Nilsen, Mayor; Geo. 5havor, Trustee; Willis Warkentien, Trustee; Paul Conpini, Trustee and Wm. R. Utecht, Clerk. Also present were Frank N. Graham, Village Attorney; Wm. E. Olson, Treas.; Vern Ljungren, Village Engineer, and Ethel E. White, Deputy Clerk and Deputy Treasurer. P~iinutes of the Special Meeting of July 17th were approved as submitted. Mayor Nilsen ad- vised he had written ~4r. Douglas Rees, of Rees-Thomson-Scroggins, Inc., 5000 Wayzata Blvd., Minneapolis, regarding the broken drainage pipe on their property which has failed to carry the air conditioning water, etc. from their buildings; and that this water is a nuisance and causing damage to private property. Nilsen stated. the correct solution to the problem is the construc- tion of a storm sewer from the catch basin in the alley to Arona and thence south on Arona to tie into the Larpenteur Avenue System, and asked that Mr. Rees, or his representative, discuss the matter with the Falcon Heights Council soon. He suggested to Mr. Spindler that we give Pdr. Rees a reasonable time to reply. It was pointed out by Engineer L~ungren that air conditioning ~~ `~;: J -G'-~-_~ water is a storm sewer problem. Storm sewer Roseville is planning to construct this Fall is designed to serve the Lexington Plaza Shopping Center and the area lying immediately north of Larpenteur and West of Lexington. This will serve the low draw immediately north of Larpenteur to Fernwood, then South on Fernwood to Larpenteur, then West on Larpenteur to the Gottfried Pit. There will be no connection to the 24" line lying north from the Gottfried Pit. Last winter a storm sewer study for the Village of Falcon Heights covering the area draining into Larpenteur and the area lying north of Larpenteur, east of Fry, south of Roselawn and west of Hemline was prepared. In this study, the engineers designed the pipe size, capacity, runoff and the other factors affecting storm sewer design. They also pre- pared preliminary plans of storm sewer necessary to serve this area. These plans were turned over to the Ramsey County Engineer's Office with design computations and other criteria. This informa- tion was used to determine the capacity of the storm sewer on Larpenteur a.nd in the design of the pumping station. When the plan for the storm sewer along Larpenteur and the Pumping Station were completed, Ljungren checked and reviewed them with the County Engineer's Office and he is reasonably certain that ad- equate provisions .have been made to handle the storm water from this portion of Falcon Heights. Resolution It was moved by Warkentien, seconded by Shavor, and unanimously Gottfried voted that County Board Resolution #9-4790, County Board File Pumping #1739, relative to drainage of the Larpenteur Avenue ponding Station area into Lake Como in the City of St. Paul, passed by the ?~oard of County Commissioners in session on May 12th, 1958, listed below, be adopted by the Village of Falcon Heights. RESOLUTION: WHEREAS, The County of Ramsey owns land situated on the north side of Larpenteur Avenue between Fernwood and Hemline Avenues which was purchased for a ponding area for waters draining from County Highways, and WHEREAS, The County of Ramsey proposes to reconstruct Larpenteur Avenue from Fernwood to Snelling in the year 1958, and in connection therewith to install a storm sewer thereon for the purpose of providing for storm eaters on said Larpenteur Avenue, and WHEP.EAS, Larpenteur Avenue between said streets is bordered by the City of St. Paul and the Villages of Roseville and Falcon Heights, the latter two of which do not have storm sewers, and ~~A~~ WHEP~EAS, the reconstruction of said Larpenteur Avenue with its storm sewer will drain a great deal of water from streets in the said two villages, and WHEREAS, The construction of and operation of a pumping station will be necessary, together with a force main extending from the pumping station to empty into the City of St. Paul's storm sewer located at Idaho Avenue and Chelsea Street in said City of St. Paul, from which point waters from the ponding area will flow by gravity into Lake Como, and WHEREAS, As a condition to use of said storm sewer and said Lake Como, the City of St. Paul has required the County of Ramsey to agree to pay a proportionage portion of the cost of an overflow from Lake Como into City of St. Paul's sewers located easterly of said Lake Como, NOW, THEREFORE, IT IS AGREED by the Village of Falcon Heights and the Village of Roseville that each of them will pay to the County of Ramsey within thirty (30) days after the completion of said pumping station and said force main 1/3 of the cost of the con- struction of a pumping station to be built on the ponding area site and 1/3 of the cost of the force main from the said pondng area to connect with the City of St. Paul storm sewer located at the intersection of Idaho avenue and Chelsea Street, and each of them agree to pay 1/3 of the County's share of the cost of the overflow from Lake Como within 30 days of receipt of advice as to their share, and each of said villages further agrees to pay to Trie County of Ramsey in or before the month of January in the year following 1/3 of the annual cost of operating and maintaining said pumping station and said force main." Alleys Alley between Idaho and California, Hamline and Albert, item 3 listed in the Notice of the Public Hearing to be held at 7:30 P. rd. Pdonday, August 1~th, 1958, has been 3/It covered with black top, sanded and sealed through a mistake on the part of the County Work Crew. Ljungren advised he had talked to Dean Anklund who told him to come down and see him and they will go through the work sheets and pull the ones covering this particular job -- they cannot and will not charge us for the work done on this alley inasmuch as it has never been brought up to specifications as an accepted impr:wed alley. It needs grading and a proper base before it can be approved by the Council. Present surface should be replaced with a granular base as it is not suitable for blacktopping as is -- it will get spongy and break up. Work Order It was brought out that a mistake yeas made by us on work order #1 to the County. We asked for a "Slow-Children Playing" sign in center of alley between Califlornia, Larpenteur, Arona and Pascal. It should have read California, Larnenteur, Pascal and Albert. Deputy Clerk was instructed to send a change order to the County Engineer's Office. ~ "„4.3 ~'~.