Nilsen, Mayor; George Shavor, Trustee and Wm. R. Utecht, Clerk. Also present were Frank N. Graham, Village Attorney; Vern L. L3ungren, Village Engineer; Wtm. E. Olsen, Treasurer and Ethel E. Vy'hite, Deputy Clerk. Absents Paul Coppini and Y~illis Warkentien, Trustees. The Minutes of the regular meeting of February 25th were approved as submitted. Trews T,4r. Fournier, of the Fournier Tree Service, 13b2 Jefferson Ave., St. Paul, was present. He advised the Council that there is serious infestation of the trees in Falcon Heights and suggested a dormant spray to clear up scurfy scale, brown elm scale and oyster shell scale. Fournier advised there are about 900 boule- vard trees. If they are not sprayed, some will be lost. Spraying with Standard Oil Company's Superior Dormant Oil in a solution of 3 gallons of oil to 100 gallons of water would cost about $1.50 a tree or between fourteen and fifteen hundred dollars. If it rains before the spray .has dried, the application will be repeated. Last year the dormant spray was applied from about a4arch 2l~th to April 10th. Sometimes good control is achieved with 1 spraying , and spraying can be skipped for 1 or 2 years. There is no guar- antee that it would not have t~ be done every year. The Council requested that Fournier submit his offer and information regarding solutions, etc. in writing. Civil Defense 1~4rs. Phyllis Hagen, Ramsey County Civil Defense Director; Carl Klohn, Civil Defense Director, Lauderdale; Gordon Nelson, Fire Chief, and A1. Helbig, Asst. Chief were present to discuss Civil Defense. Pers. Hagen advised that a Village must have a Civil Defense Director and Unit to get matching funds. Instructor Jack Yost must be paid ~l~.00 an hour. Matching funds would bring it down to X32.00 an hour. There are no complete uniforms in the "Surplus" materials, dust parts, but there are many items of equipment which can be bought anyerhere from 3 to 10¢ on the dollar -- some of it used and some brand new. The Village would get Federal Assis+.,ance as well as County Assistance. The Unit has to have more than fire training. The Unit must take police training, heavy rescue training, organizational work, mass feeding, etc. Mr. Klohn advised they have 75 residents en- rolled in Lauderdale's Civil Defense Group and that they would like to combine with Falcon Heights, Mrs. Hagen suggested that the matter of combining the taro Village Units be ,checked into by the Village Attorney, especially regarding the question of which Village is responsible for accidents and injuries to Civil Defense Personnel and equipment. Shavor recommended organizing , a Falcon Heights group. Mrs. Hagen left a copy of the State Statutes and the County set-up and recommended that we go over a suggested ordinance very carefully to see if it is dust what the Village wants. The matter will be referred to Attorney Graham . Chief Nelson was instructed to send the Instructor's bills to the Village for payment. I Geisen would like to hear what the Investigating Committee found out. 1382 Utecht read the Police Report as follows 2/16 2:50 to 3:30 19 children crossed east to west 2/17 2:50 to 3:15 16 children crossed east to west 2/18 2:50 to 3:15 13 boys west from Holton to Pascal 2/19 2:50 to 3:15 2 children walked east from Pascal to Holton. Geisen: Imhoff started the petition. Hefty and I are obposed to a walk. 1~~y biggest objection is that they come across my lawn, At the walkway, the drainage d~.tch is !~' deep. The children come across my driveway and lawn to get to the walkway. I have to be very careful when I back out. Imhoff was pretty strong on getting the property so he can build a garage and driveway. He can't put a driveway through unless he gets the additional 6 feet. Imhoff keeps it up. He said he wouldn't keep the children out. R. Kjelland I am here with a group who are interested in maintaining that 1865 Arona lane tEor the use of the children. G. Har3ung What's the purpose of the lane? Nilsen To provide a walkway in the middle of a very long block. Pdrs. V. Just having a walkway doesn't always eliminate all cases of K~elland trouble. We have no walkway. The children cut through our yard and driveway whenever they want to go anywhere. 't'hey also walk down the boulevard, We have to be careful or we would have an accident because of children in our driveway. C. Alexan- Aren't there other sidewalks in the Village. I would like to der 1868 know what he means by its taking extra effort to maintain the Arona walkway. Lgrs. ? I walk our kindergarten children to school every day, and. this is a shorter, safer way. It is dangerous when the ditch fills up with water. Wha± obligation does the Village or the ~roperty owner have to maintain the sidewalk? Pdho pays for that? Graham V~dhen a sidewalk is put in front of a home, it is usually assessed to the property owner. On the other hand, the Village could pay for the whole thing. The cost could be spread over the benefitted area, but it would be quite difficult to determine the benefitted area. Hartung Is the land to be vacated or a sidewalk t.put in? Utecht read the petition as followss "The undersigned hereby petition the Village Council to vacate the 12' wide dedicated walk in the Village of Falcon Heights, Pdinnesota, which runs from Holton to Pascal at Ruggles Street and lies dust north of lots 10 and 25, block 1, ~a.rthel Villas and dust south of lots 9 and 10, Block 1, 3arthel Villas." Hartung Is it possible to make a proper entrance so they won't be walking across this man's lawn even if a sidewalk won't be put through? 