The meeting was called to order at 7 P. P,2., the follow~.ng Council Members being
present: Harold C. Nilsen, Mayor; George J. Shavor, Trustee; YFillis Warkentien,
Trustee and Paul Coppini, Trustee. Also present were Frank N. Graham, Village
Attorney; Wm. E, Olsen, Treasurer; Nick Christensen, Building Inspector; Vern
Ljungren, ~,iillage Engineer; Don Arndt, Public Safety Commissioner and Ethel E~
Whites Deputy Clerk and Deputy Treasurer. .Absent: Vtm. R~ IJtecht, Clerks
The minutes of the regular meeting of February 11th were approved as s»bm~ttPd
Barthel i~4ayor Nilsen read the Affidavit of Publication of the J~egal Notice
Villas of Hearing on ?'roposed Feassessment for Sanitary Sewer System Im-
provement Pdo. 1 of unimproved property located on Pascal and Holton
Avenues between Garden and Holton described as lots 13s 1~~, 15, 20
'n^ 21, Block. 1, Barthel Villas Addition, as published in the Rose
Tribune January 29th and February 5th 195°.
Attc~rraey Graham summarized the situation explaining that the Village
has '??~ .^ St?"'~'"'»~^ ^rder not to issue building permits for these }~,~ .w~¢c1J
lots because it vrould interfere with the natural drainage. It ~ _.__..
appeared, after the assessment was put on, that the owners of the
lots objected to the assessments until such time as building permits
could be issued. The Village Council has the power to re-assess if
they find the original assessment is too high.
Attorney James F. Greenstein appeared on behalf of. the o~~;ners of the
property. He Gtated he did not feel this is the solution to their
problem, but it is a better situation than they have at present.
They s+ill have to pa.y taxes and c~:,znot use the property. Tars.
Barthel, vrho is the o~~~rner of most of the property, and har aughter,
~T-rs, Roberts, were present.
Sha~ror asked if the reinstatement of the assessment could be hane~led
individually if and when the Village could permit building on certain
parcels. Attorney Graham advised that it could be handled in this
manner.
After discussion, Coppini moved the adoption of the follov~ing resolu-
tion.
RESOLU'"ION REASSESSING LOTS 13, l~, 15,
20, and 21, Block 1, Barthel Villas Add-
ition for Sanitary Sewer System Improvement
No. 1.
V,HEREAS, on August 15th, 1957, the Villag® Council by resolu-
tion unanimously 4dopted the assessment roll for Sanitary Sewer
System Improvement Aio. 1 which was thereafter certified to the
County Auditor and extended or_ the groper tax lists of the County; and
VtiKEFtEAS, the said. assess~ac;;~± roll showed Lots 13, l~ , 15, 20 and
21, Block 1, Barthel Villas Addition to have an assessable frontage of
75 feet for which an assessment of X672.00 per lot was made; and
'pd'HEREAS, since the incorporation of the Village Building permits
have been refused on these lots because they are long lots and the
erection of buildings upon them would interfere with the natural
drainage; and
Vv'HEREAS, the otiti~ners of these lots have requested that the 5an-
~~~~
nary Sewer System Improvement No. 1 assessment on these
lots be removed until such time as the Village Council will
authorize issuance of building hermits on these lots when
the assessments would be -reinstated; and
~1HEREAS, Section 1}29.071 of the Pdinnesota Statutes per-
mits a reassessment to be made where the Council finds that
the original assessment is excessive, upon notice and hearing
as provided for in the original assessment; and
~dHER~45, notice of hearing on tJzis proposed reassessment
was published in the Rose Tribune on January ?_9th and February
5, 1959 as provided for in the original assessment;
NOVA THEREFORE, ~3L yT RESOLVED by the Village Council of
the Village of Falcon Heights, Pu7innesota:
1. The Village Council finds that the original Sanitary
Sewer System Improvement No. 1 assessments of "672.00 per lot
for lots 13, 1.-~, 15, 20 and 21, Block 1, F3arthel Villas Addi-
tion ~nTere and are excessive considering that the Village re-
fuses to issue building permits on these lots, and each of
said lots is hereby found to have no benefit from the said im-
pro~rement at the present time.
