coun-~y cannot take care of this. Nilsens The county provided the storm sewer on Larpenteur Avenue, but this project they will not handle. .. . There being no further discussion, Nilsen moved that the follo~ring resolution be adopted: Resolution Adopting WHEREAS, pursuant to proper notice duly given as Assessment for required by law, the Council has met and heard and passed Larpenteur-Albert upon all objections to the proposed assessment for the Storm Seger improvement of Larpenteur and Albert Streets as more Improvement 66-1) particularly described in the notice of hearing on said assessment, and has amended such proposed assessment as it deems just N09P, THEREFORE, BE IT RESOLVID by the Village Council of Falcon Heights, Minnesota as._fol.lows: 1. The proposed assessment roll is hereby amended, and the rate of assessment is determined to be .003 dollars (0.3 cents) per square foot for every parcel of land within said assessment district. ~2. Such proposed assessment, as amended, which is 'made a part of these minutes by reference, is hereby accepted and shall constitute the special assessment against the lands named therein,, and each tract of land therein included is hereby found to be benefited by the proposed improvement iri the amount of the assessment levied against it. 3. Such assessment shall be payable in two equal consecutive, annual installments. To the first instal- ment there shall be added interest at the rate of 6~ per annum on the entire assessment, from the date of this resolution until December 31, 1967. To each subsequent installment when due shall be added interest for one year on~all unpaid installments. The first of said installments shall be payable with general taxes for the year 1967, collectible with such taxes during the year 1967. 4. The owner of any property so assessed may, at any time prior to certification of the assessment roll to the bounty Auditor, pay the whole of the assessment on such m property, with interest accrued to the date of payment, to the Village Treasurer, except that no interest shall. be,cha~geti if the entire assessment is paid within 30 days from the adoption of this resolution. 5. The Clerk is directed to transmit a certified duplicate. of this assessment to the County Auditor to be extended on the proper tax lists of the County, and such assessment shall be collected and paid over in the same manner as other municipal taxes. The Clerk shall transmit said certified duplicate. of the assessment roll 30 days from the date, of its adoption. 1 D i 24.5 1 1 1 6. Z'he Clerk is directed to notify by mail the record av~mer of every parcel of real estate assessed of the amount of said assessment and that said assessment may be prepaid without interest within 30 days of the adoption of the assessment roll. Motion for the adoption of the foregoing resolution was duly seconded by Black and upon a vote being taken thereon the following voted for sames N3.7..sen, Strandquist, Black and Warkentien and the following voted against sames.. None. Whereupon said resolution was adopted this 28th day of September 1966. Amended Application After discussion regarding the amended application for for Variances- variance submitted by William Helms, 17$9 No. Asbury, William Helms Warkentien introduced the following resolution and moved 1789 No. Asburys its adoption: WHEREAS, William Helms, 1789 North Asbury, has made an amended application for variance and filed the same with the Zoning Administrator for the Village of Falcon Heights and WHEREAS, the matter has been referred to the Planning Commission. of Falcon Heights for-its consideration and recommendations, and ' S, the Planning Commission has recommended that said application be denied by reason of the followings (1) back of permission from adjacent property owners to the north, -- NCAA~, THEREFORE, BE IT RESOLVED by the Council of the - Village of Falcon Heights that said amended application for variance is hereby denied for construction of a garage at 1789 North Asbury at 'a distance of l~ feet from the north .-lot line. - - ;BE TT FURTHER RESOLVED that inasmuch as the Planning Commission recommends that.the variance application pre- viously submitted by William Helms under date of August 18, 1966 be granted, that the Council concur and grant said variance. Same will allow garage to be built on the south side of said property to within five feet of the lot line in lieu of the required 72 feet required for a two story house. Mr. and Mrs. Peter Evenson at 1775 North Asbury have consented, by letter to the council, dated September l9, 1966, to this variance. N. D. Otterkill 175. Iri view of complaints received from residents regarding business operations being carried on by N. D. Otterkill. at 175. North Holtoni Black contacted Otterkill on September 26, 1966.. Otterkill stated that all equipment and supplies and office, which are presently in his garag® at above address, will be moved to a new location outside of this village. 2L.l~6 Application for Black stated that Planning Commission has ratified Council Variance action taken on September ].l~, 1966 ixi granting variance Ronald Mitsch application submitted by Ronald Mitsch, 1l~57 West Idaho Avenue. 157 West Idaho: - - -~ Engineerts Report: Lemberg met with Arthur Jorgenson regarding the blacktop _ recently installed at 1707 Tatum Street and advised council that corrections w311 have to be made before engineer can approve the Sob. Jorgenson will. make same to bring to village specifications. Ordinance No. 39 Black moved that amendment to Dog Ordinance #39, Registering Regulating and and Regulating the Keeping of Dogs, be drawn_by Village Registering the Attorney for council review, Seconded by Strandquist.
