HomeMy WebLinkAboutCCMin_67May112551 Regular Meeting of Ntay 11, 1967 The meeting was called to order at 7:00 P.M, with the following members present: Mayor Nilsen, Clerk ~trandquist, Councilman Black and Warkentien. Absent= Councilman Stone. Also present were Treasurer Olsen, Engineer Lemberg and Attorney Kyle. Minutes Warkentien moved that minutes of regular meeting of April 27, 1967 be corrected to reflect his reason for voting for approval of resolution regarding salary increases. He voted affirmatively only because it was understood that approval of salary increases for the years 196~1and 196$ shall in no way guarantee any positions now held. Black then moved, seconded by 5trandquist that minutes. of April 27, 19b7 be approved with correction above. llyes: A11. Nays: None. Motion was carried. Correspondence: Roberts Apartment Letter under date of April 27 from Roberts Construction Landscaping: Company stated. that plans to proceed with screen planting and Garage scheme at 18l~5-55 West Larpenteur Avenue will proceed in Layouts approximately three weeks. This should include the garage layout as proposed. Recreations Evaluation of Mrs. Darleen Aamodt, class director of figure skating this r Skating Lessons: past winter at the Idaho=Snelling Playground area, submitted an evaluation of the program, which will be placed on file in the clerkts office. Tape Recorder: Warkentien moved, seconded. by Black that the maintenance department, under the direction of the village consulting engineer, arrange before next skating season, to construct an adequate receptacle in which to place the tape recorder at the Idaho-,Snelling Playground. Further that the village clerk be authorized to arrange for servicing of the tape recorder. Ayes All. Nays: None. Motion was carried. Back Stop Warkentien stated that the back stop has been installed at Installed: the Idaho--Snelling Playground and a snow fence has been placed around the pond. _ Summer Recreat~.on Warkentien has scheduled a meeting with the Recreation Program: Program Director, Dick DeSchriver, to rho aver the 1967 program.. DeSchriver will attend next meeting of the council. HEARINGS Faison Heights Congregational Church ~Re- assessment for Sanitary Sewer Imp. 195? and WaterMain Imp. 1960 No. 1: Pursuant to due call and notice, the public hearing to consider the Supplemental Assessment of Block 1, Barthel Vi7.las Addition for Water Main Improvement of 1960 No. 1 and Reassessing Lots ll~, 15, 20, and 21, Block 1, Barthel Villas Addition for Sanitary Sewer System Improvem®nt 195?, was called to order at 8700 P.M. Clerk-read Notice of Public Hearing. Roger Short and Ray Hardy represented the Falcon Heights Congregational Church.. Roger Short stated that if the church uses the lots for parking, there would be no benefit derived from the 2552 watermain nor the sanitary sewer. Some towns do not charge church property at all. Certainly what the council has done in deferring assessments is fair and there should not be any, objections. The potential purpose of the lots is for parking and there is no benefit. It is the intention of the church to'keep these lots for parking purposes. As to utilization for such, trustees realize a conditional use permit is required in an R-1 District. He further stated that the church is faced with ,the prospect of whether or not to continue to fi11 these lots, and he thinks the use of the land should be considered. As to when the lots will be improved, the church is like all other churches as far as finances are concerned. He has lived near churches and he is of the opinion the owners of homes around. there would find it desirable to have off-street parking. As the council knows, two lots are presently for parking '- there are trvo more lots on Holton and two of them primarily to be used for parking and are partially filled. On Pascal there are two lots that are not filled. It is probably not going to be a whole lot bigger church, and whether or not all four of these lots will be developed, he could not say. Ray Hardy was of the opinion that intention is to fill and level them off and then if church decides they need more parking, they will go ahead. Mayor Nilsen stated that ~rhether they start from scratch and build it up or whatever they do with the property, the assessment should be paid. Short then stated that it is~the trusteest intention to fill in these lots and then se11 them off. The best thing they think to do is hold onto that property and not se11 them off and maybe have to pay a lot more in the future to get them back if needed. He thinks property owners would like to get parking off GardBn Avenue. He cannot honestly say the church has a right to say it is receiving no benefit. The use of the land is preventing utilization of the utilities there, and it is questionable whether they will ever be. °Many communities make compromises and. treat it somewhat like their own park system. Mayor Nilsen advised that the School was assessed for sanitary sewer and storm°sewer, the water was already in when school was built. He cannot see how the council can reasonably consider not assessing. Short advised he could see benefit of storm sewer and could see no point in discussing that assessment. Hardy stated that there plans for possible addition to the church and if so, there is possibility the church membership would increase and more parking would be needed. The two lots that go up to the old parsonage --Lots 20 and 21 -would be aLt the parking needed. as far as he can tell.. It seems that the church would like to fill it in and just leave it for the time being. 