Nilsen, Mayor; George Shavor, Trustee; Paul Coppini, Trustee and Wm. R. Utecht, Clerk. Also present were Frank N. Graham, Village Attorney; Wm. E. Olsen, Treasurer, Nick Christensen, Building Inspector; Vernon L. L~ungren, Village Engi- neer and Ethel E. White, Deputy Clerk and Deputy Treasurer. Absents Willis Warken- tien, Trustee. Minutes of the regular meeting of 7/9/59 were approved as submitted. Minutes of the special hearing of 7/13/59 Mere approved as submitted. Licenses All requirements having been met, it was moved by Nilsen, seconded by Coppini 'and unanimously voted that MASTER PLUMBER'S LICENSE X39 be granted to Otto Swoboda and/or D. W. Hickey & Co., Inc., 18li1 University Avenue, St. Paul, t~, Minnesota. All requirements having been met, it was moved by Coppini, seconded by Shavor and unanimously voted that MASTER PLUMBER'S LICENSE #38 ' be granted to A. E. Wickworth, dba A. E. Wickworth & Sons Plumbing & Heating, Inc., 1050 Grand Avenue, St. Paul, Minnesota. Plumbing After discussion, Shavor moved that Wm. Jastrow's son be authorized Inspector's to substitute in his place as Plumbing Inspector during Mr. Jastrow's Vacation absence on a vacation. Seconded by Utecht and unanimously carried. Ramsey Letter of July 15tH from Attorney Graham was read. It advised he had County corrected the legal description and that it was Haw in proper form Storm to be executed by the Village. It was moved by Shavor, seconded by Sewer - Coppini and unanimously voted that file Clerk and the Mayor be author- Easement ized to execute the storm sewer easement. University Letter of July 15th from Attorney Graham was read. It stated he had Grove talked with Mr. Pavers, Ramsey County Assessor, who advised him that Taxes the repeal by the County Commissioners of the tax on household goods will not in any way affect the taxation of the professor's homes in University Grove. They will continue to be treated and taxed as other real estate in the Village of Falcon Heights. Patching & Letter of July 20th, written to the Rose Tribune by Attorney Graham, Seal Coat- was read. It stated he was enclosing an Advertisement for bids for ing Streets patching and seal coating Village Streets which should be published twice in the Rose Tribune for July 23rd, 1959 and July 30th, 1959. Storm Attorney Graham reported he had checked on the Iowa Sump Hole problem. Water In the future, we should call and get an 0. K. from the Public Works Department from Holmboe, Winkel or Tews. If we feel there is an emer- ~ency and want to pump at night but can't reach any of the above named men, it will be all right if the Village Mayor, or official in charge in his absence, gives his permission and we call first thing in the morning and report to one of the above. Winkel doesn't feel there will be any great harm done if it is handled this way. Report the length of time pumped and approximate capacity of equipment used. Records Graham thinks we can get our records back from Judge Graff when he returns from his vacation about the first of August. Dog Ordin- The proposed Dog Ordinance was read. Minor changes were made. It ante will be held for action until Warkentien returns from vacation. by `~ 'V . Bell Telephone, bill due 7/10 111.28 Lindig- Mayor Nilsen opened the hearing saying a matter that is on the Spiegler agenda before the Council this evening has been the sub3ect of Building very intensive and exhaustive study for the past seven months. Permits It has been gone into carefully and considerately by the members of the planning commission and by other elected officials of the village council. During that time, the council has sought, and has been given the facts and the expert opinion of a planning authority whose back- ground, professional ability and integrity is respected by hose in his field, and by those official bodies of other communities for whom he has done planning work. This man, in his report, provided an ob3ective and informed point of view in covering all points of debate. The Village Council faces many problems in it's deliberations, and I would say this to the people of Falcon Heights -that you expect us to face them with honesty and courage, to fully investigate, and to make a decision in the public interest. I commend to you the decision of the court, and ask that I be per- mitted to leave a thought with you. Samuel Johnson once said: "The law is the last result of human wisdom acting upon human experience for the benefit of the public." attorney Graham summarized previous proceedings by saying. the Court filed a Memorandum Decision dated July 8th, 1959, in which the Court stated it concluded that Ordinance No. 8 was not unconstitu- tional as it applied to the Wm. Lindig property. The Court would take no action on the Mandamus question at present and the Council would have a period of ten days after the filing to take action. The Findings of Fact were prepared, they were filed Monday, the 20th, Judgment was entered that day and it is up to the Council to take action on the Spiegler permit, The Judge didn't tell the Council what to do. Utecht read the summary of recommendations prepared by Dahlgren, ~~~~ Planning Consultant, July 22nd. Tilsen, attorney for Spiegler, advised that all the recommendations listed by Dahlgren in his report had been included in the revised plan submitted May 27th, 1959. Nick Christensen, building inspector, said the plans are in strict adherence to our building code. He has no suggestions for their further improvement. ~ ttorney Tilsen said Spiegler Company would agree to use a dark brick. Spiegler will start with the building nearest Larpenteur. They expect to finish the project within two or three years, and will clean up and landscape the grounds within 30 to 60 days after each