Nilsen, ~~ayor; Geo. Shavor, Trustee; uuillis i~arkentien, Trustee, Paul Coppini, Trustee; ti~Im. R. Utecht, Clerk. Also present were Frank N. Graham, Village Attorney; ilrm. Olsen, Treasurer; Nick Christensen, 3uilding Inspector, and Ethel E. ulhite, Deputy Clerk and Deputy Treasurer. P,4inutes of the Special T.Reeting of T~arch 24th, and the Re{~ular rieeting of T~~arch 27th were approved. as submitted. Fire Dept. Letter of April 8th, from Henry J. Dachtera, Secretary of the Relief Falcon Heights Fire Department Relief Association, regarding Assn. investment of X7000.00 of the Special Fund ?honey in the ".~innesota Federal Savings & Loan Association, was read; and after discussion, it was moved by Utecht and seconded by i~iarkentien that the Falcon Heights Fire Department Relief Association be authorized to deposit X7000.00 of its Special Fund ::"?oney in the T4in~ esota Federal Savings and Loan Association, subject to formal action by the '~?oard. P.7otion unanimously carried. Drainage Letter of April 7th, from the County Auditor's Office, regarding Area C pumping surplus water from the Gottfried Pit into Lake Como was read and referred to Village A±.±.orney CJraham for further study. Fire Letter of April 10th, from Chief Grumke, of the Falcon Heights School Volunteer Fire Dopartment, regarding telephone request from Chief Arthur Spotswood., retired training chief of the Minneapolis Fire Department, that Falcon Weights furnish a pumper for their use in some of the classes at the coming fire school, was read. After discussion, it v,~as moved by Nilsen and seconded by Shavor that Chief Crumke be granted permission to send a pumper over to the Fire School; the men attending t1~e fire school to take it over. A~~otion unanimously carried. • Chief Grumke advised that the three men who indicated they could attend the fire school were Herb Lier, Richard Detib7itte, and himself. It U+as moved by '~~i ~rkentien and seconded by Coz~nini that these men be enrolled in t'-e fire school. °."otion unanimously carried. Fire chief Grumke recommended that membership in the State Fire Chiefs' Chiefs' Association be .renewed for F;arl tis'". Grumke, Chief; CGordy Nelson, Assn. Asst. Chief; and V. J. Hermes, Asst. Chief. It eras moved by Utecht and. seconded by Nilsen that these men be enrolled. ".:ot,ion unanimously carried. Parking Le±.ter of P:~arch 31st, from E. J. Pennig, regarding interviews with Lots. Hermes and Labalestra regarding dust and dirt as well as traffic control at the `_r perking lots ~^ras read; and after discussion, it was decided th='t Frank Graham, Village Attorney, should work on an ordinance coverin~~ parking lot control regarding dust and traffic. Engineer Ljungren stated that covering the parking lot with a coating of calcium chloride should take care of thedust condition for about a year. Village It :^ras agreed to permit the Lauderdale Civil Defense Organization Nall to hold their meetings at our pillage Hall whenever possible -- they to check with us weekly to see if hall was free. 986 Parking lot Larry rliinfrey, 1711 Ingerson Road, as spokesman f'or the group, Falcon stated that ",2ayor Nilsen had been pr~.:~sented a petition for the Heights rezoning of lots 18 and 19 Barthel Villas from "1~ Residential" Cong. Ch. to a parking area. Petition contained 75 signatures out of a possible lU3 or 105. He acid he thought they could have had more signatures that that 75 was well over the required 5U%. He also said it ti^ras their aim to convert these two lots into a parking area j~rithout changing the grade or the water ab- sorption capacity to any great extent. It -,-ras resolved that the petition of the Falcon I-Ieig•hts Congregational Church for the rezoning of lots 18 and 19 :~arthel Villas from "aesidence A" to "!~usiness District for Church Park- ing Purposes Only" be referred to the ~,'i~lage Attorney for checking; and that a hearing on the petition be set for 7 P. ~',I. Thursday Evening, Arril 2~th, 1958, in the Council Chambers at the trillage Hall; a.nd that a notice be prepared a~.d published as required by law; and. that the petition be referred to our Planning Commission for study and reco~nmendat,ion prior to hearing, It was moved bSr Nilsen and seconded. by Shavor that the resolution as read be acted on. ~~'otion unanimously carried. Pascal George Guertin, 18l~8 ''o. Pascal said 18-~8, 1852 and 1860 Pascal ~wenue were the only three lots on pascal havin~• a d-itch in front of their homes; ditches were hard to keep up; and were being abused by children. He asked if a concrete culvert could be placed in front of lots 10, 11 and 12, ar_d ditches filled up level. Engineer Ljungren advised that pine size for storm sewer had already been determined y'or that area. ~ndrevr L. Yeller, 1852 Pascal, said it looked to him like the damage was done vrhen the sewer was put in and. that there was the alternative of putting in culverts or so~?din~. He was told contract does not cover resodding. Plan was to ret~rade the ditches to the bottom of culverts all along Ruggles and Pascal. La°netti is responsible for some of the work of cleaning those ditches. The matter was turned over to Engi- neer Ljungren for further study. "~Tayor IVilsen outlined plans for storm sewer in area, which have been partially completed, and advised that wd will continue to study the situation and plans for financing. He mentioned that we vrill ar~preciate information from the residents of the district. Nick