Also present were Attorney Kyle, Engineer Lemberg,. and Treasurer Olsen.. Minutess Black moved that the ,minutes of the regular meeting of September ].la., 196b be approved. Ayess All. Nays: None. Motion was carried. Stone moved, Nilsen seconded that the minutes of the .regular meeting of September 2$, 1966 be approved. Ayes All. Naysr None. Motion was carried. Black moved, Stone seconded that the minutes of the special meeting of October 1, 1966 be approved. Ayess All. Naysr None. Motion was carried. Nilsen moved, seconded by ~Tarkentien that the minutes of the special meeting of.October 5, 19b6 be approved. Ayess All. .Nays None. Motion was carried. Stone moved., seconded by Strandquist that the minutes of the special meeting of October 8, 1966 be approved. Ayes: All. Nayss None. Motion was carried. Stone moved, seconded by Strandquist that the minutes of the regular meeting of October I2, 1966 be approved. Ayess All. Nays None. Motion was carried. Correspondences Stoss v. Copy of Attorney Kylets letter of October 2l~, 1966 addressed Village of e to Mutual Service. Casualty Insurance Company stated that Falcon heights: Village of Falcon Heights was served with Summons and - Complaints on October 21, 1r9bb in the following actions: Ervin Stoss v. Village of Falcon Heights Dorothy H. Stoss v. Village of Falcon Heights Letter called attention to the ten day time limit within which to ans~rer .the complaints. Application for Having met the requirements, it was moved by Strandquist, Gasoline Filling seconded by Black and carried that Gasoline Filling Station Station Operators Operators License be granted to State Fair :dinit Car Mash. Licenser (This is ..transfer of operations from N._.L. Hermes tolabove.) - Glerk was requested to write letter to new operators stating that station must adhere to plans of operation which were recommended at the request of the council. and were put in operation by former operators. Application for Black introduced the following resolution and moved its Variance -Steenberg a,doptionr Construction for ~3ando Photo Companyr WHEE~EAS, Steenberg Construction, on behalf of T~dando Photo Company, 1790 ~e3t Larpenteur Avenue, has made an application for variance and filed the same with the Zoning Administrator for the Village of Falcon Heights along 2i~66 with the fee of X5.00, and WHE ~' ,the matter has been referred to the Planning Commission for the Village of Falcon Heights, and WKEREAS, the Planning Commission has recommended that .said application be granted, NAT, TH"r'ORE, BE IT RESOLVED that the Village-Council of Falcon Heights grants the variance application made by Steenberg-..Construction on behalf of b~4ando Photo Company on October 12, 1966, for variance of that property located at 1790 West Larpenteur Avenue within the Village of Falcon Heights which propert~t is presently zoned as B-l~l,, all under .the ;provisions of Section 16.05, of Ordinance. No...b~.t of the Village of Falcon Heights for the following: Building an addition of 15 feet in depth by 5~ feet in width. Extension from the rear of present structure would be to the south -fifteen fast, which would bring the building to within 2.66 feet of the rear lot line. The motion was duly seconded by Stone. Northeast Area Storm Inasmuch as Village Engineer Lemberg has approved and Sewer Street Eepair recommended for payment Contraetor~s Estimate No. 1 of and Village Street the Northeast Storm Sewer Street Repair and Village Street Maintenance and Seal ~daintenance and Seal Coat Project, Nilsen moved, seconded Coat Project 19b6: 5trandquist that council approve payment of X16,873;.90, . which is amount due the contractor, less retainage of X2,000.00, Ayers All. Nays: None. Motion was carried. N.E. Area Storm Letter dated October 26, 1966 from B. A. Lemberg, engineer, Project b5-1 -Final transmitted-the final Contractors Estimate for Commercial Estimate= Cartage Com~aany on the N. E. Storm Bearer Project 65 ].. _ Final amount of X89,161.25 included the Albert'-Larpenteur Avenue Project 66-1, and also the cast of removing and replacing concrete driveway at the southeast corner of Ruggles and Holton. Said amount is approximately $1,000 over original bid. Motion was duly carried. Ayes: All. Nayss None. . Fire Department Fire Chief Al Helbig was present and submitted regular Fire Chief report. It_is reported that Bert Slams is in the hospital Report: and expects to be back to work in a week. Volunteer Firemen to Stone moved. that in case of absence of any of the three paid fill in during absence firemen from his turn of duty due to illness or paid vacation, of regular firemans the chief be authorized to employ one or more of the volunteer . firemen to fill that tour of duty, the pay for such service to 2.67 ~ be on