Policing Letter from Dewey A. Smith was read and filed for future reference.
Falcon Moods Bonestroo's letter to Gage Construction Company was read in part as
No. 2. follows: "Driveway at 1981 Summer must be corrected to meet the
standard section such that the driveway at the property line is 0.3'
higher than center line design grade."
Snelling Drain- Bonestroo's letter of ?gay 19th regarding this matter was read and
age Pond. filed for future reference.
Cony of Attorney Graham's letter regarding Bonestroo's observations
was read and filed. .
Ordinance Utecht moved the passage of Ordinance No. 58, an Ordinance amending
No. 58 Ordinance T?o, ~t6. Seconded by Nilsen and unanimously carried.
Proposed Graham's letter of nay 17th was read and filed for future reference.

Attorney Harold Swenson, 1100 Pioneer '31dg., St. Paul, spoke in
behalf of the petitioners. He stated that while the lane in
question is actually a 12' wide dedicated Public Lane, the Village
has never maintained it. The prox~erty owners have paid for crushed
rock, plowed the snow, etc. Tha± while there are "No Thorofare"
signs at both ends there are no "Stop Signs". Cars and trucks go
through the alley at a good speed and do not stop before entering
Albert or Holton which is dangerous. The alley is not wide enough
to Hermit cars to Hass each other. There is a great chance of
collision with other people. A lane should. be a minimum of 20'
wide to Hermit vehicles. He believes this lane should be vacated
or, at the very least, confined to use as a walkway.

Utecht How do you expect to keep vehicles from going through even if it
were vacated?

Swenson They could probably add 2 or. 3' of ±heir property to their
halves o{' the vacated strip, and then put a fence down the middle
or ,they could agree to use the driveway together. If it were left
this way,_people could walk through it. If they nut up fences,
they could keep people out.
Coppini The alley could be blocked off down the middle which would
effectively keep cars from racing through there.
',?rs. Salminen It is used very little as a walkway.
Ta?arkentien Aren't children being turned away from the entrance?

~~arkentien I know it to be a fact.
Swenson Trucks drive through at greater or lesser speeds and it is
dangerous for children.
°;?rs. Salminen It gets a considerable amount of traffic.
Utecht I'dontt know any other way it could be blocked off except by
driving posts through the center.
~?rs. Salminen If it were vacated, it should be easy to close it off.
Swenson PF:onle go through it when they could dust as well go to the corner.
Businesses are on La.rpenteur and the School on Carden,
''r`iarkentien: The attorney said there was very little traffic. Salminen says
there is a lot of it. A lot of people use it going to church.

N. L. Johnson I think, gentlemen, you should take into consider=~tion the people
who own the property. It doesn't go through beyond Holton and
Albert. Therefore it is an occasional use. ',?any people like to
go through dust to irritate the property owners,
Swenson If there are objectors, why aren't they here?
harken ten Probably because they don't want to get into trouble with their
neighbors. O'Keefe said he made the complaint about the petition
being called the "O'Keefe " petition because he didn't grant to get
into trouble with his neighbors.
O'Keefe I made the complaint to caution the Council to be more careful
about seeing that legal papers were correct.
Coppini I move the alley be vacated in favor of the petitioners.

Nilsen explained that alleys were not kept up until they had
first been brought u~ to Village Standards, the work being done
on an assessment bases.

Conpini I don't think this was ever meant to be an alley.

