REGULAP ~~fEETING MARCH 2l~th, 1960.
Meeting was called to order at 7:00 P. M., the following Council Members being
presents Harold ~. Nilsen, Mayor; George Shavor, Trustee, Paul Coppini, Trustee;
44illis Vd~rkentien, Trustee and Vtm. R. Utecht Clerk. Also present were Wm. E.
Olsen, Treasurer; Frank N. Graham, Village Attorney, and Ethel.. E. White, Deputy
::Clerk and Deputy Treasurer.
Pdinutess The Minutes of the Regular meeting of March 10th were approved as
submitted.
Justice of_ Edwin A. Johnson, 1718 Arona~ was sworn in as Justice of Peace by
Peace Clerk Utecht.
Fairview Letter of March 15th, from J. D. Swan, Executive Secretary, Board
Watermain of Ramsey County Commissioners, was read. Letter authorized the
construction of a b" watermain on the west side of Fairview from
Larpenteur to a point approximately l~36' north, the 6" main to be
located approximately 9' East of the Wrest property line.
Pinnesota Letter from the Minnesota Highway Department requesting financial
Highway statement and requesting other information regarding streets,
Department street lighting, etc. was read. Utecht moved that the letter and
information blank be referred to Engineer L3ungren and that the
State Highway Department's requests be complied with. Seconded by
Shavor and carried.
Sidewalks Attorney Graham's letter of March 16th to Engineer L~ungren, re-
Hoyt Ave. questing legal descriptions of the property of people requesting
sidewalks, was read. L3ungren was asked to furnish Graham with
the required descriptions.
Larpenteur Letter of March 16th from A, D. Crampton, Principal Asst,, Harry
Avenue S. Bronson, Ramsey County Engr., was read. Crampton submitted 3
Improvement copies of a non-enchroachment agreement and 3 copies of a resolution
for adoption b' the Council. Utecht moved that the Clerk be author-
ized to enter into an agreement between the Village of Falcon Heights
and the County of Ramsey for Federal Aid Highway Improvement.
Seconded by Shavor and carried.
Iowa Drainage Mr. E. J. McCubrey, District Engineer, and Mr. F. W. Thorstenson

Hydraulic Engineer, of the Minnesota State Highway Department were
present. There was a length discussion regarding plans for the
Snelling underpass and the drainage area. The Highway Department
proposes the following terms as a basis for a cooperative agreement:

HIGHWAY DEPARTMENTS 1. Develop the ponding area in accordance with
the recreational plan as outlined in the retiort by Milner W. Carley &
Associates. 2. Design and construct the pumping station including
the force main connection to the Hoyt Avenue Sewer. 3. Maintain the
pumping equipment and associated facilities.
Highway plans are indefinite as to when the underpass at Larpenteur
will be constructed. In the interim, if the Village decides to
undertake some site development for playground purposes, the State

Village share nrovi:ded the work undertaken is consistent with the
preliminary plan for the ponding area and would. not be duplicated
in final construction. The cost of operating the pumping station
was estimated at X360.00 a year. It was estimated that the ponding
area would be flooded for a maximum of 8 hours during a 25 year
storm, For most normal rains, it wouldn~t be more than a few hours.
Pumps they plan to use have a capacity of around 1!t cu ft per
second. A. C. Kaechele, 15lt2 W. Idaho, J. C. Maguire, 1529 Iowa,
and Wayne Sorenson, 1537 Iowa, members of the Recreation Committee,
were present and expressed their approval and their opinion t3~at
the fence should be installed first as a safety measure. The
State is making arrangements with the City of St. Paul for the
enlargement of the Hoyt Avenue Storm Sewer which will permit
pumping during a rain storm, rather than waiting until the peak
load has gassed. Cartwright of the Planning Commission said that
he and the two men of the Planning Commission he had contacted
were quite enthusiastic about the proposal and recommended that
the SFillage proceed to enter into an agreement to fulfill the plan.
Ohman of the Planning Committee thinks it is good, Nilsen asked
if we were going to have a recreation area or 3ust a sump hole.
Thorstensen said "Definitely a Play Area." It was agreed that
the State Highway Department would draft their proposal and present
it to the Council for examination.
Flooding ndr. and Mrs. Geo. Kul.kay advised that water has run into their
Kulkay Prop. basement for the first time this year and asked whose responsibility
it was to see that the grading was such that this did not occur.
Attorney Graham advised that the Village had no responsibility and
it was suggested that Kulkays contact Robert Ha11 Company whom they
feel are responsible for the increased amount of water on their
property.
Assessment A~~ayor Nilsen recessed the regular meeting to hold the HEARING ON
Hearing THE PROPOSED ASSESSMENT FOR THE LARPENTEUR AVENUE WATERMAIN AND
PUMPING STATION IMPROV~hSENT.
Mayor Nilsen read notice as published and posted and also affidavit
of publication by the Rose Tribune,
Engineer L~ungren advised that the original estimate for assessment
was X7.25 per front foot. The contract to Herbst Construction was
X50,006; final contract was 550,l~02. Then there were a number of
items which were not included in contract such as driveway repair,
work done by the City of St. Paul, materials furnished by the City
of St. Paul and work done by Ramsey County which brought the total
to $59,281.00, plus engineering, overhead and. other miscellaneous
expenses, making a net cost of ~6l~,602.l~3, The actual final assessment
is ?7.25, the same as the original estimate.