1 U 1383 Shavor You got by for many years with a grass walk. Pdaybe it wouldn't have to be a hard walk. P~Rrs. ? We usually cut across the drainage lot so it means we would have to go all the way to Garden if the walk were closed. K3elland The school would prefer as many people as possible to come in the back door because they have a bad traffic situation in front with the buses and cars unloading. Nilsen Yee understood the School Principal wanted the children to come in the front door. K~elland I 3ust talked with him last night and that is what he told me. T. Barron A,s I understand it, this gentleman is complaining about the children usin e his property. Is there any remedy that would keep the children off his lawn? iM1featherston jute have a lot of school activities, but in a month or two most of the activity will be a± the playground and I think it would be a shame to close off the only access for the people and children Y~est of Pascal and force them to go to Garden or Roselawn. The people certainly knew when they bought their property that there was an easement there. Geisen I would like to leave the lane as it is. If they put a culvert and a walkway there, I would not have to worry about backing out of my driveway, I would not want to see the children stopped from going through. Y~eatherston I am in favor of putting a culvert-...there. Shavor What if there is a demand for an actual sidewalk? Weatherston As far as I am concerned, the grass serves the purpose, but there is an advantage to getting that ditch out of there. Safety wise, I think it would be adequate. If grass is acceptable, it certainly would be acceptable as far as I am concerned. Nilsen If you put in culverts and level it off, you invite the youngster on the scooter and the young fellow on the motor cycle or even the hot-rodder to go through. We don't want to make it easy for them. L~ungren A couple posts placed far enough apart to permit walking but not driving through should take care of that. Utecht moved that the petition of Harold Imhoff and others be refused and that the Village Engineer be instructed to arrange for the construction of a suitable head-on walkway with posts to prevent any vehicles from going through. Nilsen I would like to continue this hearing and discuss the matter further with the planners. Utecht I have no objections Shavor I don't feel we should give away Village property unless we are sure we won't have any use for it. I don't see any need for a 138l~ hurried disposition of this thing. It is too early to put the culvert in. I would like another two weeks. Nilsen Is there a second for Utecht's motion? No second, r.~otion denied. Weatherston Will they buy this property? Shavor No, the Village has an easement and. if it were vacated, it would revert to the adjoining uroperty owners. It was ded- icated as a walkway for the public. The Village has no power to sell it. Nilsen moved that the hearing be continued at 8x30 P. M. April 28th. Seconded by Shavor and carried. Lane, Vaca- Shavor moved that the petition to vacate the lane from Holton tion of. to Albert, 600' north of Larpenteur9 signed by John O'Keefe and others, and presented by Mrs. Salminen, be referred to Attorney Graham for checking. rdrs. Salminen suggested that posts driven at the back nronerty line would stop traffic from going through. Fairview Copies of letters written to Harry S. 3ronson and Leonard VVatermain Thompson, by Milner W. Caarley & Associates, regarding the Fairview watermain were read. Ljungren advised they have had a verbal 0. K. from the County and the '+'ater Department but that it has to came before the Board of Water Commissioners. Bonds Letter from General Insurance Company of America was read. It was moved by Shavor, seconded by Utecht and unanimously voted that the letter be referred to Attorney Graham. Plumber's It was moved by Utecht, seconded by Shavor and unanimously License voted that Master Plumber's License #~3 be issued to Wm. G. Dunkel, Crogness Dunkel Plumbing Co., 7109 Garfield Ave., So., r.4inne~nolis, 23, i+~inn. Dog Licenses It was brought to the attention of the Council that Dog Licenses must be purchased by Aril 1st. Larpenteur Plans, letter, resolution and specifications from Harry S. Ave. Imp. Bronson, on the Larpenteur Avenue Improvement from the Pest County Line to Cleveland Avenue were presented to the Council and are being held for further study. Street Ads for bids for street work were discussed and referred to work Attorney Graham who will arrange for publication calling for bids April 1l~th at 7 P. M. Engineer Vern Ljungren advised he is leaving Milner Yvr. Carley & Associates and moving to Duluth the end. of the month. He introduced 3111 Dolan who has worked onmany Falcon Heights projects with Ljungren and is familiar with the watermain, drainage at the sump area and many of the street and alley problems. Drainage Shavor moved that the Engineer be requested to up-datd the information on the Crawford-Simpson Drainage project and report at the next meeting. Seconded. by Nilsen and carried. 1385 Arc Light Mr. Geisen was advised that when the Deputy Clerk called the owners of the 3 corner lots at Holton and Ruggles asking if they were in favor of an arc light, she got a "Definitely no", "I guess that would be alright" and "I don't see the need for it, but I'll go along". It was suggested that ?.~4r. Geisen try to get the written consent of these property owners. Johnson, 1718 Arona, be and he hereby is appointed Justice of Peace for the Village of Falcon Heights to serve out the remainder of the term of Pdark Hindermann, commencing Apra, 1st, 1960, and that the Deputy Clerk arrange for a X31,000, 00 bond 138b covering tdr.
