Coppini moved that the Minutes of April 9th, 1959; May 28th, 1959 and June 9th, 1959 be approved. Seconded by Shavor and unanimously carried. Minutes of June 11th were approved as corrected. Date was changed from June 12th to June 11th and the statement that approximately 30 persons xere present xas de- leted. Strandquist, Texaco Service, Hamline & Hoyt. Kulkay suit Attorney Graham reported on the hearing before Judge Graff on the Kulkay Zoning Ordinance Suit and the Spiegler Mandamus Suit. Judge Graff has set both-suits dawn for trial commencing Tuesday, June 30th, at 10x00 A. M, The matter should be determined within a fern: weeks after that date. Police Letter dated May 12th, signed by Earl Smith, Kenneth Schmidt and LeRoy Iiumphrey, regarding salary rates was read. It was moved by Shavor, seconded by Nilsen, and unanimously voted to refer the matter to Warkentien xho will discuss it with Public Safety Commissioner, Don Arndt. Sewers Note of June 18th,. from Bert Slama, was read. It advised that he had checked the severs with Mr. Wilke, and that at 2 P. M. 6/18/59 the se~rers were clean and flowing. Slama's note of June 16th, $ A..`M., advising that Larpenteur Sewers, Fire Station, 5t. Mary's Ave., and Fry Street Sewers had been inspected and found clean was also read. Contractors will be responsible for anything that happens from now on during the road construction program. M. S. Mergens Utecht moved Mergens be paid X500.00 as the pillage Share of the cost of grading the West Falcon Heights Playground Site. Seconded by Nilsen and unanimously carried. L~ungren indicated this would be satisfactory with Mergens who will collect some additional charges from the West Falcon Heights Playground Committee. Water Mains After discussion, it was moved by Warkentien, seconded by Coppini, Larpenteur and unanimously voted that the following RESOLUTION be adopted: Ave. RESOLUTION: Whereas it is proposed to improve Larpenteur Avenue from Snelling Avenue west to a point 726'east of the center line of Cleveland Avenue by extending water mains from the existing main at Snelling west to a point 726' east of the center line of Cleveland Avenue and to assess the aubtting property for all or a 1 ~.,~..a 1 ~~, i! portion of the cost of the improvement, pursuant to Minn. Statutes l~29.011 to i~29.i11, NOW THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF FALCON HEIGHTS MINNESOTA (1} The Council will consider the improvement of Larpenteur Avenue by extending water mains from Snelling Avenue west to a point 726' east of the center line of Cleveland Avenue in accordance with the report of Milner W. Carley & Associates dated June 25th, 1959, stating that the improvement is feasible and can best be carried out as proposed, and the assessment of the abutting property for all or a portion of the cost of the improvement pursuant to Minn. Statutes 429.011 to It29.111 at an estimated total cost of the improvement of X57,338.00. A PUBLIC HEARING shall be held on such proposed improvement on Monday, July 13th, 1959, in the Council Chambers in the Village Hali at 7x30 P. M'. and the clerk shall give Public Notice of Such Hearing and Improvement as required by law. Rehnwall Engineer Ljungren reported the basement as 7' 7" deep, no block Surer showing above ground. He feels difficulty encountered in connecting to sewer was not the fault of the seller contractor or the village, but due to the fact that the basement was unusually deep. It was moved by Utecht that Mrs. Rehnwall be so advised. Seconded by Shavor and carried. Water Mains After discussion, Utecht moved 'that the Village Engineer install a 2!~" Cross-over at Fairview and Larpenteur, the East Edge of the University Property and Larpenteur, and a 30" in front of the Village Hall property; all culverts to be used for future water connections, at an approximate cost of X2,360.00. Highway Ease- Warkentien moved the Clerk and the Mayor be authorized to execute ment the Highway Easement granting a 12 foot easement across the front of the Village Hall property.