that it wasn't supposed to be an alley.
Conpini It isn't the proper width.
Warkentien Back in the ~4ode1 T days, that was wide enough for two cars. The
fact that there isn't any walkway between the other blocks is un-
fortunate.
Swenson I live close to a walkway. The residents petitioned that it be
vacated. The Planning Commission feels there is no need for it
and has referred the matter to the Council. There are sidewalks
all around.
ltdarkentien Where are the sidewalks on Albert & Holton?
Sorenson You don't maintain the walkway anyway.
Nilsen What effect would blocking the lane to vehicular traffic have in
view of the petition as bresented?
Graham I believe the Village has the power to stop vehicular traffic by
taking appropriate steps. It is not wide enough to be a regular
alley; but, I think, if youkept it for a walkway, it would still
r~:4rs. Salminen come within the purposes of the original platters.
If it is vacated, ore will maintain it.
Warkentien I question whether we should let anybody drive on a walkway. Cer-
tainly they vrant access to the driveways.
Johnson If it is vacated, it would go back to t~rivate ownership.
O'Keefe People walk in all alleys, and you find garages on a lot of alleys.
Warkentien Th~.t's true. If I had an alley, I'd put my garage on it too.
Salminen Passing isn't good. There are mud holes in it. There is always
water in front of our garage.
Nilsen Then, evidently, your garage is built too low.
Salminen No, the alley is too high.
Utecht I orithdraw my second. ~i~Ie sent out fifty notices and had no objections.
Warkentien I've had plenty of objections. People made them to me.
Utecht I would like to see it kept the way it is. Keep traffic out but let
the kids go through.
Johnson Wouldn't you have to vacate it and then dedicate it as a walkway?
Graham It is a lane but not dedicated wide enough to be a broner alley.
When this was dedicated back in '31, we didn't have the standards
we have now.

Johnson I think this Council should. act one way or the other. Either vacate
it, or vacate it and dedicate it as a walkway or we are ant to have
the sa^~e thine coming up year after ,year.
Warkentien We can't bind future councils.
Uteeht No, we can't bind future councils.
L. Pehrson I am not really affected. one way or the other but I feel it
1766 Holton would. be a fine gesture to vacate the alley in favor of the
property owners. I would like to see it vacated.
Geo. Anderson It really doesn't affect me one way or the other. I don't have
1775 Albert any small children, but there were times when the only way we
could get on to Albert was through that lane. Tha±- was the only
time we used it. I have heard. from my neighbors that their
children use it. They go up the alley and don't have to go down
to Larpen teur.
Nilsen It gets them off the traveled part of the street.
Uteeht I am in favor of stopping travel but I still think the kids should
be allowed to walk through. Let's barricade it in the middle,
Pars. Salminen Alleys are very dangerous. We have lots of little toddlers -
maybe their mothers should watch them all the time, but they don't.
Salminen It is an intrusion on your privacy. Vie might be sitting out
there enjoying a barbecue dinner and someone goes through and
raises the dust.
Coppini I still move we vacate this alley in favor of the property owners.
Coppini Previous councils have been negligent on these other walkways as
evidenced by the planners regarding an entrance to the walkway on
Ruggles.
Uteeht Let's refer it to the Planning Commission and see what they say.

Uteeht No, they are planne rs but not our Planning Commission.
Nilsen named the members of the Village planning Commission and
said it is well not to be too hasty because when they had the hearing
on the walkway between Holton and Pascal, at about Ruggles, there were
no objectors at the first meeting, but at the second meeting those
who attended were mostly objectors.
?rs. Salminen If there are objectors, why aren't they here? The notice was
posted and published and I also gave the matter a lot of publicity.
Uteeht Our normal procedure is to turn this over to our Planning Commission
and get their opinion.
Nilsen Ts there a second to Coppini's motion? None was heard. Nilsen
announced Conpini's motion dies for lack of a second.

Johnson Will there be a published notice of the continuation?
Graham tide can continue any hearing before us. If the meeting is not
concluded, we can continue the hearing to another time.
Utecht moved that the matter be referred to the Planning Commission,
with the request that they report back to the Council by June 15th
at 7 P. ?~ . DST.
Salminen I flew all the way back from California for this meeting and have
to go right back.
Coppini I move that the petition for the vacation of Johnson's alley be
referred to the Planning Commission.
Pehrson I think this should have been referred to the Planning Commission
before this meeting.
Graham It is a matter of the Council referring it to the Planning Commission.
Nilsen The Planning Commission will have all the facts now as presented by
the people.
~4rs. Salminen Am I correct in assuming that if the Planning Commission sees fit
to vacate the alley, the Council will vacate it?
Graham The Planning Commission does not take action. They make recommendations.
Salminen Are you agreeable to closing it if the Planning Commission agrees?
Utecht I move that this matter be referred to the Planning Commission with
the request that they report to us by June 15th, and that Hearing be
continued until June 15th at 7 P. Ito. Seconded by Nilsen and carried.
Imhoff Peti- After discussion, P+arkentien moved that the petition of Harold Imhoff