Graham No. You cannot be assessed any more if the pumping station goes in
as part of this improvement. You may if the pumping station goes

in and does not get in as part of this improvement. This assess-
ment covers your share of the cost of laying the main. If the pump-
ing station is to be part of this proceeding, we ha~.~e to go ahead
with it almost immediately. If we do not get it in as part of
this improvement, it stands on its own feet. We don't know yet
whether it will be necessary to put in a pumping station. This
X7.25 per foot is the entire cost to be assessed for putting the
watermain where it is at the present time.

Ljungren P~:4inimum pressure is 18#, and, normally, during theday it is running
26 or 27# - adequate to supply a home water system.
Gasparro The pressure is pretty good. It is not what it should be but it is
not too bad.
Weigt I have good pressure.
Lee Why can't the cost of this watermain be spread over the whole village?
Nilsen Because the other people have paid for their water. Only benefitted
property can be assessed.
Labalestra l~sn does the assessment have to be Maid?
Graham That hasn't been determined yet. I think it will be over a period
of 20 years at b~ interest. That's the way mast assessments were
set up. The Tatum Street and Alley Assessments were spread over a
ten year period but the sewer assessment 20 years. You will have
the right to pay it up within 30 days from the day the assessment
is anrroved without interest. Before the end of this year, with
interest from the date the assessment was approved to December 31st.
After that, you will be assessed 1/20 each year and 6~ interest.
The first assessment, if we pass it tonight, will come in with your
1960 taxes, payable in 1961, and it will include interest to the end
of 19b1.
Bradley You will be paying interest a year in advance.
Graham If you pay before December 31st, you will be paying interest from
tonight.
Labalestra There are some buildings going in on,Tatum this Spring. Are we go-
ing to provide water for them? They will want water about 300'
north of Larpenteur.
Graham The thing to do is take a petition to the adjoining property owners.
If a petition is submitted signed by 35~ of the affected property
owners, we will set up a hearing. If passed, the work could be done
by private contractors on a cash basis, or an assessment basis by
advertising for bids
Sipes Is the extension on Fairview going to be assessment or cash.

RESOLUTION
No, they put in their own line several years ago and the Larpen-
teur Avenus VTatermain does not benefit them.
Utecht moved the following resolution adopting assessment:
WHEREAS, pursuant to proper notice duly given as required by law,
the Council has met and heard and passed upon all objections to
the proposed. assessment for the improvement of Larpenteur Avenue
between Snelling Avenue and a point 72b ft east of the center line
of Cleveland. Avenue by the installation of a watermain and
appurtenances
NOw THEF.EFORE, BE IT RESOLVED ~3Y THE VILLAGE COUNCIL OF THE
VILLAGE OF FALCON HEIGHTS, MINNESOTA:
_ 1. Such proposed assessment, as amended, a copy of which is
attached. hereto and made a part hereof, is hereby accepted and
shall constitute the special assessment against the lands named
therein, and each tract of land therein included is hereby found
to be benefited by the proposed improvement in i-,he amou~ht} Sf .the
assessment levied against it.
2. Such assessment shall be payable in equal annual installments
extending over a period of 20 years, the first of the installments
to be payable on or before the first Monday in January 1961 and
shall bear interest at the rate of b% per annum from the date of
the adoption of this assessment resolution. To the first install-
ment shall be added interest on the entire assessment from the
date of this resolution until December 31st, 1961. To each sub-
sequent installment when due shall be added interest for one
year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior
to certification of the assessment to the Count;-Auditor, pay the
whole of the assessment on such property, with interest accrued to
the date of payment, to the Village Treasurer, except that no
interest shall be charged if the entire assessment is paid within
30 days from the adoption of this resolution; and he may, at any
time thereafter, pay to the county treasurer the entire amount of
the assessment remaining unpaid, vrith interest accrued to
December 31st of the year in which such payment is made.
fit. The Clerk shall, at the end of the 30 day period, transmit a certi-
fied duplicate of the assessments to the County Auditor to be extended
on the proper tax lists of the county, and such assessments shall be
collected and paid over in the same manner as other municipal taxes.
Seconded by ~Farkentien and unanimously carried.
Trees There was a short discussion about the sprayingof trees. Coopini
will contact one of the specialists recommended by Dr. Mickel and
the spray specialist from Standard Oil.
Licenses All things being in order, it was moved by Utecht, seconded by
Warkentien and unanimously voted to issue P.+IASTER PLUMBERS LICEDISE

All things being in order, it was voted by Nilsen, seconded. by

V~arkentien and unanimously voted to issue MASTER GAS INSTALLER'S
LICENSE #137 to Raymond E. Jastrow, dba Snelling Plumbing and
Heating Co., 712 No. Snelling Ave., St. Paul, !~, Minn.
Purchase V'larkentien moved that we establish a numbered purchase order
orders. system for any purchases over 45.00, and that all personnel be
written a letter to this effect - invoices will not be honored
unless the purchase has been cleared with the office first and
authorized by the Council. Seconded by Utecht and carried.
Special Utecht moved that a special meeting be set for Thursday, P,Sarch
R4eeting 31st, at 7:00 P. ~~.~. Seconded by Nilsen and unanimously carried.

Engineer Shavor moved that the Council issue a Certificate of Commendation
to Vern Ljungren for his work for the Village. Seconded by Utecht
and unanimously carried.
Police V'Tarken tier moved that we authorize the purchase of a revolving red
Equipment lamp for the squad car with the specification that seller will
refund our-,purchase price if new specifications say we have to
have a mounted light.
Road Coppini moved that the Village Engr. be instructed to post
Limits Vi=lage Roads at 3 ton. Seconded by Nilsen and unanimously carried.
