Meeting was called to order at 7:30 with the following Council Members present:
Harold C. Nilsen, Mayor; Geo. Shavor, Trustee; Willis Warkentien, Trustee;
Paul Coppini, Trustee; and Wm. R. Utecht, Clerk. Also present were Frank N.
Graham, Attorney and Ethel E. White, Deputy Clerk and Deputy Treasurer.
Minutes of the Special Meeting of June 30th were corrected to read "RTest Side of
Iowa" instead of "East side of Iowa", page 1027, 4th paragraph.
Minutes of the regular meeting of June 10th were approved as submitted.
A. E. Gerald Letter from Mr. Gerald. complaining about his driveway was read.
1478 Idaho Mayor Nilsen said he had contacted Geo. Hughes, Engr. for
TKDA& Associates who said he would go down and take a look at
it. Some work was done. Mr. Gerald is out of town at present
but Nilsen will contact him later.
Tatum St. Attorney Graham's letter was read advising that he had checked
the larr and finds that statue, Section 471.34 M. S. A., which
provides that where a village calls for bids "For the purchase
of any supplies or equipment" no bid shall be accepted unless com-
petitive bids have also been submitted, has been construed by the
Minnesota Supreme .Court not to cover contracts which include
furnishing work and labor in connection with the installation of
the supplies or equipment. See Otter Tail Power Co. v Village
of Elbow Lake (1951) 234 Minn. 419.49 N. W. 2nd. 197. This means
that even though only one bid is received in connection with the
proposed construction work on Tatum Street, it could be accepted
without violating the statute.
Attorney Grahsm's letter of July 17th was read wherein he stated
he was enclosing copies of Agreement Dated July 10th between the
Village of Falcon Heights and T. A. Schifsky & Sons covering the
Tatum St. Improvement, also 3 copies of Change Order #1, dated
July 8th, eliminating culverts on private property, 2 copies
Travelers Insurance Company Certificate of Insurance, as required,
and Public Contractor's bond of Maryland Casualty., dated July
14th in the amount of 166,47q.23. Graham advised he had checked
the foregoing papers and found them to be in order. He said the
Mayor and Clerk should execute the agreement for the Village, also
the Change Orders by signing all three of them. He suggested
that the papers be returned to him and he would see that a signed
copy of tY~e Agreement and Change Order are delivered to the con-
tractor, and to T~Ir. Ljungren. He also said he thought it would
be desirable that the Village's copy of the contract and change
order and the bond and insurance certificates be kept in his file
at the office.
Sanitary Copy of Attorney Graham's letter to L. H. Langevin, Manager Safe
Sewer Keeping Department, First National Bank of St. Paul, was read.
Improvement He advised Langevin he was enclosing 2 copies of a resolution
Bonds certified by the Village Clerk, passed by the Council Thursday,
July 10th, 1958, authmrizing the Safe Keeping Department of the
First National Bank, until instructed otherwise by resolution of
the Council, to clip and cancel the coupons on the Village of
Falcon Heights Sanitary Sewer System Improvement i3onds held in
Safe Keeping, as they become due and to cancel the bonds as they
become due, and to forward the cancelled bonds and the cancelled
coupons to the then Village Treasurer of the Village of Falcon

Snelling Mr. Graham's Netter of July 9th was read regarding the Snelling
Avenue Avenue Drainage Hole. It stated he was enclosing a Thermofax
Drainage Copy of the stipulation for settlement in the condemnation
Hole proceeding dated November 8th, 19115, whereby the State of
Minnesota acquired the westerly 20.5 ft of lots 1, 2, 3, ~,
and 5 and the northerly 19 ft of lot 6, block 9, Northome
2nd Addition for Highway purposes. Under this condemnation
proceeding, the State acquired this 20.5 strip which runs from
Idaho Avenue south along Snelling Drive for approximately 310'
for Highway Purposes, and as an incident to taking this strip
of land, they also acquired the right to drain surface waters
from Snelling Avenue onto the said property. The order further
provided that the owners of the property could fill the prop-
erty if the constructed a sump at their own expense adjoining
the culvert draining the surface water onto these lots which
sump must be at least 15 ft square and run down through any
rock or hardpan at the point where constructed.
Acceptance Steffes letter to H. E. Palmer, Dist. Maint. t~ngr. Minn.
Resurfacing Highway Department, 1246 Unive~~sity Avenue, St. Paul, was read.
E. Snelling It stated TKDA & Associates were writing with reference to
Drive - I~oyt acceptance of the resurfacing of E. Snelling Drive from Hoyt to
to Roselawn Roselawn and the restoration of the road shoulder along the
west side of the south bound lane on Snelling from approximately
Garden to Larpenteur and the resurfacing of the service drive
along the west side of t!-~e south bound lane. The construction
also included crossing under Snelling Avenue at Larpenteur.
Crossing was made by jacking a 36" reinforced concrete pipe,
Table 11 culvert pipe, under the north and south bound lane
and installing therein a 15" vitrified clay pipe with hot
poured bituminous joints. The space between the vitrified
pipe and the concrete culvert pipe was filled with sand and
the ends closed with a brick bulkhead. He asked the Highway
Department's approval and acceptance of this work so that the
release of the deposit held by the State Highway Department
may be made to the Village and the work of the contractor
accepted for final payment. He stated he would like to
recommend final payment of the work to the Council at their
meeting of July 24th.
Street Insp. Letter from Steffes of TKDA & Associates, regarding program
Tour for completing the work, and listing 17 trouble spots was
discussed.
Street There was a discussion regarding the advisability of having
P~~aintenarice our own man or a small contractor such as Nialter Hermes do
minor repair work such as patching and. cleaning out gutters,
etc. It was suggested that Coppini investigate that matter
further and report to the Council at a. later date.
Bird Paths The Deputy Clerk was instructed to check list of addresses
due to Sewer ~ and send Attorney Graham itemized list showing which contractors