2553 Short is` of the opinion it is just reasonable to keep them for insurance. Church would like to ban parking on the street and if they have enough parking facilities, street won't be as dangerous. They would appreciate a little more time if it is possible to go over the whole thing with the Board of Trustees. Black introduced the following resolution and moved its adoption: n Resolution WHEREAS, a resolution of the Village Council to Continue adopted the 13th day of A13ril, 19b7 fixed a date for Public Hearing: council hearing to consider the Supplemental. Assessment of Block 1 Barthel. Villas Addition for WaterMain Improvement, and for Reassessing Lots 1~., 15, 20 and 21, Block 1 Barthel Villas Addition for Sanitary Sewer System Improvement of 1957, and WHEREAS, the required published notice of the hearing was given and the hearing was held thereon on the 11th day of May, at which tame all. persons desiring to be heard were given an opportunity to be heard. thereon, NQI`t, THEREFORE, BE IT RESQLVED by the Council. of the Village of Falcon Heights that..said public hearing is continued until ..August. l4, 1967 at 8s00 P.M. i.n the Village Hall, 16I~l~ West Larpenteur Avenue, Falcon Heights, Minn. Motion for the adoption of the foregoing resolution was duly seconded by 5trandquist and upon a vote being taken thereon, the resolution was unanimously adopted. Fill for vacant Black moved, seconded by Nilsen that the Village Council lots in Barthel authorize the~Faleon Heights Church to arrange for filling Villas in of vacant lots described as Barthel Villas Addition, Block 1, Lots 1~., 15, 20 and 21, under the supervision of the Village Engineer. Ayess All. Nays: None. Motion was carried. Engineer's Engineer Lemberg reported that Ray Ring of Independent Report: School District b23 has reviewed the easement affecting Hamline Avenue the school property and school board is expected to Water Mains examine it this evening. Driveway at Lemberg stated. he would talk to Ramsey County about the 1.844 No. Alberta condition of the approach to the driveway at 1840 Albert which faces Garden Avenue and which is depressed and muddy as a result of installation of storm sewer. 1967 Street Warkenten introduced the following resolution and ~tlaintenance and moved its adoption! Seal Coat Projects iNHEREAS, pursuant to a resolution passed by the Council on Pdarch 9, 1967, the Village Consulting Engineer has prepared plans and specifications for the improvement of streets b~ seal coating and general maintenance of the streets east of Snelling Avenue and North of Larpenteur 2551 1967 Street ~Iainten- in the Village of Falcon Heights, in accordance with the ance and Seal Coat four year and area rotational street improvement Project (contd.) pro3ects, and has presented such plans and specifications to the Council for approval: NOW, THEREFORE, BE IT R~;SOLVED by the Village Council of Falcon Heights, ~dinnesota: 1. Such plans and specifications, which are made a part hereof by reference, are hereby approved. 2. The Village Clerk shall prepare and cause to be inserted in the official paper an advertisement for bids upon the making of such improvement under such approved plans and specifiications. At least ten days sha11 elapse between the dates of publication and the date specified for the opening of bids on said improvement. Advertisement shall specify the work to be done, shall state that bids wi11 be received by the clerk until 10:00 A.M. on June 7s 1967 at which time they will be publicly opened in the Council Chambers of the Village Ha11 by the Clerk and the Engineer, will then be tabulated, and will be considered by the Council at 8:00 P.M. on June 8, 1967, in the council chambers. Advertisement shall state that no bids will be considered unless sealed and filed with the clerk and accompanied by a cash deposit, cashier's check, bid bond or certified check payable to the clerk.for five per cent of the amount of such bid.. Motion was duly seconded by Black and upon a vote being taken thereon, the following voted in favor of same: Nilsen, Strandquist, Black and VV'arkentien and the following voted against same: None. Northeast Sanitary Nilsen introduced the following resolution and moved its Sewer and WaterMain adoptions Improvement 19671 Klatt~s Addition W~iE ,pursuant to a resolution passed by the Council & Hamline Ave.s on April 13, 1967, the village consulting engineer has prepared plans and specifications for the improvement of proposed Sheldon Street by construction of sanitary sewer 3.mprovement and construction of watermain improvement along f proposed Sheldon Street in Proposed Klatt~s Addition No. 2, and construction of watermain improvement along the vresterly edge of Hamine Avenue between Garden Avenue and