HomeMy WebLinkAboutCCMin_67Sep142605 REGULAR MEETING OF September lit., 1967 The regular meeting was called to order at 7sO0 P.M. with the following members presents Mayor Nilsen, Clerk Strandquist, Councilmen Black, Warkentien and Stone. .Also present were Treasurer Olsen, Engineer Lemberg, and Attorney Galvin. Minutess Black moved, seconded by Warkentien that the minutes of the meeting of August 2!>., 1967 be approved. Ayess A11. Nayss None. Motion was carried. Correspondences Tax Levies 1968s Letter under date of July 25, 1967 from County Auditor Thomas J. Kelley was. regarding tax levies that the village will be certifying to County Auditor, and levies that have been made for redemption of bonds and interest in 1968. N. S. P. Compar~y Letter under date of September 12, 1967 from R. L. Vannelli Mid block of N.S.P. Company in part advised that construction of Lighting: mid-block street lighting program is expead~.ed to begin in October of 1967. League of Minn. Memorandum under date of August 29, 1967 in part advised Municipalities of the 1967 series of fall regional meetings sponsored by Regional the League of Minn. l~[unicipalities. West St. Pahl is Meetings host.on October 19, 1967 at the Southview Country Club. Parker Anderson . Trees Upon request of village councilmen, Parker Anderson 1513 ~ West Hoyt made a boulevard tree survey of tree conditions on one street in the Northome Area. His report is included in letter under date of September 1, 1967. ,Strandquist moved, seconded by .Stone that councilmen express thanks and appreciation to Parker Anderson for the beneficial report submitted. Ayes sAl~Tays s None. Motion was carried. Trees Letter dated September 8, 196? from James Healy of 1859 1859 Arona Arona stated that tree is badly split down the middle. Village Clerk advised he had them instructed Northland Tree Service to remove said tree, and same has been done. Removal of .Stone moved, seconded by Nilsen that authorization be given Stumps for removal of stumps of trees remaining on boulevards after trees were ordered cut down because of damage due to Jun® 30th storm. Ayess All. Nays: None. Motion was carried. Pruning and Warkentien moved, seconded by Strandquist that the Northland Repairings Tree Service be authorized to do necessary repairing and pruning of trees as per list of thirty trees submitted to the council. Ayess A11. Nayss None. Motion was carried. Road Lighting Policy - Letter dated Augusty30, 1967 from Dean R. Anklan, County Ramsey Countys engineer, advised that the Engineer will propose that all street lights install.®d and maintained by Ramsey County or paid for by Ramsey County be transferred to municipal jurisdiction. 2606 Workmen~s Compensation: In accordance with the rate increase approved by the Compensation Insurance Board because of increased benefits provided under the Workmen's Compensation Law, an endorsement of Workmen~s Compensation Insurance Pol:icp has been issued. - Briggs and Morgan Letter under date of August 28, 1967 from Attorney Court Casess Richard Kyle reviewed procedure that has been adopted by Briggs and Morgan for billing with respect to court cases handled by that firm. Sewer Agreement - Copy of Attorney Kyles letter of September 1, 1967 to City of Saint Paul: Eugene Avery, Chief Engineer, Department of Public Works, Saint Paul, with respect to proposed sewer agreement with the City of Saint Pauli was read. SaRrer Instal3.er Having met the requirements, it was moved by Strandquist License Granted: seconded by Warkentien that Francis T. Wagner of Rose Plumbing be granted sewer installers license. Ayes: All. Nays: None. Motion was carried. Snow Plowing Nilsen moved, seconded by Strandquist that the Village 1967-1968: Engineer be instructed to get in touch with Ramsey County to make provisions for snow plowing village streets for the season of 1967 to 1968, vrith a minimum of sanding, and to include the new street known as Sheldon Street. Ayesz All. Nays: None. Motion was carried. Local 149, I.B.T.s Letter dated August 30, 1967 from Joe Prifrel, Business Manager Local No. 1l~9, advised that he had signed contract with understanding that senior employees were entitled to three weeks vacation as of this year. Council instructed Attorney Galvin to inquire as to reason for said stipulation inasmuch as the two employees had not fully completed fifteen years of service. Youth Firearm Safety Strandquist moved, seconded by Black that the request Program: of Peter J. McGough to use the village hall for five consecutive Wednesday evenings commencing September 20 through October 18, 1967, not including October 11~ for the Minnesota Youth Firearm Safety Program, be granted. Ayes: All.. Nays: None. Motion was carried. Fire Department Fire Chief Al Helbig was present and submitted report Fire Chief Report: of Fire Department to date, along with proposed budget fir 1968. Nilsen moved, seconded by Strandquist that approval be given for expenditure for the necessary four receptacles (12) twist lock plugs, and shut off valve for the 2~ hose, at a cost not to exceed X250.00. Ayess Nilsen. Strandquist, Stone, Black and Warkentien. Motion was carried. Registration Fee for Stone moved, seconded by Black that the Fire Department be First Aid Seminars: authorized to send Jerry Renchin and Henry Dachtera,fire . fighter volunteers,,. to the Seminars on Special First Aid which will be held on Tuesdays and Thursdays during October. Registration fees of X15.00 for each man 1 1 1 2607 shall be paid