Nilsen, R4ayor; George Shavor, Trustee; ~ffillis V'darkentien, Trustee; Paul Coppini, Trustee and Wm. R. Utecht, Clerk. Also present were Frank N. Graham, Village Attorney, Wm. E. Olsen, Treasurer; Nick Christensen, Bldg. Inspector, Vern Ljungren, Village Engineer and Ethel E. White, Deputy Clerk and Deputy Treasurer. The Minutes of the Special A~eeting of October bth were approved as corrected. The Minutes of the Regular Meeting of October 9th were approved as submitted. Census: Utecht read letter of October 17th from the Tevin Cities t~tetropolitan Planning Commission regarding census, and it was the unanimous opin- ion of the Council that there was no real need for the block enumer- ation; and information to be gained did not warrant the expense. Sewer Falcon Attorney Graham's letter of Octtober 16th regarding the construction Woods No. 2. of sanitary sewers in Falcon Woods No. 2 was read, It stated that the St. Paul City Council had passed a resolution, Council File 189503, authorizing the construction of the sanitary sewers in Falcon ti~`oods No. 2 and included a copy of the resolution. Larpenteur. Sewer All requirements having been met, it was moved by ~:~arkentien, Installer's seconded by Shavor and unanimously voted to grant Sewer Installer's License License to Clement J. Schmitz, 1093 .Arcade, St. Paul, b, Minn. Plumber's All requirements having been met, it was moved by Nilsen, seconded License by Shavor and unanimously voted to grant ~~aster Plumber's License #27 to Otto Swoboda, dba D. W. Hickey & Co., Inc., 18.1 University Avenue, St. Faul, 1~, Minnesota. Sewer Conn. Bids from Crogness Sewer Construction Company and .Axel Newman Village Hall Plumbing and Heating Company for making the sewer connection at the Village Hall were read, and after discussion it was moved by Coppini, seconded by Utecht and unanimously voted that the contract for the connection of the Village Hall Plumbing System to the Sanitary Sewer be granted to the low bidder, Axel Newman Plumbing and Heating Company for X75.00. He further advised a driveway was left for Standard Oil and 1 for Lido, but none for him; and that it was very difficult for trucks to get through to the business buildings without it due to the parking situation. It was suggested that Engineer Ljun~ren contact the Engineer's Office for an inter- pretation of the curbing and driveway specifications off State Highways and. advise N. L. Hermes. Streets Letter of October 13th from Arnold Steffes of Toltz, King, Duvall, Anderson and Associates was read. It advised: Total footage of streets resurfaced was 53,000 feet. Cost of oil stabilizing the 3?" of granular base material was $8lt,676.31 which equals ~G1.60 per front foot. The cost of placing the gravel on the streets, the gravel being taken from the sewer excavation or hauled in from an approved pit, was 1b1.20 per cubic yard; and placing the gravel over the 32' street to a depth of 12" was 8!t¢ afoot. Total cost for oil stabilization of the 12" of gravel equals ~2.l~2 per front foot. Engineering and Inspection costs were approximately 6~, which would add 15¢ to the cost. The total cost then wouIld be X2.57 per front foot. Steffes letter to Jaw W. Craig Company, dated October 22nd, re- garding final certificate was read and filed. Steffes letter of October 22nd to Peter Lametti Company regarding credit memorandum was read and filed. Fire Dept. Letter of September 26th from Hy Hammers ten, Clerk, Roseville, Mutual Aid was read. After discussion it was moved by Utecht, seconded by Agreement Nilsen and unanimously voted to adopt the following resolution: RESOLUTION: WHEREAS the Village Council on August 28th, 1958, passed a Reso- lution Authorizing the Fire Chief to Render Emergency Fire Service in Roseville, and 9PHEREA5 there was omitted from that resolution a provision that Runs to Roseville were to be made without charge NOVr', THEREFORE, ~E IT RESOLVED by the Village Council of the v 1499 Villages of Falcon Heights, Minnesota: 1. That all runs to Roseville under the resolution of the Council, passed August 28th, 1958, in case of Major Fire Emergencies, are to be made without charge to .the Village of Roseville. 2. The Clerk is authorized and directed to send a copy of this resolution to the Roseville Village Council advising them of the passage of this resolution and requesting them to send us a copy of their resolution covering this same matter. Streets Copy of Ljungren's letter delivered to Sina Tuesday noon October 1lt, Falcon ~~oods 1958, regarding removal of gravel was read. Ljungren reported he No. 1. had talked to Sina and Sina said he would have Shives remove gravel. Later the same day Sina said he was through - he would level off gravel so people could drive over it. Shives asked if he could correct gradation by the addition of gravel. It appeared it would take about 126 yards to correct it. Ljungren told Shives unless it was corrected by 5 o'clock Thursday, October 16th, 19Sr?, the gravel would have to be removed so that the Village could have the proper work done before the weather got too cold. Ljungren reported that at 5 o'clock Thursday, October 16th, 1958, windrows of improper gravel were still on the streets. Thereupon, Ljungren, on Friday, October 17th, 1958, had the County remove the gravel and stock-pile it on one of Gage's empty