I~ieeting of June 22, 1967
The regular meeting was called to order at 7:00 P.M. vr:ith the following members
present: Mayor Nilsen, Clerk Strandquist, Councilman Stone. Absent: Councilmen
Black and Warkentien. Also present were Attorney Kyle, Treasurer Olsen, and
Engineer Lemberg.
Minutesa Stone moved, seconded by Nilsen that the minutes of the
regular meeting of June 8, 1967 be approved as corrected.
Ayes: A11. Nays: None. Motion was carried.
Correspondences
W. K. Schultz Letter dated June 13, 1967 from William K. Schultz, D.a.S.
1630 Hollywood Court stated he withdraws all claims for any damage incurred.
Snow Plow Damages by the snowplows to his property during the winter of
1966-67.
Jay Blank Realty Letter of June 15, ].967 from Jay Blank, Realtor, inquired
1708 N. Spellings as to whether or not council would consider rezoning a
resident home on Larpenteur Avenue, between Snelling and
Hamline Avenues for an office facility. Clerk wi]1 advise
Mr. Blank to get approval by petition of residents within
300 feet of property.

Hydrant Enamel Letter from Waterous Company was concerning hydrant enamel
Paints paint that glows at night. Council agreed that maintenance
department should purchase same for use on all hydrants.
Pruning of Trees Letter of June 8, 1967 stated in part that pruning of trees
Highway Department:.. on Highway Department Right-of-~~ay is done in the winter
time.. Permission was given to this village to do work if
notification is sent to Highway Department prior to arty
operation.
State of Minnesota Letter dated June 16, 1967 from F. L. Woodward, Director,
Department of Division of Environmental Health was regarding plans and
Health -Mater Main specifications on water main extensions, which plans
Extensions Proj. 67-1s have been turned over to Water Pollution Control
Section for examination.
Department of Letter dated June 12 from John R. Jamieson, Commissioner of
Highways -Traffic Highways, enclosed brochure which illustrates T~'d.nnesota
Needs: Highway traffic needs and their attempts to meet these needs.

directed to ezater into the contract with Dunkl.ey Surfacing
Company in the name of the Village of Falcon Heights for
the Street Improvement Project 3-67 according to the plans
and specifications therefore approved by the Vi7.7.age Council .
and on file in the office of the Vi7_lage Clerk.
2. The Village Clerk is hereby authorized and
directed to return forthwith to a71 bidders the deposits
made with their bids except that the deposits of the
successful bidder and the next lowest bidder shall be
retained until a contract has been signed.
Motion for adoption of the foregoing resolution was duly
seconded by Stone and upon a vote being taken thereon, the
following voted for lames Nilsen, Stone and Strandquist
and the following voted against samet None. ~ihereupon
said resolution was declared duly adopted by the village
council this 22nd day of June 1967.
Resolution Providing Robert Sander of Juran and Moody, Inc. presented to the
for the Issuance and Council a Proposal for Issuance and Sale of X50,000
Sale of X50,000 Improvement Bonds of 1967. After discussion, Stone
Improvement bonds of introduced the resolution entitled, Resolution Pro--
1967 and levying a tax viding for the Issuance and Sale... of X50,000 Improvement
for the payment Bonds of 1967 and Levying a Tax for Payment Thereof
thereofa which is attached-hereto, and moved its adoption. Motion
was duly seconded by Strandquist and upon a vote being
taken thereon, the following voted for lames Nilsen,
Strandquist, and Stone and the following voted against
same: None. Ydhereupon said resolution was declared
adopted this 22nd day of June 1967.

VILLAGE COUNCIL OF THE VILLAGE OF
FALCON HEIGHTS, MINNESOTA
HELD JUNE 22 , 1967
Pursuant to due call and notice thereof, a regular
meeting of the Village Council of the Village of Falcon Heights,
Ramsey County, Minnesota, was duly held in the Village Hall in
said Village on June 2~, 1967, at 7:00 o'clock P.M.
The following members of the Council were present:
Nilsen, Stone, Strandquist
and the following were absent: Black, Warkentien
Member Stone introduced the following resolution and
moved its adoption:
RESOLUTION PROVIDING FOR THE ISSUANCE
AND SALE OF $50,000 IMPROVEMENT
• BONDS OF 1967
AND LEVYING A TAX FOR THE PAYMENT THEREOF
WHEREAS, the Village Council of said Village has
heretofore determined to construct various improvements in
the Village consisting of (a) construction of sidewalks, curb
and gutter along Hoyt Avenue; (b) street improvements, curb,
gutter and sidewalk on Arona; and (c) construction of Sheldon
Street, together with curb, gutter, sanitary sewer and water
and water extensions along Hamline Avenue, and
WHEREAS, the Village Council has entered into
contracts for the construction of all or a portion of said
improvements, and
WHEREAS, no other obligations have been issued to
defray the expense of said improvements,
BE IT RESOLVED by the Council of the Village of
Falcon Heights, Minnesota, as follows:

1. That the offer of Juran & Moody, Inc.,
St. Paul, Minnesota, to purchase $50,000 Improvement
Bonds of 1967 of the Village, in accordance with the terms
and conditions and at the rates of interest hereinafter
set forth, and to pay therefor the sum of $50,000 is hereby
accepted. Said bonds shall be payable as to principal and
interest at the American National Bank and Trust Company
in St. Paul, Minnesota.
2. The $50,000 negotiable coupon general obli-
gation bonds of the Village shall be dated July 1, 1967
and shall be issued forthwith. Said bonds shall be 50 in
number and numbered from 1 to 50, both inclusive, in the
denomination of $1,000 each. Said bonds shall mature
serially, lowest numbers first on July 1 in the years and
amounts as follows:
$2,000 in the years 1970, 1972, and 1974;
$3,000 in the years 1971, 1973, and 1975; and
$5,000 in each of the years 1976 to 1982,
both inclusive.