by the Village of Falcon Heights. Ayes: Nilsen, Strandquist, Black, Stone and Warkentien. Nayss None. Motion was carried. Fire Department Discussion was held regarding actuarial survey of Relief Association Fire Department Relief Association. Actuarial Survey: Transfer of Funds - Stone introduced the following resolution and moved Sewer Rental: its adoptions BE IT RESOLVED by the Village Council of Falcon Heights that the Village Treasurer be authorized to transfer ~l~000 from the Sewer Rental Rand to the General Fund in accordance with decision made in approving the budget for 1967. Motion was duly seconded by Warkentien and upon a vote, the following voted for same: Nilsen, Strandquist, Black, Stone and Warkentien and the following voted against same: None. Whereupon said resolution was declared passed. Parking on St. Mary's Vicki Jacobson of 1703 St. Mary's Street was present Streets to voice complaint that business people park cars in front of her house from 2`x30 a.m. to 11:30 p.m. and • requested council action to prohibit same. Miss Jacobson was advised that consideration would be • given to her request. HEARING Falcon Heights Continuation of Public Hearing until September 1l~, Congregational 1967 was approved by resolution at council meeting • Church - of August 2l~, 1967. Hearing regarding Supplemental Supplemental Assessments and Re-assessments against the Falcon Assessmentw Water- Heights Congregational Church was called to order at main 1960 #1 & 8:00 P.M. with Ray Hardy and Roger Short representing Sanitary Sewer the church. Improvement 1957= Mayor Nilsen read report submitted by Engineer Lemberg and Lemberg reviewed the drainage problem, which presently exists. The trouble spots were designated using an illustration of the area. It was brought out that at the time the parking lot was installed, same was made to drain into the drainage ditch. Short stated that grater presently collects on the north part of the parking lot. He also stated that he believes the most satisfactory solution is to construct an inlet that ~rould drain water into the storm sewer. He also stated that four of the lots concerned have not been benefited and he is of the opinion that assessments should be abated until such time as the improvements are utilized. The other two lots facing Pascal may never be used for parking, and no plans have been made to _ date for use of the two lots. 2608 Resolution for After discussion, Black introduced the follor~ing Supplemental resolution and moved its adoption: Assessment of Block 1, Bar thel WHEREAS, on October 17, 1960, the Village Villas Addition Council adopted the assessment roll for the for Waterl~gain WaterMain Improvement of 1960 No. 1, which was Improvement of thereafter certified to the County Auditor and 1960 #ls extended on the proper tax lists of the County and WHEREAS, the proposed assessment roll showed Lots 20 and 21, Block 1, Barthel Villas Addition to have had an assessable frontage of 75 feet each for which an assessment of X551.25 was then made; and WHEREAS, since the incorporation of the Village, building permits have been refused on these lots because of the low topography and the erection of buildings thereon would interfere with natural drainage; and WHEREAS, said lots were omitted from the WaterMain Improvement of 1960, No. 1 assessment at the request of the owners until such time as the Village Council would authorize building permits at which time the assessment would be reinstated; and WHEREAS, the Village has constructed a storm sewer system eliminating said lots as natural drainage areas and said lots are now useable for all purposes; NOW, 'I~iEREFORE, BE IT RESOLVED s 1. There is hereby levied a supplemental assessment of X551.25 for the WaterMain Improvement of 1960 No. 1 upon each of Lots 20 and 21, Block 1, Barthel Villas, and each of said lots is found to be benefited by the proposed improvement in said amount. 2. Such assessment shall be payable in equal annual installments extending over a period of 13 years, the first of the installments to be payable on the first Monday in January, 1968 and shall bear interest at the rate of 6~ per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1968. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 2609 3, The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the village treasurer, except that no interest shall be charged if the, entire assessment is paid within 30 days from the adoption of this resolution; and he may, at any time thereafter, pay to the county treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year. in with such payment is made. ~, The clerk shall transmit a certified duplicate of this assessment to the county auditor to be extended on the proper tax lists of the county, and such assessments shall be collected and paid over in the same manner as 0th®r municipal taxes. The motion for the adoption of the foregoing resolution was duly seconded by Stone and upon a vote being taken thereon, the following voted in favor thereofs Nilsen, Strandquist, Stone, Warkentien and Black and the following voted against the same: None. Whereupon said resolution was declared duly passed and adopted. Resolution Black introduced the following resolution and moved its Reassessing Lots ].l~, adoptions 15, 20, and 21 Block 1, Barthel WHE'R~F.,AS, on August 15, 1967, the Village Council Villas Addition adopted the assessment roll for Sanitary Sewer System for Sanitary Sewer Improvement No. 1 which was thereafter