2. Upon reassessment, the Council finds that the assess-
meat roll for Sanitary Sewer System Improvement No. 1 a~>-G~roved
by this Council on August 15, 1957 with respect to lots 13, l.l.t,
15, 20 and 21, 31ock 1, L:~.rthel Villas Addition, should be
changed and these lots a,re reassessed to sY~ow no benefits tc
these lots and no assessments against the lots upon the under-
standing th?t when the Village Cc~~~° ^il TRrill authorize i stiua~~cQ

will be reinstated upon notice and hearing.

to prepare a certified copy of this resolutio,~ and to deliver

made, is entared upon the necessary books and records of the

The motion for the adoption of the foregoing resolution eras
seconded. by Shaver and unanimously carried,
Rezoning LeRoy Jackson, 1609 Tliles Avenue, St. Paul, owner of tha 50'
lot on the S. ~"~. corner of Larpenteur and Pascal appeared be-
fore the Council to ask rezoning of >>roperty in question to
Hermit the building of a duplex er ~-plex. He was advised tYiis
property was already zoned "Residential District C" which ti~ould
.~.:i.nit this use but that the Council had been advised that there
eras a deed restriction on the property which would not permit
multiple dwellings. He was advised r.e vrould have to get the
deed restriction released by the benefited property owners be-
fore the Council could issue a Hermit for a multiple dwelling.

by Coppini and unanimously voted to grant iti4aster Gas Installer's
License to Roy Dahl, dba Dahl Gas Heating Co., 1688 Grand, St. Paul.
Office It wras moved by Shavor, seconded by Coppini and unanimously voted
Supplies ~ to approve order to Thermo-Fax Silos Corporation for 500 sheets of
82 x 11 buff paper, same as furnished in invoice #1039~t at `~5.05/C.
Recreation v Copies of Activity Reports by the Iowa Playground Committee, signed
by Carl Kaechele, for J, Garske, Chairman, were distributed to the
Council h~,~embers. The Deputy Clerk was requested to supply Coppini
with a statement of recreation expenditures for the 1958-59 season;
Accident Y Notice of Claim was served upon the it~ayor on Febru;~~~T 20th, 1959,
Claim with respect to a claim of X5,000.00 in behalf ref Coreen Shanley
and her father for injuries suffered in an accident at the Falcon
Heights School Skating Rink January 25th, 1959. Notice of claim
has been referred to the Insurance Company,
Sewer Letter of February 17th from Attorney Graham was read. It advised
Charges he had checked with St. Paul; that St. Paul had increased sewer
rental c3~arges in the City of St. Paul and for areas outside the
City -:~nith gore connected v~rith the St. Paul sewer. The charges are
to become effective January 1st, 1959 and the first increase will be
payable with the bills which will go out th® first of April.
Trees '-Tayor Nilsen advised r,'rig;ineer Ljungren that the people on Fairview
and Tatum are interested in betting locations for tree planting,
Ljungren advised a number of Villages are planning Tree Ordinances
and are recommending Hackberry, Ash and Soft Maple in preference to
Elms.
Proposed ~ 3olly Robbins, Attorney at Law, 1130 i:~iinnesota Bldg., St. Paul,
Apt. Bldg. reprr.~senting the persons interested in securing building permits
for the proposed apartment apr~eared before the Council. Also
present were Geo. ~~embrez, Ytim. Lindig, owners anal employees of the
Spiegler Construction Company.
Attorney Robbins stated: Trey proposed to construct 6 buildings.
The set backs on both Fry and Larperteur would be 30-. They were
allowing a 9x20' off street parking space for 1 car per unit --
our present requiremen is are 8 x 20'. Between buildings, they are
allowing a 26' space, 30 to Ito' fro.n bcundariss. The 13' spacing
just about doubles ordinance requirements. In all other respects
their plan comes v+rell within the present ordinances and should en~
title the =j.pplicant to a permi+,~ Project will amount to 3/!~ to 1
million dollars. Annual tax.., as they have projected, vrill be
approximately X25,000.00. It is a commercially zoned area at the
present time and seems to be well suited for their project. It
would increase the value of the business area and the business men
ars in favor of this project. Project would comply with all St

He had talked to L. Thompson, ~~anager of the St. Paul Water Dept.
v~rho said he doubts if i.t would affect our v~rater supply to any
anoreciable extent. At most, it would result in a pressure loss
of about 1~4#, and that is a variance you ca.n expect in any ling.
