Nilsen, Mayor; George Shavor, Trustee; Willis Warkentien, Trustee; Paul Coppini, Trustee; and Wm. R. Utecht, clerk. Also present were Frank N. Graham, Village Attorney, Wm. E. Olsen, Treasurer; Gordon Nelson, Fire Chief; Otto Bonestroo and B. Lemberg, Village Engineers, and Ethel E. White, Deputy Clerk and. Deputy Treasurer. Minutes of the meeting of August 11th were approved as corrected. (Last Sentence, last Paragraph, page 1485 changed to read: "Moved by Utecht, Seconded by Nilsen, and unanimously carried.++) Election It was moved by Utecht, seconded by Nilsen, and unanimously Board voted that Mrs. Ruth Martin, 1765 FairvieR, be appointed Chairman Chairmen of Election Board Precinct 1; Mrs. Rhodie Arndt, 1447 W. Idaho, Chairman Election Board Precinct 2, and Mrs. Laverne Olsen, 1784 No. Pascal, Chairman Election Board, Precinct 3. Real .Estate Treasurer Olsen reported he had received a check for $1,987.28 Taxes year 1957 as referred. to in County Treasurer"Killeen+s letter to County payable in 1958 Auditor Monick. Olsen also reported he had received credit-for the X6387.56 referred to in the same letter. These sums covered credits due Falaan Heights but erroneously paid to other munici- palities. 1960 Tax Attorney Graham's letter of August 23rd to Wm. E. Olsen, advising Settlement that it appeared his computation of allocations was correct, was read and placed on file. Seger Copies of Attorney Graham's letters to the City Clerk, St. Paul, and the City Comptroller, St. Paul, were read. Letters advised Graham was enclosing a duly certified copy of Ordinance No. 60 passed by the Village Council of the Village of Falcon Heights on July 28th, 1960 accepting the provisions, terms and conditions of St. Paul's ordinance No. 11782. Watermain Copy of Attorney Graham's letter to Engineer Bonestroo regard- Improvement ing tabulations for the Assessment covering the Watermain 1960 Improvement 1960, was read and filed. Tax Levy Letter from Eugene A. Monick, County Auditor, regarding annual tax levy was read and filed. Variance Letters signed by Wesley Tennyson, Richard Thorp, and S. E. Anderson, advising that they had reached an agreement on the proposed Redwood Fence for which Tennyson and Thorp requested a variance, were read. Af ter discussion, it was moved by Warkentien, _ seconded by Shavor and unanimously voted that the following reso- lution be approved: RESOLVED; that the request of Wesley Tennyson, 1935 Summer and Richard Thorp, 1929 Summer, for a variance under Ordinance No. 17, to permit them to erect a Red:rood fence as per sketch submitted, on their property at 1935 and 1929 Summer is hereby granted; the Council specifically finding that the granting of such variation will not materially affect adversely health, safety or general welfare or public or private property. 1494 ~.etter from F. Floyd ~Iansen, 1938 autumn was read. NCr. ~tansen requested a variance with respect to a fence which he proposes to erect on property belonging to Tennyson, 1935 Summer. The fence Aroposed would be an extension of the fence already approved by the Council and is necessary to have one continuous fence. After discussion, Coppini moved adoption of the following resolution: RESOLVED; that the request of F. Lloyd Hansen for a variance under Ordinance No. 17 to permit him to erect a Redwood fence on the Wesley Tennyson Property at 1935 Summer, in accordance with his request, be granted upon the condition that Mr. Wesley Tennyson loin in the request by sign- ing the letter of August 22nd, 1960; the Council specifically finding that the granting of such variance will not materially affect adversely health, safety or general welfare of public or private property. Seconded by Nilsen and carried. Fuel Oil Letter from Pure Oil quoting .1365 per gallon on #2 fuel oil Requirements and letter from Dayton Oil Company quoting .137 per gallon on Village Hall & #2 fuel oil were read. After discussion, Utecht moved that the Fire Station Village buy its requirements of fuel oil from Thorne Coal and Oil Company at .124 per gallon as quoted in their letter of August 9th, 1960. Seconded by Warkentien and unanimously carried. Snow Plowing Letter of August 15th from Eugene A. Monick was read. Letter advised the County may elect to plow snow from County Roads in Villages having a population of 5,000 or more, or make an agreement for the Village itself to plow the snow and be reimbursed by the County. In the absence of any agreement otherwise, the County will continue to remove snow from County roads in Falcon Heights. Engineer Bonestroo was instructed to contact the County