~ Street r3i11 from the County Engineer's Office, dated July 14th, in Yi(ork the amount of X2210.77 was discussed. It is the feeling of the County Council that the charga for sweeping and sprinkling Arona Avenue in Bill the amount of ~l~2.30 should be sent to the City of St. Paul inasmuch as this work was done in an effort to keep down the dust while they were laying the water line. It is also felt by the Council that the charge of $649.12 for painting the barricade at Iowa Avenue is excessive. ~e Deputy Clerk was instructed to deduct these two items from the bill. Vern Ljun- gren will discuss these two items with the County Engineer's Office. Regarding more specific bills, it was suggested by Ljungren that we send itemized work orders, and get in touch with John Sullivan, County Engineer's Cost Accountant, who makes out the bills, and he feels sure A4r. Sullivan will make the bills out as we request if we are specific when making out the work order. Fuel Oil Letters from the Thorne Coal R~ Oil Company and the Snelling Company, quoting Writes on our fuel oil requirements for the 1958-59 season were read. Inasmuch as Thorne's price is lower and they have given us consistently good service, it was decided to buy our requirements from them. Building The matter of Swimming pools was discussed. It is Mr. Graham's Ordinance opinion that our ordinance was not intended to cover swimming pools. Investment Attorney Graham advised that he had .talked to Mr. Spring who Sinking suggested we invest the entire X50,000.00 in 10 - $5,000.00 Fund. Treasury ~3onds bearing 2-5/8% interest, due February 15th, 1965, and offerred the following resolution: RESOLUTION: WHEREAS, Fifty thousand dollars of U. S. Certificates of In- debetedness being held in the Sanitary Sewer Sinking Fund Account will mature on August 1st, 1958, and should be reinvested, NOW THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF FALCON"HEIGHTS: 1) That the Safe Keeping Department of the First National Bank of St. Paul be and it hereby is authorized to purchase 10 - ~5,000.00 Treasury 2-5/8~ Bonds due February 15th, 1965 at the market price and hold these bonds in safe keeping for the Village of Falcon Heights and. remit any balance of the proceeds of these Certificates of Indebe~,edness and Interest to the Village of Falcon Heights. 2) That the clerk be and he hereby is authorized to deliver a certified copy of this resolution to the Safe Keeping Depart- ment of the First National dank of St. Paul. It was moved by Shavor and seconded by Copnini that the reso- lution as stated by Attorney Graham be passed. P~iotion unanim- ously carried. Treasurer Wm. E. Olsen, Treasurer, advised he received a check from the Falcon Heights State Fank, made out to us and the Minnesota State Highway Department, jointly, covering interest on money held in connection with the sewer work done on Snelling Avenue and asked if we could cash it. Attorney Graham advised Mr. Olsen he could not cash the check, and said he would consult with Mr. Steffes of TKDA Rr Associates about the matter and advise Mr. Olsen further. Telephone The distribution of telephone charges was discussed and it was Bills decided that Mi. l~-5575 should be split three ways -- 1~3 to Public Safety, 1~3 to General Fund and 1~3 to Fire Department. Streets Shavor asked Ljungren if it would be practical and advisable to have tests made by Twin City Testing Laboratories to see if material in streets where they are breaking up is satisfactory. Shavor also asked Ljungren about responsibility. Ljungren said we had a 1 year guarantee against faulty workmanship and faulty material - that it was a divided responsibility.- Lametti is responsible for bringing in material and Craig for stabilizing. Ljungren thinks there is some clay in the mat, or the top 1 foot of material which Lametti hauled in. Crraham suggested we take this matter up with Steffes again and tell him we don't think it should be doing this and ask Steffes if he thinks we should have tests made. Nilsen agreed to talk to Steffes. Tatum Engineer Ljungren reported finding large hunks of clay about the Street size of a bushel basket when they were opening up Tatum Street. This would be La_metti's responsibility. It was agreed that Steffes or another engineer from T. K. D. A. & Associates should be present when the next section of the street is opened up. Ljungren advised that he had T. C. Testing make a few tests of the street before they started work so they could determine the duality of the base and not be subjected to the charge of moving the base. Ljungren says Tatum is full of pure clay. He thinks Tatum was of material taken out of sewer trenches. Ljungren advised that because of the steepness of the ditch at Larpenteur and Tatum in front of Labalestra's house, the black dirt is washing away as fast as they can put it in. In view of this fact, he suggested that it be sodded around inlet and outlet of flared end of culvert at station 10 + 02 centerline. Also sodding east of ditch of Tatum from station 2 ~ 50 to Larpenteur Avenue ditch - 250 sq yds sod a.t 6s¢ ner sq yd. complete in place at a cost of °169.00. It was moved by Coppini, seconded by Shavor and unanimously voted to approve Change Order #2 to T. A. Shifsky ~ Sons covering this work. Pascal Shifsky & Sons bid X325.00 on this job so Ljungren asked them to Avenue do this job at the time they do Tatum and it should be completed Ditch in a week. Fences There was a discussion regarding fences, including the higher California Type Redwood Fences, and it eras the opinion of the Council that we should not enforce our ordinance regarding height, as long as the fence is attractive and acceptable and not just an ugly spite fence.