Thompson told him our engineer had talked to him about a 16"
water line, but that it had not yet been presented to the water
department. If the water were to be extended, Thompson doubted
it would have very little affect on the Falcon Heights Ulater
Supply. Screening by planting was omitted from plans because
they wanted to rely on recommendations of the village. They are
willing to furnish prover screening by landscaping. There appears
to be a feeling that this project would not fit in with other
buildings in the area. Project has been designed with a low sil-
houette. Al though it is a 3 story building, it would actually be
only as high as a 2 story building with living quarters in the
basement. It Vrould be lower than the Fire Department Building and
ti~rould be in conformity ti^rith other buildings in the area. Builder
would like to build in this spot, and if he doesn't build here,
he will build somewhere else in the area. Builder would like to
sit down end go over differences people referred to.
As pointed out, the total area is 2.6l~ acres; density 1100 sq. ft.
per unit; :.~1 families per acre; 2850 square feet of buildings;
percentage of lot coverage 26.5. St. Paul's requirement in ex-
cess of 35~. Total sodded area is a little over 1 acre exclusive of
parking area. I~linneapolis allows 6S~ coverage except on corner
lots vThere it may be 80~. They do not require off-street barking.
There: is no question but what the project could be built in St. Paul
just as it is proposed. In St. Faul, space bet~reen buildin~~s vrith-
out set back or side of apartmment building requ reme- t;~, ~;.~~ been
reduced from 6' to !a.'. The narrowest space proposed is 26' be-
tween buildings. This is a very valuable pyece off' ground and he
feels it is being utilized in as practical a manner as possible
ti^ri+,hout making it too expensive to build on.
Nick Christensen said he had checked with St. Paul and St. Paul
had told him the, same a.s :r. Rocbins outlined.

uul~'ings in St. Paul vrhich could be viewed. They plan 60 - 2

building at Eldridge and Fry exactly the same elevation. One
at Snelling and Stanford, St. Paul, and tv,~o buildings a,+, ?th &

about 35' high. They ,,vould use a light tan brick facing all the

Special It was moved by Nilsen, seconc?.ed by Shavor and unanimously

cation of the Spiegler Construction Company for 3uilding Permits

Fry and Larrenteur.

Report Larpenteur .Avenue YJater Piain and Thompson said he had all the data
together and that it ;-could go to the tifater Department this week
and .,~~e should have an answer in about 10 days„

Highway Department to see if they •rJant to F•o a:Long with tr~em on
the Hoyt Avenue Storm Sewer. If the State is willing. to pay the
extra cost, they will enlarge the storm sewer to handle the water
from the State Highways in that area. It doesn't appear as if the
State v~rill go along with it, Ljungren thinks, no matter what
happens, we v~rill probably be relieved of most of the State's water
that has been running into the sump area, but he feels we will
have to install a pump if we intend to keep up a sodded landscaped
playground area,
Curbing ~ There was a discussion regarding curbing on Hoyt. V~tarkentien,
Conpini and Ljungren will study the matter and determine costs
to be submitted to property owners at a later date.
Load Limits'~ It was moved by Shavor, seconded by Nilsen and unanimously voted
that the Village Engineer and tl^A Village Street Commissioner
'oe authorized to post Village Streets for three ton axle load
when and if such posting is necessary for the protection of
V_11age streets.
Drainage Engineer Ljun~•ren advised he has complete profiles, including center
line, gutter ling, tops of curbs or gutter line at the areas where
there: has been trouble with standing water, such. as Idaho & Pascal
and Simpson end Crawford.
Police There was a discussion regarding rules and regulations fo.r the police
Manual department. ~Yarkentien and Arndt will discuss. and study it further
and report at a later date.
Rerouting If necessary, it was decided the best way to route the buses would