for plowing and sanding Village Streets when he felt it was necessary. Lauderdale Letter of August 15th from Helma Gunderson, Village Clerk, Lauderdale, was read. It advised they were sending us a check to cover charges due to August 15th, but deducting X157.25 for a fire run Minneapolis made to a Falcon Heights fire. Inasmuch as Falcon Heights has no agreement with either Lauderdale or Minneapolis to furnish fire protection to Falcon Heights, the matter was referred to Attorney Graham. Gas Installation Utecht moved that permission be granted Northern States Power Company to make gas installations at 1824 Simpson, 1437 Calif- ornia, and to install gas mains on Fry Street from 1707 to reach Larpenteur Avenue. Seconded by Cobpini and carried. Streets B. C. Kueffer, 1607 Hollywood Court and Sumner Hood, 1597 Hollywood Court were present. Mr. Hood called attention to needed street repairs in Hollywood Court and he was told they would be taken care of and brought up to the same standard as other Village streets. Mr. Hood questioned the necessity of sounding the siren at noon, 9 P. M. and 8 times for a fire call. Mayor Nilsen advised that many people found the siren very helpful in reminding the child- ren when it was time to come home for lunch or from the playgrounds and skating rinks. Fire Chief Nelson said the siren was needed to alert the firemen in the shortest possible time and to clear traffic. 195 Mr. Mood advised people were disregarding the "No 'thoroughfare" sign on the Snelling Avenue Service brive. Attorney Graham advised you can't stop people from using public streets and that "No Thoroughfare" signs were put up to warn people that there may be delays such as "Stop Signs" on such streets and that it did keep some traffic off because people in a hurry usually took the main streets. Mr. Hood stated that "Stop Sign" was being ignored. Mayor Nilsen advised we would instruct the policemen to watch it closely and issue tickets. The need for a "Stop Sign" at the North alley going East out of Hollywood Court was discussed. The Deputy Clerk was advised to order one placed there by the County. Mr. Kuether, 1607 Hollywood Court, said he understood the sewers had to be connected by October 1st, 1961; he didn't need the connection, and asked what happened if they didn't connect. He was advised Ordinance 47 provides a penalty of a X100.00 fine or imprisonment in the County Jail for a beriod not to ex- ceed 90 days. Nilsen advised that the Metropolitan Planning Commission recently published another bulletin pointing out the seriousness of water polution and that the Council feels allowing cesspools where public sewer is available is contrary to all Public Health ` measures inasmuch as the contamination from cess pools gets into the water stream and travels for miles. Traffic Wm. F3rown, 1808 Asbury, was present and asked if a traffic survey was being taken in the Village. Bonestroo advised the Village will be required to make a traffic study for State Aid Funds. Brown expressed the opinion that Garden was carrying an unusually heavy amount of traffic considering the surroundings and asked if there wasn't some means of diverting some of it in the interest of protecting the children who used it. Bonestroo advised that, after a study, the Village could make recommendations to Chenoweth, but that the decision would be up to Chenoweth, Traffic Safety Engineer, Ramsey County. Brown advised he would be glad to help any way he could. Nilsen suggested that Brown try to sell his neighbors on the installation of sidewalks on Garden as a Safety Measure for the children going to school. State Aid Otto Bonestroo introduced Brad Limberg to the Council and advised Funds Limberg was working on the State Aid set up. Limberg advised: We have to lay out a system of streets - go through the entire Village, get the total mileage, excluding County State Aid Roads and State Highways. We have about 1!t miles of streets; 3.82 miles County State Aid Roads; Larpenteur, Cleveland, part of Fairview and a short piece of Hamline. County roads, Fulham, Roselawn and Garden. Hoyt is maintained by the City. We have a percentage factor of 20~ which they will allow us to put on State A.id. We come up with a total of 2.05 miles on watch we will receive an allowance for maintenance each year and will also receive an allowance of 9k2.17 per person, a little over ten thousand dollars, we would receive toward any streets we would designate as State Aid Streets. Also maintenance which we have to determine. We make a needs study based on width, base, surface, lighting, etc. 1496 This