2625 REGULAR AJ~ETING OF OCTOBER 17., 1967 The regular meeting was called to order at 7x00 P.M. with the following members presents Mayor Nilsen, Clerk Strandquist, Councilmen Black, Stone and Warkentien. Also present were Treasurer Olsen, Engineer Lemberg, and Attorney ; Kyle. Minutes: Stone moved, seconded by yarkentien that the minutes of the meeting of September 28, 1967 be approved. Ayes: All. Nays: None. Motion was carried. Correspondence Letter of October !t, 1967 from Swanson and Christofferson, Swanson & Attorneys at Law, was regarding accident-that occurred on Christofferson December 19, 196l~ involving the police car_and Arthur Village of Falcon Holmberg. Letter stated the Court entered findings that Heights vs both parties were negligent and no recovery can be made A. Holmberg: by either. Photostatic copy of the Order was enclosed. County Auditor Letter dated October 6, 1967 from Thomas J. Kelley, County Attorney General Auditor attached copy of Attorney Generals Opinion Opinion regarding concerning questions regarding certification of tax levy. Tax Levy: Letter dated October 9, 1967 from the League of Minnesota League of Minn. Municipalities contained tax levy information and the Municipalities: uncertainty that has surrounded the portion of the 1967 Tax Relief and Reform Act. League of Minn. Letter dated September 29, 1967 from the League of Minn. Municipalities - Municipalities stated that League is in process of creating Metropolitan several ad hoc committees to conduct studies and make Section Committee: recommendations on legislative questions and to foster inter municipal cooperation in solving mutual problems. List of various committees was included. N. S, P. Company; Letter of October ~., 1967 advised that distribution will be made from refund check received from its pipeline supplier to its General Service gas customers in St. Paul Division. Justice of Peace Letter to Treasurer Olsen dated October 2 from Justice of Fine Money to adze Peace Coppini requested refund of fines collected for Ramsey County fraud of checks convictions which were processed through Treasurers Justice Court. .Black moved, seconded by Warkentien that check in the amount of X122.00 be authorized in order that fine money collected be forwarded to Ramsey County Treasurer as per Minnesota Statutes. Ayes; Nilsen Strandquist, Black, Stone and Warkentien. Nays; None. Motion was carried. - Licenses Granted: Having met the requirements, it was moved by Strandquist, Sewer Installers seconded by Nilsen that John A. Healy III dba J & T Contracting Inc., 278 West Kellogg Boulevard. be graded Sewer Installers License. .Ayes; All. Nays; Norie. Motion was carried. Master Gas Having met the requirements, it was moved by Strandquist, Installers seconded by Warkentien that John E. Reuer of Quality Heating Company, 3035 Lyndale Avenue, Minneapolis, be .granted a Master Gas Installers License. Ayes: All. Nays: None. Motion was carried. 2626 Authorization to Having met the requirements, it was moved by Strandquist~ do Plumbing Work: seconded by Warkentien that Buchman Plumbing Company, 3035 Lyndale Avenue South, Minneapolis be authorized to -do plumbing work in the Village of Falcon Heights. Ayes: All. Nays: None. Motion was carried. HEARINGSs Pursuant to due call and notice thereof, the Hearing was called to order at 8x00 P.M. to hear all persons present Street, Curb and as regards the assessment against abutting properties for Gutter, Sanitary the improvement of Sheldon Street by installation of street, Sewer Improvements - curb and gutter, and sanitary sewer, such project is known 1967 -Sheldon Street as Project 67-1 (Sanitary Sewer) and Project 67-3 (curb and (Project 67-1 gutter and street). Project 67-3) Engineer Lemberg reviewed project giving estimated costs and actual costs. Attorney Kyle reviewed assessment procedures and certification of unpaid assessments and pertinent facts. Engineer Lemberg pointed out that the total estimated assessments per front fmt was $2l~.03, and actual assessment is $23.03, which includes water, sanitary sewer and street and curb and gutter. liVater Improvements Pursuant to due call and notice thereof, the Hearing was Sheldon Street and called to order at 8:30 P.M. to hear all persons present Hamline Avenue: as regards the assessment against abutting properties for (Project 67-1~ the improvement of Sheldon Street and Hamline Avenue by ~ the installation of ..water mains and lot services and related benefits, such project is known as Northeast Water. Main Installation Project 67-1. Engineer Lemberg reviewed project giving estimated costs and. actual costs. He stated that costs were higher than original estimate due mainly to increase in each one of the unit price bids and also engineering inspection time by the City of St. Paul was considerably higher than ex- pected. These factors made cost X1.00 higher than estimated. He advised that the street was not completely finished and. final paving will be held off for a wh~1e to give base it sub-base a chance to settle a little further but assessments do include finished street. Attorney Kyle reviewed assessment procedure and pertinent facts. Street, Sidewalk, Pursuant to due call and notice thereof, the Hearing was Curb and Gutter called to order at 9=00 P.M. to hear all persons present Arona Street: as regards the assessment against abutting properties for (Project 67-3) the improvement of Arona by construction of streets side- walk, curb and gutter, such project is known as Project 67 3. Engineer Lemberg ,reviewed project stating that Arona Street was. constructed under State Aid Program. Assessments are based on procedure set up_by the village in assessing only curb and gutter. The sidewalk on the east side was taken out and replaced to conform to the street and this is