an hourly rate based on the pay of the lo~-est paid regular fireman for the 2l,~ hour period. Seconded by j Warkentien. Ayes: All. Nays: None. Motion was carried. ~ ~ Requisition Fi D t t - - Purchase requisition was made for ten gallons wet water re epar men : at a cost not to exceed X35.00 and a fire helmet complete I at a cost not to exceed ~11~.50. Stone moved, seconded by Nilsen that the Fire Department be authorized to make above purchases. Ayess All. Nays: None. Motion was carried. Wet grater i.s used in fire truck tanks as rust preventive. U. Haul Trailers Donald Plowman representing U~Haul Trailers advised council Falcon Heights Shell ,that his firm wants Donald Johnston, operator of the Falcon station: _ Heights Shell Station at 1lt07 West Larpenteur, for a dealer _ of its trails. After discussion as to location of trailers and size of lot, Council. advised Mr. Plowman that 3.f resi- dents have no objection to placing of U Haul Trailers on the lot, the council is agreeaB~l.e to granting. request. Schmidt of I7t~6 Albert Street under date of October 13, 1966 expressed concern regarding unsatis- factory condition of sanitary sewer at his residence and also other residences on Albert Street. Northern States Black moved that the Council approve letter drawn up by Paver Company - N. J. Drgis of NSP regarding installation of additional Additional Street streetlights and requesting cooperation of residents when Lighting: NSP representative is obtaining necessary right-of-~ay for '~ - installations. Said letter will be sent to citizens on stationery of the village, PQOtion was seconded by Nilsen. Ayesa All. Nays: None. Motion eras carried. Motion was carried. 2.68 Larpenteur- Mayor Nilsen advised the members of the Council that a $nelli.n~ Signal meeting with Ramsey County and State Highway Department Changes officials will be set at an early date to discuss the Larperrteur-Snelling intersection and signal changes. Edwin L. and Elvis After discussion regarding variance application made by Schmidt ~ppl3cation Edwin L. and Elvis Schmidt, 17t~6 N. Albert, council for Variance deem~ed..it advisable to table action on this matter until 171u6 N. Albert: inspection has been made of the premises. Such inspection shall be made on Saturday morning, October 29. Preliminary Plans Request for variance of Roy P. Klatt, Administrator of Proposed Plat - Estate of Conrad Klatt i.nvolves,pro~sct between Ruggles Ray P. Klan - and Roselawn Avenues on the street which will be known as RQoselaorn and Ruggles Sheldon Street. Request involved corner lots which as Avenue - per village Ordinance require width of 90 (ninety) feet Application far minimum lot size and request is made for 76.5 feet. Variance: Black stated that Planning Commission recommends to the ~- Village Council that preliminary subdivision plans -sub- . witted by ~. Klatt be approved subject to developrnant in such a way that the -lot sizes adhere to village ordinances and the corner lots of this development remain at 90 feet. Black moved that this application for variance and the material attached thereto, and all other pertinent material be referred to the Village Engineer. Strandquist seconded. Ayess All. Klatt, administrator for divisions _ Conrad Klatt Properties, and requ.~st for subdivision . submitted by Nic Pothen~ also be referred to the Village Engineer for his inspection and review and subsequent mitten report. Justice of the Peace Warkentien moved, seconded by Stone that the Village Court Not Guilty attorney be authorized to apps ar and prosecute all Pleas ordinance violations in Justice-Court in which the defendant pleads tNot Guiltq~ and is represented by counsel. Mayor Nilsen, Clerk Strandquist, Councilmen Warkentien, Black and Stone. Variance Application After Councilmen had today reviewed the property Edwin L. Schmidt located at 17t~6 North Albert, for which variance 1746 North Alberts application eras made on October ~, 1966, it was moved by Black, seconded. by Nilsen that application for variance be denied and that construction of Denied column supports for trellis be limited to ordinance requirements. Ordinance xequires side yard set back of five. feet, which in this instance requires that trell.i.s be set back five feet from the south lot line. Further moved that said trellis conform to ordinance requirements of front yard set back of thirty feet. Upon a vote being taken, the following voted in favor of sames Nilsen, S trandquist, Stone ~ Black and Warkentien, and the following voted against_samex None. Motion was carried. Volunteer Firemen Moved by Stone, seconded by ~Iarkentien that the motion 2h Hour Shift:, passed at special council meeting of October 22, to employ volunteer firemen to work shift of regular fire~en be rescinded.