3. The bonds of said issue maturing in the years
and bearing the serial numbers set forth below shall bear
interest, payable July 1, 1968 and semiannually thereafter
on January 1 and July 1 of each year, at the respective
rates per annum set opposite said maturity years and
serial numbers.

ALL MEN BY THESE PRESENTS that the Village of
Ramsey County, Minnesota, certifies that it
for value received promises to pay to bearer
ONE THOUSAND DOLLARS
on the first day of July, 19 and to pay interest
thereon from the date hereof until the principal is paid
at the rate of four and twenty five hundredths per cent
(4.250 per annum, payable on the first day of July, 1968
and semiannually thereafter on the first day of January
and the first day of July in each year, plus additional
interest at the rate of one and seventy-five hundredths
per cent (1.75x) per annum from October 11, 1967 to July 1,
1969, payable July 1, 1968, January 1, 1969 and July 1, 1969
in accordance with ahd upon presentation and surrender of
the interest coupons hereto attached, which are in two sets,
one representing interest at the rate of four and twenty five

Both principal and interest are payable at the American

All bonds of this issue maturing in the years
1973 to 1982, both inclusive (bonds numbered 8 to 50,
both inclusive), are subject to redemption and pre-

This bond is one of an issue in the total principal
amount of $509000 all of like date and tenor, except as to
maturity and redemption privilege, which bond has been issued
pursuant to and in full conformity with the Constitution and
laws of the State of Minnesota for the purpose of providing
money for various improvements, and is payable out of the
Improvement Bonds of 1967 Fund of the Village. This bond
constitutes a general obligation of the Village, and to
provide moneys for the prompt and full payment of said
principal and interest when the same become due, the full
faith and credit of said Village have been and are hereby
irrevocably pledged.
IT IS HEREBY CERTIFIED AND RECITED that all acts, conditions
and things required by the Constitution and laws of the State of
Minnesota to be done, to happen and to be performed, precedent to
and in the issuance of this bond, have been done, have happened
and have been performed, in regular and due form, time and manner
as required by law, and this bond, together with all other debts
of the Village outstanding on the date hereof and the date of its
actual issuance and delivery does not exceed any constitutional
or statutory limitation of indebtedness.
IN WITNESS WHEREOF, the Village of Falcon Heights,
Ramsey County, Minnesota, by its Village Council has caused
this bond to be executed in its behalf by the .signatures of
the Mayor and the Village Clerk, one of said officers having
signed manually and the other by having a facsimile of his sig-
nature imprinted hereon, and the corporate seal of said Village
to be affixed hereto, and has caused the interest coupons to be
executed and authenticated by the facsimile signatures of said
officers, all as of July 1, 1967.

Village of Falcon Heights, Ramsey County, Minnesota, will pay
to bearer at the American National Bank and Trust Company, in
St. Paul, Minnesota, the sum shown hereon for interest then
due on its Improvement Bond of 1967, No. dated July 1,
1967.

6. The Village Clerk is directed to cause said
bonds to be prepared and the Mayor and Clerk are authorized
and directed to execute the same, and tq cause said coupons
to be executed and authenticated by the printed, engraved
or lithographed facsimile signatures of said officers.
• 7. The said bonds when so prepared and executed
shall be delivered by the Treasurer to the purchaser there-
of upon receipt off' the purchase price, and the said purchasep
shall not be obliged to see to the proper application
thereof.
8. There is hereby created a special fund to be
designated "Improvement Bgnds of 1967 Fund"
to be held and administered by the Village Treasurer separate
and apart from all gther funds of the Village. Said fund
shall be maintained ip the manner herein specified until all
of the bonds herein authorized and the interest thereon have
been fully paid, In said #'und there shall be maintained two
separate accounts, to be designated as the "Construction
Account" and the "Sinking Fund Account", respectively. The
proceeds of the sale of the bonds herein authorized, less
accrued interest received thereon, shall be Credited to the
Construction Account, From which there shall be paid all
costs and expenses of making said improvement, including the
costs of construction contracts heretofore let and all other
costs incurred and to be incurred and the moneys in said
account shall be used for no other purpose, provided that if
upon completion of said improvement there shall remain any
unexpended b~.lance in said Construction Account, said balance