certified to the System Improvement county auditor and extended on the .proper tax lists of the No. 1 (1957) county; and WHERF~AS, the said assessment roll, shored Lots 1l~, 15, 20 and 21, Block 1, Barthel Villas Addition to have an assessable .frontage of 75 feet each for which an assessment of X672,00 per lot was made; and \ 1N~IEREAS, since the incorporation of the Village building permits have been refused on said lot because of the low topography and the erection of buildings thereon would interfere with natural drainage; and 'VitHERF~AS, the owner of said lots requested that Sanitary Sewer System Improvement No. 1 assessment on said lots be removed until such time as said lots could be used for all purposes at which time fihe assessment would be reinstated; and WFB;REAS, on F®bruary 26, 1959, the Village Council by resolution reassessed, Lots 1l~, 15,- 20, and 21, Block 1, Barthel Villas and removed said assessment pursuant to M.S.A. 1129.071 because said assessment was excessive in view of the fact that the Village had permitted no use of said lot; and ~GHERF.AS, subsequent to said reassessment of pots 114, 15, 20 and 21, Block 1, Barthel Villas, the Village has installed a storm sewer system resulting in the removal of said lots as drainage areas and making them available for all purposes; 2610 Extension of Storm Sewer Drainages Summer Recreation Program .Review NCJ6ff, THEREFORE, BE TT RESOLVER by the Village Council of the Village of Falcon Heights, Minnesotan 1. The assessment originally adopted Au 2s~ ~, 1957 by the Village Council in the amount of ~672.OC'~~or the Sanitary Seger System Improvement No. 1 is hereby reassessed and shall constitute the special assessment against Lots 11~~ 15, 20 and 21, Block 1, Barthel Villas, and said lots. are found to be benefited by the improvement in said amount. 2. Such assessment shall be payable in equal annual installments to be payable over a period of 10 years, the firs t of the installments to be payable on the first Monday in January 19E8, and shall bear interest at the rate of 6~ per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1968. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. Whereupon said resolution was declared duly passed and adopted. econded by Warkentien Stone moved that the Village Council authorize the village engineer to undertake an investigation and to plan the most feasible method of extending the existing storm suer drainage area to include the property lying between Pascal and Holton Streets and Roselawn and Garden Avenues and to obtain preliminary estimates as to cost. Engineer is instructed to confer with owners of properties (which includes both the Falcon Heights Church and private land owners) regarding drainage. Said plans shall be submitted to the Village Council at the next regular meeting. Ayers All. Nays: None. Motion was carried. Dick DeSchriver was present and gave report of the 1967 Summer Recreation Program. He feels that the council should take a look at the program and see what direction to take. At present village is conducting a minimally adequate program. The southeastern quadrant of the village could be serviced by adding to the staff and other expenses. He felt that two-and- one half staff members is only minimally adequate and program could be further enhanced. Three staff members would be more 2611 ideal. Council might also consider feasibility of including University Grove area, then his recommendations would have to be revised, however, University Grove children could go to Falcon Woods Playground. He thought that a full time .girl ..staff member could~be obtained for $500 for the eight weeks period. DeSchriver~s 1967 Summer Program Final Report is on file in .the Clerks office. Julia Lindigts Art Lindig made inquiry as to possible disposition of Propertys property north of his own that was Julia Lindig~s prior to her death. Counci.~: was of the opinion that at the present time there appears to be no solution. Resolution was duly seconded by Warkentien and upon a vote being taken thereon, the following voted in favor thereof: Nilsen, S trandquist, Black, Stone and Warkentien and the following voted against same: None. Whereupon said reso- lution was declared duly passed and adopted. Northome Shopping It was reported that Don Julen of the Stepnitz Agency stated Centers that (1) the back parking lot will be done very shorty, (2) bumpers should be installed on Larpenteur Avenue, (3) signs showing traffic direction into parking area in front should be installed. 2617 Parking on Stone introduced the following resolution and moved its ' Saint Marys adoptions Street: ~~, the Village Council of Falcon Heights has investigated the facts and finds thatthere is a serious problem of traffic congestion because of parking on the east and west sides of Saint Mary's Street north of~ Robert Hall Store and. Lido Cafe NO~P', THERx;FORE, BE IT RESOLVED that pursuant to Village of Falcon Heights Ordinance No._80, Section 5s Parking shall be prohibited for more than two hours between the hours of 8:00 o~clock A.M. and l~:00 o~clock P.M. except on Saturdays, Sundays, and Legal Holidays on the east and west sides of St. Mary's Street. lying between a point that is 17l~ feet north of Larpenteur Avenue and a point that is ~.7l~ feet north of the northerly edge of Larpenteur Avenue on Saint Mary's Street. Nilsen duly seconded the motion and upon a vote being taken, the following was recorded: Ayes: All. Nayss None. Motion was carried.