Christensen said the storm sewer on Ruggles should be put in now because the road isn't finished yet. Plilsen said prior to the improvement of I~arnenteur Avenue, we have been unable to drain water out of our area., but now we would be able to. The storm sewer under Larnenteur is sized to meet our req~iire- ments. I~2r. Guertin •3sked if it was perm.issable for the garage at the parsonage to be located on the property line and he was ad- vised that it tin;as being moved as required by the building code. Nilsen expressed. his opinion that it is obligatory on Lametti's part to get in there and do that work. David Cartz^fright, 1800 No. Albert, asked if we couldn't solve all these problems by putting storm sewer in Area C. He was advised we can't do it at ntesent -- the Vrork at Gottfried's pit will be done this sur~~~~er but won't be ready for use until fall . It was stated that the problem of drainage was being studied for the village as a whole. L. Winfrey pointed out that the County is willing to pay its share. Ljungren has worked out the cost of storm sewer in Area C and would like to go over it, and the method of-financing with Frank Graham. Autumn D. Aide, 1998 Autumn, representing 20 or 22 families in the & Prior area, presented the Council with a petition, signed by residents, Streets as follows: "The be],ow named citizens residing on Prior and Autumn Streets in this Village a.re of the opinion that: 1. The street constructed by the Ray Sina Contracting Co., Inc. is inadequate due to: A - h:~nroper drainage. B - Insufficient gravel base C -Violation of basic construction principles includ- ing laying of blacktop in standing Urater. D - Unknown factors. 2. The Village should not have anrroved the construction effort, particularly in view of complaints of citizens at the time of construction. 3. Having approved this street, the Council is responsible for acting to enforce the one year warranty. ~t. "Repair" of the existing street will not be sufficient. These opinions have b-en confirmed by competent engineering authority and the present condition of the street validates these o*~inions beyond question. Accordingly the below named citizens request that the Council direct the Pray Sina Contracting Company, Inc. to replace the entire street with an adequate and acceptable construction at no additional cost to the village of Falcon Heights or its citizens." :.4ayor Nilsen said he felt the charges in the petition were pretty serious; and he felt it would be well to give the Council a little time to consider them. After discussion, it was agreed that P~:embers of the Council, a representative from Toltz, King, Duvall, Anderson ~ Associates, Village Engineer Ljungren, and Ray Sina, the contractor, if po:_sible, should meet with residents of the street Saturday, at l0 A. ~T., to inspect the street and make further plans. ~~~ P~ecreational :~"r. Curtis Larson, 1885 Tatum, presented the Council with Areas. the following petition signed by residents: 'r:'~;e, the undersi~;ned, are residents and home owners of Falcon _ Heights, living in the area bounded by Fairview, Clevel and, Larpenteur and Roselawn Avenues. ~°~rithin this area there are about 100 homes and approximately 1l~0 children, A you know, there is not a single playground facility within this parti- cular area and the school playgrounds are t.oo far away to be of use. As the number of children increases, we are finding that the lack of a playground area is becoming more and :Wore acute. lTe therefore request that the tirillage of Falcon Heights acquire and establish ~orie_or more playgrounds within the above area. Any such area should be at least 200' x 300' in size to accommodate a ball field and otner re- creational facilities. use urge that this request be given careful consideration before further sub-divisions are approved in our area". After a general discussion, '?ayor f•ailsen said the Council had given the matter some consideration; vrould '~e glad to go into it further; and would annrecia.te any help the residents could give them regarding acquisition of suitable property, financing of same, planning and supervision. Development Mr Gage advised he had submitted his plans for another South of "Figure 8" development to ~:ar. Steffen, and ~'r. Uteffes advised Falcon him that it ryas his opinion that he would get bet+er drainage, 1~TOOds etc. if the proposed development were laid out as a straight street. It was pointed out that there was no access from this proposed street to Tatum. Smoke Ex- LettFr from Chief Grumke, regarding need for smoke extrac+,or, tractor was read. It tivas moved by Shavor and seconded by Nilsen that the matter be referred to `~arkentien for checking -- especially with reference to the power supply. Trees Ger- Letter of l~'_arch 31st from Gerhard. F. achmitt, 1725 Asbury, Hard Schmitt regarding trimming of trees was read. and filed. Lauderdale Attorney Graham reported he had checked the Lauderdale Fire Fire Contract and feels it requires us to answer fi.r.; calls only. Contract In their let+er of November lath, 1956, the Lauderdale Council instructed us not to answer anything but fire calls. Graham suggasted vre vrrito a letter to the Fi~~e pepartment and tell them that vre ar•e to answer fire calls only. It was also sur~gested ~.~;e write the Lauderdale Council stating we feel the Department must be allowed to use some judgment on emer- gency calls. ~~~ PE'GUL%'R P~'EETING THUF.SDAY, April lU, 1958.