not being assessed. The curb and gutter and sidewalk on the vast side are then assessed at X2.50 lineal foot. C. Warren Peterson Regarding the alley drainage on the east side of Arona - 1513 W. California: the initial installation was revised but there is still a problem. Can you describe what might be done? 2627 Lemberg: Alley will have to be properly graded. Under the rotating maintenance program, the alleys in Northome are improved every four years, that is patching and repairing and seal coating. Since we are within one year of doing alleys, we could take care of alley advantageously when the time comes. We know the drainage is poor, we have other alleys, too. Two or three garages are quite low and we wouldn't want to flood out any driveways or garages. It will be corrected in 1969. Hoyt Avenue Sidewalk Pursuant to due call and notice thereof, the Hearing Curb and Gutter• was called to order at 9:30 P.M. to hear all persons Improvements present as regards the assessment against abutting (Project 67-3) properties for the improvement known as Hoyt Avenue Sidewalk, Curb and Gutter Improvement, Project 67 3. Engineer Lember reviewed project which consists of two separate parts ~l) installation of concrete curb and gutter, and (2) installation of sidewalk and replacing existing sidewalks. Carriage walks were replaced and will be paid for by the Village. Attorney Kyle explained assessment and certification procedures and pertinent facts. Black introduced the following resolution and moved its adoptions RESOLUTION ADOPTING ASSESSMENTS FOR Resolution (a) Water Improvements (Sheldon St. & Hamline Ave.) Adopting (b) Street Improvements (Sheldon Street) Assessmentss (c) Street Improvements (Arona Street) (d) Street Improvements (sidewalk, curb and gutter) (Hoyt Avenue) WHEREl~S, pursuant to due notice given as required by law, the council has met and heard and passed upon all objections to the proposed assessments for the 1967 improvements as more particularly described in the notice of hearing on said assessments, and has amended such proposed assessments as it deems just, NOW, THEREFORE, BE IT RESOLVED by the Village Council of Falcon Heights, Minnesota as follows: 1. Such proposed assessments, as amended, copies of which are on file jn the Clerk's office and made a part of these minutes by reference, are hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included in hereby fotuZd to be benefited by the proposed improvements in the amount of the assessments levied against it. 2. The assessment for Water Improvements (Sheldon Street and Hamli~e Ave., Ramsey County Auditor No. 673) shall be payable in 20 equal, consecutive, annual install- ments. To the first installment there shall be added interest at the rate of 6~ per annum on the entire assess- ment from the date of this resolution until December 31, 1968. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 2628 The first of said installments shall be payable with general taxes for the year 1968, collectible with such taxes during the year 1968. 3. The assessment for Street Improvements (sheldon Street - Ramsey County Auditor No. 670) shall be payable in 20 equal, consecutive, annual installments. To the first installment there shall be added interest at the rate of 6~ per annum on the entire assessment from the date of this resolution until December 31, 1968. To each subsequent installment when due shall be added interest for one year on all unpaid installments. The first of said installments shall be payable with general taxes for the year 1968, collectible with such taxes during the year 1968. It. The assessment for Street Improvements (Arona Street - Ramsey County Auditor No. 671) shall be payable in 5 equal, consecutive, annual installments. To the first installment there shall be added interest at the rate of 6~ per annum on the entire assessment, from the date of this resolution until December 31, 1968. To each subsequent installment when due shall be added interest for one year on all unpaid installments. The first of said installments shall be payable with general taxes for the year 1968, collectible with such taxes during the year 1968. 5. The assessment for Street Improvements -sidewalk and curb and gutter (Hoyt Avenue -Ramsey County Auditor No. 672) shall be payable in 5 equal, consecutive, annual installments. To the first installment there shall be added interest at the rate of 6% per annum on the entire assessment, from the date of this resolution until December 31, 1968. To each subsequent installment when due shall be added interest for one year on all unpaid installments. The first of said installments shall be payable with general taxes for the year 1968, collectible with-such taxes during the year 1968. 6. The owner of any property so assessed may, at any time prior to certification of the assessment rolls to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the Village Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution. 7. The Clerk is directed to transmit certified duplicates of these assessments to the County Auditor to _ be extended on the proper tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. The clerk shall transmit said certified duplicates of the assessment rolls 30 days from the date of its adoption. 8. The clerk is directed to notify by mail the record owner of every parcel of real estate assessed of the amount of said assessment and that said assessment may be prepaid without interest within 30 days of the adoption of the assessment roll. The motion for the adoption of the foregoing resolution was duly seconded by Stone. 