Shavor, Trustee; Willis Warken tien, Trustee; Paul Coppini, Trustee and V'7m. R. Utecht, Clerk. Also present were Frank N. Graham, Village Attorney; Nick Christensen, Building Inspector; Vern Ljungren, Village Engineer; Wm. E. Olson, Treasurer and Ethel E. White, Deputy Clerk and Deputy Treas. The Minutes of the special meeting of September 3rd. were approvedaas submitted. J. V. Lee Mr. Lee advised the Council that the County had widened the Highway 180 Larpen- to such an extent that the right-of-way comes half way up his front tear. steps and asked the Council if there was anything in the Village Ordinances which could require that he move his house back. Attorney Graham advised him that inasmuch as the house was there before the Ordinances were passed, there was nothing the Village could do to make him move it back if he left it as is, or made very minor altera- tions such as moving the front en trance to the side. However, if he were to make extensive alterations such as adding•on, or selling the property for business use, it would have to be mowed back to conform with the ordinance. License All requirements having been met, it was moved by Nilsen, seconded by Utecht and unanimously voted to issue MASTER GAS INSTALLERS LICENSE #133 to Roy A. Miller, Customer Furnace Company, 1931 St. Anthony, St. Paul 1~W, Minnesota. Volunteer Utecht moved that Mr. Warkentien write Gordon E. Nelson, Fire Chief Fire Dept. advising him that all applicants must be passed on by the Council in accordance with the operating manual and that no fireman will be eligible for pay until certified by the Council as provided for in Ordinance 38; and that the Chief be instructed to submit a list of all new men who have applied for membership in the Volunteer Fire Department. Seconded by Coppini and unanimously ..carried. Civil Defense Warken tien reported that they had had an extensive discussion regarding Civil Defense at the last meeting of the Volunteer Firemen. Warkentien•and Chief Nelson feel that our~Firemen, who have all been trained in First Aid, would make an efficient and logical nucleus for a Civil Defense Organization with some help from the citizens. They also feel that we should be entitled to buy Civil Defense Supplies from the Government with this set up and they are going to interview Colonel Schoen. Water Mains Vern L~ungren reported that the cost of running the water main along Fry Street was estimated at X6,750.00 which, if divided by 1978.58', would make the cost per front foot $3.37. Korstad, Attorney for the Maple Knoll Residents, said they xould contribute about X1500.00 to~- ward the cost of laying the main on Fry Street. M.•Spiegler said they would contribute X300.00 toward laying the main on Fry Street, making the total of the proposed contribution about x].800.00. This to be a personal matter between the residents of Fry Street and the donors -- the assessment to go through for the full amount (About X3.37 per front foot) and be handled in the regular manner. After discussion, the following resolution was moved by Warkentien, ~,`~,~~~- seconded by Utecht and carried unanimously: RESOLVED that the Council determines that the connection charge for tying the Fry Street y"later Main, if constructed, to the Maple Knoll Water Main be set at X860.00 for the Maple Knoll Group as their fair portion of the cost of the pumping station on Larpen- teur Avenue, if constructed. L~ungren thinks he can have the figures on the pumping station ready for the meeting to be held September 21st, 1959. They could then publish notices September 2l~th and October lst and have the meeting October 5th. Korstad advised the Fry Street Residents plan to submit a peti- tion October 5th requesting the water main installation on Fry St. Mel Spiegler thinks they will need water about the first of the year, Spiegler said they planned to start Frith the northernmost building. Korstad said Spiegler had agreed to start with the southernmost building at Fry and Larpenteur, and if he started with the northernmost building hey Korstad, would withdraw the offer of the contribution! to the residents of Fry Street] to help cover the cost of the Fry Street Water Main. Mel Spiegler said he intends to put up the four apartment build- ings for which permits were requested, but that it was not conven- ient to start with the southernmost building therefore they were starting with the northernmost building. Attorney Graham said he didn't think the Council had the right to specify the order in which. the buildings were to go up. The Council had granted the permits when faced with the Mandamus Action. He believes the Court would have ordered the Council to issue the permits for the 1~ apartment buildings as proposed and finally approved. Spiegler was asked about parking - they have no plans for a parking lot behind the northernmost building, Spiegler said they could develop temporary parking doing to Larpen tear - that they have an easement on the west side of the property along Weight's property following the whole west boundary and. that the county has put a driveway in there. There are openings for two driveways on Larpenteur. Mel Spiegler said that if Korstad and the Maple Knoll People do not make the 91500.00 donation, he (Spiegler) will go ahead and contribute the 4300.00 he had promised to donate. After discussion, it was decided that probably the best way to handle the water situation would. be for Spiegler to pay to have the Fry Street Main run up Fry Street to his northernmost building - he would see the two families across the street and see if he could make an arrangement with them. L~ungren said. if Spiegler puts the main in Fry Street, the main cannot be smaller than 6". Pumping Sta. L~ungren advised that he had had a call from Mrs. Piecek of the Lido Cafe advising that there was a restriction on their property which prevents any building within 70~ of Larpenteur Avemse. This will necessitate a change in the plans for the location of the Pump House. The Council authorized L~ungren to work on other arrangements and submit new plans for Council approval as soon as ~~ ~L 1 possibl e. Streets Ljungren advised he had inspected the streets and called the contractor's attention to some locations which needed further work and the con tractor has agreed to take care of it. Falcon Woods Ljungren advised that he had gone into the street situation Streets in Falcon Vdoods No. 2 with Mr. Cage and they feel that, due to the lateness of the season and the fact that there are still gas lines to go in, also that only 9 of the 19 houses are occupied, the best thing to do would be to finish up the gas installations, grade the streets, haul out the clay, haul in gravel and oil it well - leaving the rest of the work go until Spring when they will be assured of a Good street job. Ljungren does not feel it is wise to attempt anything more this Fall due to the lateness of the season and the amount of construction work still to be completed. Permit All requirements having been met, it was moved by Utecht, seconded by Nilsen and unanimously voted to issue General Corporate License No. 75 to Forrest G. Root, Root's Cities Service #7, authorizing the operation of Root's Cities Service #7 Filling Station at 1670 No. Snelling Avenue, Falcon Heights. Gas Permit It was moved by Utecht that we purchase from N. L. Splett Co., Blanks St. Paula 500 - 3 part gas permit forms for X18.10 500 - 2 part gas permit forms for 16.60 Seconded by Shavor and unanimously carried. Playgrounds Nick Christensen submitted his claim for Building Inspection Fees in the amount of ?6692.55, of which he very generously contributed X307.80 to the Playground Fund to be allocated in such away that all playgrounds will be equally benefited.