building is completed. Utecht moved that the Spiegler Construction Company be Qranted a permit to erect an apartment house of 17 units at each of the following locations: 1689 Fry, 1707 Fry, 1699 Fry and 1717 Fry, subject to the plot plan as submitted to the Village Council, and for the construction of an 87 car parking lot to be black-topped in accordance with specifications set forth by the Village Engineer, at 1677 Larpenteur; and that a play area 9U ft x 80 ft be constructed in the northwest corner of the area with a wooden fence and screen planting as shown by the plot plan, with the complete area to be screen planted as each unit is finished. Seconded by Shavor and carried unanimously. Mayor Nilsen then said "With the granting of these building permits, we welcome you to the community and know we can live together and work together to solve our common problems." Water Main Vernon L. Ljungren presented plans and specifications for. the proposed Extension extension of the water main from Snelling Avenue to a point 726' east of the center line of Cleveland Avenue including the installation of a line pump near Snelling Avenue. He pointed out that with the in- clusion of the line pump, the estimated cost would be increased 12 to 1~~;-and that it would cost about $1800.00 a year for electricity to operate the pump, or about 1/2 mill. He pointed out that the pump would increase pressures to approximately 5Zt# off the pump and to at least 40# at the Hawkins property. He reported that he had checked with the St. Paul Water Departanent and they feel that the pump should be satisfactory. The pump would be regulated by an automatic timer and run from 6:30 ~,. M. to 10:30 P. M, and would pump approximately 1000 gallons per minute. He pointed out that with this pressure the Insurance Underwriter's might agree to change the village from class 7 to class 6. The possibility of extending a line up Fry Street tp Maple Knoll was discussed and it was pointed out that this would probably increase pressures in Maple Knoll to where they would be satisfactory. It was estimated that the cost of running the line up Fry Street would be about $7000.00 and it would probably have to be put in by assessment of abutting properties. The attorney pointed out that this could not be done as a part of this project but that it would have to be set up as a separate improvement project after a hearing at which the Fry Street Residents would have an opportunity to be heard. Mr. Korstad pointed out that the Maple Knoll Owners were about to receive a settlement from the Cardinal Construction Company in a suit they had pending against Cardinal Construction. Mr. Korstad suggested the amount of the settlement might be used either to defray part of ~M ~ti the cost of extending a main up Fry Street or part of the cost of the pump. RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISE- MENT FOR BIDS: WHEREAS, pursuant to a resolution passed by the Council on July 13, the Village Engineer has prepared plans and specifications for the improvement of Larpenteur Avenue between Snelling Avenue and a point ?26' east of the center line of Cleveland Avenue by the in- stallation of a water main and appurtenances and has presented such plans and specifications to the Council for approval, NCW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF FALCON HEIGHTS, MINNESOTAs 1. Such plans and specifications, a copy of which have been filed in the office of the Village Clerk, are hereby approved. 2. The Village Clerk shall prepare and cause to be inserted in the Rose Tribune an advertisment for bids for the making of such im- provement as per approved plans and specifications. This advertise- ment to be published on July 30th, 1959 and August 6th, 1959, shall specify the work to be done, shall state that bids will be opened and considered by the Council at 7 P. M. on Monday, August 10th, 1959 in the Council Chambers in the Village Hall at 161~1t W. Larpen- teur Avenue, and that no bids will be considered unless sealed and filed with the Clerk and accompanied by a cash deposit, cashier's check or certified check payable to the Village of Falcon Heights in the.. amount of 10~ of such bid. Adoption of the above resolution was moved by Utecht, seconded by Nilsen and unanimously carried. Utecht moved that Vern L3ungren, Village Engineer, be authorized to arrange with the Water Departanent of the City of St. Paul to make the necessary modifications to the Snelling Avenue Main to allow for the connection of the 12" water main on Larpenteur Avenue; and that he be authorized to malae application for the necessary permits with the Minnesota Highway Department. Seconded by Shavor and carried. Easements Graham said he had submitted easements to Standard Oil, Kroemer and Hermes for a 10' permanent, and a I~0' working easement for the con- struction of the water main. Attorney Christensen feels sure he can get the same easements from Weigt and Lindig, Nilsen will talk to Labalestra for the necessary easements from Lido. Fry Street RESOLUTION ORDERING PREPARATION OF REPORT ON IMPROVEI~dENTs Water Main WHEREAS, it is proposed to improve Fry Street from Larpenteur Avenue to Maple Knoll Drive by the extension of a water main along said street and to asses the benefited property for all or a portion of the cost of the improvement pursuant to Minn. Stats. lt29.011 to l~29.11, NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF FALCON HEIGHTS, MINNESOTA: 1. That the proposed improvement be referred to Vernon L. Ljun- ~- ~ ~ gren, Village Engineer, for his study and that he be requested to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposal is feasible and as to whether it could best be made as proposed or in connection with some other improvement.