money can be used to build up your street system, The minimum width is 40' sorb to curb, St. Paul has asked us to consider naming Como, a boundary line, as one of our State Aid Streets. That would be about 25/100 of a mile or 1/8 of what we could designate. St. Paul asked that we either name this as one of our State Aid Streets or allow them to annex the other side of Como. State Aid Funds can be used for curb and gutter. Shavor indicated the Council might consider St. Paul's proposal regarding Como but can't make an immediate decision. The matter requires study. Coppini moved the adoption of the following resolution: RESOLUTION ESTABLISHING MUNICIPAL STATE A.ID HIGHWAYS 11R(HHEREAS, it appears to the Village Council of the Village of Falcon Heights that the streets hereinafter described should be designated as Municipal State Aid Streets under the provisions of Minnesota Laws of 1959, Chapter 500s NC~IfT THEREFORE, BE IT RDSOLVID, by the Village Council of the Village of Falcon Heights that thestreets described as follows, to- wit: 1. Arona Avenue from Hoyt Avenue to Roselawn Avenue 2. Pascal Avenue from " " n ~ ~+ 3. W. Idaho Avenue from Snelling Ave. to Hamline Ave. 4. Crawford Avenue from Snelling Ave. to Arona Ave. bey and hereby are established, located and designated Municipal State Aid Streets of said. Village, subject to the approval of the Commissioner of Highways of the State of Minnesota. BE IT FURTHER RESOLVED, that the Village Clerk is hereby author- ized and directed to forwrard tx~ro certified copies of this reso- lution to the Commissioner of Highways for his consideration, and that upon approval of the designation of said road or portion thereof, that same be constructed, improved and maintained as Municipal State Aid Streets of the Village of Falcon Heights, to be numbers d and known as Municipal State Aid Streets 101, 102, 103 and 104. Bids street Warkentien moved the adoption of the following resolutions work WHEREAS, pursuant to a resolution passed by the Village Council, the Village Engineer has prepared plans and specifications for the resurfacing of the streets disturbed by the installation of watermains under Watermain Improvement of 1960, No. 1, and has presented his plans and sketches to the Council for approval; NOW THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF FALCON HEIGHTS, MINNESOTAs 1. Such plans and specifications a copy of which are hereby filed with the Deputy Clerk and made a part hereof, are hereby approved. 2. The Village Clerk shall prepare and cause to be inserted in the official paper and in the Construction Bulletin an advertisement for bids upon the making of such improvement under such approved plans 'and specifications. The advertisement shall be published for 10 days, shall specify the work to be done, shall state that bids will be opened and considered by the Council at 7:30 P. M., Monday September 1?_th, 1960 in the Council Chambers of the Village Hall, and that no bids will be considered unless sealed and filed with the Clerk and accompanied by a cash deposit, cashier's check, bid bond or certified check payable to the Clerk for 5% of the amount of such bid. Seconded by Shavor and unanimously carried. Streets Falcon Bonestroo: There must have been a grade change that wasn't on the Woods No. 2 plans. We blue topped it. It is surfaced and the people are happy. We will have to put in 2 or 3" on the peripheral edge of the cul de sac. T feel Attorney Graham should write the people who have that high, steep drivexay. It is too high and the situation will be worsened now that we have graded a gutter. I will get the name and address of the owner and send it to Mr. Graham. Boulevards After discussion, Nilsen moved that the Engineer be instructed to No. Larpenteur proceed with the work necessary to finish up the boulevards on the North side of Larpenteur, West of Snelling, excluding the Spiegler property, which were disturbed by the installation of the Larpenteur Avenue Watermain, at a cost of not more than X300.00. Seconded by Utecht and carried. Office Nilsen moved that the Clerk's Office be authorized to purchase Supplies 1500 verified account forms. No action was taken. Fire Dept. There was a discussion regarding extension ladders. Chief Nelson recommended a Pirsch ladder, 50', X531.25, and suggested that Warkentien and Shavor stop at Minneapolis Station 19 and look at one, which they agreed to do. Chief Nelson will contact Roseville regarding a contract for fire protection in Roseville's North area. The Council feels Roseville should approach Falcon Heights if they are interested.
