Motion was carried. Strandquist moved, seconded by Ston© that the minutes of the special meeting of ~~Iarch 2,..,1967 be approved. Motion was carried. Correspondence: Sewer Rates Letter of P~Zarch 3, 1967 from Eugene Avery, Chief Engineer Dept. of Public Department of Public ti`r'orks, St. Paul was in answer to ,;,- d~orks: Clerks inquiry as to status_of sewer rates. In part __ it stated that it is their purpose to develop contract and exhibits for each suburban community and it is their hope that this exhibit attachment (on which specific charge to this community ~rould be based) can be developed in draft form for council review by about April 1, 1967. State Fire School Letter of February 23 from E.L. ~'teber, .Asst. Commissioner May 1 - ?~: of Fire T,~iarshal Department,,State of Minnesota advised that ' the _T~Rinnesota State Fire School will be held ~~iaay 1 - ~., 1967. Traffic Summons D~Zr. R. Huberty, recipient of traffic ticket for parking in Parking:, violation of ordinance,, stated in his letter of March 7 the circumstances under which he received this ticket. Harmers Request It was stated that Police Commissioner Arndt had spoken for 1965 Vacation to Gwen Harmer, former police officer, regarding the Pay: latter~s request for 1965 vacation pay, Motor Vehicle Vincent Schadeggis letter of February 2~, 1967 stated in Records on Volunteers part that motor vehicle records on all of the drivers of in Fire Departments vehicles covered under the villages policy are within the range of acceptability ti~rith the exception of one volunteer . in the fire department. Fire Chief will be responsible for seeing to it that this volunteer does not, any time, drive village vehicles. After discussion, Stone moved that Resolution of January 11, 1967 be rescinded 252. and Stone introduced the following resolution and moved its adoption: RESOLVED that the Falcon Heights State Bank of Falcon Heights, Minnesota be and is hereby designated as a depository for the funds of the Village of Falcon Heights anc# that the Village Treasurer is authorized to deposit General and other Village Funds therein to the amount of one-hundred and forty-fivethousand dollars (~11i.5,000). RFSOLZtED FURTHER. that the collateral shall be furnished by the Falcon Heights State Bank in lieu of the corporate or surety bond... required by law, consisting of one- hundred and forty thousand dollars (1l~0,000) face of U. S. Government Obligations accompanied by an assignment pro- viding that in case of default on the part of the Falcon Heights State Bank, the Council has full pourer and .authority to sell the collateral or so much as may. be necessary to realize the full amount due the municipality. RESOLVID FURTHER that checks of the Village of Falcon Heights drawn upon. the said. bank account shall be honored by said bank only if signed by the Mayor, the Clerlc and the Treasurer of the Village of Falcon Heights, ~dinnesota. RESOLVF~ FURTHER that this designation shall, be effective.. until the end of the present council year. _ Seconded by Strandquist and upon a vote being talten, the resolution was declared unanimously passed and adopted. Klattrs Addition No. 2 Black introduced the following resolution .and moved its Resolution Determining adoption: Suffici.ency.of Petition: ~ ~ iAS, the Council has received a petition (copy of which is on file in the office of the Village Clerk) signed by all of the owners of real property abutting upon, the street named in said petition for the construction of street, curb and. gutter and sanitary sewer improvements on Sheldon Street between Ruggles anc~ Roselawn Avenue, as more .fully appears in said .petition; and ~IERI;AS, said petitioners have waived their rights to public. hearings on said proposed construction of said improvements; and YVIiF.REAS, said petitioners have petitioned to have the entire cost of the construction of said improvements assessed against their properties; NOa{(, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Falcon I~eights,_Minnesota as follows: 1. Said petition is received and the Clerk shall file the same with the Village records. 2. The Council hereby finds, determines and declares that the petition attached hereto has been signed by all the owners of the real properties abutting upon the street named 2525 in said. petition as the location of said improvements, and said owners have asked that the entire costs of said improvements be assessed against their properties. The motion for the adoption of the foregoing resolution was duly seconded. by Ytarkentien and upon a vote being taken thereon, the following voted in favor thereof: Nilsen, Strandquist, Warkentien, Black and Stoney and the following voted against the same: None. ~9hereupon said resolution was duly declared passed and adopted, ZYater ~Tain on Black introduced the following resolution and moved its Hamline Avenue and adoption: Sheld©n Avenue - Sanitary Sewer on Resolution Receiving Preliminary Report and Ordering Sheldon Avenue - Hearing Construct Sheldon Avenue in Klatt ~T-1'EREAS, the Village Council deems it necessary and Addition No. 2: expedient that the Village of Falcon Heights, R2innesota construct certain improvements consisting of street, sanitary sewer, and watermain extension as described in and in accordance with preliminary plans and reports prepared by Bonestroo, Rosene, Anderlik and. The nature of the improvement, the estimated cost thereof, and the areas proposed to be assessed. there- fore are described in the form of notice of hearing herein- after set forth. 