Albert St. Geo. Anderson, 1775 Albert asked what plans were being made for the
improvement of Albert Street just North of the intersection at
Larpenteur. He said it is low, there is water standing there all
the time, it gets in brake drums, etc. Bonestroo advised Albert is
too low at that spot and has no crown. 1Ve don't have enough tonnage
this year. Running a storm sewer would be too costly. He thinks we can
accentuate the crown to take the water away from Liedholms. On
Simpson, it will be cheaper to move the crown. These are things we
will have to evaluate. Anderson asked if it would be possible to
drain the water into one of the vacant lots. Bonestroo said that
is one of the things we intend to dog along with lowering the catch
basin.
Hermes Prop. N. L. Hermes asked about grading the entrance to the alley back of
Lido's so the water drains out of the alley and also to make it
easier for trucks to get in and out. As it is~ the bump causes trucks
to sway and jerk their loads. Bonestroo suggested that Hermes ask

the men who are working on his parking lot at present to blade
the entrance to the alley and recommended running a swale down
the center of the alley to keep the water off the neighbors'
property. Bonestroo thinks they can get the water out of the
alley.
Lighting ldr. Vanelli of Northern States Power showed pictures of various
Business business lighting arrangements and agreed. to appear before a
District gathering of the business men and council to plan suitable
lighting arrangements for the Fusiness District. He estimated
that the standards would cost between eight hundred and eight
hundred and fifty dollars per unit installed. Northern States
bids on dust the energy.
Planning' Letter from the State of Minnesota regarding funds available for
Planning Programs was referred to Attorney Graham.
Provosed Engineer Bonestroo reported he thought they could reduce the
Storm Sewer amount of storm sewer necessary by reshaping the crown of the
Arona & streets in some places and grading in others. They have also
Crawford worked out a program for fixing up Arona for about X1900.00.
WHEREAS pursuant to the request of the council, a report has
been prepared by Otto Bonestroo & Associates with reference to
the Storm Sewer and Street Improvement #1 for the Arona Street
and Crawford Street Area

1. The Council will consider storm sewer and street improvement
#1 in accordance with the report and the assessment of the
benefitted property for all or a portion of the cost of the
improvement pursuant to hinnesota Stats., Secs. l~29.011 to
1~?_9.111 at an estimated total cost of the improvement of ~1~.,000.
2. A Public Hearing shall be held on the proposed improvement on
June 15th, 1960, in the council chambers of the village hall at
8s00 P. M. Dst and the clerk shall give published notice of such
heaxing and improvement as required by law.
The adoptign of the above resolution was moved by Utecht, seconded
by Nilsen and unanimously carried.
Curb & Gutter After discussion, Warkentien moved that the Village Engineer be
l~,rona & Larp. authorized to permit property owners on both sides of Arona from
Larpenteur north tb-.:the alley to install concrete curb and gutter
in accordance with plans and specifications prepared by the Village
Engineer and supervised by the Village Engineer, at the property
owner's expense. Seconded by Coppini and carried.
4nholes Co~pini moved that the Village Engineer be instructed to have all
manholes brought to grade at a cost of X27.00 per unit.

Drainage Utecht moved that the 12ayor and the Clerk be and that they hereby

Dog Kennel There was a discussion regarding the dog kennel. Warkentien will
contact Arndt and Johnson.
License V`Jarkentien moved approval of General Corporate License #78 authorizing

22, to sell ice cream products ,and soft drinks from his truck.