may be transferred by the Council to the fund of any other
improvement instituted pursuant to Chapter 429 M.S.A.
There is hereby pledged and there shall be credited to the
Sinking Fund Account, all collections of special assessments
and taxes herein levied, all accrued interest received upon
delivery of said bonds, and all funds remaining in said
Construction Account after completion of the improvements
and payment of the costs thereof, not so transferred to the
fund of another improvement. The Sinking Fund Account shall
be used solely to pay principal and interest on the bonds
issued hereunder.
9. It is hereby determined that no less than $45.000
of the cost of improvements shall be paid by special assess-
ments to be levied against every assessable lot, piece and
parcel of land benefited by said improvements. The Village
hereby covenants and agrees that it will do and perform
as soon as they may be done, all acts and things necessary-for
the final and valid levy of such special assessments, and in
the event that any such assessment be at any time held invalid
with respect to any lot, piece or parcel of land due to any
error, defect, or irregularity, in any action or proceedings
taken or to be taken by the Village or this Council or any of
the Village officers or employees, either in the making of
such assessments or in the performance of any condition
_ precendent thereto, the Village and this Council will forthwith
do all such further acts and take all such further proceedings
as may be required by law to make such assessments a valid
and binding lien upon such property.
a) Said assessments for the Sheldon Street improve-
ments, consiting of street, curb, gutter, sanitary sewer
and watermains and said watermain improvements along Hamline
Avenue shall be payable in twenty (20) equal, consecutive, annual
installments, the first of said installments to be payable
with general taxes for the year 1968, collectible with such
taxes during the year 1968. To the first installment there
shall be added interest at the rate of 6~ per annum on
the entire assessment from the date of the resolution
levying the assessment until December 31, 1968. To each
subsequent instalment there shall be added interest at
said rate for one year on all unpaid installments.
b) Said assessments for the Hoyt Avenue improve-
ments, consisting of sidewalks, curb and gutter, shall be
payable in five (5) equal, consecutive, annual installments,
the first of said installments to be payable with general
taxes for the year 1968, collectible with such taxes during

the year 1968. To the first installment there shall be
added interest at the rate of 6~ per annum on the entire
assessment from the date of the resolution levying the
assessment until December 31, 1968. To each subsequent
installment there shall be added interest at said rate for
one year on all unpaid installments.
c) Said assessments for the Arona Street improve-
ments, consisting of base, surfacing, curb, gutter and
sidewalks, shall be payable in five (5) equal, consecutive
annual installments, the first of said installments to be
payable with general taxes for the year 1968, collectible
with such taxes during the year 1968. To the first install-
ment there shall be added interest at the rate of 6q per
annum on the entire assessment from the date of the reso-
lution levying the assessment until December 31, 1968. To
each subsequent installment there shall be added interest
at said rate for one year on all unpaid installments.
10. To provide moneys for the payment of said
principal and interest there is hereby levied upon all of
the taxable property in the Village a direct annual ad
valorem tax which shall be spread upon the tax rolls and
collected with and as part of, other general property
taxes in said Village for the years and in the amounts as
follows:

Said tax shall be irrepealable so long as any of
said bonds are outstanding and unpaid, provided that the
Village reserves the right and power to reduce the levies
in the manner and to the extent permitted by Sea. 475.61.(3)
M.S.A.
For the prompt and full payment of the principal
of and interest on said bonds, as the same respectively
become due, the full faith, credit and taxing powers of the
Village shall be and are hereby irrevocably pledged.
11. The Village Clerk is hereby directed to file
a certified copy of this resolution with the County Auditor
of Ramsey County, Minnesota, together with such other
information as he shall require, and to obtain from said
Auditor his certificate that said bonds have been entered in
the said Auditor's Bond Register, and that the tax levy
required by law has been made.
12. The officers of the Village are hereby
authorized and directed to prepare and furnish to the pur-
chaser of said bonds, and to the attorneys approving the
legality of the issuance thereof, certified copies oP all
proceedings and records of the Village relating to said
bonds and to the financial condition and affairs of the
Village, and such other affidavits, certificates and informa-
tion as are required to show the feats relating to the legality
and marketability of said bonds as the same appear from the
books and records under their custody and control or as other--
wise known to them, and all such certified copies certificates
and affidavits, including any heretofore furnished, shall be
deemed representations of the Village as to the facts recited
therein.
The motion for the adoption of the foregoing
resolution was duly seconded by member Nilsen and upon vote
being taken thereon, the following voted in favor thereof:

Council has received complaints concerning the former Killmer~s
Swill Vacant: Nursery properties which, because said properties have been
left unattended and. buildings left vacant for over a year,
has created conditions leading to certain nuisances and
disturbances to the surrounding residents. Clerk was
instructed to write to A.L. F'~ubinger, manager of proposed
apartment buildings to~inquire as to when construction
will proceed.
Engineer's Report: Engineer Lemberg advised he had attended. meeting of the
Ramsey County League of Municipalities Solid V~'aste Disposal
Committee. Purpose was to gather information from all
municipalities inasmuch as most of the metropolitan area
is experiencing shortage of dumping facilities.
Lindig Third Addition After discussion, council advised Art Lindig that it z~~ould
Garage Building: appear the only requirement he need fulfill to build
garage behind his greenhouse is to obtain building permit.