lots. There were about 260 cubic yards of gravel. It took until noon Friday, October 17th, to clean the gravel and the residue from the surface of the streets. The original agreement was that 970.OU was to be paid to Sina for this work, of which Lametti was going to pay X270.00 and Gage X500.00. Sina was to furnish labor and equipment. At the present time the gravel removed is worth about X325.00, less the cost of removal. Sina is responsible for the cost of the gravel, and Skives is responsible for the cost of removal. Graham pointed out that the ownership of the gravel was probably in Skives. Regarding rolled curbing, Ljungren thinks b" of sod will match the mat and do as good a job as a rolled curb. Alleys Ljungren reported one is surfaced, the other not quite half done. It will require about another 3 hours work, plus seal coating. California Utecht thinks Craig did a very poor job on California, and he Street doesn't see how a seal coat can smooth it up. Ljungren will contact Steffes. Trees Graham advised that in his opinion the Village is responsible for trimming broken ?::ranches on boulevard trees which are in a danger- ous condition as the Village is responsible if anyone is hurt. It is the opinion that the Village should have dead limhG rAmb~r~d. Burning It was decided any policeman who sees anyone burning leaves or Rubbish rubbish on a bituminous surface should give the person a copy of Bituminous Ordinance 13 and warn them of penalty clause which will be invoked Surfaces on any future infractions. Rees' It was recommended that Attorney Graham write Mr. Rees advising that Property due to the lateness of the season, we will wait until later before proceeding with plans to correct the drainage in the alley between 11Q0 _Larpenteur and Crawford. Coppini reported that since the air conditioning has been shut off, the alley is dry. Tatum St. It was moved by ~tarkentien, seconded by Coppini and unanimously Assessments voted that the Clerk be authorized to take necessary steps to certify v;ith the County Auditor of Ramsey County all unpaid Tatum Street Assessments as soon as possible after November 5th, 1958. Unpaid It was moved by Nilsen, seconded by ~darkentien and unanimously Sewer voted that the Clerk be authorized to certify to the County Rental Auditor at the time which taxes are certified to the County Auditor, the unpaid sewer rental bill and penalties owed by ia'Irs. ~4arguerette J. Xoungner, 1867 W. Larpenteur Avenue. Gage Escrow It was moved by Coppini, seconded by Nilsen and unanimously voted that the Escrow Deposit of X500.00 made by Mr. Gage to assure construction of Prior Avenue from Autumn Street to the south property line of Falcon Woods No. 1 be switched over to an Escrowr Deposit to cover the construction of Prior Avenue from Summer Street to the south property line of Falcon ~~oods No. 2, it being understood that BBr. Gage will construct Prior Avenue from Autumn Street to the south property line of Falcon Woods No. 1 in connection with putting in the street in Falcon V~'oods No. 2. Fire Dept. Attorney Graham suggested putting in a dollar figure for .. Relief Firemen's Relief when setting up the budget as requested by Assn. the Auditor's Office by phone October 10th, 1958. Law Suit The Northern States Power Suit against Lametti and against the Village is still scheduled to go to trial November 3rd. Lametti asked for permission to amend their answer in connec- tion with protecting Northern States Power Company's lines while putting in the sewer. Lotion is coming up for hearing this i~onday. Graham thinks they will be permitted to do it. He also thinks Northern States will ask to amend their original charge to include work done later in the year. ?3arthel After discussion, it was recorunended that Attorney Graham write Villas Attorney Greenstein advising him that the Committee assigned to investigate the purchase of these lots had suggested that the Council pay $500.00 per lot, the Village to take over the assessment. Culverts It was recommended. that Ljungren check all culverts and see that the leaves, etc. are cleaned out before winter so we will have good drainage. Policing .After discussion, it was moved by Utecht, seconded by ~iarkentien and unanimously voted that Jerome Johnson, 1029 Argyle, St. Paul, be hired as of November 1st at the rate of X350.00 per month with fringe benefits the same as apply to the Fire Department, with hours to be established by the Police Comm. as directed by the Council. Uniforms It was moved by Utecht, seconded by Shavor and unanimously voted that 'Narkentien be authorized to spend up to X125.00 to provide the new Police Officer with a uniform. 1 1~.~1 Policing Letter of October 1l~th, signed by Sheriff Tom Gibbons and Kermit Hedman was read. It commended Henry Dachtera for his alertness and good policing in the arrest October 11th of convict Merle Bowen who escaped from the Michigan State Penitentiary. It also stated Dachtera showed good judgment and intuition in assuming the man had a car nearby, locating the car, which turned out to be a stolen one, which in turn resulted in the arrest of Bowen as an escaped convict. The F. ~. I. also extended compliments to all concerned in the apprehension of this man. Bills On motion by Shavor, seconded by Coppini, the following bills were ordered paid: Otto W.