Roselavm Avenue together with all necessary connections and appur- tenances to the existing water systems in the Village, and has presented such plans and specifications to the council for approvals NOYs~, THEREFORE, BE IT RESOLVED BY the Council of Falcon Heights, Minnesota: 1. Arona Street zmp.s Strandquist introduced the following resolution and moved Sheldon Street its adoptions Improvements ~IHEREAS, Pursuant to resolution passed by the council Hoyt Avenue. on April 13, 1967, the consulting engineer has prepared Imnrovements plans and specifications for the improvement of Aron a Street between Larpenteur Avenue and California Avenue by Miscellaneous Street Repairs: the installation of sidewalks, curb and gutter, and street improvements, and has presented such plans to the council, WHERF,AS, pursuant to resolution passed by the council on September 11~, 1966, the consulting engineer has prepared plans and specifications for construction of sidewalk curb and gutter improvement on Hoyt Avenue from Hamline Avenue to Snelling Drive in the Village of Falcon Heights, and has presented such plans and specifications to the council for approval, and SYHEP~FAS, pursuant to a resolution passed by the council on April l3, 196b, the village consulting en gineer has prepared plans and specifications for the construction of Sheldon Street from Roselawn Avenue to Ruggles an d between Albert Street and Hamline Avenue, as mare parti- cularly described in proposed Klatt Addition #2, consisting of grading, base bituminous-.surfacing, concrete curb and gutter, and has presented such plans and specifications to the council for approval, and WHEREAS, the consulting engineer has also included in such plans and specifications, additional miscellaneous street repair work within the Village of Falcon Heights, and has presented such plans and specifications to the Council for approvals A N(JW', THEF?.EFORE, BD IT RESOLVED F1Y the Council of the Village of Falcon Heights, AJU.nnesotas 2556 1. Motion was duly seconded by Warkentien and upon a vote being taken thereon, the following voted in favor of sames Nilsen, Strandquist~ Warkentien and Black and the following voted against sames None. Whereupon motion was declared passed and adopted. Oil Spilled Lemberg advised that at tk~.e time of seal coating of in Alleys village streets, the. contractor will make necessary repairs to the alley behind 11~.l~b West Larpenteur Ave. and Crown Oil Company will pay for costs. N.E. Area Storm Lemberg stated there are a few spots that are in need Sewer Improvement of repair as a result of construction of the N. E. Area 1965 -,Repairs: Storm Sewer Improvement 1965 Project. Strandquist moved that. the Village Engineer be authorized to engage and negotiate with proper firm to pick up the sod and fill and repair the boulevax~is at 1867 Simpson and 1796 Holton, which need repair. Motion was seconded by Nilsen. Ayess All. Nays; None• Motion was carried. Flasher Signal Lemberg stated that poles holding flasher signals at at Crosswalks crosswalk between Arona and Snelling on Larpenteur Avenue will have to b® removed. Warkentien moved that Village Engineer be instructed to arrange for posting signs on both sides of Larpenteur Avenue where flasher is presently located, such signs to read Crossing Only at Corners Seconded by Strandquist. Ayes: A11. Nayss None. Motion was carried. Larpenteur Manor Lemberg. was instructed to communicate with A. L. Rubinger Apartments: of Larpenteur Manor Apartments to advise that building permit may not be obtained for building apartments until such time as final plans and specifications have been approved by the Village Council. This action was prompted by the fact that engineer has received inquiries from various builders who appear to be making up bids for construction of the apartment buildings. 2557 Application for Black introduced the following resolution and moved its Variances adoption: Donald W. Adead Klatt~s Add. WHEREAS Donald bY. Mead has made application for No. 2: variance and filed the same with the Village Council of Falcon Heights along with the fee of $5.00, and WHEREAS, the matter has been referred to the Planning Commission for the Village of Falcon Heights, and WHE~.EAS, the Planning Commission has recommended that said application be granted subject to the followings _. 1. Side yard setback of 15 feet from boulevard line along Ruggles Avenue to outside wall of garage and/or house. Construction to be such that south wall of _ building will not be closer to Ruggles Avenue than existing houses at 186I~ Albert and 1863 ,Albert Street. NC1ffP, THEREFORE, BE IT RESOLVED, that the Village Council of the Village of Falcon Heights grants the variance application made by Donald W. Mead on the 1 1 th day of May 1967 for variance use of that property described as Lot 7, Block t~, located on the northwest corner of Sheldon and Ruggles in Klattts Addition No. 2, which property is presently zoned as R-1 all under the provisions of Sec. 16.05, Ord.. No. 6t~ of the Village of Falcon Heights subject to the side yard set back as recommended. by the Planning Commission. Motion was duly seconded by Warkentien. Ayes: All. Nays None.