3. The estimated cost of said improvements is 5~19,3a5.l~5• The area proposed to be assessed for said improve- ments is every lot or parcel of land benefitting therefrom and abutting on said proposed Sheldon Street. 2. Construction of watermains along said proposed Sheldon Street in proposed I~att's Addition No. 2 and along the westerly edge of Hamline Avenue between Garden Avenue and Roselawn Avenue, together with all necessary connections and appurtenances to the existing water system in the Village. - The estimated cost of said improvements is $~19,91l~.J~O. The area proposed to be assessed for said improvements is every lot or parcel of land benefitting therefrom and abutting along said proposed Sheldon Street and the westerly edge of Hamline Avenue between Roselawn Avenue and Garden Avenue, The Council proposed to proceed under Chapter l~29 M.S.A. Such persons as desire to be heard with reference to-,the proposed improvement will be heard at this meeting. !~. The Village Clerk is hereby authorized and directed to cause notice of said hearings to be given two publications in the official newspaper. Said publications shall be one week apart, and at least three days shall elapse betvreen the last publication and the hearing. Not less than ten days before the hearing the Glerk shall: mail notice of the hearing to the owner of each parcel of land within the area to be assessed. The Council proposed to proceed under Chapter l~29 Q.S.A. The area proposed to be assessed 228 for such improvement is every lot or parcel of land benefitting therefrom and abutting on said Arona Street between Larpenteur Avenue and the southerly edge of California Avenue extended westerly to the westerly edge of Arona Street. The estimated cost of said improvement is ~19,018.00~ of which sum approximately X16,$1$ will be derived•from the Villages T~.4unicipal State Aid Fund. and approximately X2,200 will be assessed against abutting properties, Such persons as desire to be heard with reference to the proposed improvements will be heard at this meeting. Meeting is scheduled for Tuesday,_~?arch 28, 1967 at 8s00 P.M. and will be held in the ante-room of the Village Hall.- WaterMain on Warkentien moved that the matter of the status of the Hamline Avenue from watermain on Hamline Avenue from Larpenteur to Garden Larpenteur to Avenue on the west side of••Hamline Avenue be referred to Roselawn: the Village Engineer and Village Attorney to determine villages responsibility regarding same. Motion was duly seconded by Stone and upon a vote being taken the following vote was recorded -Ayes: All. Nays; None. Motion was declared passed. 1967 Seal Coating Moved by 1~`rarkentien, secondec by Nilsen that Engineer be of Streets: instructed to prepare preliminary plans and specifications for street maintenance of seal coating streets east of Snelling Avenue and north of Larpentaur Avenue and present such plans to the Council for. approval. ,Ayes: A11. Nays: None. Motion was carried. Northome Area l~larkentien mentioned that the sheriffs department had Garage Doorss reported ~9 garace doors left open in-.the Northome area of the vil,.lage. Sheriff will issue tags to warn residents to keep the doors. closed. B & E Dog Patrols Moved by Stone, seconded by Black that the Ivlayor and Clerk be authorized to sign agreement in the name of the 1 1 2529 tha Village of Falcon Heights with B and E Patrol for control of animals for the year 1967. Ayes; AL1.. Nays None. Motion was carried. Viewer Rate Charges Clerk was instructed to withhold or deduct from the City of 1582 Hollywood Saint Paulus next billing for charges for sewer rental and Court: sewer maintenance an amount of X74.80. Said sum is amount that has been overcharged for past six years on surer services at 1582 Hollywood Court. Issuance of Warning Attorney Kyle has revievred the tags that could be issued Tickets or Summons to violators of Ordinance No. 79 entitled An Ordinance to owners of Dogs Amending Ordinance No. 39 Registering and Regulating the violating ordinance :. Keeping of Dogs. Attorney states that said tags could be ,legally used in Falcon Heights to either warn violators or issue summons to violators. When Summons is issued, the fine shall be X5.00; if recipient_of summons wishes to plead 'notguilty~ he may appear before the Justice of the Peace. C1erk_.was instructed to proceed with printing of tickets for same.