2629 Claim;Filed - Due to the fact that Mrs. Molkenthin, 1397 West Hoyt Hoyt Avenue Avenue, brought forth a letter stating claim and objection Sidewalk and against assessment, Black moved, seconded by Stone that Curb and Gutters the above motion be rescinded. Ayes: All. Nays: Non®. Motion was carried. Mrs. Molkenthin objected stating that sod is not properly laid and terrain is not in a satisfactory condition as it was previously. She claims that the irons are driven down to a lower elevation, and the iron to the east is not in the correct place and to~the west cannot locate same. The sidewalk, she contends, is crooked, and there are bubbles in it and it is crumbling. Resolution After Mrs. Pdolkenthin~s claim had been duly received and Adopting filed with the Village Clerk, Black re-introduced the Assessments ~ rescinded resc~lution~and moved its adoption. Motion was duly seconded by Stone and upon a vote being taken, the following voted fbr same: Nilsen, Strandquist, Stone Warkentien and Black and the following voted in oppositions None. Whereupon resolution was declared duly passed and . adopted this 11th day of October 1967. Resolution Reducing Warkentien introduced the following resolution and moved Tax Levy for 1968 - its adoption. WaterMain Improve- ment 1963 Levy: WHEREAS, in Section 6 of a resolution entitled 'Resolution Providing for the Issuance and Sale of Water- main and Sanitary Sewer Improvement Bonds of 1963,Ft adopted by the Village Council of the Village of Falcon Heights, Minnesota on September 11, 1963, there was levied upon all of the taxable property in the Village a direct general ad valorem tax in the amount of X3,000 to be spread upon the tax rolls and collected with and as a part of the other general property, ta~,es in said Village for the year ~ ` 1967, to provide for moneys for the payment of principal and interest on said bonds; and 1IVHEREAS, under Section x.75.61, Subd. 3 of the Minnesota Statutes said tax levy is irrevocable unless there is on hand an excess amount in the Sinking Fund and the fact and amount thereof is certified to the County Auditor, in which case the County Auditor shall reduce by the amount so certified the amount otherwise to be included in the rolls next thereafter prepared; and ` ~ WHEREAS, there is now on hand in the Watermain and Sanitary Sewer Improvements of 1963 Fund an excess amount greater than $3000 and the Village Council deems it advisable to have this fact certified to the County Auditor under Section 175.61, Subd. 3 of the Minnesota Statutes so that the County Auditor will so reduce the tax levy heretofore made, NONE, THEREFORE, BE TT RESOLVED BY THE VILLAGE COUNCI L OF THE VILLAGE OF FALCON.HEIGHTS, MINNESOTA: 1. The Village Council hereby determines that there is on hand in the Watsrmain and Sanitary Sewer Improvements ~, l.- a 2630 of 1963-Fund, an excess amount greater than $3,000 and that the X3,©00 tax levy for the year 1968, made in Section 6 of the resolution of the Council providing for the issuance and sale of Watermain and Sanitary Sewer Improvement Bonds of 1963, adopted on September 11, 163, and thereafter certified to the Ramsey County Auditor and entered in the Bond Register of the Ramsey County Auditor on September 23, 1963, shall be reduced by $3,000 and no amount thereof shall be included by the County Auditor in the tax rolls prepared for the year 1968. 2. The Village Clerk is hereby directed to file a certified copy of this resolution with the County Auditor of Ramsey County, Minnesota together with such other information as he shall require. Motion was seconded by Stone. Upon a vote being taken, the following voted for same: Nilsen, Strandquist, Warkentien, Black and Stone and the following voted in oppmsition: None. Whereupon resolution was declared duly passed and adopted. Budget 1968 - Stone introduced the following resolution and moved Levy for year 1967 its adoption. Collectible in 1968: BE IT RESOLVED by the Village-Council of the Village of Falcon Heights, that the following sums be and they .are hereby levied upon the taxable property of the Village of Falcon Heights for the year 1967, collectible in the year 1968. Whereupon resolution was declared duly passed and adopted. Council meeting Inasmuch as Thanksgiving Day falls on the same day as the date changed due regularly scheduled meeting of the council, Stone moved,. to Thanksgivings seconded by Strandquist that the council meeting be scheduled for Tuesday November 21, 1967 in lieu of Thursday, November 23. Ayes: A1.1. Nays: None. Motion was carried. 1 1 D ~~.~ ~ ~~ State and County Representatives Requested to attend Council Meeting regarding Hollywood Courts 2631 Clerk was instructed to address letter to E. J. McCubrey, State District En gineer and also to Floyd Snyker, County Assistant Engineer, requesting their presence at the Council meeting of October 26, 1967. Discussion regarding certain problems that have arisen due to the service road leading out of Hollywood Court being changed to one way traffic only, has been scheduled. Sewer Rental The following resolution was in troduced by member Stone Delinquent Accounts who moved its adoption: certif ied to County Auditor: W~-IEREAS, the following described real estate located within the Village of Falcon Heights show unpaid sewer rental charges, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Falcon Heights, Ramsey County, Minnesota as follows 1. It is hereby determined that there are delinquent sewer charges against the properties hereinafter set forth, in the amounts set forth opposite the description of such properties. 2. A special assessment in the amount hereinafter set forth is hereby levied against each of such tracts respectively. 3. The total amount of such special assessment, in each case, shall be payable with the 1967 real estate taxes due and payable during 1968. }~. The Clerk shall forthwith transmit a certif ied copy of the assessment to the County Auditor to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes, ~.