which were repaired by the Village.
Resurfacing Letter of July 1ltth written by Steffes of TKDA Rr, Associates to
Streets &. Harry S. "ronson, County Engineer, City Ha:_1 and court House,
Restoration St. Paul, was read. It stated the final inspection of the

work for the Sanitary Sewer Construction at Falcon Heights
was made on Saturday, July 12th, with the Village Council;
and Mayor Nilsen had asked Steffes to write Bronson with re-
gard to the resurfacing of Garden from Pascal to Ha*~line;
Hamline from Hoyt to Roselawn; and the restoration of ditches
along the south side of Roselawn from Fairview to Autumn; and
Roselawn one block along the south side between Holton and
Pascal. Resurfacing and restoration of ditches, including
sodding along Larpenteur Avenue was completed last fall. The
Village should have the County's approval and acceptance of all
the work restored to its original condition where the sanitary
sewer construction took place on and along the County Roads.
Manholes Letter written by Steffes to Jay W. Craig Co., 1814 California
Ave., Minneapolis, was read. It stated the manholes at the
following locations require cleaning and adjustment: Holton
300' north of Garden; Albert at Roselawn; Albert 300' north
of Roselawn; Ruggles and Asbury; and Ruggles and Arona.
Tatum St. Attorney Graham's letter to Mr. & Mrs. ~iernon Whitloff advising
that tie Council had determined that they would not at this
time put in culverts to the East and to the West of Tatum Street
was read. He also stated he was returning to them the original
easement dated June 26th, 1958, giving the Village an easement
across their property in connection with putting the c~:lvert to
West of Tatum St. Since the Village will not be using this
easement, they may destroy it.
Dogs Letter from Jack Ziegler to Mr. & Mrs. Pranke, regarding dog
trouble was read and filed.
Barthel Petition regarding Barthel Villas was read and discussed and it
Villas was decided to turn it over to Attorney Graham who will contact
the attorneys for Barthel and see if they can come to some
agreement.
Storm Shavor made up a list of questions he would like Vern Ljungren
Sewer to check regarding the old County Storm Sewer on Garden,
east of Hamline, and the assist-ant clerk was asked to deliver
it to Ljungren Friday, July 18th.
F. H. Congre- There was some discussion about the piles of dirt on the park-

Church Park- Warkentien will make inquiries as to who put the dirt there

Requisition It was moved by Warkentien, seconded by Utecht and unanimously

Gottfried Letter to the Village of Falcon Heights, attention Mayor
Pumping Nilsen, regarding resolution confirming our acceptance of
Station our share of the cost of construction and operation of the
pumping station at the Gottfried Pit was discussed and turned
over to Attorney Graham for further consideration.
Alleys Attorney Graham offerred the following resolution:
RESOLUTION: WHEREAS, pursuant to resolution adopted by the
Falcon Heights Village Council June 3pth, 1958, a report has
been prepared by Vern L~ungren, Village Engineer, with refer-
ence to the improvement of four alleys (Block 7 Cables Hamline
Heights Addition, Block 8 Cables Hamline Heights Addition,
Block 1~, Northome Addition, and Block 12, Northome 3rd Addi-
tion) and this report was received by the Council on July
17, 1958
NOW THEREFORE BE IT RESOLL'ED by the Village Council of Falcon
Heights, Minnesota:
1) The proposed improvement of the said alleys are hereby
consolidated as one improvement in accordance with the
recommendation of the Village Engineer.
2) The Council will consider the improvement of such alleys
in accordance with the report and the assessment of the
abutting property for all or a portion of the cost of the
improvement pursuant to Minn. Stats. It29.011 to 429.111 at
an estimated total cost of the four alleys as follows:

on Monday, the ltth day of Au.ust, 1958, in the Council Chambers
at the Village Hall, 16ltl~ W. Larpenteur, at 7:30 P. M.; and
the Clerk shall give published notice of such Public Hearing
and Improvement as required by law.
It was moved by Utecht, seconded by Warkentien and unanimously
voted to adopt the above resolution.

Sanitary Sewer Installation was read, contents noted and filed.
Hydrant ~3ill from the Board of Water Commissioners in the amount of $325.21
Larpenteur covering cost of setting hydrant at Larpenteur and Arona Avenues
& Arona was discussed and the Assistant Clerk instructed to write Mr.
Roy Holzer, Water Department, City of St. Paul, referring to
our letter of May 1l~th, wherein we informed him of the action
taken by the Council May 13th, 1958, and tell him it was the
understanding of the Council that this hydrant was to have been
installed without cost of any kind in return for the privilege
of running their water line down Arona from Larpenteur to Hoyt.
Policing After a discussion regarding policing which covered time,
wages, and hours of coverage, VJarkentien was asked to contact
Public Safety Commissioner Arndt, discuss the matter with him,
and report to the Council at a later date.
Needs The matter of weed inspection was discussed and it was suggested
that Copnini ask Bill Carroll, weed inspector, to submit his
bill once a month.
